WHEREAS, at a public meeting held in the chambers of the Board of County Commissioners, Weld County, Colorado, by the Board of County Commissioners on the thirteenth day of September 1976, the Board of County Commissioners, Weld County, Colorado, did hear the application of Larry Shivers for a lot size variance from the minimum lot size requirements of the Weld County Zoning Resolution, and WHEREAS , Section 9-4A(6) of the Weld County Subdivision Regulations requires that a lot size variance be obtained before a recorded exemption is granted to an applicant, and WHEREAS, the Board of County Commissioners, Weld County, Colorado, having heard the testimony of those present and having considered the recommendations of the Planning Commission staff, finds that the applicant has not shown good cause for granting a lot size variance under Section 9-4A (6) of the Weld County Subdivision Regulations. NOW, THEREFORE, BE IT RESOLVED, that the application of Larry Shivers for a lot size variance on a parcel of land described as part of the East Half of the Northeast Quarter, Section 35 , Township 5 North, Range 65 West of the 6th P.M. , Weld County, Colorado, be, and hereby is, denied as inconsistent with provisions of the Weld County Zoning Resolution, the Weld County Subdivision Regulations and the Weld County Comprehensive Plan. The above and foregoing Resolution was, on motion duly made and seconded, adopted by the following vote on this 15th day of September , A. D. , 1976 . The parcel of land is described as part of the Ez of the NE4 of Sec. 35, T5N, R65W of the 6th P.M. , Weld County, Colorado. Said property is located 4 miles east and z mile north of LaSalle. The subject property contains approximately 30 acres of Class III and IV irrigated soils. These soils are classified as prime agricul- tural soils by the Soil Conservation Service. The request is to split the property into two 15 acre parcels. Presently there are no improvements on either of the two proposed lots. The stated intent is to build a house on each of the two proposed parcels. The following additional information is submitted to aid the Board in reaching a decision on this request. The subject 30 acre parcel was split from the NE% of Section 35, T5N, R65W in May of 1968. Mr. Shivers obtained the property in January of 1975. Mr. Shivers took out a building permit for a residence in April of 1976. Said building permit has expired and no con- struction has taken place. Within a five mile radius of the subject pro- perty there have been twenty recorded exemptions approved since the adoption of the recorded exemption procedure by the Board of County Commissioners. A copy of a map showing the locations of these recorded exemptions is included in the attached packet. Based upon the information submitted, the above data, and the adopted policies in the County, the Planning Commission staff recommends denial for the follow- ing reasons: WELD COUNTY COMMISSIONERS GLENN K. The proposed split does not comply with the Weld County Com- prehensive Plan because it would promote non-agricultural use of agricultural land and it would encourage urban en- croachment on rural land use. 2. The recorded exemption request is not in conformance with the intent clause of the Agricultural Zone District (Se-tion 3.3A of the Weld County Zoning Resolution) which states: "Intent - The intent in establishing the A-I Agricul- tural Zone District is to allow all agricultural and related uses in those areas in which agriculture is and should continue to be the predominant land use. This district is intended to discourage encroachment of imcompatible uses upon the agricultural land in the district, to encourage agricultural uses as the highest and best use of the land in the district as compared with other uses in conflict therewith, and to provide for the orderly expansion of urban growth in conformance with the Weld County Comprehensive Plan." The request would not be encouraging agriucltural uses as the highest and best uses, it would not be providing for the orderly expansion of urban growth, and it would be promoting the division of agricultural lands into smaller, less economic parcel sizes. 3. The recorded exemption request is not in compliance with the in- tent clause of the recorded exemption procedure (Section 9-2 of the Weld County Subdivision Regulations). Said clause states: "The intent in establishing the Recorded Exemption pro- cedure is to provide, in accordance with the Weld County Comprehensive Plan, a means whereby non-productive agricul- tural lands may be developed for higher or more productive uses, in-so-far as such uses are compatible with surround- ing agricultural uses in areas where such land divisions are proposed. (Rev. 4/17/74)" The existing 30 acre parcel has no improvements. The split would allow two sets of improvements to be built (one on each proposed parcel ) and therefore create an urban encroachment which would be non-compatible with the Agricultural District. 4. The minimum lot size in the irrigated Agricultural District is 80 acres. Description of land follows: Located in the East Half (E ) of the Northeast Quarter (NEt) of Section 35, Township 5 North, Range 65 West of the 6th P.M., Weld County, Colorado. The acreage is not productive enough to pay for itself as farm land. The entire 30 acres is sandy loam which makes it difficult to water evenly to produce a good crop. The land needs to be leveled to make irrigation more effective; however, the cost would be prohibitive for such a small acreage and would not pay for itself. Being sandy loam, the land needs to have a ground cover at all times of the year to prevent blowing. Alfalfa or grass of some kind would be ideal for the type of land. However, it would be impossible with such a crop to make any profit. If the acreage were divided into two parcels, it would be sufficient to have a home on each parcel and the remainder of each parcel could be planted to grass or alfalfa and the owners could have a horse or other livestock. A review of this requestindicates that a Recorded Exemption must be applied for and approved by the Board of County Commissioners prior to any land split. The proposed division was reviewed and appears to not be in compliance with the Weld County Comprehensive Plan and other applicable regulations. The location of the property is not within an existing communities growth area and is irrigated soil with a good agricultural capability. Morgan , Colorado 80701 , • Re: Inquiry on subdividing via a Recorded Exemption - a parcel of land described as part of the SE4 • of the NE4 of Sec . 35 T5N R65W of the 6th P . M . , Weld County , Colorado containing 30 acres more • or less . Dear Mr . Shivers : • • The Planning Commission staff has reviewed your proposal to. split off approximately one acre from the above described • parcel of land . The decision of the staff is to recommend denial for the following reasons : • 1 . The proposed split does not comply with the Weld County Comprehensive Plan because it would promote non-agri - cultural use of agricultural land and it would en- courage urban encroachment on rural land use . • • 2 . The proposed recorded exemption request is not in com • - pliance with the intent clause of the recorded exemption • procedure ( Section 9-2 of the Weld County Subdivision Regulations ) . Said clause states : "The intent in establishing the Recorded Ex- • • emption procedure is to provide , in accordance • with the Weld County Comprehensive Plan , a means whereby non-productive agricultural lands may be developed for higher or more productive uses , in-so-far as such uses are compatible with surrounding agricultural uses in areas where such land divisions are proposed . (Rev . 4/ 17/74 ) " ; Soils in this area are Class III , and IV . The granting of • the recorded exemption would allow for the conversion of productive irrigated agricultural lands since a new set of improvements would be allowed on the one-acre parcel. 3 . The request is not in conformance with the intent clause of the Agricultural Zone District ( Section 3 . 3 A of the Weld County Zoning Resolution ) which states : " Intent - the intent in establishing the A- I Agricultural Zone District is to allow all agricultural and related uses in those areas in which agriculture is and should continue to be the predominant land use . This district is intended to discourage encroachment of incompatible uses upon the agricultural land in the district , to encourage agricul - tural uses as the highest and best use of the land in the district as compared with other uses in conflict therewith , and to provide for the orderly expansion of urban growth in conformance with the Weld County Compre- hensive Plan . " The request would not be encouraging agricultural uses as the highest and best uses , it would not be providing for the orderly expansion of urban growth , and it would be breaking up a large block of agricultural land .
