RE: RECORDED EXEMPTION NO. 220 - PAUL A. ANSLEY and
ETHEL R. ANSLEY.
WHEREAS, it has been determined by the. Board of County
Commissioners, Weld County, Colorado, at a public meeting held
on the 27th day of September, 1976, in the Chambers of the
Board of County Commissioners , Weld County, Colorado, that a
certain parcel of land, being the property of Paul A. Ansley
and Ethel R. Ansley, Orchard, Colorado, described as that
portion of Section 29, Township 4 North, Range 61 West of
the 6th P.M. in Weld County, Colorado, more particularly
described as follows :
Description of the whole parcel
A parcel of land described as the W3/8of the NE4 and the E- of the NW4
Sec.29 T4N R61W 6PM subject to easements for Highway No.34 and the Bijou
Canal, more particularly described as Commencing at a point on the south side
of said NE4 1642.5 feet west of the E4 corner of said Sec.29; thence N 0°35'
W 2656 feet along an established fence line north of the Bijou Canal and
prolonged south of the Bijou Canal to the centerline of Hwy.34 and the north side
of said Sec.29 to a point which is 1668 feet west of the NE corner of said
Sec.29; thence on assumed bearing West 1651 foot along the centerline of said
Hwy. No.34 and the north side of said Sec.29 to a point directly north of
a long established fence line; thence S 0°15'E 2662 feet along said established
fence line prolonged south of the Bijou Canal to a point on the south side
of the NW4 Sec.29 which point is 23 foot north of the centerline of a U.S.B.R.
power line; thence N89°48'E 1666.4 feet to the point of beginning containing
in all 101.25 acres.

A parcel of land being the W3/8 of the NE4 and the E4 of the NW4 Sec.29

to be 50 feet south of the centerline of said Bijou Canal) more particularly
described as Commencing at a point on the south side of said NE4 Sec.29
1642.5 feet west of the E4 corner of said Sec.29; thence N 0°35'W along an
established fence line prolonged south of the Bijou Canal 486 feet to a point
on the south R.O.W. line of said Bijou Canal; thence N 86054'W 1666.4 feet
parallel to and 50 feet south of the centerline of said Bijou Canal to the
intersection with a north south fence prolonged south across the Bijou Canal;
thence S 0°15'E 582 feet along the prolonged fence line to the south side
of said NW4 Sec.29 which point is 23 feet north of the centerline of U.S.B.R.
powerline; thence N89°48'E 1666.4 feet along the south side of said NW4and NE4
Sec. 29 to the point of beginning, containing in all 20.41 acres.
Description Parcel B
A parcel of land being the W3/8 of the NE4 and the E4 of the NW4 Sec.29
T4N R61W 6PM subject to easements for Highway No.34 and Bijou Canal lying
north of the south R.O.W. line of the Bijou Canal (assumed to be 50 feet south
of the centerline of said Bijou Canal) more particularly described as Commencing
at a point on the centerline of said Hwy.34 and the north side of said Sec.29
1668 feet west of the NE corner of said Sec.29; thence on assumed West bearing
along the centerline of said Hwy.34 and the north side of said Sec.29 1651
feet to a point directly north of a long established fence line; thence S 0015'E
2080 feet along said established fence line to a point 50 feet south of the
centerline of said Bijou Canal; thence S 86054'E 1666.4 foot parallel to and

does not come within the purview of the definition of the
terms "subdivison" and "subdivided land" as set forth in
Section 30-28-101 (10) , CRS, 1973 , as amended, and
WHEREAS, the Board of County Commissioners of Weld
County, Colorado, desires to exempt this particular division
of land from the definition of "subdivision" and "sub-
divided land" pursuant to its authority under Section 30-28-101
(10) (d) , CRS, 1973 , as amended, and Section 2-lA( 3) of the
Weld County Subdivision Regulations ;
NOW, THEREFORE, BE IT RESOLVED by the Board of County
Commissioners of Weld County, Colorado, that the hereinabove
described parcel of land owned by Paul A. Ansley and Ethel R.
Ansley be exempt from the definition of the terms, "subdivision"
and "subdivided land" as provided for in Section 30-28-101 (10)
(d) , CRS, 1973 , as amended and in Section 2-1A(3) of the Weld
County Subdivision Regulations , subject to the following con-
ditions . The above-described parcel A and the parcel A of
Recorded Exemption No. 219 , being further described as :

A parcel of land described as that part of the E 5/8 of the NE4
Sec. 29 T4N REIN 6PM lying south of the south R.O.W. line of the Bijou Canal
(assumed to be 50 feet south of the centerline of said Bijou Canal) more

N0O02'W along the east side of said NF'r Sec.29 333 feet to a point 50 feet
south of the centerline of said Bijou Canal; thence 1484O53'W 1652.5 feet

This is to certify that we, the undersigned, grant a right-of-way
easement on the lower part of Section 29, Township 4 North, Range 61 West
of the 6th P. M. to LeRoy D. Peterson for access to the property of LeRoy

Re: Bridge crossing the Bijou Canal and easement:
TO WHOM IT MAY CONCERN:
The Board of Directors of The Bijou Irrigation Company of Fort
Morgan, Colorado and owner of an irrigation canal located in Morgan
and Weld Counties of Colorado, at their meeting on the 5th day of
August, 1976, did give permission and right-of-way for a bridge
crossing of the Company's canal at a point approximately 2317'
South of the Northeast corner and 5' West of the East Section line
of Section 29, Township 4 North, Range 61 West of the 6th P. M. in
Weld County, Colorado, to LeRoy D. Peterson and Patty S. Peterson
as an access to their property.
This access bridge and easement is not to be construed as public
access.
The size and type of construction to be to the satisfaction of
the aforesaid parties.
The approval of the crossing by the Board of Directors of this
company is entered in the minutes on August 5th, 1976 and thereby
become a matter of record.

August, 1976, did give permission and right-of-way for a bridge
crossing of the Company's canal at a point approximately 2317'

Dear Commissioners:
The attached applications, plats and related items are in reference to
requests by Paul A. Ansley and Ray C. Peterson for recorded exemptions.
The reason for addressing these two recorded exemptions together is that
the same person, LeRoy Peterson, is desirous of obtaining the severed
parcel from each applicant and combining them into one contiguous legal
lot. The parcels of land in question are described as part of Section 29,
T4N, R61W of the 6th P.M. , Weld County, Colorado. Said properties are
located one-half mile south and three-quarters of a mile east of Masters.
Mr. Ray C. Peterson's property (RE:219) contains 100.81 acres. Mr. Ray
Peterson's request is to split 15.43 acres from his total parcel and give
it to his son, LeRoy Peterson. Mr. Paul Ansley's property contains 101 .25
acres. Mr. Ansley's request is to sever 20.41 acres from his entire parcel
and transfer said 20 acre parcel to Mr. LeRoy Peterson. Mr. LeRoy Peterson
is desirous of obtaining the two parcels containing 20.41 acres and 15.43
acres and combining them into one contiguous level lot. His stated intent
is to build a single family residence on the property. The soils on the
20.41 acre parcel and the 15.43 acre parcel are Class VI soils which are
not prime agricultural lands as classified by the Soil Conservation Service.
As shown on the recorded exemption plats the Bijou Canal provides a natural
and practical division line for the subject parcels.
On September 23, 1976, the Weld County Board of Adjustments approved requests
for variances from the 180 foot frontage requirement as set forth in Section
3.14 of the Weld County Zoning Resolution and Section 9-4(A)(3) of the Weld
County Subdivision Regulations. Said variances were granted with the stipu-
lation that the 20.41 acre parcel obtain from Mr. Ansley and the 15.43 acre

in the County, the Planning Commission staff recommends approval for the fol-
lowing reasons:
1 . The proposals are in compliance with the Weld County ComprehensivePlan,
the intent clause of the agricultural zone district (Sec. 3.3(A) of the
Weld County Zoning Resolution) , and the intent clause of the recorded
exemption proceedure (Sec. 9-2 of the Weld County Subdivision Regulations)
since non-productive agricultural lands (Class VI Soils) are being
utilized for a use which would appear to be compatible with the surround-
ing agricultural uses in the area.
2. As stated above the Bijou Canal provides a natural division line. Addition-
ally, the Bijou Canal acts as a barrier to normal farming operations and thus
makes said operations impractical .
3. The applicants have complied with the requirements of the recorded exemption
proceedure as set forth in Section 9-3 of the Weld County Subdivision
Regulations.
It should be pointed out that when the Board of Adjustment approved the request
for the variances, the Board of Adjustment requested that the private access
easement and right-of-way crossing over the Bijou Canal be shown on the re-
corded exemption plats.
