WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, the Board of County Commissioners has determined at a public hearing held on the 31st day of May, 1978, in the Chambers of the Board of County Commissioners of Weld County, Colorado, that a certain tract of land is owned by Charles Kinder, which land is more particularly described as follows: The East 660 feet of the SEA of Section 26, Township 1 North, Range 66 West of the 6th p.m., Weld County, Colorado. WHEREAS, the owner of said tract of land desires to obtain a variance from the minimum lot size requirement so that said applicant may make application to the Board of County Commissioners for a recorded exemption, as set forth in Section 9-4.A. (6) of the Subdivision Regulations, and WHEREAS, the Board of County Commissioners of Weld County, Colorado, based upon the recommendations of the Department of Planning Services, feels that the applicant has shown good cause for granting a lot size variance under Section 9-4 .A. (6) of the Weld County Subdivision Regulations. NOW, THEREFORE, BE IT RESOLVED by the Board of County Com- missioners of Weld County, Colorado, that a variance from lot size requirements, be and hereby is, granted to Charles Kinder for the above described parcel of land. The property is described as the East 660 feet of the SE* of Section 26, T1N, R66W of the 6th p.m. , Weld County, Colorado. This property is located 2 mile west of Lochbuie on the north side of Weld County Road 4. The property contains approx- imately 40 acres of Class III , IV, and VI irrigated soils. There is an existing set of improvements located in the SE corner of this property at the present time. The request is to obtain a variance from the minimum lot size requirement , Section 9-4 A . (6) , so that he can make application to apply for a recorded exemption. If this lot size variance is granted, Mr. Kinder will proceed with his application for a recorded exemption to divide the property into two parcels. Mr. Kinder wishes to purchase five acres and live on the property making it easier for him to care for the horses located on the property. Based upon the information submitted and the adopted policies in the county, the Department of Planning Services staff recommends this request be approved for the following reasons : 1. The request is in compliance with the intent clause of the recorded exemption procedure (Section 9-2 of the Weld County Subdivision Regulations) in that the proposed use of the property will be com- patible with the surrounding agricultural land uses. 2. The request is in compliance with the intent clause of the Agri- cultural Zone District (Section 3. 3A of the Weld County Zoning Resolution) and the Weld County Comprehensive Plan in that the request will be encouraging a related use to agriculture which is the predominant land use.
