RE: RECORDED EXEMPTION NO. 253 - BETTY JO HADLEY AND RUTH M.

WHEREAS, it has been determined by the Board of County
Commissioners of Weld County, Colorado, at a public meeting
held on the 2nd day of March, 1977, in the Chambers of the
Board of County Commissioners of Weld County, Colorado, that
a certain parcel of land, being the property of Betty Jo
Hadley and Ruth M. White, Weld County, Colorado, more partic-
ularly described as follows :

"Subdivision" and "subdivided land" as set forth in Section 30-28-
101 (10) (d) , CRS 1973, as amended, and
WHEREAS, the Board of County Commissioners of Weld County,
Colorado, desires to exempt this particular division of land
from the definition of "subdivision" and "subdivided land" pur-
suant to its authority under Section 30-28-101 (10) (d) , CRS 1973, as
amended, and Section 2-1A(3) of the Weld County Subdivision Regulations;
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners
of Weld County, Colorado, that the hereinabove described parcel of
land owned by Betty Jo Hadley and Ruth M. White, be exempt from the
definition of the terms, "subdivision" and 'tubdivided land" pursuant to
its authority under Section 30-28-101 (10) (d) , CRS 1973, as amended, and
Section 2-1A (3) of the Weld County Subdivision Regulations.
The above and foregoing Resolution was, on motion duly made and
seconded, adopted by the following vote on the 2nd day of March,
A.D. , 1977.
The above and foregoing Resolution was read into the record and
signed on the 7th day of March, A.D. , 1977.

RE: Recorded Exemption #253
Dear Commissioners:
The attached application, plat, and related items are in
reference to a request by Betty Jo Hadley and Ruth M.
White for a recorded exemption. The subject property is
described as part of the SW* of Section 9, T1N, R68W of
the 6th P.M. , Weld County, Colorado. Said property is
located 1* miles east and 1 mile north of Erie. The pro-
perty in question contains 17.66 acres of non-irrigated
land with Class III and IV non-irrigated soils. The re-
quest is to split the property into parcels of 10.76 acres
and 6.90 acres.
On January 26, 1977, the Board of County Commissioners
approved a request by Ms. White and Ms. Hadley for a lot
size variance so that they could make application for this
recorded exemption. At the time they made the decision on that
request, the Planning Commission staff submitted a letter
of recommendation to the Board. A copy of that letter of
recommendation is included in the attached packet. On
February 24, 1977, the Weld County Board of Adjustment
approved a request by Ms. White and Ms. Hadley for a vari-
ance of 180 feet from the requirement of 180 feet of lot
frontage onto a public road as set forth in Section 3. 14
of the Weld County Zoning Resolution and Section 9-4(A)(3)
of the Weld County Subdivision Regulations. Nothing has
been received by our office which would change our recom-
mendations of approval for this request as outlined in
the letter to the Board of County Commissioners dated January
24, 1977.

Dear Commissioners:
The attached letter and related materials are reference to a request by
Ruth M. White and Betty Jo Hadley for a lot size variance. The subject
property is described as part of the SWW of Sec. 9, T1N, R68W of the
6th P.M. , Weld County, Colorado. Said property is located one and one-half
miles cast and one mile north of Erie. The property in question contains
approximately 17 acres of non-irrigated land with Class III and VI non-
irrigated soils. The request is to obtain a variance from the minimum lot
size requirement, Sec. 9-4 (A)(6),so that they may make application to
apply for a Recorded Exemption. Sec. 9-4 (A)(6) states;"that the original
tract or parcel of land to be divided under this section meets the mi.nimun
lot size requirements established by the Weld County Zoning Resolutior;
variance fran this requirement being allowed only upon good cause being
shown to the Board of County Commissioners or where said tract or parcel
of land lies within the Comprehensive Plan area of an existing incorporated
town of Weld County. (Revised 4/17/74. )"
If this lot size variance is granted, Ms. White and Ms. Hadley will proceed
with tl'eir application for a Recorded Exemption to divide the property into
two lots. One lot is proposed to contain approximately 7 acres with an
existing set of improvements. The second lot is proposed to contain approxi-
mately 10 acres. Although the second lot does not presently contain an
existing set of improvements there is a 1,000 gallon septic tank and garage
located on this proposed parcel. This septic tank was utilized by the o.vners
of the property on a temporary basis while they were building the existing
residence on the proposed 7 acre parcel.
Based upon the infonnation submitted and the adopted policies in the County,
the Planning Camtission Staff recommends the request be approved for the
following reasons:

1. The request complies with the intent clause of the Recorded
Exemption procedure in that non-productive agricultural land
(Class III and VI non-irrigated soils) is proposed to be split
and utilized for residential purposes which would be compatible
with land uses in the surrounding area.
2. The seventeen acre parcel in question has low utility for
agricultural use due to the shall acreage involved and the poor
soils underlying the property.
3. As explained above, utilities presently exist (septic, water
supply, and electrical service) on the proposed 10 acre parcel.
4. The Erie Planning Commission has indicated that the Town of Erie
has no objections to the granting to this lot size variance
request.
