HomeMy WebLinkAbout20111721.tiff RESOLUTION RE: ACTION OF BOARD CONCERNING RECORDED EXEMPTION #4663 - ANTHONY YEAGER WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, on July 24, 2007, the Department of Planning Services administratively approved the request of Robert May, 4496 County Road 63, Keenesburg, Colorado 80643, for Recorded Exemption #4663, to divide the property into parcels estimated to be approximately 75 acres and five (5) acres, for property which is located on the following described real estate, to-wit: N1/2SW1/4 of Section 8, Township 1 North, Range 63 West of the 6th P.M., Weld County, Colorado WHEREAS, the Department of Planning Services staff notified the applicant, by certified letters dated April 6 and May 4, 2011, that certain outstanding Conditions of Approval had not been completed and that the matter would be scheduled for a hearing before the Board of Weld County Commissioners unless written documentation was received requesting a withdrawal of the case, or the outstanding items were completed and the mylar plat recorded, and WHEREAS, after reviewing Department of Planning Service's concerns and hearing the testimony presented, the Board determined that said request shall be continued until July 18, 2011, to allow the applicant additional time to complete the remaining Conditions of Approval and record the mylar plat. WHEREAS, after reviewing the matter and hearing the testimony presented on July 18, 2011, the Board determines that the request for the withdrawal of the application for Recorded Exemption #4663 be accepted. I acquired this land through a foreclosure and it was the previous mortgagee who initiated this application. For the past four months I have been under contract to sell to Bill Havengar, during which time I assumed he would continue the process of the application. As of June 30, 2011 my contract with Bill expired and Christine Curl forwarded to me her correspondence with you. In an effort to keep a future application option, as recommended in your e- mail to Christine, I am writing to you. I wish to withdraw the Recorded Exemption Application RE-4663 due to be heard on July 18, 2011. If at all possible would you please give me some proof of your receipt of this request and an understanding that an application can be made in the future. It would be best to request withdrawal of the application rather than waiting for the Board to deny this application at the July 18th hearing. If the application is denied, than if the existing or future landowner wishes to reapply for a recorded exemption—they cannot reapply unless they can determine that the new application is a substantial change from the previously denied application in accordance with Chapter 2 of the Weld County Code. A letter or e-mail requesting withdrawal of the application would suffice.
