WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS , it has been determined by the Board of County Com- missioners of Weld County, Colorado, at a public meeting held on the 21st day of September, 1977, in the Chambers of the Board of County Commissioners of Weld County, Colorado, that a certain parcel of land being described as Part of the S1 of Section 6 , Township 4 North, Range 68 West of the 6th P.M. , Weld County, Colorado, more particulary described as follows , to-wit: The Southeast Quarter (SE4) of Section 6, Taanship 4 North, Range 68 West of the 6th P.M. , Weld County, Colorado, and a portion of the Southwest Quarter (SW4) of said Section 6, being more particularly described as follows: Beginning at the Southeast Corner (SE Cor) of the Southwest Quarter of said Section 6, Township 4 North, Range 68 West of the 6th P.M. , Thence West 579 feet; Thence North 1128.5 fact; Thence East 579 feet; Thence South 1128.5 feet to the place of beginning, and containing 15 acres, more or less; minus all land lying between the west line of said tract and the centerline of the McIntyre Lateral Ditch, namely that land lying East of the West line of said tract and West of the centerline of the McIntyre Lateral Ditch, and containing 1 acre, more or less. does not come within the purview of the definition of the terms , "sub- division" and "subdivided land" , pursuant to its authority under Section 30-28-101 (10) (d) , CRS 1973 , as amended, and WHEREAS , the Board of County Commissioners of Weld County, Colorado, finds that this particular division of land is not within the purposes of the Weld County Subdivision Regulations and the Board desires to exempt this particular division of land from the definition of "subdivision" and "subdivided land" pur- suant to its authority under Section 30-28-101 (10) (d) , CRS 1973 , as amended, and Section 2-lA (3) of the Weld County Subdivision Regulations. NOW, THEREFORE , BE IT RESOLVED, by the Board of County Com- missioners of Weld County, Colorado, that the hereinabove de- scribed parcel of land owned by Mr. Edward Kirlin, be exempt from the definition of the terms , "subdivision" and "subdivided land" (2/2 ` 770754 pursuant to its authority under Section 30-28-101 (10) (d) , CRS 1973. The parcel of land in question is described as Pt . Sz of Section 6, T4N, R68W of the 6th P.M. , Weld County, Colorado. Said property is located 7 miles west of Johnstown at the northwest corner of the junction of County Road 3 and County Road 48. The subject property contains 174 . 6 acres more or less of predominantly Class II irrigated soils . The request is to split 14 .6 acres with an existing set of improvements from the remainder of the un- improved agricultural land. As stated in a letter dated July 16 , 1977 submitted by Mr. Kirlin , it is Mr . Kirlin ' s intent to sell off the 14 . 6 acre parcel with the existing set of improvements, and to retain the 160 acre parcel of unimproved agricultural land as a site for the abbey of Solesmes. Based upon the information submitted and the policies in the County, the Planning Commission staff recommends the request be denied for the fol- lowing reasons : 1 . The proposed split does not comply with the Weld County Comprehensive Plan because it would promote non-agricultural use of agricultural land and it would encourage urban encroachment on rural land use . 2 . The recorded exemption request is not in compliance with the intent clause of the recorded exemption procedure (Section 9-2 of the Weld County Subdivision Regulations) . The soils in this area are pre- dominantly Class II irrigated soils. The granting of this request would allow for the conversion of productive agricultural land since a new set of improvements would be allowed on the 160 acre parcel . 3 . The proposed split is not in conformance with the intent clause of the Agricultural Zone District (Section 3 . 3a of the Weld County Zoning Resolution) since it would not be encouraging agricultural uses of the highest and best uses, it would not be providing for the orderly expansion of urban growth, and it would further diminish the size of the agricultural unit . Eisenhower Blvd. July 16, 1977 Board of County Commissioners Weld County Colorado Greeley, Colorado 80631 Gentlemen: I am requesting a recorded exemption, as explained in the accompanying application form. The survey plat, together with the additional forms and data required, have been completed and are enclosed. The tracts concerned are a quarter of a section, 160 acres, and an adjacent 15 acre piece with a house and outbuildings. The 160 acres contains an eminence near the center, forming an extraordinary site, with a grand view. This is the reason that I secured the place, as a site for the famous Abbey of Solesmes in Europe -- to provide them with a location in America. They have visited and approved it. They rated it as excellent, as 'magnificent' , and they intend to make an establishment on it as soon as sufficient personnel is available for this. The additional contiguous land is part of the full tract, although not necessary to the site and its surrounding area. The more important thing now, with delays and complications, is simply to hold the site and 160 and keep it available to them until a large enough group is ready and able to come. They wanted to wait until they could send a sizable contingent for a beginning in America. To hold the place until then is clearly a basic necessity. The house and acreage is the least important part and the most effective, because of its comparatively high value, combined with the least area; the house and buildings are about equal in value to the acreage they stand on. Thus, the least area is involved. At the same time, there will be no essential change in the situation there; an owner-occupant, instead of a tenant-occupant. And, it will be the better taken care of, as a result.. Obviously, the house on this neighboring acreage is not necessary to the 160, nor to those who will locate on the site, instead. This is the logical and best arrangement. Gouging 2O acres out of the 160 would not only mutilate it, as well as the farming and irrigating of the 160, but it would also open that 2O acres up to possible subdivision. Many ask for the house and acreage, but want no more. An extra 20 acres forced on them would likely be considered for subdivision, to rid the buyer of the unwanted burden. Release of the 15 acres alone will virtually eliminate attempts at subdivision, for the normal buyer, securing it as a home and comfortable acreage for himself and family. The latter class have been repeatedly asking me to sell it to them. Therefore, in order not to mutilate the 160 and open part of it up to subdivision, in order to meet the debts on the property, and hold the site, and in order to realize this ideal and charitable end, this special distinction for Colorado and. America, I urge the Weld County Commissioners to grant the exemption. requested. I thank you for your consideration.
