Bill OMIT • 2011-2084 1 1) • 1 • MEMO • I 23 A II: 23 July 25, 2011 TO: Weld County Commissioners cc Weld County Planning Services FROM: Bill Bennett SUBJ: Case# USR-1781 • On May 4th I forwarded comments regarding this case to Chairwoman Kirkmeyer along with • submissions to the Weld County Planning Services office and the Weld County Planning Commission. Said submission was referenced when this case came up for hearing by the Weld County Planning Commission on July 12, 2011. Minimal points therein were noted at that time but did include: The third 'bullet', in part, regarding a total failure of a percolation test and necessitated redesign of septic systems was addressed by the project architect. The project sponsor did state she had talked to North Weld Water about placing a fire hydrant (no definitive action noted) when queried by a board member. The public works representative did reference a traffic study conducted in 2007 but there was no indication the escalation in traffic since that date due to oil and gas as well as rural development was taken into consideration. The majority of public comment arose from a cadre of project supporters presenting an emotionally charged plea for approval based upon meeting a societal need of the persons they intend to help. Such a plea was actually unneeded as likely all present, including myself, would support the projects intent. It is only the location of the project that presents serious public safety concerns that is at issue. The Planning Commission did ultimately recommend approval on the part of the Planning Commission of the project with one member directing the sponsor to note and seriously • consider the concerns outlined in my May 4th submission. It is felt such recommended approval • • was in line with issues applicable to project form, function and code compliance that the Commission could address under their regulatory guidance. • For all intent and purposes, the balance of the comments contained in my May 4m submission deal with public safety concerns,the majority of which center directly upon the mothers and children this project proposes to help. Potential medical and traffic issues remain as stated. At the Planning Commission hearing, the project sponsor stated the girls are not going to be drunk or using drugs as they want out of that life style. This is likely true and as such they are not the threat focus but rather their 'associates' from whence they came as spoken to in the 4th bullet of the May 4 submission. Several other bullets speak to child supervision, protection and safety. Concern remains as to the encountering or escalation of risk if children wander from the proposed establishment. No project presenters have mentioned walls, fencing or other means of containment to aid in the avoidance of childhood injuries. This appears to remain as an issue to be addressed, not ignored. Relative to the purported 'shooting range', it was quite active on July 16 with the majority of fire arising from fully automatic weapons. Yet another indication that serious issues are not being addressed and mitigated even within and among parties directly associated with the sponsoring organization promoting this project. • Final points in the May 4 submission address project awareness and funding. At the Planning • Commission hearing the project sponsor stated they had advertised a community meeting and only one person showed up and at a previously advertised 'free' chili supper only 2—3 people came. I would contend this illustrates a lack of interest and support on the part of the local community and therefore a lack of local input was gained regarding the proposed project. Further, with such a lack of public interest, it will likely be very difficult to adequately fund this project for and during construction much less sustain operation into the future. In discussing this project with two mothers in the neighborhood, they caught a huge risk they have and remain concerned about that was not previously considered. That risk is the irrigation systems and the presence of entryways into 5 underground culverts under major roadways or into pipeline delivery systems within close proximity to this proposed project. All of these support substantial water flow and are of a size sufficient to accommodate the body of even an adolescent child or small adult. Due to the length and design of the culverts/pipelines, entry when water is present would undoubtedly be fatal. Irrigation system ditches are attractive to children as play sites and unless restricted from the same either physically or via repetitive training as they become older, they can prove a fatal risk. • • • Though the Weld County Planning Commission recommended approval of this project, they were likely guided to such a recommendation based upon project criteria they are convened to • address. This would not include issues related to public safety or the public good as a whole. With your ability as the Weld County Board of County Commissioners to address public safety and welfare within your statutory authority, it is requested you review this project in that light. There is no argument that such a project has merit and could help meet a societal need that government agencies are finding it difficult to provide for. The problem with the current proposal rests with the location of the chosen site and the inability to provide for public safety and first responder services at that location. Therein the greatest risk is to the very same individuals the sponsors propose to assist and secondarily, but no less significant, to the neighboring public. The breadth and magnitude of such risk is sufficient to warrant mitigation by locating an alternate site within a district/jurisdiction that maintains full time staffing of first responder services and which would not pose the multitude of other risks set forth in the May 4 submission. Therefore, I would ask the Weld County Board of County Commissioners at their hearing scheduled for August 3, 2011 to deny approval of this project at the proposed site. The board could then recommend to the sponsors that they seek an alternate site that can adequately • meet public safety and service needs and thus provide for the common good of all individuals impacted. I won't be able to attend the hearing because of a conflict taking me to Denver Wednesday morning. The big reason I am in favor of this USR is that it provides for a private sector, Christ-based solution for some of the potential social services clients you're likely to see without Genesis. We all know how difficult it is for government to solve people's problems. Genesis, just as it's name implies provides a new beginning for young women at what is likely a low point in their lives. Genesis offers Life, Hope, Love and Training. Genesis has answered questions regarding their water source and is actually enhancing supply for fire suppression for the neighborhood. Genesis will build an estate style home that can serve 20-40 young women per year, that will fit in with the neighborhood and be a marketable property if an exit strategy is someday needed.
