Home My WebLink About20110304.tiff RESOLUTION RE: ACCEPTANCE OF FILING OF AMENDED AND RESTATED CONSOLIDATED SERVICE PLAN, REFERRAL TO WELD COUNTY PLANNING COMMISSION FOR STUDY AND RECOMMENDATION, AND SET HEARING DATE FOR CONSIDERATION - BEEBE DRAW FARMS METROPOLITAN DISTRICT NOS. 1 AND 2 WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, the Amended and Restated Consolidated Service Plan for the Beebe Draw Farms Metropolitan District Nos. 1 and 2, was received by the Clerk to the Board on January 14, 2011, from counsel for Beebe Draw Farms Metropolitan District Nos. 1 and 2, McGeady Sisneros, P.C., 450 East 17th Avenue, Suite 400, Denver, Colorado 80203, for filing with, and consideration by, the Board of County Commissioners, and WHEREAS, Section 32-1-204(2), C.R.S., requires that the Amended and Restated Consolidated Service Plan be delivered to the Weld County Planning Commission for study and recommendation to the Board of County Commissioners, such recommendation to be received by the Board within thirty(30) days after the filing of the Amended and Restated Consolidated Service Plan, and WHEREAS, the Board of County Commissioners deems it advisable to accept the filing of the Amended and Restated Consolidated Service Plan as of January 14, 2011, and to refer it to the Weld County Planning Commission for a hearing to be held on March 1, 2011, with study and recommendation to be received by the Board from Planning Commission on or before March 9, 2011, pursuant to the proposed schedule approved by the applicant, which schedule waives the thirty (30) day requirement, and WHEREAS,the Board of County Commissioners deems it advisable to set a public hearing date for its consideration of said Amended and Restated Consolidated Service Plan, said hearing date to be March 16, 2011, at 9:00 a.m. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that the filing of said Amended and Restated Consolidated Service Plan be, and hereby is, accepted. BE IT FURTHER RESOLVED that said Amended and Restated Consolidated Service Plan be, and hereby is, referred to the Weld County Planning Commission for study and recommendation back to the Board of County Commissioners, such recommendation to be received by the Board on or before March 9, 2011. BE IT FURTHER RESOLVED by the Board of County Commissioners of Weld County, Colorado, that the public hearing for consideration of the Beebe Draw Farms Metropolitan District Nos. 1 and 2, be, and hereby is, March 16, 2011, at 9:00 a.m. BE IT FURTHER RESOLVED by the Board of County Commissioners that the organizers of the proposed Amended and Restated Consolidated Metropolitan Districts have paid the required statutory filing fee of$500.00 to the Clerk to the Board. I discussed the timing of the hearings on the Beebe Draw Service Plan Amendment with MaryAnn. We are concerned that if we hold the hearings in mid/late March or April and in the event there is opposition and we need to continue the hearings, there will not be sufficient time for the Districts to take all actions outlined in the Amended Serviced Plan by June 1, 2O11. I and 2/Amended and Restated Consolidated Service Plan Hearings Dear Mr. Barker: As you know, on January 14, 2011, Beebe Draw Farms Metropolitan District Nos. 1 and 2 (the "Districts") formally submitted to the Clerk for the Weld County Board of County Commissioners ("BOCC") their proposed Amended and Restated Consolidated Service Plan ("Service Plan"). Section 32-I-202(1)(a), C.R.S. requires that the Service Plan be referred to the Weld County Planning Conunission, which shall consider and make a recommendation on the Service Plan to the BOCC within thirty (30) days after the Service Plan was filed with the County Clerk. We understand that the County Planning Commission only meets once a month, and therefore it is impracticable for the Planning Commission to hear and consider the Service Plan at its regularly scheduled meeting on February I, 2011. Therefore, at the County's request, the Districts hereby agree to a one time waiver of the thirty (30) day requirement set forth in Section 32-1-202(1)(a), C.R.S. and are agreeable to the Planning Commission hearing the Service Plan at its regularly scheduled meeting on March 1, 2011, with a hearing in front of the BOCC to follow on March 16, 2011.
