HomeMy WebLinkAbout20110088.tiff HEARING CERTIFICATION DOCKET NO. 2010-43.C RE: HEARING TO SHOW WHETHER CAUSE EXISTS FOR REVOCATION OF USR #1351 FOR A USE SIMILAR TO A JUNKYARD/SALVAGE YARD (POLICE IMPOUND LOT) IN THE A (AGRICULTURAL) ZONE DISTRICT-JAMES WRENFROW A public hearing was conducted on January 12, 2011, at 10:00 a.m., with the following present: Commissioner Barbara Kirkmeyer, Chair Commissioner Sean P. Conway, Pro-Tem Commissioner William F. Garcia Commissioner David E. Long Commissioner Douglas Rademacher Also present: Acting Clerk to the Board, Esther Gesick County Attorney, Bruce Barker Planning Department representative, Tom Parko The following business was transacted: I hereby certify that pursuant to Probable Cause Resolution #2010-1805, dated August 9, 2010, a public hearing was conducted on September 1, 2010, to Show whether cause exists for revocation of Use by Special Review Permit #1351 for a Use Similar to a Junkyard/Salvage Yard (police impound lot) in the A (Agricultural) Zone District. At said hearing, the Board deemed it advisable to continue the matter to September 8, 2010, to allow adequate time to meet publication requirements. On September 8, 2010, pursuant to a legal notice dated August 20, 2010, and duly published August 25, 2010, in the Fort Lupton Press, the Board deemed it advisable to continue the matter to December 8, 2010, to allow adequate time for clarification of the ownership of the property, and then again to January 12, 2011, in order to allow adequate time for staff to make an additional attempt to provide notice to the property owner. At said hearing on January 12, 2011, Bruce Barker, County Attorney, made this a matter of record. Tom Parko, Department of Planning Services, provided a brief summary of the location of the site, which is currently approved for the operation of a police impound lot. He explained a Health Violation was issued for excessive trash and debris on the property, at which time the Department of Planning Services became involved and determined non-compliance with the permitted use of a police impound lot. Mr. Parko stated since September, 2010, staff has been unsuccessful at contacting the owner(s), although certified mailings were sent for each of the previous hearings. He stated staff did receive a signed certification concerning the notice which was sent for today's hearing; however, they have not been contacted to address any of the outstanding issues, the telephone numbers on file are not current, and the owner does not have a listed number. He stated staffs' recommendation is to revoke the permit. He verified they have tried to work with the applicant; however, all attempts have been disregarded and no progress has been made. CL .. PL ' C� 2011-0088 1 - 2L,2 -t l PL1569 SHOW CAUSE HEARING CERTIFICATION -JAMES WRENFROW (USR-1351) PAGE 2 Chair Kirkmeyer confirmed that neither Mr. Wrenfrow, nor a representative, were present to speak concerning this matter. In response to Commissioners Long and Conway, Mr. Parko confirmed notice of this hearing was also provided to Mr. Wrenfrow's wife, April Wrenfrow. Chair Kirkmeyer provided the opportunity for public testimony; however, none was provided. Commissioner Garcia moved to revoke Use by Special Review Permit #1351 based on continuing evidence of noncompliance with the permitted Use Similar to a Junkyard/Salvage Yard (police impound lot) in the A (Agricultural) Zone District. The motion was seconded by Commissioner Conway. Commissioner Garcia stated this issue has been discussed on several occasions; however, Mr. Wrenfrow has failed to make an appearance, and although his wife came once and attempted to find a solution, no further progress has been made and this has been an on-going problem that needs to be resolved. Commissioner Conway commented the issue came to the Board's attention due to a serious Health violation, and staff did a great job cleaning up the site in an expeditious manner. He stated the prior reason for a continuance was to allow Ms. Wrenfrow the opportunity to have the property transferred to her name and commence with improvements to the site; however, it does not appear she intends to proceed with that option. There being no further discussion, the motion carried unanimously and the hearing was completed at 10:06 a.m. This Certification was approved on the 17th day of January, 2011.
