THE DEPARTMENT OF PLANNING SERVICES' STAFF RECOMMENDS THAT THIS REQUEST BE
DENIED FOR THE FOLLOWING REASONS:
1. The submitted materials are not in compliance with the application requirements of Section 23-2-260
of the Weld County Code.
2. It is the opinion of the Department of Planning Services' staff that the applicant has not shown
compliance with Section 23-2-220 of the Weld County Code as follows:
A. Section 23-2-220.A.1 --The proposed use is not consistent with Chapter 22 and any other
applicable code provisions or ordinance in effect. Section 22-2-20.H. A.Goal.8 states
"Ensure that adequate services and facilities are currently available or reasonably obtainable
to accommodate the requested new land use change for more intensive development.
Further, Section 22-2-20.H. 1. A.Policy 8.1. The land use applicants should demonstrate that
adequate sanitary sewage and water systems are available for the intensity of the
development and Section 22-2-20.H. 2.A.Policy 8.2.The land use applicants are responsible
for contacting and determining the status of the water well through the State Division of
Water Resources . . . ."
The Colorado Division of Water Resources in their referral dated August 18, 2011 states
"[T]he Amen family's current domestic well appears to have a permit no.217954. This permit
is currently registered to a different person. The Amen family may want to submit a change
of ownership form to this office to update the database. The Amen family should be aware
that because the property is larger than 70 acres they would likely be able to obtain two

exempt well permits, one full domestic permit including outdoor water use and commercial

• drinking and sanitary well permit. Two permits could be obtained if each permit were
assigned a specific 35 acres or more of the property. The ability of the Amen family to obtain
a second well permit for commercial use would be evaluated at the time the well permit
application is submitted to our office." Further, the Division states"the applicants propose
that the business will not have any water use, that employee sanitation would be provided
through a portable toilet with hand sanitizer and employees would use only bottled water."
The Weld County Department of Public Health and Environment in their referral dated
September 12, 2011 states "Permanent drinking water and sewage disposal facilities
must be provided to employees and drivers who access the site. There is an existing
residence on the property that is served by an individual sewage disposal system (Permit
No. SP-9900407) and was sized for 5 bedrooms or 10 people. If the existing septic
system for the home is used for employees, the septic system must be evaluated by an
engineer to determine if adequate.
The residence is also served by an individual well (Well Permit No. 217954), and it is
approved for domestic purposes only. In a letter dated August 18, 2011, from the Division
of Water Resources, the Division noted that the applicant would likely be able to obtain
two exempt well permits, one domestic permit and one commercial drinking and sanitary
well permit. According to the Division, two permits could be obtained as long as each
permit was assigned a specific 35 acres or more of the property.
In lieu of re-permitting their domestic well or drilling a new well for commercial use, and
providing a restroom in the house for the drivers, the applicant is requesting that portable
toilets, hand sanitizer and bottled water be allowed since the drivers are only on the
property for short periods to pick up and drop off business vehicles and equipment. The
• proposal as submitted in the application materials is not consistent with County policy or
consistent to similar land use applications in both employee numbers and intensity of use.
This recommendation for denial is based, in part, upon a review of the application materials submitted by the
applicant, other relevant information regarding the request, and responses from referral entities.
Should the Planning Commission elect to approve this application, then the Department of Planning Services'
staff requests the following be required:
1. Prior to recording the plat:
A. The plat shall be prepared per Section 23-2-26O.D of the Weld County Code. (Department of

B. All sheets of the plat shall be labeled USR11-0011 (Department of Planning Services)
C. The plat shall be amended to delineate the following:
1) The attached Development Standards. (Department of Planning Services)
2) County Road 38 is designated on the Weld County Road Classification Plan as a
local gravel road, which requires 60 feet of right-of-way at full build out. There is
presently 60 feet of right-of-way. All setbacks shall be measured from the edge of
future right-of-way. The applicant shall verify the existing right-of-way and the
documents creating the right-of-way. If the right-of-way cannot be verified, it shall be
dedicated. This road is maintained by Weld County. (Department of Public Works)
3) County Road 49 is designated on the Weld County Road Classification Plan as a

arterial road, which requires 140 feet of right-of-way at full build out. There is

• presently 60 feet of right-of-way. An additional forty(40)feet shall be delineated on
the plat as future County Road 49 right-of-way. All setbacks shall be measured from
the edge of future right-of-way. The applicant shall verify the existing right-of-way
and the documents creating the right-of-way. If the right-of-way cannot be verified, it
shall be dedicated. This road is maintained by Weld County. (Department of Public

4) All parking for this site must be off street and internal and delineated on the plot plan
map. Each parking space shall be equipped with wheel guards or curb blocks to
prevent vehicles from coming into contact with walls or other structures. (Department

5) The application materials did not include a Lighting Plan. Should exterior lighting be
a part of this facility, all light standards shall be delineated on the USR Plat.

6) The business will utilize the existing access from County Road 38. Adequate
(minimum 45 foot) truck turning radiuses are required at the access. Please show
the existing accesses on the Plat and label them with the approved Access Permit

7) A water quality feature design has been provided and is acceptable. Please show the
boundaries of the Water Quality Area on the plat and label as"Water Quality— No

D. The applicant must address the requirements (concerns) of Colorado Division of Water
Resources, as stated in the referral response dated August 18, 2011. Written evidence of

E. The applicant shall attempt to address the requirements(concerns)of the Farmers Reservoir
and Irrigation Company as stated in the referral dated September 12,2011. Written evidence
of compliance shall be submitted to the Department of Planning Services. (FRICO)
F. The applicant must address the requirements (concerns) of Weld County Department of
Environmental Health, specifically address:
1. In the event the applicant intends to utilize the existing septic system at the home,
for employee use, the septic system shall be reviewed by a Colorado Registered
Professional Engineer. The review shall consist of observation of the system and
a technical review describing the system's ability to handle the proposed hydraulic
load. The review shall be submitted to the Environmental Health Services Division
of the Weld County Department of Public Health and Environment. In the event
the system is found to be inadequately sized or constructed the system shall be
brought into compliance with current Regulations. (Department of Public Health

2. The applicant shall submit evidence of an Aboveground Storage Tank permit
from the Colorado Department of Labor and Employment (CDL&E), Oil Inspection
Section for any aboveground storage tanks located on the site. Alternately, the
applicant can provide evidence from the (CDL&E), Oil Inspection Section that
they are not subject to these requirements. (Department of Public Health and

• 3. A signed copy of the Spill Prevention, Control and Countermeasure Plan shall be
provided to Environmental Health Services Division of the Weld County

• Department of Public Health & Environment. In accordance with Section 3-6-1 of
the Colorado Department of Labor and Employment Division of Oil and Public
Safety Storage Tank Regulations (7 C.C.R. 1101-14) as well as EPA regulations

4. The applicant shall submit written evidence from the Colorado Division of Water
Resources, demonstrating that there is a well appropriately permitted for the

G. The applicant shall submit a Lighting Plan to the Department of Planning Services for review
and approval. With approval,the Lighting Plan information shall be graphically delineated on

H. The applicant shall submit three (3) paper copies of the plat for preliminary approval to the
Weld County Department of Planning Services. (Department of Planning Services)
2. Upon completion of 1. above the applicant shall submit a Mylar plat along with all other documentation
required as Conditions of Approval. The Mylar plat shall be recorded in the office of the Weld County
Clerk and Recorder by Department of Planning Services' Staff. The plat shall be prepared in
accordance with the requirements of Section 23-2-260.D of the Weld County Code. The Mylar plat
and additional requirements shall be submitted within sixty (60) days from the date of the Board of
County Commissioners resolution. The applicant shall be responsible for paying the recording fee.

4. In accordance with Weld County Code Ordinance 2005-7 approved June 1, 2005, should the plat not
be recorded within the required sixty (60) days from the date the Board of County Commissioners
approval was signed a $50.00 recording continuance charge may be added for each additional 3

5. Prior to the Release of Building Permits:
A. Building permits shall be obtained prior to the construction of any structure or change of

B. A plan review is required for each building. Plans require the wet stamp of a Colorado

C. Buildings shall conform to the requirements of the codes adopted by Weld County at the

Energy Conservation Code; 2008 National Electrical Code and Chapter 29 of the Weld

D. Each building will require an engineered foundation based on a site-specific geotechnical
report or an open hole inspection performed by a Colorado registered engineer.

• E. Fire resistance of walls and openings, construction requirements, maximum building

1. The Site Specific Development Plan and Special Review Permit for an Oil and Gas Support
Facility (roust-a-bout, construction and excavating service) in the A (Agricultural) Zone
District, as indicated in the application materials on file and subject to the Development
Standards stated hereon. (Department of Planning Services)
2. Approval of this plan may create a vested property right pursuant to Section 23-8-10 of the
Weld County Code. (Department of Planning Services)
3. All liquid and solid wastes (as defined in the Solid Wastes Disposal Sites and Facilities Act,
30-20-100.5, C.R.S., as amended)shall be stored and removed for final disposal in a manner
that protects against surface and groundwater contamination. (Department of Public Health

4. No permanent disposal of wastes shall be permitted at this site. This is not meant to include
those wastes specifically excluded from the definition of a solid waste in the Solid Wastes
Disposal Sites and Facilities Act, 30-20-100.5, C.R.S., as amended. (Department of Public

5. Waste materials shall be handled, stored, and disposed in a manner that controls fugitive
dust, fugitive particulate emissions, blowing debris, and other potential nuisance conditions.

non-specified Zone as delineated in Section 14-9-30 of the Weld County Code. .

11. Any septic system located on the property must comply with all provisions of the Weld County

12. A permanent, adequate water supply shall be provided for drinking and sanitary purposes.

13. This application is proposing a well as its source of water. The applicant should be made
aware that while they may be able to obtain a well permit from the Office of the State

Engineer, Division of Water Resources, the quantity of water available for usage may be
limited to specific uses, i.e. domestic use only, etc. Also,the applicant should be made aware
that groundwater may not meet all drinking water standards as defined by the Colorado

14. All hazardous chemicals must be handled in a safe manner in accordance with product
labeling and in a manner that minimizes the release of hazardous air pollutants(HAP's)and
volatile organic compounds(VOC's). All chemicals must be stored secure,on an impervious

15. The Spill Prevention, Control and Countermeasure Plan shall be available on site, at all

16. The operation shall comply with all applicable rules and regulations of State and Federal

21. Weld County shall not be responsible for the maintenance of onsite drainage related facilities.

may create a traffic hazard to operators of motor vehicles on public or private streets;and no
colored lights may be used which may be confused with or construed as traffic control

the property or become established as a result of the proposed development, the
applicant/landowner shall be responsible for controlling the noxious weeds. All vegetation,
other than grasses, needs to be maintained at a maximum height of 12 inches until the area

29. The Special Review activity shall not occur nor shall any building or electrical permits be
issued on the property until the Special Review plat is ready to be recorded in the office of the

30. The property owner or operator shall be responsible for complying with the Design Standards

34. The property owner or operator shall be responsible for complying with all of the foregoing

35. WELD COUNTY'S RIGHT TO FARM: Weld County is one of the most productive
agricultural counties in the United States, typically ranking in the top ten counties in the
country in total market value of agricultural products sold. The rural areas of Weld County
may be open and spacious, but they are intensively used for agriculture. Persons moving
into a rural area must recognize and accept there are drawbacks, including conflicts with
long-standing agricultural practices and a lower level of services than in town. Along with the
drawbacks come the incentives which attract urban dwellers to relocate to rural areas: open
views, spaciousness,wildlife, lack of city noise and congestion, and the rural atmosphere and
way of life. Without neighboring farms, those features which attract urban dwellers to rural
Weld County would quickly be gone forever.
Agricultural users of the land should not be expected to change their long-established
agricultural practices to accommodate the intrusions of urban users into a rural area. Well-
run agricultural activities will generate off-site impacts, including noise from tractors and
equipment; slow-moving farm vehicles on rural roads; dust from animal pens, field work,
harvest and gravel roads; odor from animal confinement, silage and manure; smoke from
ditch burning; flies and mosquitoes; hunting and trapping activities; shooting sports, legal
hazing of nuisance wildlife; and the use of pesticides and fertilizers in the fields, including the
use of aerial spraying. It is common practice for agricultural producers to utilize an
accumulation of agricultural machinery and supplies to assist in their agricultural operations.
• A concentration of miscellaneous agricultural materials often produces a visual disparity
between rural and urban areas of the County. Section 35-3.5-102, C.R.S., provides that an
agricultural operation shall not be found to be a public or private nuisance if the agricultural

• operation alleged to be a nuisance employs methods or practices that are commonly or
reasonably associated with agricultural production.
Water has been, and continues to be, the lifeline for the agricultural community. It is
unrealistic to assume that ditches and reservoirs may simply be moved "out of the way" of
residential development. When moving to the County, property owners and residents must
realize they cannot take water from irrigation ditches, lakes, or other structures, unless they
have an adjudicated right to the water.
Weld County covers a land area of approximately four thousand(4,000)square miles in size
(twice the size of the State of Delaware) with more than three thousand seven hundred
(3,700) miles of state and County roads outside of municipalities. The sheer magnitude of
the area to be served stretches available resources. Law enforcement is based on

be traveled may delay all emergency responses, including law enforcement,ambulance, and
fire. Fire protection is usually provided by volunteers who must leave their jobs and families
to respond to emergencies. County gravel roads, no matter how often they are bladed, will
not provide the same kind of surface expected from a paved road. Snow removal priorities
mean that roads from subdivisions to arterials may not be cleared for several days after a
major snowstorm. Services in rural areas, in many cases, will not be equivalent to municipal
services. Rural dwellers must, by necessity, be more self-sufficient than urban dwellers.
People are exposed to different hazards in the County than in an urban or suburban setting.
Farm equipment and oil field equipment, ponds and irrigation ditches, electrical power for
pumps and center pivot operations, high speed traffic, sand burs, puncture vines, territorial
farm dogs and livestock, and open burning present real threats. Controlling children's
activities is important, not only for their safety, but also for the protection of the farmer's

• Comments:
County Road 38 is an all weather road with bar ditches each side. The road dips to the East past the Amen
property. County Road 49 is a two lane heavily traveled bituminous road with posted speeds of 65 MPH at this
location. Public Works has indicated that in the future date uncertain this will be an arterial status road having
140 feet of right-of-way, or forty feet additional to the East on the Amen property. The intersection of County
Roads 38 and 49 has good sight-distance in both direction as this intersection lies at the crest of the hill. There is
one locked and gated access onto County Road 49 for use by the oil and gas company. Residential and
business access to this site is from County Road 38 onto an all weather internal access drive.
The Amen property is sited well to the East of CR 49 as the land slopes away to the east. Additionally the
applicant has constructed a six foot cedar fence around all areas associated with the proposed construction
company service yard. This action has created adequate screening from public rights-of-way and adjacent
properties.
The surrounding properties are primarily grazing lands with sparsely located single family homes, oil and gas
facilities and County Road 49, a future major arterial road is adjacent to the West. Overhead electric and
upderground telephone is adjacent to the property. There are nine residences within 500 feet of the property.

• The Departments of Planning Services, Building Inspection, Environmental Health and Public Works have
completed their review of the documents submitted for review post pre-application meeting held in the
offices of the Department of Planning Services on April 21, 2011.
This letter serves as a joint response from all County departments on the completeness of the submitted
materials prior to accepting the application and the application fee.
The Department of Planning Services reviewed the Questionnaire component of the submitted materials
and the supplemental materials and has the following comments.
1 Planning staff requests an electronic copy of the application materials including the maps

• On Thursday, April 21, 2011 an informal discussion took place at the Greeley Administrative
Offices Conference Room regarding an oilfield and roust-about business. (The legal description
is Part of the NW4 Section 6, T3N, R64W of the 6th P.M.; Situs Address is 24138 CR 38)
Background Information:
The applicant has been operating an oilfield and roust-about business from the subject property and
would like to obtain the necessary land use permits. There are currently 12 employees and they
arrive at the site in their personal vehicles early each morning to pick up company vehicles and
orders and leave to work at the various jobsites and then return again in the evening.
Building Department
According to Department records, there are four (4) structures on site and three are Ag Exempt.
The 80 by 120 foot shop building is currently used for personal storage of vehicles as well as for the
company vehicles and maintenance performed on those vehicles. A Change of Use Building Permit
will need to be obtained for this building. A Design Professional will need to perform an analysis of
the structure and an engineer will need to sign off on the structure. The applicant indicated that he
can provide stamped drawings for the building. Upon further research,staff indicated that it appears
no sprinkling system is required for this building.
The applicant added that there is a concrete apron for parking in front of the building and there are
no grade changes. Due to the nature of the business, employees are required to be ambulatory.
The applicant mentioned that he may possibly build an indoor arena for private use only. Staff
stated that this building could be applied for through an Ag Exempt building permit. Staff further
• advised the applicant to put all future buildings on the site plan.
Health Department
The applicant indicated that he allows the employees to utilize the restroom in the residence. Upon
research of Department files, Septic Permit#SP99-00407 is sized for 5 bedrooms or 10 people. If
• there are more employees, an engineer will need to evaluate the system for adequacy. The
applicant indicated that he may install a restroom in the shop building in the future.
Staff advised the applicants to visit with the Division of Water Resources regarding the criteria of re-
permitting their domestic well. If there are 25 or more full-time employees,the applicant will need to
obtain a state permit.

The applicant indicated that he irrigates the existing landscape from a pond onsite.
Public Works
A Site Plan identifying the existing access from CR 38, parking, existing and future buildings and
circulation will be required.
No traffic study is required; however staff requested that a narrative providing an estimate and the
type of vehicles be provided.
No Drainage Report is required; however the applicant shall provide a short description of the
• historic stormwater flows across the property and how their application will affect those flows. The
description shall include but not be limited to: 1) where the water originates if it flows onto the
property from an offsite source, 2)where it flows to as it leaves the property, 3)the direction of flow
across the property, and 4) if there have been previous drainage problems with the property. The
application shall also provide flow arrows on the map showing where the stormwater starts, how it
goes across the property, and where it leaves the property. The applicant will still be responsible for
providing a water quality feature that conforms to the methodology outlined in Volume 3, Section
4.4.2 of the Urban Storm Drainage Criteria manual.
Planning Department
The applicant stated that currently there is a cedar pickett fence surrounding the commercial area.
Staff stated that no more landscaping/screening would be required.
The applicant indicated that he proposes no additional lighting.
The applicant stated that he owns all the minerals onsite.
Staff informed the applicants that upon building permit issuance, additional fees are applied, such

Staff stated that the USR boundary encompasses the entire property boundary; however the fee

building burned down. He added that this site was permitted under an existing Use by Special

Amen Oilfield Service, Inc. specializes in oilfield construction. They currently have 12 employees
• who meet at the site around 6:30 each morning and leave around 7:00. On average the
employees work a 10 to 12 hour day off site. Amen Oilfield Services is on 24 hour call so on rare
occasions workers may be at the site at different hours of the day. One building on site is
designated for the business. It is used for minor repairs to the equipment. No washing of

The site has been screened by a six foot wood fence. Recycled asphalt has been laid on the
