HomeMy WebLinkAbout20112850.tiff HEARING CERTIFICATION DOCKET NO. 2011-60 RE: A SITE SPECIFIC DEVELOPMENT PLAN AND USE BY SPECIAL REVIEW PERMIT#1786 FOR A GOLF COURSE, SHOOTING RANGE, GUEST FARM AND HUNTING LODGE, AND ONE (1) SINGLE-FAMILY DWELLING UNIT PER LOT, OTHER THAN THOSE PERMITTED UNDER SECTION 23-3-20.A OF THE WELD COUNTY CODE, IN THE A (AGRICULTURAL) ZONE DISTRICT - EQUUS FARMS, INC. A public hearing was conducted on October 5, 2011, at 10:00 a.m., with the following present: Commissioner Barbara Kirkmeyer, Chair Commissioner Sean P. Conway, Pro-Tem Commissioner William F. Garcia Commissioner David E. Long - EXCUSED Commissioner Douglas Rademacher Also present: Acting Clerk to the Board, Esther Gesick County Attorney, Bruce Barker Planning Department representative, Tom Parko Health Department representative, Mary Evett Public Works representative, Heidi Hansen The following business was transacted: I hereby certify that pursuant to a notice dated August 19, 2011, and duly published August 24, 2011, in the Fort Lupton Press, a public hearing was conducted to consider the request of Equus Farms, Inc., for a Site Specific Development Plan and Use by Special Review Permit#1786 for a Golf Course, Shooting Range, Guest Farm and Hunting Lodge, and one (1) Single-Family Dwelling Unit per lot, other than those permitted under Section 23-3-20.A of the Weld County Code, in the A (Agricultural) Zone District. Bruce Barker, County Attorney, made this a matter of record. Tom Parko, Department of Planning Services, presented a brief summary of the proposal, entered the favorable recommendation of the Planning Commission into the record as written, and gave a brief description of the location of the site. He stated the overall property is comprised of four parcels, totaling 938 acres; however, the amenities will be limited to 80 acres of the site. He further stated the proposed uses include a private golf course, shooting range, hunting lodge and guest housing, which do require a USR permit. Mr. Parko stated the property is not located within any municipal three-mile referral area, eleven referral agencies reviewed the proposal, and five responded with comments that have been addressed in the Conditions of Approval and Development Standards. He stated staff has received no correspondence from surrounding property owners and he displayed photographs of the site. Chair Kirkmeyer advised Mike Johnson, applicant's representative, that he has the option of continuing this matter to a date when the full Board will be present. However, if he decides to proceed today, it will require three affirmative votes, or in the case of a tie vote, Commissioner UA QLI iNO 2011-2850 1O 10 PL2129 11 HEARING CERTIFICATION - EQUUS FARMS, INC. (USR-1786) PAGE 2 Long will listen to the record and make the determining vote. Mr. Johnson indicated he would like to proceed today. In response to Commissioner Conway, Mr. Parko stated the Planning Commission unanimously recommended approval of this request. Heidi Hansen, Department of Public Works, stated the applicant will be using an existing access from County Road 87, which is a local gravel roadway with 60 feet of right-of-way. She stated staff is not requiring any additional stormwater controls and there are no outstanding Conditions of Approval. Mary Evett, Department of Public Health and Environment, stated the applicant has submitted evidence of a Class V Injection Well Permit, therefore, Condition of Approval #4 may be deleted. She stated they have also submitted a Waste Handling Plan and she recommended the deleting of Condition of Approval #3. Ms. Evett stated the only outstanding condition is the applicant is in the process of re-permitting the domestic well to increase service from two residences to three. She stated dust control will be by water truck, and Development Standards #5 through #15 are the general health standards for this type of facility. In response to Commissioner Rademacher, Mr. Parko stated he included the Design and Operations standards in criteria paragraph#2.b of the Resolution and the proposed uses will not emit heat, therefore, the site will be in compliance. Mr. Barker stated it is appropriate to keep the language, as proposed, and if the Board wants to change that standard, it will need to be addressed in a different venue as an amendment to the County Code. Responding to Commissioner Rademacher, Mr. Johnson stated the uses are for the property owner's private use. No public testimony was offered concerning this matter. In response to Chair Kirkmeyer, Mr. Jonson stated thirty (30) days will be adequate to complete the Conditions and submit the mylar plat for recording, and he also agreed with the deletion of Conditions of Approval #3 and #4, as recommended by staff. Commissioner Rademacher stated he would like to delete Development Standard #12, since the hunting will take place on private property and they should be able to use any targets they please. He further stated he is in agreement with Development Standards #3 and #4 as drafted by staff, concerning the number of employees and hours of operation. Responding to Chair Kirkmeyer, Mr. Johnson stated he and the applicant have reviewed, and agree to abide by, the Conditions of Approval and Development Standards, as proposed and modified. Commissioner Rademacher moved to approve the request of Equus Farms, Inc., for a Site Specific Development Plan and Use by Special Review Permit #1786 for a Golf Course, Shooting Range, Guest Farm and Hunting Lodge, and one (1) Single-Family Dwelling Unit per lot, other than those permitted under Section 23-3-20.A of the Weld County Code, in the A (Agricultural) Zone District, based on the recommendations of Planning staff and the Planning Commission, with the Conditions of Approval and Development Standards as entered into the record. His motion included deleting Conditions of Approval #3 and #4, and Development Standard #12, and renumbering subsequent paragraphs as appropriate. The motion was seconded by Commissioner Conway. Commissioner Garcia commented this is a beautiful and well-maintained property which is located near the historic Dearfield Townsite and was once 2011-2850 PL2129 HEARING CERTIFICATION - EQUUS FARMS, INC. (USR-1786) PAGE 3 promoted as a resort community. He stated the property owner and site staff have done a good job in displaying the beauty of the area. Commissioners Rademacher and Conway commended both the applicant and County staff for presenting a clean-cut application. There being no further discussion, the motion carried unanimously and the hearing was completed at 10:22 a.m. This Certification was approved on the 10th day of October, 2011.
