WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, the Board of County Commissioners of Weld County, Colorado, held a public hearing on the 18th day of October, 1978 at the hour of 2 : 00 o'clock p.m. , in the Chambers of the Board of County Commissioners, for the purpose of hearing the applica- tion of Richard D. WHEREAS, the petitioner was present, and WHEREAS, evidence was presented in support of the granting of the Special Use Permit for an open cut mining permit for gravel on the above described real estate, and WHEREAS, Section 3. 3 (E) (2) of the Weld County Zoning Resolu- tion authorizes such a use in an Agricultural District upon appro- val by the Board of County Commissioners, and WHEREAS, the Board of County Commissioners of Weld County, Colorado, heard all the testimony and statements of those present, has studied the request of the petitioner and the recommendations of the Weld County Planning Commission and all of the exhibits and evidence presented in this matter, and having been fully informed and satisfied that the request for a Special Use Permit for an open cut mining permit for gravel on the hereinabove described real estate, conforms to the purposes of Section 3. 3 (E) (2) of the Weld County Zoning Resolution. NOW, THEREFORE, BE IT RESOLVED by the Board of County Com- missioners of Weld County, Colorado, that the application of the petitioner for a Special Use Permit for an open cut mining permit for gravel on the hereinabove described tract of land, be and hereby is , granted subject to the Development Standards and the Operational Standards contained in the Special Use Permit and also that an additional operational standard be included requiring that upon completion of the mining of Phase III and the first pond to the west, that an agreement be drawn between the City of Greeley and the developer to protect the public usage of the City of Greeley property north of the river. RECOMMENDATION September 5, 1978 The Colorado Geological Survey gravel resources map of the Greeley quadrangle identifies the gravel deposit as Fl floodplain deposit and as such, it is classified as a resource conservation area. As stated in the Mineral Resource Plan, this mining project should be encouraged since it lies within a resource conservation area. 2. It is the opinion of the Planning Commission that this proposed operation is in compliance with the provisions of Sections 3.3(E) (2) and 6. 1(3) of the Weld County Zoning Resolution. The proposed use will be compatible with the surrounding area, in harmony with the character of the neighborhood and existing agricultural uses, compatible with the future development in the area and will not adversely affect the health, safety, and welfare of the inhabitants of the area and the county. This determination is based upon the following: A. It is the opinion of the Planning Commission that open-cut mining operations as outlined and controlled in the Operations Standards will minimize impacts on surrounding uses and the area to the greatest extent possible and provide adequate protection of the health, safety, and welfare of the inhabitants of the area and the county. B. The Weld County Health Department has indicated certain recommendations and concerns for this request as indicated in a letter dated August 17, 1978. These concerns and recommendations have been satisfied and included in the Operations Standards. C. The Colorado Geological Survey has not been able to identify any geological problems involved with this operation. D. The West Greeley Soil Conservation District could see no reason why this request should not be granted so long as concerns in their letter dated August 14, 1978, were dealt with. These concerns are dealt with in the Operations Standards . E. The City of Greeley Planning Commission has indicated the City has no objections to the proposed operation. F. The Weld County Engineering Department has not identified any engineering problems with the proposal. Comments regarding specific access location and design may be desired at a later date. 3. All requirements of Section 6. 1(3) of the Weld County Zoning Resolution have been fulfilled. Richard D. Geisert III S SUP-369 : 78:21 ' P. C. RECOMMENDATION September 5, 1978 The Planning Commission recommendation for approval is conditional upon : 1. The attached amendments to the Operations Standards being recommended and approved for this request. 2. The mining plan map being amended to show the Operations Standards on the plat prior to recording the maps in the Weld County Clerk and Recorder's Office. 3. The Mining Plan map being amended to eliminate the "proposed dike" as shown and to illustrate the 100 year "intermediate Regional Flood" boundaries as defined in the Flood Plain Information Cache La Poudre River Colorado Volume II Greeley Weld County report prepared for Larimer-Weld Regional Planning Commission by Department of the Army, Omaha District , Corps of Engineers, 68102, March, 1974. • Richard D. Geisert , Open Cut Mining - Gravel OPERATIONS STANDARDS 1. No excavation or processing of sand and gravel shall be permitted nearer than 10 feet to the boundary of adjacent property, ease- ment or irrigation ditch or right-of-way , nor nearer than 125 feet to any existing residence , unless by written agreement to the owner or owners of such adjacent property consent to a lesser distance and the Planning Commission approves such lesser distance . The Planning Commission may set a greater distance than mentioned above when, in their opinion, it is justified. 2 . All sand and gravel operations shall be conducted during the hours of daylight except in the case of public or private emergency, or to make necessary repairs to equipment . This restriction shall not apply to operation of administrative and executive offices or repair facilities located on the property. 3. Weeds and any other unsightly or noxious vegetation shall be cut or trimmed as may be necessary to preserve a reasonably neat . appearance and to prevent seeding on adjoining property. 4 . Existing trees and ground cover along public road frontage and drainageways shall be preserved, maintained and supplemented if necessary, for the depth of the setback in order to ,protect against and/or reduce noise, dust and erosion . 5 . In-so-far as practicable, all means of access to the property from any street shall be located and designed as to avoid the routing of vehicles to and from the property over streets that primarily serve residential development . One access located at the north- east corner of the property will be allowed. Final location and design of said access must be reviewed and approved by the Weld County Engineering Department . 6 . All access roads from sand and gravel operations to public high- ways, roads , or streets , or to adjoining residential structures , shall be paved or otherwise treated to minimize dust conditions on all parts of such access roads which are located within one- fourth mile of the public highway, road, street , or adjoining residential structure . 7. Where topsoil is removed, sufficient arable soil shall be set aside , for respreading over the excavated area. 8. Rock crushers may be allowed. 9. Insurance - The operator shall furnish evidence he is insured to the extent of not less than $100, 000. 00 against liability for any negligent act or omission by the operator from the operation or maintenance of the sand and gravel pit and the extraction and production of sand and gravel and all activities connected with or incidental thereto. 10. A septic system is required for the proposed office maintenance building. A permit for such a system must be obtained through the Environmental Services Division , Weld County Health Department . The system must be designed by a registered professional engineer 11. An emission permit (fugitive dust ) must be obtained from the Air Pollution Control Division of the Colorado Health Department , 4210 East 11th Avenue, Denver, Colorado, for dust emissions (mining activities, road construction, and parking lot area) . 12. Another emission permit must be obtained as in (11) for the portable rock crusher. 13. A National Pollutant Discharge Elimination System permit must be obtained from the Water Quality Control Division , Colorado Department of Health for the discharge of water into the Cache La Poudre River. 14. Noise levels shall comply with those limitations listed in 25-12-103, C.R.S . , 1973. 15. No diking or berm shall be allowed on the SpeciallUse Permit area which would cause damage to upstream or downstream properties by altering the historic drainage pattern. 16. No stock pile of topsoil , overburden spoils or sand and gravel shall be permitted within the 100 year flood plain limit as shown on the Mining Plan map. ♦ Comments : Our office has received one letter of opposition from Herman and Alma Banghart. • The Weld County Planning Commission held a scheauled meeting on September 5, 1978 , at 1 : 30 p.m, in the Weld County Centennial Center County Commissioners Hearing Room, first floor, 915 10th Street , Greeley, Colorado. No reasons for denial were given at that time. Mr. Ginsberg, attorney for the applicant , then requested a re-hearing by the Planning Commission which was granted on August 1, 1978. Mr. Ginsberg then stated that the WieckYs desire to rezone 33 one acre parcels to create a subdivision . The property is adjacent to the Carmacar Subdivision on the north and the Parkland Subdivision to the south. The Erie Comprehensive Plan is still in effect . There are no changes proposed for the Plan and is thus in agreement with the proposal . Water is presently on the property . Mr. Ginsberg also stated that there is little residential growth in the county and it is time for a change. He also asked that the Planning Commission take into consideration as well that the Planning Staff is also in favor of the change of zone. Mr. Ginsberg requested that the recommendation by the Planning Staff be read into the record. Mrs . Norton stated this had already been done at the previous hearing. Melvin Dinner, attorney representing Mr. and Mrs . Kenneth Koch and the Erie Coal Creek Ditch and Reservoir Company , stated he had no objection to this _ the record reflect the entire transcript of the previous proceeding as part of this hearing. Discussion followed as to whether this was a continuation of the previous hearing or a completely new hearing. After consultation with Mrs. Norton , Mr. Carlson stated it would be a complete new hearing. There being no questions or comments at this time, Chuck Cunliffe read the staff ' s recommendation for approval . IIe feels also it is not desirable to have a subdivision adjacent to a ditch system which would involve over half the lots proposed and feels this ground should be left as is because it is prime agricultural land. He also expressed opposition because the proposal is totally deficient of an environmental impact statement . David Oscarson , President of the Erie Coal Creek Ditch and Reservoir Company, again expressed concern basically in regard to higher taxes and more pollution that would be created. Shirley Koch also stated that she was strongly opposed as there would be no service areas or jobs close which would eventually create more pollution and traffic for people to get to jobs elsewhere and is concerned that the septic sewer system would contaminate the ground water. Frank Suckla expressed concern in that he feels with a 5/8" water tap there will not be enough water for the one acre parcels . General discussion followed regarding the Town of Erie and what their position would be regarding the fire district and what services would be available . Also the problems that are involved with building homes next to a ditch . Virginia Thurman expressed concern about the noise and safety involved with building a subdivision next to an airstrip . REFERRAL FROM WELD COUNTY: SPECIAL USE PERMIT LOCATION: North of Cache La Poudre River, West of 11th Avenue • Mr. McRae explained that this property is adjoined on the west by three or four other gravel pits, and they have submitted the proper requests for this. Advertisements will be made locally - with a public hearing to be held on this item. The County Planning Commission will be hearing this item also, and there are approximately 1 90 acres involved here. The City owns property near here and has leased a triangular piece of the property to the saddle club. Commissioner Cummins asked where the access would be. Mr. McRae replied that it would be from near the salvage yard. Topsoil on the land runs from 0-21 feet and the gravel below this is 50- 55 feet. Commissioner Cummins questioned whether gravel was in a channel deposit or terrace. Mr. McRae replied that it was channel. Fifty of the ninety acres cannot be used because of the other developments in the area. This property is within the flood plain and the developers are willing to address themselves to those problems. Future studies are to be made concerning use of the gravel pits after they are mined. They have addressed themselves to the procedures of mining with one access off of 11th Avenue, and the extraction plan calls for block mining in eight mining areas. NoII mining will be done at the front of the property, and the final plan shows three pond areas. The developer will be working with the soil conservation people and wildlife as well as the state, and they are looking at about ten to fifteen years on the total mining program. Most of the material will be loaded and hauled away , however, at times a crusher will be moved in to wash and clean small amounts . The County has set a half mile limit on residences in the area and there are 185 residences within the half mile radius and about 30 within a one fourth mile range. He anticipated little problem with I this. Commissioner Clift made a motion to recommend no objections to this ,i proposal. Commissioner Ewald seconded the motion. He also questioned whether the Island Grove study is official. Mr. Sasaki replied.that it is not. Commissioner Cummins asked if the 15 years was a conservative time limit here. The proposed use will be compatible with the surrounding area, in harmony with the character of the neighborhood and existing agricultural uses, compatible with the future development in the area and will not adversely affect the health, safety, and welfare of the inhabitants of the area and the county. This determination is based upon the following: A. It is the opinion of the Department of Planning Services staff that open-cut mining operations as outlined and Richard Geiesert SUP-369 :78 :21 STAFF RECOMMENDATION September 5, 1978 controlled in the Operations Standards will minimize impacts on surrounding uses and the area to the greatest extent possible and provide adequate protection of the health, safety, and welfare of the inhabitants of the area and the county. No excavation or processing of sand and gravel shall be permitted nearer than 10 feet to the boundary of adjacent property, ease- ment or irrigation ditch or right-of-way , nor nearer than 125 feet to any existing residence , unless by written agreement to the owner or owners of such adjacent property consent to a lesser distance and the Planning Commission approves such lesser distance. The Planning Commission may set a greater distance than mentioned above when , in their opinion , it is justified. 2 . All sand and gravel operations shall be conducted during the hours of daylight except in the case of public or private emergency, or to make necessary repairs to equipment . This restriction shall not apply to operation of administrative and executive offices or repair facilities located on the property. 3. Weeds and any other unsightly or noxious vegetation shall be cut or trimmed as may be necessary to preserve a reasonably neat appearance and to prevent seeding on adjoining property. 4 . Existing trees and ground cover along public road frontage and drainageways shall be preserved, maintained and supplemented if necessary , for the depth of the setback in order to protect against and/or reduce noise , dust and erosion . 5 . In-so-far as practicable, all means of access to the property from any street shall be located and designed as to avoid the routing of vehicles to and from the property over streets that primarily serve, residential development . One access located at the north- east corner of the property will be allowed. Final location and - design of said access must be reviewed and approved by the Weld County Engineering Department . 6 . Insurance - The operator shall furnish evidence he is insured to the extent of not less than $100, 000. 00 against liability for any negligent act or omission by the operator from the operation or maintenance of the sand and gravel pit and the extraction and production of sand and gravel and all activities connected with or incidental thereto. 10. A septic system is required for the proposed office maintenance building. A permit for such a system must be obtained through the Environmental Services Division , Weld County Health Department . The system must be designed by a registered professional engineer 11. An emission permit (fugitive dust ) must be obtained from the Air Pollution Control Division of the Colorado Health Department , 4210 East 11th Avenue, Denver, Colorado, for dust emissions (mining activities, road construction , and parking lot area) . 12. Another emission permit must be obtained as in ( 11) for the portable rock crusher. 13 . A National Pollutant Discharge Elimination System permit must be obtained from the Water Quality Control Division, Colorado Department of Health for the discharge of water into the Cache La Poudre River. 14. Due to the fact that a portion of the property has histori- cally been used as flood way, any berming above the existing ground elevation would have an effect of impounding or diverting water onto adjoining properties . We therefore would be agreeable to removing any proposed berm with- in the property that has an elevation that would alter the general elevation of the natural ground. We also agree that no material stockpiles are to be placed on the site within the area defined by the Corps of Engineers, March 1974 report as the Intermediate Regional Floodway. " After all testimony and evidence was received, Commissioner Jacobucci made a motion to approve the SUP with all conditions and standards as recommended by the Weld County Planning Commission and the addition of the operational standard as proposed by Commissioner Steinmark. LOCATION: The site under consideration for the proposed gravel extraction operation consists of 87.5+7 Acres, located in the Northeast Quarter of the Southwest Quarter, and the Northwest Quarter of the Southeast Quarter and the North- east Quarter of the Southeast Quarter of Section 31 , Township 6 North, Range 65 West of the Sixth Principal Meridian, Weld County, Colorado. The site is bounded on the South and West by the Cache La Poudre River; on the East by 11th Avenue; and on the North by cultivated farmland. Approximately 7 Acres in the Southeast corner of the property is located in the City of Greeley. This occured during the original platting of the Town of Greeley in February, 1878, when the Northern town limits was defined as the center of the Cache La Poudre River. At some intervening time, the river channel was changed leaving this tract separated from the city. The remaining portion of the tract lies in the unincorporated portion of Weld County. 2. OWNERSHIP: The site is presently owned by Monfort of Colorado, Inc. and is under contract to purchase by Richard Geisert and Francis Geisert. Both the surface and mineral rights are to be transferred. There is an oil and gas lease of record as well as right-of-way for road and utility purposes. Richard and Francis Geisert are owners of Dick's Excavating, and Fran & Sons Construction whose address is P.O. Box 1265, Greeley, Colorado 80631 . The telephone number is 352-3255. The applicant has held no other open cut or other type of mining permit. The lands herein do not affect any lands described in Section 1 .56 (9) of the Colorado Mined Land Reclamation Board Regulations. An Irrigation Well (Reg. #29-11874, R.F. 200") forming a part of the Larimer-Weld Augumentation Plan is located on the described property. 3. TOPOGRAPHY AND PRESENT USE: The site varies in elevation from approximately 4655 feet to 4646 feet above mean sea level, resulting in an average slope of approximately 0.22% to the Southeast. The site is bounded on the South by the Cache La Poudre River. Several old river channels meander through the site. Presently, about 60 Acres is being cultivated and irrigated for farming. The remainder is either too small in configuration or lies within the old river channels and is too rough to farm. The only improvement on the property is a well pumphouse at the Northwest corner of the property. 4. ADJOINING USES: Whereas the site adjoins the City of Greeley, fortunately the surrounding property has not been extensively developed or populated. Located on about 6 acres at the Southeast corner of the property is D & D Salvage Company with an open storage auto salvage yard. A mobile home provides a residence for a caretaker. The area East of 11th Avenue is also primarily a salvage area and contains several small residences. The area South of the River, Southeast of the siteyis primarily vacant land with a few businesses and residences along 11th Avenue. Due South of the central portion of the site is the City of Greeley's Island Grove Park. This is a large (102 Acre) multipurpose park including play fields, historical village, County Fair buildings and horse barns and the rodeo grounds and pens. The 7.0 Acre triangular piece of ground that lies North of the river and projects into the center of the subject property is also owned by the City. This tract is presently leased by the City to the Greeley Saddle Club. Areas to the Southwest, West and Northwest are presently being used for gravel extraction. The Southwest area has been used for many years and will probably be completed in the next few years. The other areas are larger and appear to have several more years of use. The area North of the Easterly 2/3 has been leveled and is being used as cultivated farmland. 5. ZONING: The portion of the land lying in Weld County is zoned "A" Agricultural. Gravel extracting is a permitted use, but requires that an application, information on the operation and fees be presented to the Weld County Planning Commission and approved by the County Commissioners:,and that a "Special Use Permit" be granted. The small portion of the land that lies within the City of Greeley is zoned "I 2" Medium Industrial. This zone allows gravel extraction by right but requires a "Special Use Permit" similar to the County's require- ments. As no mining is planned in the area within the City, no application is being made directly to them, however, both the State and County will refer the Gravel Extraction Plans to the City for review. The City's Master Plan shows this area to eventually and properly be zoned "CD" Conservation District as the land is both within the flood plain and contains commercial mineral deposits. The uses by right within a "CD" district are cultivation of crops, rainsing of livestock; public parks and golf courses, holding ponds and other structures for flood control and watershed protection, and commercial mineral extraction activities. The uses by review are dwellings for caretakers, permanent buildings and structures accessory to any uses by right, radio towers, and sanitary land fills. 6. FLOODING AND DRAINAGE The Flood Plain Information -- Cache La Poudre River -- Colorado -Volume II, Greeley, Weld County, prepared by the Corps of Engineers in March, 1974, designates that the total area lies within either the Intermediate Regional Flood or Standard Project Flood areas. An Intermediate Regional Flood is defined as one that occurs with an average frequency of occurance of about once in 100 years. The Standard Project Flood is much larger and occurs only from a severe combination of meteorlogical and hydrological conditions and is very uncommon. The survace drainage affecting the site is limited to the area lying North of the Easterly 2/3 of the North boundary. This area is relatively flat and under cultivation and would enter the subject property in sheet flow and basically collect in the old river channel to flow to the river. Drainage areas further West and Northwest are intercepted by either the River or existing gravel ponds. Therefore offsite drainage is considered to have a minimal effect on the subject property. The investigation was carried out by means of test borings and laboratory testing of samples obtained from these borings. The objectives of this investigation were to (1) determine the soil profile and groundwater elevations at the site, and (2) determine the quantity and quality of the gravel encountered. SITE INVESTIGATION The field investigation, carried out on February 16, 1978, consisted of drilling, logging, and sampling eight (8) test borings. The locations of the test borings are shown on the Test Boring Location Plan included on page 5 of this report. Boring logs prepared from the field logs are shown on pages 7 and 8. These logs show soils encountered, location of sampling, and groundwater at the time of the investigation. All borings were advanced with a four-inch diameter, continuous- type, power-flight auger drill . During the drilling operations, a field engineer from Empire Laboratories, Inc. was present and made a continuous visual inspection of the soils encountered. SITE LOCATION AND DESCRIPTION The proposed pit is located along the Cache la Poudre River north of Island Grove Park, north of Greeley, Colorado. More particularly, the area is described as a tract of land situate in Section 31, Township 6 North, Range 65 West of the Sixth P.M. , Weld County, Colorado. -1- The site consists of a relatively flat area located within the floodplain of the Cache la Poudre River. Most of the area consists of irrigated, plowed farmland. An abandoned sanitary landfill is located in the southeast corner of the area. Many trees are located along the river and the irrigation ditch encountered on the property. Overhead utility lines are located along the north property line. An existing gravel pit is located adjacent to the northeast edge of the property. SOIL AND GROUNDWATER CONDITIONS The soil profile at the site consists of strata of materials arranged in different combinations. In order of increasing depths, they are as follows: (1) Silty Topsoil : The majority of the site is overlain by a one- half ('-z) to one (1) foot layer of silty topsoil . The topsoil has been penetrated by plant roots and organic matter. (2) Sandy Silty Clay: A layer of clay underlies the topsoil in all but Boring 3 and extends to the sand and gravel below. The silty clay is plastic, contains varying amounts of sand, and is damp to moist in its natural state. (3) Sand and Gravel : The gravel was encountered below the clay and topsoil at depths of one-half (2) to five (5) feet below the surface and extends to the bedrock below. The sand and fine gravel is clean to slightly silty and poorly graded. It is estimated that the gravel within the stratum ranges in size up to three (3) inches in diameter. (4) Claystone (Bedrock) : The bedrock was encountered in Borings 4 at a depth of sixty-five (65) feet and extends to greater depths. The upper two (2) feet of the bedrock is highly weathered; however, the underlying claystone is firm. (5) Groundwater: At the time of the investigation, free groundwater was encountered at depths of five (5) to ten (10) feet below the surface. Water levels in this area are subject to change due to seasonal variations, irrigation demands on or adjacent to the site, and the volume of flow in the Cache la Poudre River. DISCUSSION Over fifty (50) feet of sand and gravel consisting of fragments of quartz and igneous and metamorphic rock carried by the river from the mountains to the west was encountered in the test borings. These materials appear to be hard and durable. When properly screened and/or crushed, the sand and gravel should be suitable for use in construction materials such as concrete, asphalt, subbase, base course and fill material . The quantity of gravel at the site is in excess of seven million (7,000,000) cubic yards. We estimate that one-half million (500,000) cubic yards of overburden will have to be removed to obtain the gravel . The above quantities were determined by use of a planimeter, assuming an average gravel thickness of fifty (50) feet. Since the majority of the gravel was encountered below groundwater, the quarry will either have to be dewatered or the gravel will have to be removed by use of a drag line. GENERAL COMMENTS The gravel quantities determined are based upon the data obtained in the test borings at the locations indicated on the Test Boring Location -3- Plan; this report does not reflect any variation which may occur between these borings. The nature and extent of variations between the borings may not become evident until quarrying operations take place. The quality of the gravel encountered has been assumed from a visual inspection of the material . It is recommended that representative samples of this material be obtained in the field and subjected to testing in the laboratory to provide a sound basis for determining its physical properties. GENERAL OPERATING METHODS: The operation proposed for the site is an open pit gravel operation utilizing normal construction equipment, including loaders and scrapers. This equipment will operate in a manner normally used in both dry&wet gavel mining methods and construction excavations. No blasting will be required. During the time the actual mining operation occurs, farming will continue on the portions of the site where farming is now conducted and which are not actually disturbed at that time by the mining operation. As will be described below, it is the intention of the mining and reclamation process to remove only a portion of the land at the time from its existing condition --either farmland or vegetated flood plain land, -- and then return it as soon as the mining is completed to its proposed final configuration so the final recla- mation processes can proceed. As shown in the mining plan, the irrigation and farming of the land presently cultivated can continue in decreasing area as the mining and reclamation phases overtake the land. Basically, the mining operation will commence at the West end of the property and progressively work to the East. An office and maintainance shop and parking area will be constructed at the North. portion of Area 10. An access road will be constructed along the North property line. This will be used for all phases of the operation and will remain in the reclamation plan for access to the river, ponds and open space. The mining operation described in more detail below has been designed to minimize the area disturbed at any one point in time as well as to minimize double handling of materials, specifically overburden. The block-cut method of mining is proposed for extraction operations at the site. Conceptually, as the overburden is removed from a given area it will be placed directly in the area which has been previously mined. After the overburden is removed from an area, the gravel will be removed from that area until the water table is encountered. At that time, either well points will be installed, or a de-watering trench will be excavated around as much of that area as is required to de-water that particular area. Essentially, the water table will be lowered by pumping only in the area(s) which is being mined and backfilled. A detailed discussion of the methods of disposal of that water are described in a following section. As the water table is lowered in an individual mining area, the gravel which was formerly below the water table will be removed down to bedrock or until the quality of the gravel deteriorates below acceptable standards, whichever event occurs first. While the water table is still artificially lowered in that individual mining area, the overburden from the next mining area will be placed in the de-watered area so that it can be properly placed and the moisture content controlled during placement. This method is highly preferred to attempting to place the same material in a wet or pond area. De-watering will continue until the overburden has been filled to a grade three feet above the normal water table, including an adequate thick- ness of top soil. The gravel materials mined at the site are intended for use as base courses beneath pavements and as aggregate in asphaltic pavement and concrete and as fill material. Initially, the major portion of the aggregate mined from the site will be used in the Geiserts' construction business . _ Only enough aggregate must be stockpiled to supply Geiserts' own construction projects and some smaller contract sales and therefore, smaller stockpiles can be tolerated than if raw aggregate is sold in large volume directly from stockpile. 2. OPERATIONS PHASING : The overall mining operation has been divided into 8 phases. The mining plan shown on Exhibit "D" shows the site divided into 10 areas. Roughly the mining will take place in the area whose number corresponds to the phase number. A detailed description of the mining activities to occur in each phase is as follows: Phase I: At the commencement of overburden stripping, that material will be used to construct a berm along the South and West sides of Area 1 and along the West side of Area 2. This berm will be approximately 20 feet wide at the top and have side slopes not to exceed 2 : 1 . The elevation of the top of berm will be based on the Standard Project Flood and slope from 4658.5 at the Northwest Corner of Area 2 to 4656.5 at the Southeast Corner of Area 1 . This fill will vary from 2 to 7 feet. The purposes of the berm are several: (1 ) To provide pro- tection to the operation from flood levels in the river, (2) To provide noise and visual barriers to the adjoining properties, (3) To allow reclamation to commence on the outer slopes, (4) To provide working and future access to all points along the river. Any additional overburden will be placed on the dike between Area 1 and Area 4. In the initial gravel extractions, an adequate sub-base will be laid along the total Northern property line to construct an all weather access road to 11th Avenue. The gravel in Area 1 will be removed down to the water table, and de- watering operations will begin. The deeper gravel will be then mined. As part of Phase I, it is anticipated a portable gravel crushing unit will be used to stockpile a quantity of crushed material to provide a more com- plete line of aggregate for the Geisert's operation. This stockpile is to be located at the Northeast corner of Area 3. It is anticipated that this crusher operation will occur periodically as required to maintain a supply of this type of aggregate. Phase II: The overburden will be removed from Area 2 and used to provide shaping and topsoil for the Southerly part of Area 1 . Area 1 will be seeded and planted at this time. Area 2 will then be mined in the standard manner. Phase III: The overburden will be removed from Area 3 and used to provide shaping and topsoil for the Northerly and Westerly banks of Area 2. These . banks will then be seeded and planted. The irrigation ditch across Area 3 will be relocated along the access road so irrigation water can be provided to cultivated areas to the East. Area 3 will then be mined in the standard manner. Phase IV: The overburden from Area 4 will be used to shape and provide topsoil for Area 3. At this time the first pond will be completed and the final reclamation phases on this area can commence. Additional over- burden from Area 4 will be used to continue the 20 foot dike along the River. Area 4 will then be mined in the standard manner. Phase V: The overburden from Area 5 will be used to shape and provide topsoil for Area 4. The 20 foot dike will be continued along the Poudre River. Care will be taken along the Easterly edge of Area 5 to protect any living trees and to provide a buffer to the Greeley Saddle Club area. The area will then be mined in the standard manner. Phase VI & VII: These areas will be handled in the standard "block" manner. The irrigation water will have to be rechanneled or piped to continue serving the field in Area 8. Completion of the mining in Area 7 will complete the second pond. Phase VIII: This is the last area to be mined. Overburden from this area will be used to shape and provide topsoil to Area 7. Overburden and topsoil necessary for the reclamation of Area 8 will be stockpiled in Area 9. Also at the time Area 8 is opened for mining, the agricultural use of the irrigation water will cease. At this time, the water will be available for both reclamation pro- cedures and/or water augumentation. Area 8 will then be mined in the standard manner and then reshaped and topsoiled with the stockpiled material. Phase IX: An old city dump exists in the location of Area 9. Further explor- ation will be required to determine the actual limits. The dump area will not be mined and adequate cover will be maintained to separate the two uses. Area 9 will be reshaped at the same time Area 8 is being completed. Phase X: As previously mentioned, the North portion of Area 10 has been used for the office and maintainance area during the mining operation. At the completion of the mining in Area 8, and the final shaping of Areas 8, 9, and 10, the site work will be completed. At this time, Phase X: (Contt.) a determination will be made on the conversion of the building and parking facilities to supplement the recreational use or their removal. The results of the above mining phases will be three separate ponds-with surface :areas of approximately 17.0, 23.0 and 9.9 acres. The total pond area of about 50 acres is 57% of the total site surface. Often times as much as 95% of the available land is left as pond area in gravel pits located along the rivers. This is indicative of the owners desire to leave a tract of land that has a combination of beneficial recreational uses. Also, if desired, with minor revisions in the dike elevations, the ponds could be used as detention areas to store large quantities of storm water during large frequency storms. 3. TIME SCHEDULE: Based on the gravel requirements of the existing contracting business of the Geiserts and taking into consideration the future growth and demands of the area, the following time table was detemined to be a reasonable projection. The Use Rate was based on a 20% per year growth in the first five years and 10% per year therafter. On this basis, the time to complete this gravel pit operation would be about 12-1/2 years. Many combinations of factors could influence the timetable, but at this time an operational period of 10 to 15 years is anticipated and appears reasonable. SITE DISTURBANCE: The Colorado Mined Land Reclamation Board has defined different degrees of disturbance in a mining and reclamation operation. The definition of those three types of disturbance are as follows: Major Disturbance: That area of a mining operation that includes excavations, overburden spoils, and topsoil stockpiles. Moderate Disturbance: That area of a mining operation which is a result of backfilling of an open cut, stabilization of waste dumps, leveling of overburdened soils, the smooth grading and the distribu- tion of topsoil or other suitable approved plant growth median. Also includes within the affected area on-site privateways, roads, railroads, evaporation or settling ponds, leeching dumps, work parking storage or discharge areas and areas in which structures, facilities, equipment, machines, tools, or other materials or properties which result from or are used in the mining operation are situated. Minor Disturbance: That area of a mining operation which is under- going prepartation immediately prior to planting or seeding, is being Minor Distrubance: (Con't.) planted or seeded, or has been planted or seeded and has not been released from bond upon full completion of all reclamation requirements as set forth in the permit. The expected tim6bable for the mining operation and the amount of land disturbed at any point in the mining operation (using the definitions above) is found in the following table. This table assumes that the mining operation will be of an intermediate duration, that is, abount 12-1/2 years as discussed in a previous section. GROUNDWATER AND WELL PROTECTION: The high water table across the site requires that de-watering occur in an area for a certain length of time. The sequential mining will limit the area being de-watered to the area being mined. The time and length of times for the de-watering will be similar to the mining timetable. In general, de-watering will be required during approximately 90% of the mining operation. The de-watering operation will result in the lowering of the water table in the immediate vicinity of the mining area; however, due to the high water table and the proximity to the river, there will be a minimal affect on the water table outside the immediate area. disposal of the pit water will be to the Cache La Poudre River under one of the following plans: a.) De-watering by well points with discharge directly to the Cache La Poudre River. b.) De-watering by open pumps with water pumped to either temporary settling pond or previously constructed pond areas for settling with exfiltration and/or overflow to the Cache La Poudre River. In either case, an application will be made for a N.P.D.E.S. Permit from the Colorado Department of Health for discharge to the river. 6. ENVIRONMENTAL PROTECTION AND SAFETY The natural biomes of the area have been disturbed as a result of the farming, mining operations, and use of the area by the public. Therefore mining operations would have a small additional environmental impact on the eco-systems at the site. The majority of the impact would also be limited as the plan is to return the site to open and recreational uses and the river channel is to remain in a natural condition. The mining operation and the recirculation of the ground water with methods proposed should not result in any water pollution. Fortunately, residential use in the near vicinity is very sparse and in most cases, minimal in its habatibility. The sequence in mining operations puts the longer period of operation (the first phases) furthest from the residential and urban uses. Phase 8 which is closest to the intensive uses is anticipated to be in operation less than 1 year. Operations at the site will be limited to the daylingt hours. Construction of the berm along the West and South perimeters should also provide additional barriers to the visual, noise and dust impacts from the area. 6. ENVIRONMENTAL PROTECTION AND SAFETY: (Con't.) The type of environmental pollution most commonly associated with mining operations of the type proposed for the site is the addition of particu- late matter (dust) into the air in the area. Fugitive dust has two sources in gravel operations: wind erosion of fine-grained overburden materials, and rock dust generated by crusher operations. The overburden at the site is considered the most likely source for fugitive dust. The sequence of operations is such that• most of the overburden is handled only once; from the new mining site to its final location as shaping and topsoil on the previously mined area. As soon as possible the area will be landscaped and planted. The lack of overburden stockpiles should drastically minimize this source of air pollution. The gravel materials which will be processed through the crusher at the site will be in a moist condition. This will result in a much lower pro- duction of dust than f the material were dry. The mining operation itself will be much lower than the surrounding area and generally be handled in a moist condition due to de-watering necessary, which should minimize the dust from this phase of the operation. Generally, all operations at the site produce noise at a low level. Safety considerations at the site can be divided into two general catagories. (1 .) Operational safety by authorized personell, in which the operator has the responsibility of providing proper instruction, warnings and equipment; 4.nd (2.) Unauthorized entry by persons--in which the property will be properly posted. Generally, the sites will be excavated to the finished slopes and grades during the gravel extraction operation. The banks of the ponds will be cut at 3:1 (horizontal to vertical ratio ) from 5 feet above to 10 feet below the expected water line; below the 10 foot level, slopes will not exceed 2:1 . 7. SITE ACCESS AND TRAFFIC: A single access located at the Northeast corner of the site will serve the site. The entrance will be enlarged to provide good turning movement 7. SITE ACCESS AND TRAFFIC: (Con't.) into and out of the site. The access at this point is to 11th Avenue. Eleventh Avenue is a two lane paved road that in the past provided a major access to the City of Greeley. The construction of U.S. 85 Bypass and the improvement and connection of 8th Avenue to the By-pass have lessened the traffic demand on 11th Avenue. Gravel deliveries to all areas, except those within the downtown area of the city, would travel North one-half mile on 11th Avenue at which point deliveries to the West would use County Road #64 and deliveries to the North, South and East would use U.S. 85 By-pass. With this rela- tive short access to major arterials, the impact of the additional traffic from the gravel site is considered to be minimal. C.7 - c_� C' cr L , {- _ _ _ __ L L RECLAMATION PLAN BY DOUGLAS CAMPBELL CITY OF GREELEY PARKS PLANNER (PART-TIME) M.A. in Recreation Administration 1 Reclamation The reclamation plan is based, to a great extent, on two key environmental factors: (1) the site is bounded on the west and the south sides by the Cache la Poudre River, and (2) the site is located within the floodplain area of that river. With these factors in mind, the site is to be reclaimed for a park open space/greenbelt area and as a limited wildlife habitat area. Both measures are feasible and would enhance each other. Assuming the water level in the Cache la Poudre will fluctuate, depending on several variables (time of year, amounts of storm drainage, runoff, climatic conditions, etc.) the site reclamation plan must be able to accomodate the likelihood of several unique conditions. The relatively flat contour of the land will generally be maintained, except for the removal of gravel material from the three major mining areas, as outlined previously. These areas will, after mining, form three ponds which will cover the majority of the acreage. (see accompanying drawing.) Reclamation plans call for large berms to be constructed at the perimeter and throughout the site. Overburden materials will be taken from the direct mining sites and used to create the berms, in an effort to minimize double handling of materials. The berms along the riverfront will be constructed and compacted in order to maintain a definite separation between the river and the adjoining properties. 2 All berms will have approximately 3:1 slopes and will be planted with trees and ground cover to retard erosion caused by the river and by winds across the site. The berms around the site's perimeter, for the most part, will be 50-75 feet in width. This will provide a more than adequate environmental barrier along the property line. In addition, it is felt that berms of such size, compacted and sloped properly, will be a positive step toward controlling the existing river channel along the west and southern boundaries of the site. As the site is located within the floodplain area of the Poudre River, the implications are fully realized. In the even of possible flooding, the reclaimed area could have an advantage in providing three large ponds where some flood waters might be contained. Drainage within the area will be controlled in such a manner that excessive waters beyond the area's holding capacity would flow back toward the Poudre River. In any event, the design will complement the existing topographical configurations, both in the present field areas north of the river, and along the river bank itself. The first major purpose of the reclamation plan provides for preservation of open space/greenbelt areas for the Greeley-Weld County area. Planting of trees along the berms will add to the aesthetic value of the primary area, as well as surrounding properties. Because of the eventual park atmosphere after reclamation, the owner could choose to open the area for light recreational use. 3 Recommendations for proper re-vegetation at this site were obtained from the District Conservationist of the USDA Service Center in Greeley. (see Appendix ). It is the intention of D&F ENTERPRISES to follow the re-vegetation suggestions as outlined. Adhering to the recommendations of the Soil Conservation Service will insure that the site under question will not only be mined in a sequential manner, but shall also have a desirable re-vegetation plan to complement the total reclamation package. This will help protect the entire region north of the Cache la Poudre River, as it will provide an environmentally sound reclam- ation project for the primary area, thus enhancing the value of the surrounding acreage. The second major thrust of the reclamation program is concerned with wildlife preservation. The reclamation package should have a positive effect on the existing wildlife. The extensive planting schedule of trees and shrubs throughout the area will provide adequate cover and nesting spots, and should be instrumental in attracting additional birds and mammals. In addition to the existing wildlife, it should be noted that a recent evaluation of the area compiled by the USDA Field Office, stated that the three large pond areas would have "a very good potential for a fisheries development." 4 It is difficult to make time projections for the reclamation of this site because it is totally dependent upon the mining schedule. However, all planning has been based on a 15-20 year time span. Since the mining operation will be contingent, to a large part, on the demand for gravel in the area, it would be nearly impossible to assign a precise timetable to the reclamation phase. It should be noted, however, that D & F ENTERPRISES has every intention of beginning reclamation measures as soon as possible after mining operations have been completed in a given sector, as outlined. After a final grade has been established in an area, that area will be re-vegetated according to the enclosed recommendations of the USDA. The planting schedule will also take into account the best times of year for such work and current climatic conditions affecting growth of vegetation. Preliminary Water-Management Plan GEISERT GRAVEL OPERATION Greeley, Colorado 1 . INTRODUCTION The proposed gravel operation will take place on a parcel of land of approximately 87.5 acres , located generally in the NE%SW% and the N SE% of Section 31, T6N, R65W north of Greeley, Colorado. Gravel will be extracted by both wet and dry pro- cesses, over a period of time yet to be determined. Associated with any gravel operation in the State of Colorado is a Water Resource: Management Plan which provides appropriate information regarding quantitative and qualitative effects that will result from the mining plan. The purpose of this report is to provide preliminary comments on the required scope and content of the Plan, to summarize information avail- able to date, and to recommend whatever additional investiga- tions may be required. 2 . HYDROLOGIC CONSIDERATIONS At the present time, the gross water supply to the 87.5 acre parcel is provided by precipitation and by an irrigation well in the northwest corner of the property. As a result, depletion of the water supplies available to the South Platte River watershed due to the irrigation of corn has historically been accounted for as a reduction in tributary groundwater inflow to the Cache la Poudre River. When the gravel operation is completed several years hence, the depletion resulting from the irrigation of corn will be replaced by a depletion resulting from a combination of non- irrigated open space, developed areas , and open water surfaces . The gross extent of each has apparently not yet been precisely ( 1) identified. However, depletion resulting from water-surface evaporation will , as it has been historically, be accounted for as a reduction in tributary groundwater inflow. Rates of depletion for different land-use categories are summarized in the first column of Table 1, and represent gross evaporative losses irrespective of precipitation amounts . Depletion rates from irrigated cropland are calculated with the assumption that the total moisture needs of the crop are satisfied by the use of irrigation water to supplement natural precipitation. 3 .LEGAL CONSIDERATIONS Although floodwaters of the South Platte River occassion- ally leave Colorado in excess of compact committments to Ne- braska, on average the resources of the watershed are complete- ly utilized within the State of Colorado. As a result, addi- tional depletions of the water supply are not only contested by other water users but generally are not allowed either by the Division of Water Resources or by the Courts . A consequence of this criterion is that land-use and water- resource planning for the proposed gravel operation must be co- ordinated such that depletions resulting from the future con- figuration of the hydrologic system do not exceed the historic depletion. The necessary balance can be achieved . in either of two ways : a• On-site balance. A balance may be obtained on the specific parcel provided that the exposed pond area after mining is lim- ited in extent by evaporation-loss criteria. One possible com- bination of land areas which would provide a local hydrologic balance is shown in the last two columns of Table 1, and indi- cates that no more than 59 acres may remain in open water sur- face. Other combinations are possible including irrigated open space , some of which may require fill material . However, present plans include a lake of only 51 acres in surface area, so that the fill alternative may not require further consideration. (2) b. Plan for augmentation. A Plan for Augmentation is a pro- cedure established in Colorado water law whereby water rights of varying character may be substituted, transferred or ex- changed in order to preserve the distribution of streamflow. In the case of the proposed gravel operation, a plan would be required if the final land configuration includes a lake large enough to cause a depletion greater than has historically oc- curred. Briefly, the plan would consist of the acquisition and abandonment of water rights with a history of depletion at least equal to that of the increase caused by the lake. 4. CONCLUSIONS AND RECOMMENDATIONS The proposed gravel operation will occupy a site which has historically been planted to corn irrigated from an 800- gpm well . The well is authorized by Permit No. RF-200 issued by the Division of Water Resources , and is adjudicated for the irrigation of 120 acres by a decree of the Water Court issued 14 March 1977 in Case No. W-2002 . A petition to the Court for a change in use will consequently be required if the well is to be used for evaporation makeup or streamflow enhancement. Regardless of its size, the lake resulting from the ex- traction of the underlying gravel will alter the time distri- bution of groundwater inflow to the Cache la Poudre River. During periods when inflow is less than the historic values the shortage will have to be made up from the well if required by downstream water rights . If the lake is larger than_ 59 acres , additional water rights must be secured in order that the overall hydrologic balance of the South Platte River Basin is preserved. In addition, the rights must have been used in a location such that their abandonment will serve the purpose of preserving the local streamflow regime. ( 3) The decreed water rights are sufficient to compensate for the new depletion caused by an exposed water surface of up to 59 acres . Inasmuch as the site will be developed over a 10 to 15 year period , there will be a substantial overcompensation to the Cache la Poudre River in the first several years of development. Based upon the hydrologic and legal factors discussed above, the following steps are recommended: 1. Historic land use be accurately defined in terms of the number of acres in each category. '2 . Final land-use configuration be estimated as accurately as possible, particularly if the alternative of importing fill material is considered. 3. Availability of appropriate water rights be investigated in order to determine the economic tradeoff between water rights acquisition and cost of fill material , if either is required. 4. Proposed Mitigation Measures Including Reclamation for Wildlife Habitat Upon completion of the mining the lakes will be developed into an open space - park atmosphere. The shore lines and waste areas are to be reclaimed to SCS specifications. However, to enhance the use by wildlife, trees and shrubby plantings should be used for nesting and cover habitat for the many species of birds and small mammals. The lakes should have the banks sloped properly and they also have a-very good potential for a fisheries development. This proposed gravel pit site is comprised of Bankard sandy loam and Aquolls and Aquents, gravelly substratum soils. These soils can be subject to flooding. A high water table often exists from April through June. The Bankard sandy loam and Aquolls and Aquents (top soil) soils could provide a plant growth medium. The top soil from these soils could be stockpiled and used later on for vegetative reclamation. i ° `i Bankard soils are generally unsuited as a good source of sand or gravel for construction purposes. However, Aquolls and Aquents are a good source of sand and gravel for construction materials. See the attached soils map and descriptions for more information. It formed in stratified recent alluvium along streams and rivers throughout the survey area. Included in this unit are numerous sand and gravel bars. Some non- calcareous areas arc also included. Typically the surface layer is grayish brown sandy loam about 4 inches 1 athick. The underlying material , to a depth of 60 inches , is light yellowish brown calcareous sand stratified with thin lenses of sandy loam and loam. . Permeability is moderately rapid and available water capacity is low. ' Effective rooting depth is 60 inches or more. Surface runoff is slow r-1 and erosion hazard is low. - These soils arc suited to very limited' cropping. , They ark sandy and J subject to flooding. Pasture is the best use for this soil, with , tall wheatgrass , tall fescue and annual sweetclover some of the best suited crops. Light frequent irrigations by furrows and flooding are recommended. Commercial fertilizers improve the amount and value of forage produced. 1 The potential native vegetation on this soil is dominated by switch- grass , Indiangrass , sand bluestem, sand reedgrass , sideoats grama, needle-and-thread and blue grama. Much of this site has inclusions of other soils and vegetation in such a complex pattern that it is . • r, ,¢.,; - _ '1 hard to map separately. Potential production ranges from 2500 pounds u. . . ._ per acre in favorable years to 1500 pounds per acre in unfavorable years. When range condition deteriorates , the tall and mid-grasses - —1 decrease, blue grama, sand dropseed and forbs increase and production drops. Undesirable weeds and annuals invade the site as range condition becomes poorer. Management of vegetation on this soil should be based on taking half and leaving half of the total annual production. Seeding is only _ 1 advisable on areas large enough to prepare a seedbed on or interseed with an interseeder. __.__i Switchgrass, sand bluestem, sand reedgrass, sidcoats grama, little bluestem., blue grama, pubescent wheatgr.-tss and intermediate wheat- _I grass are suitable for seeding. For successful seeding, use of an a::=l interseeder or a firm, clean sorghum stubble -- prepared the growing —y season prior to seeding -- and a grass drill are required. Early spring seeding has proven most successful. This soil is generally not suited to ithe establishment and growth of trees and shrubs . On-site investigation is needed to determine feasibility and possible tree and shrub species . Wildlife is an important secondary use , with these soils best suited for openland and rangeland wildlife. T11 cropland areas , habitat favorable for ring-necked pheasants , mourning doves , and many non- game species can be developed by establishing wildlife areas for nesting and escape cover. For pheasants , the inclusion of undisturbed j `� nesting cover is vital and should he included in plans for habitat development. This is especially true in areas of intensive agriculture. J' Lbsi Rangeland wildlife , such as deer and antelope , can be assisted and encouraged by proper livestock grazing management and range reseeding where needed . This soil is not suited for urban or recreational development due to the flood hazard. *See note below. Capability subclass lVw irrigated Vlw nonirrigaced Sandy boLtomland range site *This statement was discussed with the Soil Conservation Service and it pertains to the soil in its present condition. With the modifications of the area as outlined in the mining and reclama- tion plan, the area will be suitable for "open space" and recreation uses . 5:74 4:7e_c_ A Gerald B. McRae - Aquolls and Age"ts , graved substratum These nearly level soils are on bottom lands and flood plains of all the major streams in the survey area . The Aquolls , which have dark colored surface layers , make up about 65 percent of the mapping unit. The Aquents , which have lighter colored surface layers , make up about 25 percent. About 10 percent is Aquolls and Aquepts , flooded , and Bankard sandy loam. These are deep , poorly drained soils. They formed in recent alluvium. Typically they have mottled , mildly to moderately alkaline , loamy or - - 1 clayey surface layers and underlying material, and are underlain by- -= sand or sand and gravel within 48 inches . They may or may not have a gleyed layer in the underlying material. Most of these soils are subject to flooding. A watertable is at or near the surface early in the spring and recedes to as deep as 48 inches by late fall in some years . 1 These soils are used for rangeland and wildlife habitat. Some small areas have been reclaimed by major drainage and leveling operations and is farmed to irrigated crops. The potential native vegetation on these soils is dominated by alkali sacaton, switchgrass and western wheatgrass . Saltgrass, sedge , rush and alkali bluegrass are also prominent. Potential production ranges - --1 from 3000 pounds per acre in favorable years to 2000 pounds per acre in unfavorable years . When range condition deteriorates , switchgrass , • 1 3 'f alkali sacaton and western wheatgrass decrease and saltgrass , sedge and rush increase . 1 Management of vegetation on this soil should be based on taking half 1 and leaving half of the total annual production. Seeding on this site is difficult and costly since numerous tillage practices are required to eliminate the saltgrass sod . Switchgrass , western wheatgrass , alkali sacaton , tall wheatgrass and tall fescue are suitable for seeding. For successful seeding a clean, firm seedbed -- usually requires more than one year to eliminate the saltgrass sod -- and a grass drill ` I should be used. Early spring seeding has proven most successful . ----1 Wetland wildlife , especially waterfowl, utilize these areas . The availability of moisture due to the wetness of this soil allows pro- --;t:-.. J . duction of wetland plants that provide nesting and protective cover, as a well as some food for waterfowl. J Management for wildlife would include prevention of overgrazing by livestock, protection from unplanned fire , and prevention of drainage . Where livestock are present , these valuable wildlife areas should be - • fenced to prevent unwanted encroachment and overuse by livestock. • These soils have a good potential as a source of sand and gravel. Capability subclass VIw ,1 Salt meadow range site I • RECLAMATION SUGGESTIONS Adequate plant growth media will need to be stockpiled for revegetation of the area. At least twelve inches of plant growth media will be neces- sary on the mined surface for grass establishment. If crops are to be established, the plant growth media will need to be sufficient to meet the established root zone (2 - 6 feet) of the proposed crop. Vegetation Reclamation Suggested vegetative cover: For a vegetative ground cover on flat bottoms, a mixture of grasses and legumes could be seeded. Alfalfa (Medicago sativa) 757, variety ladak; and Smooth brome (Bromus inermis) 257, variety lincoln, `' H would provide excellent ground cover and wildlife habitat, as well as an • economic return of sellable hay. Recommended seeding rate: 40 pure live seeds (P.L.S.) per square foot. Alfalfa 75% = 6.0 lbs. P.L.S./Acre A Smooth brome 25% = 3.3 lbs. P.L.S./Acre ;3 A -1 . VEGETATION RECLAMATION Suggested vegetative cover: For a vegetative ground cover on slopes of 3:1 or flatter, with a northeast exposure, a mixture of the following grasses could be seeded: Western wheatgrass (Agropyron smithii) 30%, variety Barton; Side oats grama (Bouteloua curtipendula) 40%, variety Vaughn; Blue grama (Bouteloua gracilis) 30%, variety Lovington. Recommended Seeding Rate: 40 pure live seeds (P.L.S.) per square foot. Western wheatgrass 30% = 4.8 lbs. P.L.S./Acre Blue grama 30% = 0.6 lbs. P.L.S./Acre Side oats grama 40% = 3.5 lbs. P.L.S./Acre TOTAL 8.9 lbs. P.L.S./Acre Suggested Vegetative cover: For a vegetative ground cover on slopes of 3:1 or flatter with a southwest exposure, the following mixture would be accepta- ble: Blue grama (Bouteloua gracilis) 30%, and Side oats grama (Bouteloua curtipendula) 70%. Recommended Seeding Rate: 40 pure live seeds (P.L.S.) per square foot. Blue grama 30% = 0.6 lbs. P.L.S./Acre 1 Side oats grama 70% = 6.2 lbs. P.L.S./Acre TOTAL 6.8 lbs. P.L.S./Acre All suggested seeding rates are based on using a grass drill. If the broadcast method is used, the seeding rates should be increased two fold. Slopes at 3:1 should be mulched after seeding to reduce water and wind erosion before the area is protected by the seeded vegetative cover. An effective mulch of clean straw (grass, hay or cereal grain) applied at a rate of 4,000 pounds per acre, will provide 92 percent of coverage for the soil surface. This will increase soil moisture and reduce the surface temperature to protect germinating seeds and seedlings. The straw should be crimped into the soil to prevent it from blowing and washing away. Other acceptable mulch materials are excelsior matting, jute netting and erosion control fabric. SEEDING DATES: All seedings should be made in the spring, if possible, to take advantage of the best moisture period. Recommended dates are between March 15th and May 15th. Late fall seeding can be made after October 15th. Germination will not take place until the following spring. - -1 SEEDING EQUIPMENT: A grass drill with depth bands should be used. This will insure a better seed germination and survival rate. A septic system is required for the proposed office maintenance building. A permit for such a system must be obtained through the Environmental Services Division, Weld County Health Department. The system must be designed by a registered professional engineer. Also, high groundwater may be encountered. 2. An emission permit (fugitive dust) must be obtained from the Air Pollution Control Division of the Colorado Health Department, 4210 E. 11th Avenue, Denver, Colorado, for dust emissions (mining activities, road construction, and parking lot area). 3. Another emission permit must be obtained as in (2) for the portable rock crusher. 4. A National Pollutant Discharge Elimination System permit must be obtained from the Water Quality Control Division, Colorado Department of Health for the discharge of water into the Cache La Poudre River. 5. Noise levels shall comply with those limitations listed in 25-12-103, C.R.S. 1973. 6. As stated in the application packet, mining plan prepared by McRae and Short, Phase IX area will not be mined as it is the location of an abandoned landfill . Geisert, to be located in the NE4SW4j NW4SE4, NF SE4 of Section 31, Twp. 6N, Range 65W. The proposed Open Cut Mine is to be located on lands that are considered the flood plain of the Cache La Poudre river. The two soils present are Bankard sandy loam, 0 to 3 percent slopes and Aquolls and Aquents, gravelly substratum. These soils are not considered prime agriculture land. The reclamation plan as proposed conforms to the recommendations that we provi- ded to the individual during the plan preparation. As stated in the application, mine reclamation will conform to the standards and specifications of the Soil Conservation Service. However, the reclamation plan does not provide a time schedule for revegetation of disturbed areas. It is our recommendation that the proposed dike along the river be revegetated as soon as practical (same season or year) to assure a vegetative cover that will resist water action which may occur during flooding on the Cache La Poudre river. In phase I of the mining plan, the berm or dike is described to have side slopes not to exceed 2:1. However, in the reclamation plan, all dikes and berms are described to have 3:1 slopes. For ease in establishment of vegetative cover, slopes of 3:1 or flatter are recommended. We can see no other reason why this request should not be granted, as gravel operations in the vacinity are presently being conducted. The reclamation of the area to recreational and wildlife habitat uses seems feasible and reasonable as long as timely action is taken in the revegetation of disturbed areas to avoid wind and water erosion. The Commission noted the following concerns : (a) inadequate public improvements (water, fire, sewer , street) , (b) lack of interior street and secondary access , (c) inadequate use buffers and site development controls , and (d) non- confor- mance with Comprehensive Plan which suggests commercial activity clustered near First Avenue and the cemetary. 2) Rezoning "E" to "C" (Bernhardt) - -The Commission recommended denial on the same grounds as the Bliss rezoning. 3) Recorded Exemption (Hertzke) - -The Commission recommended no objection. It. was requested that the applicant work with the Highway Department to ensure adequate dedication for a widened 10th Street . 4) Recorded Exemption (Uyemura) --The Commission recommended denial . The site already is bounded on the northwest, west, and partly on the south by active and inactive gravel pits. The drill-hole logs presented by Empire Labora- tories confirm my map information that this deposit attains thicknesses of 50 to 60 ft with up to 5 ft overburden. The phased mining and reclamation plan will recover nearly 6.5 million tons of gravel and will leave three ponds totalling 51 acres in surface area. I see no geologic problems involved with this operation. Although plans and recommendations have been made for water augmentation, I would suggest a clarification be made of the existing water rights on the property. The flood hazard information and data used by the applicant 's engineer was accepted and approved by a Colorado Water Conservation Board resolution dated February 26, 1975. We have found that the water surface elevations used for the 100-year and Standard Project floods to agree with the values in the approved report entitled, "Flood- plain Information, Cache La Poudre River, Volume II, Greeley, Weld County" dated March, 1974. Because the proposed use is located in the Cache La Poudre River floodplain, we recommend that any future operations not obstruct flood flows. A discharge of 9,600 cfs has been computed for the 100-year flood event. Any protective levees or dikes which may be constructed, should be so engineered as not to cause damage to others . The proposed mining site is located in the main conveyance area of the floodplain. Should this area be removed from the 100-year flood- plain, it could change the direction of flood waters and rise flood elevations .
