RESOLUTION
RE: GRANT OF A SPECIAL USE PERMIT FOR AN OIL FIELD FLUIDS RE-
CYCLING AND DISPOSAL SITE TO WELD COUNTY DISPOSAL, INC. ,
BOX 455 , PERRYTON, TEXAS 79070.
WHEREAS, a public hearing was held on December 15th,
1976 in the Chambers of the Board of County Commissioners ,
Weld County, Colorado, for the purpose of hearing the petition of
Weld County Disposal , Inc. , Box 455, Perryton, Texas 79070 ,
requesting a Special Use Permit for an oil field fluids re-
cycling and disposal site located on a parcel of land in the
Northwest Quarter of Section 13 , Township 1 North, Range 66
West of the 6th P.M. , containing 38. 624 acres more or less ,
and being more particularly described as follows :
That part of the Northwest one-quarter Northwest one-quarter Section 12, Township
1 North, Range 66 West of the 6th Principal. Meridian, Weld County, Colorado,
described as: Beginning at the Northwest corner said Northwest one-quarter Northwest
one-quarter; _thence 589°55'41."E on an assumed hearing along the North line
said Northwest one-quarter Northwest one-quarter a distance of 1259.89 feet to a
point 50.00 feet West of the Northeast corner said Northwest one-quarter Northwest
one-quarter; thence S00°21 ' 56"W parallel with the East line said Northwest one-quarter
Northwest one-quarter a distance of 1333.30 feet to a point on the South line
said Northwest one-quarter Northwest one-quarter; thence N89°57 '04"W along the
South line said Northwest one-quarter Northwest one-quarter a distance of 1263.39
feet to the Southwest corner said Northwest one-quarter Northwest one-quarter; thence
N00°30' 56"E along the West line said Northwest one-quarter Northwest one-quarter a
distance of 1333.83 feet to the point of beginning.
WHEREAS , Petitioner was present, and
WHEREAS, the above described parcel of land is located
in an Agricultural Zone as set forth in the Weld County Zoning
Resolution, and
WHEREAS , Section 3. 3.E. 4 of the Weld County Zoning Resolution
authorizes such use in an Agricultural District on the Grant of a
Special Use Permit by the Board of County Commissioners, and
WHEREAS, the Board of County Commissioners has considered
all the testimony and statements of those present, has studied
the request of the petitioner, and has studied the recommendations
of the Weld County Planning Commission, and having been fully
informed and satisfied that the requested use complies with the
Weld County Comprehensive Plan and the provisions of the Weld
County Zoning Resolution,

NOW, THEREFORE BE IT RESOLVED by the Board of County
Commissioners of Weld County, Colorado, that the application
of Weld County Disposal, Inc. , Box 455 , Perryton, Texas 79070,
for an oil field fluids recycling and disposal site, be and
hereby is, granted subject to the Development Standards
contained in the Special Use Permit, and is further approved
that all excess water draining from the real estate described
above, must be inspected periodically by the Weld County
Health Department to insure that said water is satisfactory
for use for irrigation of growing crops.
BE IT FURTHER RESOLVED that the use of County Road No. 12
and No. 35 for parking trucks in connection with the business
to be carried out upon the site described above, is hereby pro-
hibited, and further that the Board of County Commissioners of
Weld County, Colorado reserves the right to require acceleration
and deceleration lanes to be installed on the right-of-way of
State Highway 52 , if and when the business carried out on the
site described in this Resolution requires the same, and pro-
vided that the State of Colorado gives permission for the con-
struction of said acceleration and deceleration lanes.
The above and foregoing Resolution was, on motion duly
made and seconded, adopted by the following vote on the 22nd
day of December, A.D. , 1976.

I hereby certify that pursuant to a notice dated November 8, 1976, duly
published November 12, 1976 and December 3, 1976 in the Greeley Booster,
a public hearing was held on the request of Weld County Disposal, Inc.
for a Special Use Permit for an oil field fluids recycling and disposal
site. After discussion, motion was made by Commissioner Carlson to
approve the request subject to the development standards listed by the
Weld County Planning Commission with two additions made by the Board
of Commissioners to expand the Planning Commission's standard #5 to
include any appropriate ground cover, and to prohibit parking on
County Road 12. Commissioner Jacobucci seconded the motion and it carried

Dear Mr. Cunliffe,
This site was inspected June 26, 1979. St is in an area of relative low
density of game animals and birds. However, there is a considerable -number
of -songbirds using the area on a seasonal basis as well -as mourning dove.
The greatest area of concern from our viewpoint is of course the matter of
waterfowl. Since there -have been some problems with duck-s dying from getting
into ponds with oil in the past, -it is recommended that any pond -that h-as oil
in it at anytime should be protected. This should be -done in such a manner
that no wildlife could gain access to it.

PLANNING COMMISSION RECOMMENDATION

reviewed this request and have set forth no objections to it :
A. Colorado Oil and Gas Commission;
B. Fort Lupton Planning Commission;
C. Weld County Engineering Department. It has indicated that
the applicant will be required to upgrade Weld County Road
35 to accommodate increased truck traffic should the
proposed expansion generate more truck traffic than at the
present time.
D. Colorado Department of Health. It has indicated that the
bentonite blanket embankment designs and plans submitted by
Chen and Associates have been approved;
E. Colorado Geological Survey.
The Planning Commission recommendation for approval is conditional upon
the following:
1 . The attached Development Standards being recommended and adopted
for the Special Use Permit .

DEVELOPMENT STANDARDS
1 . The water and oil fluids recycling and disposal site granted by
this Special Use Permit on the hereon described parcel is limited
to the facilities shown hereon. Said facilities shall be:
(a) 600 square foot (minimum) structure built in accordance
with the requirements of the Uniform Building Code and
utilized as an office and a residence by an employee
for the control, operation, and security of the facility;
(b) Eight 300 barrel tanks;
(c) One circulating pump and motor;
(d) One 8 ' and 20 ' heat and filtering vessel;
(e) Two bentonite sealed lagoons as shown hereon. The
lagoons may include an aeration system as part of
the operation.
(f) Settling pit screen with a one-inch wire mesh.
Additionally, all uses permitted by right in Section 3 . 3 of the
Weld County Zoning Resolution are allowed within the Special Use
Permit area.
2 . Access to the Special Use Permit area is limited to one access
point shown hereon. The access shall have the approval of the
Weld County Engineering Department. The access shall be
constructed in accordance with the recommendations and/or
requirements of the Weld County Engineering Department. All
private interior roads shall be graveled.
3 . The Special Use Permit area shall be maintained in such a manner
so as to prevent soil erosion, fugitive dust, and the growth of
noxious weeds.
4 . All phases of the operation shall comply with all County and
State Health Standards and Regulations pertaining to air
quality, water quality, noise emission, and sanitary disposal
systems. Representatives or members of the Weld County Health
Department and/or Colorado Department of Health shall be
granted access onto the site at any reasonable time in order to
insure the operations carried out on the site comply with all
applicable Weld County and State Health Regulations.
5 . Upon cessation of operations at the site all structures shall be
removed to 30" below grade and all ponds or pits shall be
filled and graded so as to conform with the surrounding terrain.
The Special Use Permit area shall be reclaimed to a formable
state upon completion of the operations. The property shall be
seeded in wheat or alfalfa or other appropriate ground cover
approved by the Soil Conservation Service.

6. Storage of oil field drilling and associated equipment shall not
be permitted within the Special Use Permit area .
7. Parking on County Roads 12 and 35 will be prohibited. Only parking
will be allowed within the property described hereon.
8. The settling pit as shown hereon shall be screened with a one-inch
wire mesh to prevent wildlife gaining access to the pit. If at
any time the lagoons as shown hereon contain oil, the applicant
shall be required to screen them in a like manner as the settling
pit.
9. Construction of the lagoons and bentonite blanket embankment shall
be in accordance with the design as shown on the Special Use Permit
plat and the recommendations as contained in the Chen and Associates,
Subsoil Investigation Report, Job. No. 19, 030, dated August 29 ,
1979 .
10 . The Special Use Permit shall be limited to the plans shown hereon
and governed by the Development Standards stated above and all
applicable Weld County Regulations . Any material deviations from
the plans and/or Development Standards as shown or stated above
shall require the approval of an amendment to the Special Use
Permit by the Planning Commission and the Board of County
Commissioners before such changes from the plans and/or Development
Standards shall be permitted. Any other changes from the plans
and/or Development Standards shall be filed in the office of the
Department of Planning Services.
11 . The property owner and/or operator of this operation shall be
responsible for complying with all of the above stated Development
Standards. Noncompliance with any of the above stated Development
Standards shall be reason for revocation of the Special Use Permit
by the Board of County Commissioners.
12. There shall be a groundwater well(s) to monitor possible leakage
from the evaporation ponds and other pits on the property. The
Weld County Health Department and State Health Department shall
have access to this well(s) at all times to determine possible
contamination of the groundwater . This well(s) shall be installed
as per Weld County Health Department guidelines for depth to
groundwater table.
13. The freeboard allowance for all dikes designed to retain water or
other fluids shall be as specified by the Weld County Health
Department .

REQUEST BE approved FOR THE FOLLOWING REASONS :
1 . It is the opinion of the Department of Planning Services staff
that the requested changes do not substantially differ from what
was originally approved by the Board of County Commissioners.
2 . It is the opinion of the Department of Planning Services staff
that the requested changes in the operation is in compliance with
the provisions of Section 3 . 3 (E) (2) of the Weld County Zoning
Resolution. The proposed use will be compatible with the
surrounding area, in harmony with the character of the neighborhood
and existing agricultural uses, compatible with the future develop-
ment in the area and will not adversely affect the health, safety
and welfare of the inhabitants of the area and the County. This
determination is based upon the following responses from the

Dear Mr. Hall :
Since our hearing on July 17, I have consulted with an engineer in an
attempt to see where we stood _on our water storage and capacity. The
results of the calculations are attached hereto.
As you can see, using the average of 300,000 barrels per year, we will
eventually run out of storage capacity. However, this will be over five
years down the road, and we have additional land available to construct
additional pits.
The engineer said it was not possible to accurately predict the effect
]Df aeration since I have no specifications on the system. He did feel
it would increase the evaporation, but the amount of increase would
depend on how much water is directed into the air and exposed to the
elements. The effect of the aeration could be evaluated after it is in
operation. It is possible that the effect of the aeration could offset
our deficit completely or at least make a dent in it.
At any rate, I feel we will have sufficient storage to completely take
care of the water disposal needs for some time. We will probably have
to construct additional pits later if the aeration system does not take
up the slack. However, I feel our proposed pits are sufficient at this
time. -If you have any questions, let me know.

RE: Modification of Speical Use Permit Issued to
Weld County _Disposal Inc.
Dear Sir:
The purpose of our request for modification of the special use permit is
primarily to expand our water storage facilities. With the -exc-eption of
one change which -is discussed below, the facility will be operated in the
same manner as it -has in the past except that we will have additional
water pits and we will have closed the far south pit.
The one change that -we are making is to incorporate an aeration system into
our present system. The h-entonit_e lined pits will bE sealed and there will
be ev-aporation of the surface water just by -exposure to the sun and elements.
In a-ddition, we want to expose this water to the elements by spraying it
into the air to more effectively evaporate the water through -aeration.

Dear Chuck:
This is re-affirming our telephone conversation of July 27, 1979, con-
cerning Weld County Disposal .
As you know geld County Disposal is operating under a tease and Desist
Order issued by the Colorado Department of Health, March 20, 1379. The
enforcement of this Cease and Desist Order has been lenient in -order to
provide the owner Mr. James W. Smith time to implement his proposed plan
to eliminate groundwater contaminati-on by his operations as outlined in
his leiter of March 28, 1979.
No documentation, in the form of proposed or preliminary plans and engineering
design, has been received to date -by this office. Mr. Smith was contacted
again today notifying him that indeed an engineering design of the pits must
be submitted to this office.
Specifically, -this office must have the following informati-on:
1 . An engineering drawing of typical pit design with specific detail
of liner design.
2. Specifications of -materials to be used in the liner construction and
specific method of emplacement of said liner.
3. Construction standards, methods or specifications insuring that the
proposed"6. liner will be properly installed to provide an impermeable
(K=hc1Dcm/sec) barrier to percolation of contaminating fluids to
groundwater.

4. Designation of responsible party (preferably a registered professional
engineer) who will oversee the project to insure use of suitable
materials and proper installation and certify same.
In the opinion of the Division of Water Quality Control , the owner Mr.
Smith and his designated engineer Mr. Ed Lind have had sufficient time to
submit the requested data and commence work to alleviate the groundwater
contamination occurring from the present disposal practices.
The Division of Water Quality Control , will not lift the Cease and Desist
Order unless or until the above information is received and approved.
In fact failure to submit this data, in a timely manner, will result in
enforcement of the Cease and Desist Order.
I hope this answers your questions. If not I plan on attending the Planning
Commissions meeting August 21 , 1979, at 1 :30 p.m. and I will be available
to discuss this matter in more detail .
