To preserve your appeal rights, your Petition to the County Board of Equalization must be

proof of mailing.
You will be notified of the date and time scheduled for your hearing. The County Board of

This appeal is in three parts: First, the Assessor erred in valuing the 16 lots in Block 114, Silver
Peaks Filing No. 1 at $32,516 per lot, by using as comparable sales the sales of lots in the second
phase of development at Silver Peaks, located west of Freestone Street, rather than comparable sales
(or lack of sales) east of Freestone Street. All of the lots west of Freestone are owned by two related
builders who have been successful at Silver Peaks (Journey Homes and J&J Construction), and there
are no sales or other builders for the lots east of Freestone, owned by Lochbuie Land. Second, even if
the sales of the Journey lots west of Freestone would otherwise be considered comparable, those sales
were sales between related entities and should not be considered comparable. Third, the Assessor
erred in valuing the 16 lots in Block 10, Silver Peaks Filing No. 2 at $12,500 per lot. Due to market
conditions, all 32 lots should have been valued at $9,632 per lot.
As to the first grounds for appeal, all thirty-two of the referenced lots were developed as part of the
first phase of development at Silver Peaks in the fourth quarter of 2005 and were completed in
January of 2006. The first phase of development at Silver Peaks consisted of 231 lots -- 215 lots
were replatted as Silver Peaks Filing No. 2 and 16 lots in Block 114 of Silver Peaks Filing No. 1 were
not replatted because no changes to lot lines were required, but were part of the same phase of
development as the 215 lots in Filing No. 2. Attached is a drawing showing the completion of the
231 lots in the first phase of development, which includes Block 114 of Filing No. 1. It was erroneous
for the Assessor to value the lots in Block 114 by comparing them to the Journey lots west of
Freestone. Consequently, the lots in Block 114 listed above should have received the same valuation
as the lots in Block 10 listed above. Therefore, we respectfully request that the valuation of the Block
114 lots be lowered to $12,520 per lot to correspond to the valuation of the Block 10 lots. Moreover,
if the valuation of the Block 10 lots is lowered to $9,632 per lot, then the Block 114 lots should be
lowered to $9,632 as well.

Second, the 122 lots west of Freestone in the second phase of development were sold to Silver Peaks
Investments LLC (an entity affiliated with Journey Homes LLC and J&J Construction of Northern
Colorado LLC) in 2008. All of the comparable sales used by the County for the valuations consisted
of lots sold by Silver Peaks Investments LLC to either Journey Homes LLC or J&J Construction of
Northern Colorado LLC, which were related entities and were not arm's length transactions. Silver
Peaks Investments indicated in its related appeal that the lots were sold at a price that related to its
internal financing arrangements and did not reflect the market value of these lots.
The 32 lots in Blocks 10 and 114 owned by Lochbuie Land have remained unsold for over five years.
There are no builders currently fapurchasing lots —certainly not anywhere near $32,516 per lot (the
valuation of the Block 114 lots) and not even at $12,520 per lot (the valuation of the of the Block 10
lots), although that valuation is certainly closer. The continuing lack of marketability and the
depressed housing market must be considered in the valuation of these lots. We are requesting a
reduction in value for the 32 above referenced lots to $9,632.

The Weld County Board of Equalization has set a date of July 28, 2011, at or about the hour of
11:50 AM, to hold a hearing on your valuation for assessment. This hearing will be held at the
Weld County Centennial Center, First Floor Hearing Room, 915 10th Street, Greeley,
Colorado.
You have a right to attend this hearing and present evidence in support of your petition. The
Weld County Assessor or his designee will be present. The Board will make its decision on the
basis of the record made at the aforementioned hearing, as well as your petition, so it would be
in your interest to have a representative present. If you plan to be represented by an agent or
an attorney at your hearing, prior to the hearing you shall provide, in writing to the Clerk to the
Board's Office, an authorization for the agent or attorney to represent you. If you do not choose
to attend this hearing, a decision will still be made by the Board by the close of business on
August 5, 2011, and mailed to you on or before August 12, 2011.
Because of the volume of cases before the Board of Equalization, most cases shall be limited to
10 minutes. Also due to volume, cases cannot be rescheduled. It is imperative that you
provide evidence to support your position. This may include evidence that similar homes in
your area are valued less than yours or you are being assessed on improvements you do not
have. Please note: The fact that your valuation has increased cannot be your sole
basis of appeal. Without documented evidence as indicated above, the Board will have no
choice but to deny your appeal.
If you wish to obtain the data supporting the Assessor's valuation of your property, please submit
a written request directly to the Assessor's Office by fax (970) 304-6433, or if you have
questions, call (970) 353-3845. Upon receipt of your written request, the Assessor will notify
you of the estimated cost of providing such information. Payment must be made prior to the
Assessor providing such information, at which time the Assessor will make the data available
within three (3) working days, subject to any confidentiality requirements.
