This project falls under the Use by Special Review Standard, Weld County Code, Chapter 23, Article II, Division 4, Section 23. Staff comments made during this phase of the Use by Special Review process may not be all-inclusive, as other issues may arise during the remaining application process. All issues of concern and critical issues during further review must be resolved with the Public Works Department. Weld County Road Classification Plan (FHU): WCR 81 is a local gravel road and requires a 60-foot right-of-way at full build out. There is presently a 60-foot right-of-way. This road is maintained by Weld County. Pursuant to the definition of SETBACK in the Weld County Zoning (23-1-90), the required setback is measured from the future right-of-way line. WCR 120 is a collector road and requires an 80-foot right-of-way at full build out. There is presently a 60- foot right-of-way. This road is maintained by Weld County. Our most recent traffic count for WCR 120 showed 212 vehicles per day in July of 2009 with an 85th • percentile speed of 70 mph. Access/Roadway: The site will utilize a single access onto WCR 81. The application states that the haul route will require all trucks to go north to WCR 120 and then they will likely split 50-50 east-west. They are providing double cattle guards to prevent site materials from being tracked onto WCR 81. We will require a full Improvements Agreement for upgrades and maintenance on WCR 81 and WCR 120. 1. An Improvements Agreement between the Applicant and the County will be required for this project. It will detail the approved haul route(s), any onsite and offsite requirements, and a maintenance agreement for the haul routes. Intersection improvements will be needed at the intersection of WCR 81 and WCR 120 and shall include a paved apron with sufficient turning radiuses for large trucks. Road maintenance will also be required including possible dust control on WCR 81 triggered by traffic counts. Contact Amy Burry, Utility Coordinator for Weld County Public Works, at (970) 304-6496 ext. 3764 for a Right-of-Way permit for any work that may be required in the right-of-way. A special transport permit will be required for any oversized or overweight vehicles that may access the site and may be obtained by contacting Amy as well. Site: No structures have been proposed on this site. There will be a maximum of 3 employees working at the site. 2. Pursuant to Chapter 15, Articles I and II of the Weld County Code, if noxious weeds exist on the property or become established as a result of the proposed development, the • applicant/landowner shall be responsible for controlling the noxious weeds. EXHIBIT C.\Documents and Settings\kogle\Local Settings\Te ---- -"'--"' "" k\NU 2011-0201 • Stormwater: The applicant has submitted a "Drainage Letter-Konig Barrow Pit" dated October 18, 2010 and signed and stamped by Chris Rundall, P.E. #40319. 3. Please ensure that the culvert at the entrance to the site will have a minimum of 1' of cover. 4. The elevations for extending the culvert listed on the"Mine Plan Map" dated 9/10/10 don't appear to work with the existing contour elevations (Existing Roadway is at 5081 while the culvert is labeled with inverts of 5088). Please correct the invert labels. 5. The historical flow patterns and run-off amounts will be maintained on site in such a manner that it will reasonably preserve the natural character of the area and prevent property damage of the type generally attributed to run-off rate and velocity increases, diversions, concentration and/or unplanned ponding of storm run-off. 6. The applicant must take into consideration storm water capture/quantity and provide accordingly for best management practices. 7. The applicant is required to comply with all Colorado Department of Health and Environment, Water Quality Control Division regulations regarding storm water quality permitting and protection and construction storm water discharges. No permanent structures are proposed, and no processing (screening, crushing) will occur. Portable toilets and bottled water may be utilized at the working face of the mine. The application indicates that the mining operation, along with reclamation could occur for up to 10 years. As this operation is not temporary (6 months or less), an individual sewage disposal system is required. A vault would be allowed as sewage disposal system. A permanent water source is also required. • According to the applicant, maintenance of vehicles and excavating equipment will not occur on the property. There is a shop on property to the south of this site where maintenance will be performed. Noise will be restricted to the level allowed in the industrial zone district. The applicant submitted a waste handling plan which indicates there will be minimal waste; trash and garbage from employees. The waste from the site will be removed and disposed of by Waste Management of Ault, Colorado. The applicant submitted a dust abatement plan which indicates that Noble Energy will provide dust abatement for the mining operation. A water truck will be used to treat on- site and off-site areas to suppress dust, including the stockpile areas. Haul trucks will be required to cover their loads and reduced speed limits will be controlled at the site. The applicant We have no objections to the proposal; however, we do recommend that the following conditions be part of any approval: We recommend that the following requirements be met prior to allowing the plat to be recorded: • 1. The applicant shall submit evidence of an Air Pollution Emission Notice (A.P.E.N.) • and Emissions Permit application from the Air Pollution Control Division, Colorado Department of Health and Environment, if applicable. Alternately, the applicant can provide evidence from the APCD that they are not subject to these requirements. 2. Submit documentation to Environmental Health Services, Weld County Department of Public Health & Environment indicating that a permanent water source is available for sanitary uses. 3. In the event washing of vehicles will occur on site the applicant shall ensure that any vehicle washing area(s) shall capture all effluent and prevent discharges from the washing of vehicles in accordance with the Rules and Regulations of the Water Quality Control Commission, and the Environmental Protection Agency. Vehicle washing areas should be designated on the plat. 4. In the event that 1 or more acres are disturbed during the construction and development of this site, the applicant shall obtain a stormwater discharge permit from the Water Quality Control Division of the Colorado Department of Public Health and Environment. We recommend that the following requirement be incorporated into the permit as a condition that must be met prior to operation: • 1. An individual sewage disposal system is required and shall be installed according to the Weld County Individual Sewage Disposal Regulations. We recommend that the following requirements be incorporated into the permit as development standards: 1. All liquid and solid wastes (as defined in the Solid Wastes Disposal Sites and Facilities Act, 30-20-100.5, C.R.S., as amended) shall be stored and removed for final disposal in a manner that protects against surface and groundwater contamination. 2. No permanent disposal of wastes shall be permitted at this site. This is not meant to include those wastes specifically excluded from the definition of a solid waste in the Solid Wastes Disposal Sites and Facilities Act, 30-20-100.5, C.R.S., as amended. 3. Waste materials shall be handled, stored, and disposed in a manner that controls fugitive dust, fugitive particulate emissions, blowing debris, and other potential nuisance conditions. 4. The applicant shall operate in accordance with the approved "waste handling plan", at all times. • 2 • 5. Any vehicle washing area(s) shall capture all effluent and prevent discharges from drum washing and the washing of vehicles in accordance with the Rules and Regulations of the Water Quality Control Commission, and the Environmental Protection Agency. 6. Fugitive dust and fugitive particulate emissions shall be controlled on this site. The facility shall be operated in accordance with the approved "dust abatement plan", at all times. 7. This facility shall adhere to the maximum permissible noise levels allowed in the Industrial Zone as delineated in Section 14-9-30 of the Weld County Code. 8. Adequate drinking, hand washing and toilet facilities shall be provided for all personnel located at or entering the facility. 9. A permanent, adequate water supply shall be provided for drinking and sanitary purposes for personnel located at the facility. 10.Any septic system located on the property must comply with all provisions of the Weld County Code, pertaining to Individual Sewage Disposal Systems. 11.Portable toilets may be utilized on sites that are temporary locations of the • working face. 12.Bottled water shall be provided to employees at the temporary locations of the working face. 13.The applicant shall remove, handle, and stockpile overburden, soil, sand and gravel from the facility area in a manner that will prevent nuisance conditions. 14. If applicable, the applicant shall obtain a stormwater discharge permit from the Colorado Department of Public Health & Environment, Water Quality Control Division. 15. The operation shall comply with all applicable rules and regulations of the Colorado Division of Reclamation Mining and Safety. 16. The operation shall comply with all applicable rules and regulations of the Colorado Division of Reclamation Mining and Safety. 17.The operation shall comply with all applicable rules and regulations of State and Federal agencies and the Weld County Code. • 3 � ( MEMORANDUM • Elk DATE:O Konig Ag C .,October2 402010 Mine- Case File USR-1767 COLORADO FROM: Kim Ogle, Planning Services SUBJECT: Konig Borrow Mine c/o Michael Konig, applicant c/o Chris Rundall Baseline Corporation, Consultant The Department of Planning Services reviewed the above referenced Use by Special Review application materials and offers the following comments: Per the application materials, the applicant is proposing a Site Specific Development Plan and a Special Use Permit for Mineral Resource Development Facility including gravel mining in the A (Agricultural)Zone District.. Staff reviewed the text and supporting documents associated with the application, specific to the landscape component of the application. The mineral extraction landscape treatment consists of top soil berms placed at the perimeter of the property to screen the internal activities from adjacent properties and also internal to the mine site. From the discussion it appears that a dryland seed mix will be hydraulically applied with a wood fibre mulch and tackifer to ensure seed germination thereby adequately establishing cover of the ground plane. Staff did not identify any clumps of deciduous and evergreen trees, woody plant material or other"soft materials" for mine the period. • It is suggested that the mine be secured at the single point ingress and egress and "No Trespassing" signs be posted and maintained on the perimeter fence to clearly identify the boundaries of the site. Should temporary lighting be utilized, the lights must be oriented in a down angle to the land. Lighting provided for security and emergency night operation on the site shall be designed so that the lighting will not adversely affect surrounding property owners. Water Division 1, Water District 1 Dear Mr. Ogle: This referral does not appear to qualify as a "subdivision" as defined in Section 30-28- 101(10)(a), C.R.S. Therefore, pursuant to the State Engineer's March 4, 2005 memorandum to county planning directors, this office will only perform a cursory review of the referral information and provide comments. The comments do not address the adequacy of the water supply plan for this project or the ability of the water supply plan to satisfy any County regulations or • requirements. In addition, the comments provided herein cannot be used to guarantee a viable water supply plan or infrastructure, the issuance of a well permit, or physical availability of water. According to the submitted information, the proposed Gravel Mining operation does not anticipate exposing groundwater. Therefore, exposure of ground water must not occur during or after mining operations. The applicant has identified that water will only be used for dust control via water trucks. The applicant will need to document that the water used for dust control was obtained from a legal source, or the water was diverted in priority under a water right decreed for such industrial use. If stormwater runoff is intercepted by this operation and is not diverted or captured in priority, it must be released to the stream system within 72 hours. This may require a discharge permit from CDPHE-WQCD. Otherwise, the operator will need to make replacements for evaporation.
