COMPUTATION OF DAMAGES The computation of damages is not applicable. Plaintiff has requested that this honourable Court declare that Plaintiff is the rightful and exclusive titleholder to his real property, that Defendants herein be declared to have no estate, right, title or interest in said property and a judgment be entered forever enjoining Defendants from asserting any estate, right, title or interest in the subject property. The history of the road indicates that road right-of-way was granted for that portion of the road from WCR 113 easterly for a half mile. The road right-of-way from that point easterly to the intersection with Deford Street was never dedicated to the public. Maintenance has been with the County, however no documentation is present to justify why we are maintaining that portion of the road. Testimony indicates there are a minimum number of vehicles presently using the roadway. After reviewing the situation, the group decided to abandon the roadway. Since it is not a dedicated right-of-way, no formal documents will be required. The County will cease maintenance of that portion of the road located between the west line of the East One-Half of Section 33 and Deford Street. The County will also install a"Not A Thru Road" sign at the intersection of WCR 113 and WCR 86'1. You may obliterate and fence that portion of the • roadway that is on your property, if you so wish. We understand there is some overlap in the deeds held by Mr. Locke and yourself. Our research indicates that you own the land south of the road and Mr. Locke's deed indicates that he owns to the Quarter Section Line, thus causing an overlap. This is a civil matter between you and Mr. Locke and as such does not involve the county. Consequently, the County has no opinion in that matter. Garcia, Chairman Board of County Commissioners of Weld County, Colorado This is a letter to help you understand some background leading up to the letter you sent on 12/15/2009. Mr. &Mrs. Locke were sold property by Melvin Everhart and were led to believe that the southern boundary of their property was deep into my land. I tried to explain where the boundary was, and it came to my attention that a portion of real 86 1/2 was not where it was supposed to be. (When I moved in, Doris Williams told me"that the portion of road is not supposed to be there".) I brought the matter to public works, and they agreed. Public Works abandoned the portion of road that was never dedicated to the public. The road was abandoned on 10/22/2009. (See attached letter.)The comment regarding the overlap was written in error. The true property line is much further north on the south side of true county road 86 '1 east of Deford Street. It is the only county road 86 1/2 in the north east quarter section. This also raises the question of the land being sold twice. The question that needs to be asked is who authorized the illegal road? There is no Quit Claim deed or survey and roads do not pop up like daisies. Someone had to order the road which is a gross miss use of taxpayer monies. The amount of money makes it a felony. The continued maintaining of the"road"adds to the constantly increasing total of misappropriated money. The county abandoned the road and I have never given up possession, and no longer wish to bear the liability if someone gets injured. I need to fence it off again. I only took the fences down to make the survey easer. The closed road signage was still in place when I took the fences down. From what I have seen the survey never took place. I need to start to work the land per Section 35-3.5-102, C.R.S If you still feel the need to claim the portion of my land under C.R.S. 43-2-201(1) (c), and since you were not in possession of the road at the time, I will sell you the road. I currently have the lots up for sale for $20,000 each. The Road intersects (5) Five lots. That portion of the road will cost $100,000 to offset the money I would lose. The agricultural portion will be an additional amount. On July 1, 2008 HB 2008-1148 was signed into law by Governor Ritter, and applies to all adverse possession cases following this date. With the new law the burden of proof will lie with the possessor to prove they have evidence they were the actual owner, which should reduce the number of cases appearing before the court. Box 758 Greeley, CO 80632 Re: WCR 86%1, Section 33, T8N, R59W Dear Mr. Garcia: This letter is in response to your December 15, 2009 letter, addressed to Mr. Bruce Atkinson and Mr. Philip Locke. The law firm of Grant, Hoffman& Kamada has been retained to represent Mr. Atkinson in the above-mentioned matter. Contrary to your assertions in your December 15, 2009 letter, the section of WCR 86'/1 that extends from the half-section line of Section 33, T8N, R59W, into the platted subdivision of Buckingham onto Colorado Avenue, and then intersecting with Deford Street is the sole property of Mr. Atkinson and does not meet the requirements to be a public highway. Under C.R.S. §43-2-201(I)(c), a road over a private land is declared to be a public highway if"used adversely without interruption or objection on the part of the owners of such lands for twenty consecutive years". Without addressing whether use of the road was adverse, it is quite clear that the twenty (20) year statutory period has not been met. In a letter dated October 26, 2009, addressed to my client, from the Weld County Public Works Department it was stated that the roadway would be abandoned and that a "Not A Thru Road" sign would be installed by the County. See Enclosure. The intent of the County to abandon the roadway is apparent. Additionally, the letter stated that Mr. Atkinson could, "obliterate and fence that portion of the roadway that is on [his] property" and that "Testimony indicates that there are a minimum number of vehicles presently using the roadway". By abandoning the roadway and erecting the sign, the statutory period required under C.R.S. §43-2-201(1)(c) was clearly interrupted. Furthermore, even if the County had met the statutory requirements for the road to become public, the October 26. 2009 letter from the Weld County Public Works Department was sufficient to exterminate the public nature of the road. In Board of County Commissioners of County of Morgan v. Kobobel, the court holds that a public road ceases to be public if"abandoned by some appropriate action." 74 P.3d 401, 406 i I (Colo. App. 2002). Abandonment requires intent to abandon and nonuse. Id at 407. Both factors have been met here, as the October 26 letter is more than sufficient to show the County's intent to abandon and the subsequent erection of the "Not A Thru Road" sign and fencing of the road are sufficient to show nonuse. If Weld County would like to purchase the road to dedicate it to the public, my client would be willing to negotiate a purchase price. After a careful review of the Road Petition with Mr. Atkinson, we are doubtful that the filing of the Road Petition would be proper in this case. Upon reviewing the relevant statutes and documents, the road has already been vacated and/or abandoned [presuming the County ever held possession of the premises]. The letter of abandonment dated October 26, 2009 from the Weld County Public Works Department clearly evidences this action. Pursuant to C.R.S. § 43-1-202.7, the road was vacated and/or abandoned and the letter is clearly a conveyance document. Further, the actual validity of any claim by the County to the road is in question as well. There are no documents to support any ownership by the County and furthermore, the road cannot and does not meet the requirements for a public road. As stated in your December 15th letter, you claim that the aforementioned road is a public road and that Weld County has the authority to declare this as such under C.R.S. § 43-2-201(1)(c) (2010). The legislative intent of this section was to establish a "narrow alternative" to other means by which a public entity can establish a road. McIntyre v. Bd. Of County Comm'rs, 86 P.3d 402, 413 (Colo. 2004). The other means available to a public entity includes: the owner may dedicate the road to the County either expressly or by implication; the County may purchase the road or; the County may initiate a condemnation proceeding and pay just compensation to the true owner. Id According to your letters, no documentation exists regarding the justifiable maintenance of the road, dedication or formal documentation for ownership. As such, there appears to be no dedication, purchase, or condemnation proceeding that has effectively transferred ownership of this road to the County. This section is simply a codification of the common law method by which the public can obtain title by adverse use. Malinke v. Coughenour, 458 P.2d 747, 750 (Colo. 1969). For � I the County to claim adverse possession of a road over private land, the County must show that the public used the road under claim of right and in a manner adverse to the landowner's property interest, the public use was uninterrupted for 20 years, and the landowner had actual or implied knowledge of the public's use and made no objection to such use. Bd. of County Comm'rs of Morgan County v. Kobobel, 74 P.3d 401, 405 (Colo. App. 2002) (emphasis added). Our position is that the County does not meet the elements necessary for it to claim adverse possession of the aforementioned road. As for the County's claim that they adversely possessed the road for the last 20 years, we do not believe this to be accurate. For the public to use a road under claim of right and in a manner adverse to the landowner's property interest, the possession must be hostile. Town of Silver Plume v. Hudson, 380 P.2d 59 (Colo. 1963). "The possession must be hostile from its inception, because if the original entry is not openly hostile or adverse, it does not become so, and the statute does not begin to run as against the rightful owner until the adverse claimant disavows a holding by permission." Id at 61. For permissive use to change to adverse use, the County must give the landowner notice that the County is claiming an exclusive right and is possessing the road adversely. Bd. of County Comm'rs v. W.HI, Inc., 992 F.2d 1061 (10th Cir. 1993). Therefore, more must be done than "mere travel" over lands by the public to establish a public highway by prescription. Id at 1066. At a minimum, the County must show that they possessed the road under a hostile claim of right for at least 20 years. In this case, the County never took hostile possession of the road. Upon information and belief, when Melvin Everhart owned what is now Mr. Atkinson's property, his nephew maintained the subject road. However,this "entry"by the County at this time can hardly be characterized as hostile or under a claim of right. This situation was solely permissive. Additionally, the fact the County never changed its type of entry onto the road precludes adverse possession. The County never gave notice to any subsequent landowner that it was now claiming a right to the road against all others. In fact, by your own letter, the County has no documentation confirming this claim of right. Therefore, the County never adversely claimed a right to this road, and as such, may not claim ownership of the road at this time. Furthermore, the claim that memory by neighbors and community members will demonstrate adverse possession for at least 20 years is problematic. First, community members' knowledge is insufficient as explained above. The landowner's actual or implied knowledge is what controls whether the County has effectuated adverse possession. Second, to meet this element, the County must prove such usage for 20 years by clear and convincing testimony. Bd of County Comm'rs v. Masden, 385 P.2d 601 (Colo. 1963). Based on the vague description you provided regarding your witnesses, we do not believe you will be able to meet the standard of this element to adverse possession. Lastly, in this case, since no adverse possession was ever claimed until now, there was no chance or opportunity to object. Once the County made its adverse possession claim to Mr. Atkinson's road, he immediately objected in writing to the County, and then proceeded to hire counsel to engage in negotiations for the sale and/or abandonment of 2 the road. This is a clear objection by the present owner. It is for these reasons that we believe any adverse possession claim by the County will fail. At this time, we would request that the County confirm the property right of Mr. Atkinson and that your letter dated October 26, 2009 constitutes a vacation and/or abandonment for the road located at the section of WCR 86'1 that extends from the half- section line of Section 33, T8N, R59W, into the platted subdivision of Buckingham onto Colorado Avenue, and then intersecting with Deford Street and that it is the sole property of Mr. Atkinson. In this letter, you claimed that the property was subject to a civil dispute between Mr. Locke and Mr. Atkinson. Bruce wants to know if Weld County will move the road off his private property (Blocks 13 and 14) and relocate the road in the existing ROW granted by the Buckingham Townsite Plat. This relocation is shown as a dashed red line. If the County is unwilling to relocate this road,then he would prefer that we abandon and obliterate the road.He has considered selling Blocks 13 and 14 but the road on the property makes that impossible. Philip Locke purchased C about 5 months ago. Mr.Locke would prefer that we leave the road as it presently exists. If we can't do that, then he would prefer to have it abandoned and obliterated. He did indicate to me that if the County absolutely had to relocate the road and there was no other option,then he would not fight it but he wouldn't like it. WCR 86 '/2 was granted by petition from WCR 113 east for''/2 mile and stops.There is no record or documentation of how this road came into existence.From local testimony,it began about 40 years ago as a kid's bike path and slowly developed over the years into a graveled road. It is slightly narrow than most of our graveled roads.Mr Atkinson states the only traffic that uses this road is the postman, occasionally the Air Force(missile base labeled AF)and a neighbor every now and then. He stated that he does not travel east from his home so it would not be a problem to have it obliterated. As I see it, we have four options. Leave the road as is and inform Mr. Atkinson that the road was there when he purchased the property.The road has been in existence long enough to be considered a legal public roadway but without documentation.We could obliterate the road thus slightly reducing our maintenance costs and provide Mr. Atkinson with useable city blocks. We could relocate the road to the right of way that was provided for by the Plat of Buckingham thus allowing the public to continue using the road. Finally we could have both owners grant right of way to us for this road. There would then be documentation of its existence,but would not eliminate Mr.Atkinson problem.
