RE: EXPRESSION OF SUPPORT FOR THE PASSAGE OF H.B. 11-1082
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, for a number of recent years, the oil and gas industry in Weld County has
been required to include ozone reduction mechanisms on their production equipment, and since
2006, such mechanisms have been successful in reducing the three-year (2007-2010), fourth
maximum ozone levels in Weld and Larimer counties to levels below the Federal requirements
of .075 ppb, and
WHEREAS, disregarding such reductions, S.B. 09-003, which was enacted into law in
2009, required portions of Weld and Larimer counties to be included in the "Enhanced
Emissions" program already in place in the Denver metropolitan counties in an effort to bring the
region into compliance with Federal limits for ozone, and
WHEREAS, as a result of S.B. 09-003, emissions testing of certain vehicles in Weld and
Larimer counties began in December, 2010, and
WHEREAS, H.B. 11-1082 has been introduced in the Colorado General Assembly,
which, if passed, will end such required emissions testing in Weld and Larimer counties until
such time as the ozone levels at the monitors there evidence levels of the three-year, fourth
maximum going over .075 ppb, and
WHEREAS, the Board wishes to express its support for the passage of H.B. 11-1082.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of
Weld County, Colorado, that it hereby expresses its support for the passage of H.B. 11-1082.
