A detailed review of these items was not completed at this step in process. Comments made during this stage of the review process will not be all inclusive; as revised materials are submitted other concerns or issues may arise. All issues of concern and critical issues during further review must be resolved with the Public Works Department. REQUIREMENTS: Pursuant to Chapter 15, Articles I and II of the Weld County Code, if noxious weeds exist on the property or become established as a result of the proposed development, the applicant/landowner shall be responsible for controlling the noxious weeds. All vegetation, other than grasses, needs to be maintained at a maximum height of 12 inches until the area is completely developed. MEMORANDUM 11 ' TO: Chris Gathman, Planning Services Q FROM: Lauren Light, Environmental Health • SUBJECT: USR11-0021 K N Wattenberg Transmission LTD COLORADO DATE: 11/16/2011 Environmental Health Services has reviewed this proposal to add 6 compressors, 3 separators and 2 slug catchers to an existing compressor station facility. There is one full time employee located at the facility and several contractors will access the site on a weekly basis to monitor equipment. There is an existing commercial well (115364) which is permitted for "drinking and sanitary facilities only in an individual commercial business". There is also an existing individual sewage disposal system (G-19800110) which is permitted for 8 people. On site dust will be controlled by reducing vehicle speeds and applying chemical dust • suppressant as needed. The waste handling plan indicates a Spill Prevention, Control and Countermeasure Plan (SPCC Plan) will be developed for this site. A copy of the plan shall be kept on the site at all times and shall be provided to the Department of Environmental Health. The waste handling plan also states Mesa Oil will dispose of used oil and Waste Management will collect employee trash. A dumpster is located next to the employee building. Noise is regulated by the Colorado Oil and Gas Conservation Commission. The compressors will be enclosed in buildings which will aid in reducing noise. We have no objections to the proposal; however, we do recommend that the following conditions be part of any approval: We recommend that the following requirements be met prior to allowing the plat to be recorded: 1. The applicant shall submit evidence of an Air Pollution Emission Notice (A.P.E.N.) and Emissions Permit application from the Air Pollution Control Division, Colorado Department of Health and Environment to Environmental Health Services Division of the Weld County Department of Public Health & • • Environment. Alternately, the applicant can provide evidence from the APCD that they are not subject to these requirements. 2. A signed copy of the Spill Prevention, Control and Countermeasure Plan shall be provided to Environmental Health Services Division of the Weld County Department of Public Health & Environment. We recommend that the following requirements be incorporated into the permit as development standards. 1. All liquid and solid wastes (as defined in the Solid Wastes Disposal Sites and Facilities Act, 30-20-100.5, C.R.S., as amended) shall be stored and removed for final disposal in a manner that protects against surface and groundwater contamination. 2. No permanent disposal of wastes shall be permitted at this site. This is not meant to include those wastes specifically excluded from the definition of a solid waste in the Solid Wastes Disposal Sites and Facilities Act, 30-20-100.5, C.R.S., as amended. 3. Waste materials shall be handled, stored, and disposed in a manner that controls fugitive dust, blowing debris, and other potential nuisance conditions. • 4. The applicant shall operate in accordance with the approved "waste handling plan", at all times. 5. The Spill Prevention, Control and Countermeasure Plan shall be available on site, at all times. 6. Fugitive dust and fugitive particulate emissions shall be controlled on this site. The facility shall be operated in accordance with the approved "dust abatement plan", at all times. 7. The operation shall comply with all applicable State noise statutes and/or regulations. 8. The operation shall comply with all applicable rules and policies regulated by the Colorado Oil and Gas Conservation Commission. 9. All potentially hazardous chemicals must be handled in a safe manner in accordance with product labeling and in a manner that minimizes the release of hazardous air pollutants (HAP's) and volatile organic compounds (VOC's). All chemicals must be stored secure, on an impervious surface, and in accordance with manufacturer's recommendations. • 9 • 10.A permanent, adequate water supply shall be provided for drinking and sanitary purposes, at all times. 11.Adequate drinking, handwashing and toilet facilities shall be provided for employees and patrons of the facility, at all times. 12.Any septic system located on the property must comply with all provisions of the Weld County Code, pertaining to Individual Sewage Disposal Systems. 13.The applicant shall obtain a Colorado Discharge Permit System /CDPS permit from the Colorado Department of Public Health and Environment (CDPH&E), Water Quality Control Division, as applicable. 14.This application is utilizing a well as its source of water. The applicant should be made aware that groundwater may not meet all drinking water standards as defined by the Colorado Department of Public Health and Environment. C R.S. Therefore, pursuant to the State Engineer's March 4. 2005 and March 11, 2011 memorandums to county planning directors, this office will only perform a cursory review of the referral information and provide informal comments. The comments do not address the adequacy of the water supply plan for this project or the ability of the water supply plan to satisfy any County regulations or requirements. In addition, the comments provided herein cannot be used to guarantee a viable water supply plan or infrastructure, the issuance of a well permit, or physical availability of water • According to the submitted information, the application is for construction of additional compressor units, separators, and slug catchers at this existing industrial facility, the Frederick Compressor Station. The current water supply, a well with permit number 115364, is not proposed to change. The permitted uses for this well include drinking and sanitary facilities only inside an individual commercial business. The average daily appropriation is not to exceed 800 gallons.
