HomeMy WebLinkAbout20110868.tiff RESOLUTION RE: APPROVE APPLICATION FOR COLORADO WASTE TIRE GRANT PROGRAM AND AUTHORIZE CHAIR TO SIGN WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS,the Board has been presented with an Application for the Colorado Waste Tire Grant Program from the County of Weld, State of Colorado, by and through the Board of County Commissioners of Weld County, on behalf of the Weld County Department of Public Health and Environment, to the Colorado Department of Public Health and Environment, commencing July 2, 2011, with further terms and conditions being as stated in said grant application, and WHEREAS,after review, the Board deems it advisable to approve said application, a copy of which is attached hereto and incorporated herein by reference. Wallace, MD, MPH Subject: Application for Tire Grant to CDPHE Date: March 28, 2011 Attached, for your consideration, is an application from the Environmental Health Services (EHS) Division of the Department of Public Health and Environment for a Waste Tire Cleanup Grant from the Colorado Department of Public Health & Environment (CDPHE). This application requests $36,763 in funding to provide financial assistance to Weld County residents for the clean-up and recycling of illegally stored waste tires. I recommend that the EHS division be given permission to proceed with this application. BACKGROUND: The EHS Division has successfully implemented several tire cleanup grants over the past few years using a voucher type program. Owners of identified tire sites, for whom clean-up of their tires would constitute a financial constraint, are provided a voucher to cover the recycling costs of their tires (must meet certain requirements as described in the application), at our selected tire recycler (contractor). The owner is required to transport their own tires for recycling. Based on prior waste tire cleanup grants implemented by the EHS division, it is estimated that in a 12 month period (commencing 07/02/2011), we will be able to assist with the recycling of approximately 25,000 tires for a total project cost of$59,109 (see application for full cost breakdown). Weld County will be contributing $22,346, as in-kind (includes salary, fringe, and residents estimated transportation costs). The contractor, Snowy River Enterprises, has already been selected, through an open-bid process. Snowy River Enterprises has been the selected contractor for all our previous waste tire grants. Describe how long the illegal tire site has been at the current location. How was the site found/reported? What has the response been of the property owner to conduct a cleanup? Indicate what previous steps were taken to stop or cleanup the illegal tire site. What steps are going to be done so another illegal waste tire dump does not occur again at this site? What, if any, has been the public response on the illegal tire dump site?Cite applicable regulations and ordinances that allow for funding to clean up the illegal tire site (Provide current copy in appendix). Minimum '/2 page required for this question Weld County is roughly 4,000 square miles,with approximately 34%of the land within its boundaries being used for agriculture purposes. Waste tires are a common concern in areas of high agricultural use,with approximately 3 million waste tires being used, nation-wide,for agricultural purposes every year. While every one of these tires is being re-used for a useful purpose, and not being dumped somewhere illegally,there comes a time when they,too,will need to be disposed of,either because they are no longer needed or they have broken down to the point where they are needing to be replaced. Tire piles(legal or illegal) pose a major health threat. They provide a receptacle for standing water,where mosquitoes may lay eggs, increasing their population. Mosquitoes are a known vector for transmitting deadly diseases, including West Nile virus and dengue fever. Weld County has documented numerous cases of both human and animal West Nile infections. Other disease carrying pests, such as rodents,can also be found in tire piles. Fire also presents a concern. Scrap tire fires are difficult to extinguish and can burn for long periods, releasing thick black smoke and contaminating the soil and nearby waterways with an oily residue. Illegal waste tire piles in Weld County are typically identified by our code enforcement officer, using the definition of a noncommercial junkyard, as defined in our county code. The storage of waste tires by a private home/land owner constitutes a noncommercial junkyard. If the Zone district does not allow for a noncommercial junkyard,the waste tires(and other junk or secondhand materials) must be removed. If there are quite a number of tires,this can represent a significant financial hardship to the property owner. Whereas the county does have a solid waste fund (funded by a surcharge to the tipping fees at all landfills located in Weld County)to support our household hazardous waste disposal facilities, and community cleanups (in unincorporated Weld County), it does not provide for the cleanup of private properties. In years past,with funding from the Department of Local Affairs,we have been able to assist in the cleanup of illegal waste tire piles. Initially, our efforts focused on identifying larger sites and assisting with the cleanup of those. We've also sponsored"tire amnesty"days,where Weld county residents could bring their waste tires to a designated drop-off site for free disposal. The method we've found most successful, however, which we started using in 2007, is the process we would like to continue with, if awarded funding. Through this method, illegal tire sites are usually identified in one of two ways. Either the property owner has self-identified (we usually do a press release and other no-cost advertising)or through a complaint to the County's zoning compliance officer. To receive assistance,the property owner must meet a few minimum requirements, including: (1)they must have at least 50 tires, (2)tires must not have been received from a tire recycler for use in windbreaks or snow fences, (3)cost of disposal presents a financial hardship, (4)the owners of the tires must transport their own tires our selected contractor, and (5) property owner must sign a statement indicating that they will not collect any more tires on their property. Once we get a request for assistance from a county resident,we assess their eligibility, before doing a site visit. We do a site visit to determine that the tires are indeed coming from the location stated by the resident (that they're not being brought in from somewhere else)and to confirm the number of tires. We take a picture of the tires and provide the homeowner with a voucher, listing the number and type of tires they will be allowed to take to the tire recycler(contractor). The owner of the tires is then responsible for confirming a delivery date and time with the contractor, and for transporting their own tires. The contractor then takes only the number and type of tires listed on the voucher. If the owner ends up having more tires than originally estimated (counted), we can issue another voucher for the remainder. After the tires have been delivered to the contractor, we do a follow-up site visit to assure that all the tires have been removed from the property and to take an"after" picture, for documentation. 2. (Note: If multiple sites, breakdown number(or weight) of waste tires for each location) Based on the number of tires collected during our previous waste tire cleanups, we anticipate collecting approximately 25,000 tires, with a breakdown as follows: 87% (21,750 tires) will be passenger vehicle tires without rims, 7% (1,750 tires) will be passenger vehicle tires with rims, 4% (1,000 tires) will be truck/tractor tires less than 28", and 2%(500 tires)will be tractor tires greater than 28". 4. How will the tires be transported? As part of the in-kind match, the property owners will be responsible for the transportation of their own tires to the selected contractor. 5. What will be the end use of the tires(recycled or reuse only): Snowy River Enterprises, our selected contractor has been in the scrap tire business since October of 1991, and has been a 100%recycle facility since 2007. Some of the end uses of the tires collected at Snowy River Enterprises include, shredded tire chips for civil engineering applications, leach fields, landscape"bark", playgrounds, and horse arenas. It was stipulated in the county's bid request that all tires collected through this project must be recycled. 7. It is estimated that county staff will spend approximately 5 hours per week(or.125 FTE)on this project ($4,862 gross monthly salary x .125 x 12 months). Fringe is calculated at 35%of employee's salary. The cost for the contractor is based on price per tire(and type)for recycling (see table below). Rustye Cole,owner of Snowy River Enterprises, selected recycling contractor, estimates the per ton cost to process raw waste tire material to be$115. 13. How often will you be submitting invoices for reimbursement?(Note: maximum of one invoice per month allowed) Invoices will be submitted on a quarterly basis. 14. This contract will be on a cost reimbursement basis. What will be your organization's source of cash and how will your organization manage its cash flow between the time costs are incurred and reimbursed? General county funds will be used to support this program between the time costs are incurred and the time we are reimbursed. 15. Is there any compliance issues by the county or municipality currently open with the state of Colorado? Please describe in detail what the issue is and how it could potentially impact the cleanup process. There are no compliance issues by Weld County currently open with the state of Colorado. 16. What experience does the project director have with dealing with illegal waste tire cleanups? With managing a grant project with the state? The project director, Gabrielle(Gabri)Vergara, has managed two out of our three past waste tire programs. In this capacity she has been responsible for all aspects of the program,from working with the waste tire "generators"and recycling contractor, to submitting reports and other correspondence with the State. In addition to these grant funded projects, Gabri has experience managing several other state grants for us. We also have other environmental health specialists on staff with expertise in waste management that can assist Gabri if needed. 17. Is there any known potential issues or concerns that would cause the delay or non completion of this project? There are none.
