A. Changes in the District's taxing boundary or Service Area boundary. On April 22, 2010, approximately 151.24 acres of property were excluded out of the District. See attached Order for Exclusion recorded in the real property records of Weld County at Reception No. 3688380. B. Intergovernmental Agreements A letter filed with the Division of Local Government declaring the agreements the District has with other political subdivisions as of February 1, 2011 is attached. C. Changes in the District's rules and regulations The District did not amend its rules and regulations in 2010. D. Summary of any litigation which involves the District The District was involved in the following litigation in 2008. Case No. 06CW256, Water Division No. 1, Application for Approval of Plan for Augmentation, Including Claims for Conditional Ground Water Rights, Storage Rights, Change of Water Rights and Appropriative Rights of Substitution and Exchange ("Augmentation Plan") pertains to a plan for augmentation for the Pioneer Development. Pioneer Communities Inc. is a co-applicant in the case. Status: Dismissed by order of the court dated September 20, 2010. E. Status of construction of improvements The District did not construct any improvements in 2010. F. Pursuant to Section 32-1-501(2), the Board of Directors of the District held a public hearing on the Petition and thereafter granted the Petition and ordered the Property be excluded from the boundaries of the District. 5. Pursuant to Section 32-1-501(4)(b), C.R.S., a certified copy of the Resolution of the Board of Directors of the District excluding the Property from the boundaries of the District has been filed with the Clerk of the Court. NOW, THEREFORE,THE COURT ORDERS: I. Pursuant to Section 32-1-501(4)(b), C.R.S., the Property shall be and is hereby excluded from the boundaries of the District. 2. Pursuant to Section 32-1-503(1), C.R.S., the Property shall remain subject to the levy of taxes for the payment of its proportionate share of any indebtedness of the District and the interest thereon outstanding immediately prior to the effective date of this Order for Exclusion, but shall not be subject to any property tax levied by the District for operating costs or any bonded indebtedness created after the effective date of this Order. 3.
