RESOLUTION RE: ACTION OF THE BOARD CONCERNING BCV #1000085 AGAINST KORY HANSON FOR VIOLATION OF THE WELD COUNTY CODE WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, Kory Hanson, BCV #1000085, is allegedly in violation of the Weld County Code, and WHEREAS, despite efforts by the Planning staff to resolve said matter, the violation has not been corrected, and WHEREAS, on the 12th day of July, 2011, a public hearing was held before the Board of County Commissioners for the purpose of hearing testimony relating to said violation, and WHEREAS, Kory Hanson, property owner, was present at said hearing, and WHEREAS, the Board of County Commissioners deems it advisable to refer said violation to the Weld County Attorney's Office for legal action, with an instruction for delay of action upon such referral until August 12, 2011, to allow adequate time for the necessary permit applications to be submitted. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that BCV #1000085 be, and hereby is, referred to the Weld County Attorney's Office for legal action against Kory Hanson to remedy the violation of the Weld County Code, and any other persons occupying the properties, any persons claiming an interest in the properties, and any persons acting in active concert with the identified parties, with an instruction for delay of action upon such referral until August 12, 2011, to allow adequate time for the necessary permit applications to be submitted. 'l7te licensing plan provided for by the Code, sections 12-43.3-101 et seq., C. .S., is a dual licensing arrangement. Because the Applicant's local licensing au ority will not be issuing the Applicant a locally approved medical marijuana b iness license based on the prohibition against the operation of medical m rijuana centers, optional premises cultivation operations and medical m Tijuana-infused products manufacturers' licenses and has declared that all such o rations cease on July I,2011,then by law,the Division is without authority to issue such a state medical marijuana business license to the Applicant for that jurisdiction. See section 12-43.3-305(3),C.R.S. 3. Under the provisions of Hli 11-1043, the slate legislature has attempted to make some: concessions to help medical marijuana businesses located in a city or county which voted to ban such businesses to potentially relocate to another jurisdiction. However, the provisions of 1Jii 1 (-•1043 do not become law until July 1, 20) 1. Additionally, finding a different local licensing authority willing to accept new applications, working with the local application process, and completing any build-out for a new business facility in a new jurisdiction will likely take an applicant substantially longer than July 1, 2011. 1. The provisions of H-11i 11-1043 allow applicants that were in compliance with section 12-43.3-103 of the Code to transfer the location of' a '`pending application" with the Division to a new local licensing authority. If ara application has been denied by the Division, however, it is no longer a "pending application" because final. terminating action has been taken by the Division. The Code requires the Division to deny a state license it' a local licensing authority will not be issuing a local license. See section 12-43.3-306(1), I he Division is on notice that the Applicant's local licensing authority will not he issuing any local licenses for medical marijuana centers, optional premises cultivation operations or medical marijuana-infused products manufacturing. Therefore, the Division must deny pending applications from that jurisdiction as required by the Code. The prohibition against the operation of medical marijuana centers, optional premises cultivation operations and medical marijuana-infused products manufacturers' licenses enacted by the Applicant's local licensing authority constitutes grounds for denial of your application(s), pursuant to sections 12-43.3-2.02(1)(a)and 12-43.3.306(1), C.R.S. TO AVOID DENIAL OF YOUR APPLICATION On or before 5:0tl p.m. (MST) on June 30, NU, you can voluntarily withdraw your application(s). Withdrawal is a voluntary action by an applicant, which is then approved or disapproved by the Division. If at sometime, concurrent with rules to be promulgated bused on the provisions of 1113 11-1043, the Applicant finds a new local authority which allows them to locate in their jurisdiction and then complies with and satisfies the application requirements of the new local authority, the Applicant could then request their withdrawal be rescinded by the Division based on a change in the law.
