WHEREAS, the petitioner was present, and WHEREAS, evidence was presented in support of the approval of the Amendment of the Commercial Unit Development Plan upon the aforementioned tract of land, and WHEREAS , Section 6. 6 of the Weld County Zoning Resolution authorizes the Board of County Commissioners to grant approval to an amendment to a Commercial Unit Development upon a showing by the Petitioner of compliance with all of the requirements of Section 6. 6 of the Weld County Zoning Resolution, and 770014 BIDp'C X3,5 I 1736838 WHEREAS, the Board of County Commissioners of Weld County, Colorado heard all the testimony and statements of those present, has studied the request of the petitioner and the recommendations of the Weld County Planning Commission and all of the exhibits and evidence presented in this matter, and having been fully in- formed and satisfied that the request for granting the amendment of Commercial Unit Development Plan complies with all of the conditions set out in Section 6. 6 of the Weld County Zoning Resolution, NOW, THEREFORE, BE IT RESOLVED by the Board of County Com- missioners of Weld County, Colorado, that the petition of H & S Irrigation Company, La Salle, Colorado 80645, for an amend- ment of Commercial Unit Development Plan on the tract of land set forth herein, be and hereby is granted, subject to the Develop- ment Standards of the Planning Commission, and that certain agreement by and between H & S Irrigation Company and the Town of LaSalle dated July 5th, 1977. It is the opinion of the Planning Commission that the requested change in use does not substantially differ from the use approved by the Board of County Commissioners on January 26, 1976. 2. The Town of LaSalle Planning Commission has indicated they have no objections to the proposed change in use. They recommended that the Town Board sign the .agreement between the Town and H & S • Irrigation Company. Additionally, the LaSalle Planning Commission desired to continue to have the ability to review any new and different uses proposed to be located on the property in question. 3. The Weld County Engineering Department has indicated they could not identify any engineering problems with the request. 4. No opposition to this requested amendment has been received by our office from any of the surrounding property owners. The permitted use on the hereon described property shall be the sales, service and storage of construction materials for irrigation systems. Presently there exists 4, 000 square feet of warehouse space and 800 square feet of office area. An additional 10, 000 square feet of warehouse space is approved provided the use is for the permitted use described above. Residential facilities currently located on the property shall_ be phased out at the time the proposed road running adjacent to the westerly line of subject property is constructed. Future development (buildings, roads and parking areas) if approved by the Board of County Commissioners shall not cover more than 60% of the total acreage. 2. The property in question shall be maintained in such a manner so as to prevent soil erosion, fugitive dust and the growth of noxious weeds . 3. Exterior lighting may be maintained for security purposes provided it does not obscure the vision of highway traffic or create a nuisance for adjacent properties. 4. Access to the property shall be via the state highway frontage road located on the east side of the property. This access shall be abandoned when the proposed public road on the west side of the property is constructed. 5. The outside storage of pipe and materials shallbe enclosed by a 6 foot high chain link fence. 6. The installation of signs shall comply with Section 4 .4 of the Weld County Zoning Resolution. 7. Any changes to the permitted uses described above, the Develop- ment Standards, and/or the Commercial Unit Development Plan shall require approval by the Board of County Commissioners of an amendment to the Commercial Unit Development Plan prior to such changes being permitted. WI IHNESSETH: WHEREAS: H and S Irrigation Company is the owner of -a 11 .95 acre tract of land located close to the sauthernhoundery of the Town of LaSalle, aid tract of land being more specifically described as follows: All that part of the North Half of the Southwest QuaTter (N;}SWf) of Section Six (6) , Township Four (-4) North, -Range Sixty—five (65) West of the 6th P.M. , lying South of -the Right—of-way of the Union Pacific Railroad (Dent Branch) and West of the State Highway , -being more particularly de- scribed as follows : Commenci-ng at the SW Corner of Said Section 6, and consider- ing the West line of Section 6 to bear North 00°00' 00" East and -all other bearings contained here in relative thereto: Thence North 00°00' fast along the West line of said Section 6 a distance of 1 ,286. 7 feet to the True Point of Beginning; Thence continuing North along the West line of said Sect ion 6 a distance of 695.86 feet to a -point on the Southerly Right- of way of the U . WHERE-AS: H and S Irrigation Company has request the Weld County Planni-ng Commission and the Board of County Commissioners of Weld County to change use on the 11 .95 from A Chemical Company use to other Commercial uses approved in the County Commercial Ordinances and H and S Irrigation Company has drafted this Agreement to aid the Town of LaSalle with their future growth. Hand S Irrigation Company will use only completely enclosed sanitary sewer disposal system. C. H and S Irrigation company will use water available from a pump located on the property for its source of domestic water. D. H and S Irri-gation Company agrees to terminate the us.e of on-site -ewer and connect to the Town of LaSalle sanitary sewer system 90 days after such services are available and to pay all proportional costs. E. H and S irrigation Company agrees to at such time as the Town of LaSalle annexes H and S Irrigation Company or future owner of above describe-d property to sell the Town of LaSalle approximately .95 acres of land along the westerly property line in the form of a 60' wide North and South strip for the construction of a future road; and sale price to be 51 ,600. F. H and S Irrigation Company agrees to at such time as the Town of LaSalle annexes comply with all restrictions and conditions of annexation. The Division has the following comments for your due consideration. In reviewing the site, it was found that there is no definite delineation of either the access road or driveway/street entrance. It would be our recommenda- tion that the frontage road driveway/entrance be improved to county standards , with delineation of driveways to existing building and farm house. It would also be our recommendation that the frontage road within the property be improved to county standards. This would insure adequate access to the lots from the frontage road until such time as the westerly road is constructed. It should be noted that the present frontage road was constructed to provide access to the farms and houses in the area. Commercial use of this frontage road may cause damages to its serviceability. At this time, the Division has no plans to improve the frontage road. The developers may want to consider its improvement along with the construction of the internal streets. Such improvement would be at the developers ' expense. Due consideration should be given to developing the westerly road system as a part of the development plan if improvements are not made to the frontage road.
