Board of Assessment Appeals: You have the right to appeal the County Board of Equalization's(CBOE's)decision to the Board of Assessment Appeals(BAA). Such hearing is the final hearing at which testimony, exhibits, or any other evidence may be introduced. If the decision of the BAA is further appealed to the Court of Appeals, only the record created at the BAA hearing shall be the basis for the Courts decision. You and the CBOE select an arbitrator from the official list of qualified people. If you cannot agree on an arbitrator, the District Court of the county in which the property is located will make the selection. Arbitration Hearing Procedure: Arbitration hearings are held within sixty days from the date the arbitrator is selected. Both you and the CBOE are entitled to participate. The hearings are informal. The arbitrator has the authority to issue subpoenas for witnesses, books, records, documents and other evidence. He also has the power to administer oaths, and all questions of law and fact shall be determined by him. The arbitration hearing may be confidential and closed to the public, upon mutual agreement. Manufactured Homes Land Code: 1135 Imp. Code: 1235 (Including pre-1976 mobile homes) Manufactured homes (including pre-1976 mobile homes*), which are titled through the Division of Motor Vehicles and have a residential use, are classified in this subclass. Properties where both the land and the titter manufactured home are owned by the same owner, or the titled manufactured home is situated on land owned another person, or where the titled manufactured home is located in a manufactured home park, are included it this subclass. Factory built (modular) residential structures are classified as single family residential. NOTE: Manufactured home hook-up values are included with and abstracted with the land. Detached garages and sheds used in conjunction with a manufactured home are classified as manufactured homes (1235). *Manufacturers stopped producing mobile homes in 1976. This type of structure is now called a manufacturec home. Manufactured homes are built to HUD standards and can be identified by a red plate usually located on the back of the structure. If the structure is shipped in more than one piece, each piece will have a red plate. If red plate is missing, an 8 1/2 x 11 inch paper "data plate," which gives the specifications of the structure, may located near the water heater or furnace. Manufactured homes can also be placed on a permanent foundatio and never titled. Titled manufactured homes may or may not have the axles and wheels in place. For structural reasons, the I-beams must be left in place, even if the home is placed on a permanent foundation. Manufactured homes have a red HUD plate on the left rear side of each section. Mobile Home Many mobile homes that were built to American National Standards Institute (ANSI) standards are typically placed on a temporary foundation and titled. Manufacturers stopped making mobile homes in 1976. Mobile homes typically have no label; however, the State of Colorado had a Mobile Home Certificate label for homes built from 1971-1976, and the label was placed on the left rear side of the home. Definitions. Modular Home Modular homes are factory built to standards set by International Residential Code (IRC), and International Building Code (IBC) for non-residential property. I-beams may be use during transport for support; however, they are removed when the homes are set. Modular homes are identified by a silver plate located under the kitchen sink. Definitions. (8.3) "Modular home" means any preconstructed factory-built building that: (a) is ineligible for a certificate of title pursuant to part 1 of article 29 of title 38, C.R.S.; (b) is not constructed in compliance with the "National Manufactured Housing Construction and Safety Standards Act of 1974", 42 U.S.C. sec. 5401 et seq., as amended; and(c) is constructed in compliance with building codes adopted by the Division of Housing in the Department of Local Affairs. § 39-1-102, C.R.S. To Weld County Board of Equalization: I just received my Notice of Determination from the Weld County Tax Assessor. Mr Woodruff has once again "taken the easy way out", but only correcting ONE title in the tax records, but he has incorporated old dilapidated trailers which are older than 1977 (and by State Law still considered Mobile Homes) in with ALL OTHER homes. He also neglected to fix the "Built As:" part of the record. He has my house listed as a "Double Wide" ... yet, he has a house, almost identical as mine (located at 408 Glen Ayre Street) as a "Built As: Modular". Whether the house is a Modular or a Manufactured Home, if it is a ranch style home, and wider than 16 feet, it came in two pieces; therefore, a Modular is just as much a"Double Wide" as a Manufactured (HUD) Home, so why does he continue to single out this type of home. In accordance with State and County Statutes, this is wrong. My house was "Built As" a Single Family Dwelling and not as a "Double Wide". I have only given you one error, but I have pages of errors that Mr. Woodruff has neglected to fix in the two years I have been trying to correspond with this office to get them to comply with their OWN regulations. He continues to falsify documents and after two years, I have to ask whether he just doesn't want to do a proper job for this county, or he is incompetent. I have a list of homes that Mr Woodruff and staff have classified differently than my home, yet they are the same type of HUD home as mine. My home has been installed on a permanent foundation and the title has been purged; therefore, he has NOT been in compliance with the laws of Weld County since my home was placed on my property. No where on my property description should my home be listed as "Double Wide", yet it is, for public view and mortgage companies and banks question this. I should not be penalized because of Mr Woodruff's apparent refusal to follow County and State Ordinances. It appears that Mr. Woodruff has deliberately ignored the County Codes, particularly Section 29-2-110 and State Statutes pertaining to his office, in particular: Manufactured home means a structure, transportable in one (I) or more sections, which is eight (8) body feet or more in width or forty(40)body feet or more in length, or, when erected on site, is three hundred twenty (320) or more square feet, and which is built on a permanent chassis and designed to be used as a dwelling with or without a permanent foundation when connected to the required utilities, and includes the plumbing, heating, air-conditioning and electrical systems. (See also the definition of afactory-built home.) NOTE: Applicants for building permits for manufactured homes are advised that the definition for manufactured homes, as set forth in Chapter 23 of this Code, is the following: Manufactured home means a single-family dwelling which: is practically or entirely manufactured in a factory; is not less than twenty-four (24) feet in width and thirty-six (36) feet in length; is installed on an engineered permanent foundation in compliance with ANSI A225.1, 1994, Manufactured Home Installations, Appendix C; has brick, wood or cosmetically equivalent exterior siding and a pitched roof; and is certified pursuant to the National Manufactured Housing Construction and Safety Standards Act of 1974, 42 U.S.C. 5401 et seq., as amended. A manufactured (mobile) home shall not be allowed to deteriorate to the condition of a derelict manufactured (mobile) home. Manufactured homes meeting this definition qualify as vv Ilinp_c, under Chapter 23 of this Code. All other manufactured homes are treated as mobile homes under Chapter 23 whose use is limited to certain zone districts and may be required to obtain zoning approvals issued in accordance with Chapter 23, Article IV, Division 3 of this Code prior to the issuance of building permits. (See Section 29-7-60) Because of Mr Woodruff's refusal to comply with this Code and the State Code which states that the term Mobile Home does not refer to any structure built after 1976, the Glens of Dacono have suffered and the growth of this section of Dacono has been seriously affected because of his gross negligence and incompetence. Also, I have found in the Colorado Revised Statutes that he has committed criminal acts in that he has knowingly and deliberately falsified Public Documents which is a Class I Misdemeanor according to the Colorado State Statute which states: STATUTORY CITATIONS ETHICAL ACTIONS OF PUBLIC SERVANTS This section is a compilation of citations from Colorado Revised Statutes (C.R.S.), which relates to the ethics of public servants' actions. I do have proof beyond a reasonable doubt that he has knowingly and willingly falsified public documents, because I supplied him with both the County Codes and State Statutes last year in several different emails, of which I still have copies, when I was denied a mortgage because my house was listed on the County Website as a Mobile home. As head of the Assessors Department, he authorized use of software that was outdated in terminology which is a waste of our tax dollars and will continue to be detrimental to some residents of Weld County. I have also gone to several banks and have showed them the public record produced by Mr. Woodruff of my own home ... and then showed them a picture of my house. I was advised by every loan officer that the public record would be a problem once my loan would reach the underwriting department. This deliberate misrepresentation makes some affordable housing not available to a family who does not have cash in hand, but does make the housing even cheaper for the slum lord. For example: Wells Fargo WILL finance manufactured housing ... they will NOT finance a mobile home. Mr. Woodruff, by not making these corrections in over a year has not been an asset to Weld County, nor does he have the towns and the people who reside in these towns in his best interest. He is even in direct violation of The Weld Assessor's Code of Ethics, adopted January 1, 2008. He has followed NONE of the below listed Code: Weld County Assessor's Office Code of Ethics 1. Weld County Code 21-1-20 and Other Misc Definitions—This Packet Contains the County Code which clearly states how my home should be listed because it is on a permanent approved and inspected foundation, the title is purged and my home meets all width, length, and age requirements to be designated a"single family dwelling". State Statutes and Tax Assessors Guide information is also included. It also contains a definition from Nationwide Homes which states Modulars and Manufactured Homes are "built as ranch homes", and not "built as Double Wide" as currently stipulated in the tax records. 3. Possible Laws Broken—The two state laws, one from the Tax Assessor's Guide, the other from Colorado State Statutes pertaining to knowingly and willfully reporting erroneous and falsifying public data. 4. Sixteen Year Evaluation of Property Records, Possible Law Established By Custom—This package contains 16 years of data for a home located at 1203 Mac Murry Court. For at least 11 years (possibly as long as 34 years), this home was considered a "Ranch 1 Story" ... Not until 2007 was the classification changed 3 times. According to the legal definition of"custom", it seems the custom may have been established in Weld County for at least a decade. 5. Examples of Inaccurate Tax Assessment Data—Two homes with incorrect descriptions and no mention of large garages in the assessments. Pictures show the homes and garages. One home is listed in the name of a man who died in January 2008 and the home went into foreclosure. 6. Mislabeled Mobile Homes, Manufactured vs Modular Documentation - This folder contains homes that are mislabeled in accordance with County and State Codes. There are 5 mobile homes mislabeled as "manufactured hm", all older than 1976, 2 which are mislabeled as "Modular". One which is not clear whether it is a Manufactured or Modular because both terms have been indicated. In addition, it contains floor plans from Colorado Factory Modulars which states the same home can be purchased whether it is IRC (Modular) or HUD (Manufactured) compliant. I have contacted four different mortgage companies who have stated to me that I had to get Weld County to correct their records before they could send my paperwork to the Underwriters. When I asked about getting an independent appraisal (at an additional cost of about$400.00 to me) I was told that until Weld County Corrected at least the "Property Type: Mobile Home" ,the underwriters would reject it. It really is an internal code for valuation purposes and a common description in their computer system. However, the dilemma falls when an outsider looks at the assessors records and it shows the home as modular, manufactured or mobile, when it is truly a purged manufactured home. Keep in mind the assessor's job is to value property and how ever they list the property for valuation purposes is their choice and in many cases a descriptor assigned by their computer vendor. The problem is when an owner, of a manufactured home that is permanently affixed to land, wants to refinance their home, it is better to say the home is "modular" or "single-family" rather than "manufactured" or "mobile", but the appraiser for the lender must state what the home is: HUD or IRC(codes for construction of the residence) and the lender should refinance based on the fee appraisers physical inspection. The reason that the assessor is not willing to change the records from "modular", "manufactured" or "mobile" is that the property would be valued incorrectly. If it is a purged manufactured home they don't want to value with titled manufactured homes, because typically titled manufactured home owners do not own the land. The county assessors' don't want to value HUD code homes with IRC code homes because it would not reflect the correct value for the property. In Colorado statute, a mobile or manufactured home is considered real property, therefore by law the assessor is to value HUD homes as real property per § 39-5-203, C.R.S. Also, "residential improvements" means a building designed for use predominantly of a place of residence, which includes manufactured, mobile, and modular homes, § 39-1- 102(14.3), C.R.S. This is a long and drawn out answer, but I hope it helps. Please let me know if you need additional information. It was built on a permanent cinder block foundation in accordance with IRC specifications and was inspected (document enclosed). This home was built in April 1999 and has an energy efficiency rating that exceeds most stick built homes. It was also built to withstand a constant wind of 70 mph and can hold a load of 30 psi on the roof(Document enclosed). The pitch on the roof is 4/12 which is standard for most stick built ranch homes. All appliances are energy star. There are GFI plugs installed in each bathroom and in the kitchen. The walls are taped and textured, and has tile, wood and carpet flooring. Smoke alarms are located in two places in this home and there are windows designated as "escape" routes. The home is certified by the Northwest Energy Efficient Manufactured Home Program and Northwest Energy Codes on 4-12-1999 (Document Enclosed). For a comparison, I have enclosed pictures of a stick built home and a picture of my home for a side by side comparison. (Pictures Enclosed). My home is approximately 27 feet by 52 feet. The home was approved by the building inspector on May 10, 2007 (Building Permit enclosed). In accordance with Weld County Code 29-1-20 (enclosed), my home meets all the criteria to be classified as a "single family dwelling". In addition and in accordance with the Tax Assessors Guide, my home should have been considered "new construction" because it was new to Weld County and it did not replace a manufactured home on the same location. The foundation for the home was built and inspected just prior to the house being set (document enclosed). Weld County Code CLEARLY distinguishes between Manufactured and Mobile Homes. Definitions from both the State Statutes and County Codes continually separate Mobile from Manufactured, and more closely align Manufactured with Modular. The Weld County Tax Assessor has apparently ignored the rules of the State and County beginning in 2007. I have also included documentation from the Colorado Manufactured Housing Association and from American Homestar Corporation, the manufacturer of my home and other documentation to support my claim that my home is NOT the same as a 1976 or older Mobile home. From 1995 through 2006, this home was classified Property Type: Residential, Built As: Ranch 1 Story. In 2007, the classification was changed to Built As: Modular, at which time, the tax assessors office ADDED 160 Linear Feet of"Mh Skirting". According to the property owner, the house sits on a permanent foundation, and in fact has never had skirting. Subsequently, the property designation was changed again in 2011 to Property Type "Mobile Home" Built As: "Double Wide" which was again changed in 2011 to "Property Type: "Manufactured Hm" Built As: "Double Wide". State statute states that this property is to be classified a "Single Family Dwelling." Weld County Code 29-1-20 (Enclosed) states that when a home is permanently affixed to a foundation and the title has been purged, that property is no longer considered a manufactured home. What this evidence shows is an inconsistency in the manner by which property in the Glens of Dacono has been and is classified by the assessor's office since 2007. (20) "Manufactured home" means any preconstructed building unit or combination of preconstructed building units that: (a) Include electrical, mechanical, or plumbing services that are fabricated, formed, or assembled at a location other than the site of the completed home; (b) Is designed for residential occupancy in either temporary or permanent locations; (c) Is constructed in compliance with the federal act, factory-built residential requirements, or mobile home standards; (d) Does not have motor power; and (e) Is not licensed as a recreational vehicle. (24) "Mobile home" means a manufactured home built prior to the adoption of the federal act. (25) "Modular home" means a factory-built residential structure. (26) "Owner" means the owner of a manufactured home. NOTE: Applicants for building permits for manufactured homes are advised that the definition for manufactured homes, as set forth in Chapter 23 of this Code, is the following: Manufactured home means a single-family dwelling which: is practically or entirely manufactured in a factory; is not less than twenty-four (24) feet in width and thirty-six (36) feet in length:is installed on an engineered permanent foundation in compliance with ANSI A225.1, 1994, Manufactured Home Installations, Appendix C; has brick,wood or cosmetically equivalent exterior siding and a pitched roof; and is certified pursuant to the National Manufactured Housing Construction and Safety Standards Act of 1974, 42 U.S.C. 5401 et seq., as amended. A manufactured (mobile) home shall not be allowed to deteriorate to the condition of a derelict manufactured (mobile) home. "Manufactured hones meeting this definition qualify as single-family dwellings,under Chapter 23 of this Code. All other manufactured homes are treated as mobile homes under Chapter 23 whose use is limited to certain zone districts and may be required to obtain zoning approvals issued in accordance with Chapter 23, Article IV, Division 3 of this Code prior to the issuance of building permits. (See Section 29-7-60) Manufactured/Modular Hybrid Homes Defined Manufactured/Modular Hybrid homes are also known as "on-frame" modular homes. These are typically built by manufactured home companies' when they build to the minimum local and state codes so that they can market their homes as modular. They are not true manufactured homes, nor true modular homes. These homes are typically still built on permanent black steel frames. Hybrids are typically built with lower quality materials and are therefore more affordable, and they can be sold & financed as "real property" such a modular or 100% site-built home. However, this is starting to change in many areas - if a home has a permanently attached steel frame, the building permitting offices are starting to take notice and consider them manufactured homes even though they are code-compliant enough to pass as a modular home. These Manufactured/Modular Hybrid homes, like manufactured homes, are typically only.bpilt as ranch homes and can come in one, two, or three sections. Hybrid homes can also be built as cape cods, but not two stories due their steel frames. 7.14 Line E - New Construction Certify the assessed value of taxable real property improvements newly constructed in the previous year and new personal property connected with the new construction. New construction includes remodels and additions,.A manufactured home may be considered new construction if it is new to the county and is not replacing a manufactured home that previously existed at the same location. For state assessed properties, use the new construction amount listed in the"5.5%Limit"column on the Notice of Valuation. • For residential properties, the value of the remodel or addition must be determined by the market approach to value. If the structure change results in added value to the improvement, it is reported as new construction. For structures that take longer than one year to complete, two options exist for reporting the value of the new construction. Option one: report only that portion of the value of the structure completed each year as new construction. Any portion of the value of the structure that was reported as new construction the previous year is not reported again. Option two: report the full value of the new structure as new construction when the structure is 100 percent complete. Line F - Increased Production of Producing Ming Certify the increased assessed valuation due to the increased volume of production of a producing mine (abstract codes 6110, 6120, 6130, 6140, 6150). Do not certify the increased valuation of a natural resources property. For instructions on classification, refer to Producing Mines Property, in Chapter 6, Property Classification Guidelines and Assessment Percentages. There is no assessment rate applied to producing mines land. The actual and assessed values are the same figure, which is the greater of 25 percent of gross proceeds or 100 percent of net proceeds. The assessor certifies this value automatically; however, before a taxing entity can exclude this from the limit, it must provide evidence showing that the increase causes an increase in the level of services provided by the taxing entity. The impact certification document is obtained from the Division of Local Government. The Division of Local Government recommends that each affected entity file the impact certification document no later than ten days after the certification of values is received. Line 6 — Annexations/Inclusions Certify the assessed value of taxable real and personal property annexed into the boundary of a municipality, and the assessed value of taxable real and personal property included within the boundary of a special district. The amount is certified ONLY to the entity that is affected. • If new construction exists within an annexed or included area, the value of the new construction is certified as either new construction OR as an annexation for that taxing entity,NOT BOTH. • The assessed value of the taxable real and personal property within the annexed or included area is reflected in the "Current Year's Gross Assessed Value"for the taxing entity that included the property in its boundaries. 15-AR-DPT ARL VOL 2 1-84 Rev 01-11 6.7 SPECIAL CLASSIFICATION TOPICS PROPERTY CHANGING USE When the use of a property changes after January 1, the assessment date, the classification assigned to the property as of January 1 remains in place until the following January 1. This includes a class or subclass change mid-year, such as a subdivision plat filed after January 1, a titled manufactured home that moves onto or is removed from a parcel, a single-family residence converted to a retail store, or a structure completely destroyed after the assessment date. For example: • A residential subdivision plat is filed in June of the current year. The plat is processed by deleting the original unplatted vacant land parcel (0550) and creating new parcels for the platted residential lots. The new lots remain classified as unplatted vacant land (0550) for the remainder of the current year. The following January 1, the platted lots are reclassified as vacant residential lots (0100). • A titled manufactured home moves from another Colorado County onto a vacant residential lot (0100) in April of the current year. The land remains classified as a vacant residential lot (0100) for the entire current year. On January 1 of the following year,dhe land is reclassified as residential manufactured home land(1135), and the titled manufactured home is classified as a manufactured home improvement (1235). • A Certificate of Permanent Location, along with an application for purging a Certificate of Title is filed and recorded in June of the current year for a titled manufactured home located on land (1135/1235). The titled manufactured home and land remain classified as 1135/1235 for the current year. On January 1 of the following year, the land and the manufactured home are reclassified as single-family residential 0112/1212). • A single-family residence (1112/1212) is converted to a retail store in February of the current year. The property remains classified as a single-family residence for the entire year and is reclassified the following January 1 as commercial merchandising property(2112/2212). • In October, a duplex (1115/1215) is completely destroyed by fire. The property is classified as a duplex for the entire year. If the parcel is unimproved the following January 1, the property is reclassified as a residential lot (0100). Exceptions to the rule include real property that changed taxable status after January 1 and the classification of land when a structure is assessed as omitted property. (The omitted structure was in place on January l; therefore, the use of the land must correspond.) PARTIALLY COMPLETED STRUCTURES Structures (improvements) that are partially complete on January 1 are classified according to their intended use when completed. Minimally, a structural foundation or support system such as manufactured home tie-downs or footers must be in place as of January 1 for the property to be reclassified from vacant land. Classification guidelines for foundations that remain after structures have been destroyed are provided in the following section, Destroyed Structures. 1S-AR-DPT • ARL VOL 2 1-84 Rev 04-11 3.13 July 1, § 39-5-132(2)(a)(I)(B), C.R.S. The classification of the land is based on its status on the January 1 assessment date, which is typically vacant land, unless the newly constructed building is a residential unit. If the newly constructed building is a residential unit and if the land was classified as vacant, the land is reclassified as residential and the assessment rate applied to the land is based on the residential classification, § 39-5-132(2)(c), C.R.S. ARL Volume 3, LAND VALUATION MANUAL, Chapter 4, Valuation of Vacant Land Present Worth, provides procedures for present worth valuation. In the procedures, it directs that the present worth value is applied only to vacant land. Once a building is on the land, present worth valuation does not apply; thus, the Division suggests the present worth valuation be removed when the land classification is changed to residential due to the installation of a residential improvement. Taxpayers must be mailed a notice of actual valuation that provides the January 1 value, the prorated valuation of the building, and the total valuation for the entire year. Protests will be heard the following May, at which time the owner can address both valuations, § 39-5-132(2)(a)(I)(C), C.R.S. A special report must be filed with the county commissioners by August 25 of each year showing the amount of growth for that year, § 39-5-132(3), C.R.S. MANUFACTURED HOMES TERMINOLOGY Manufactured Home Built to Department of Housing and Urban Development (HUD) standards, manufactured homes are typically placed on a temporary foundation and titled. Manufactured homes can also be placed on a permanent foundation and never titled. Titled manufactured homes may or may not have the axles and wheels in place. For structural reasons, the 1-beams must be left in place, even if the home is placed on a permanent foundation. Manufactured homes have a red HUD plate on the left rear side of each section. Definitions. Mobile Home Many mobile homes that were built to American National Standards Institute (ANSI) standards are typically placed on a temporary foundation and titled. .Manufatturers stopped making mobile homes in 1976. Modular Home Modular homes are factory built to standards set by International Residential Code (IRC), and International Building Code (IBC) for non-residential property. Prior to 2003, the standards were set by Uniform Building Code (UBC). Modular homes are typically placed on a permanent foundation and not titled. I-beams may be used during transport for support; however, they are removed when the homes are set. Modular homes are identified by a silver plate located under the kitchen sink. Definitions. (8.3) "Modular home" means any preconstructed factory-built building that: (a) is ineligible for a certificate of title pursuant to part 1 of article 29 of title 38, C.R.S.; (b) is not constructed in compliance with the "National Manufactured Housing Construction and Safety Standards Act of 1974", 42 U.S.C. sec. 5401 et seq., as amended; and (c) is constructed in compliance with building codes adopted by the Division of Housing in the Department of Local Affairs. §39-1-102, C.R.S. Factory Built Home This is another term for modular home. Panelized Home Panelized homes are modular homes consisting of packaged components that are assembled on site. They are also built to IRC/IBC/UBC standards. Camper Trailer Camper trailers are wheeled vehicles without motive power that are designed to be drawn by motor vehicles over public highways. They are used for temporary living or sleeping accommodations. Camper trailers may have a Recreation Vehicle Industry Association (RVTA) sticker designating them as recreational vehicles and is located inside the door to the trailer. A camper trailer generally has a license plate issued to the owner by county motor vehicle. Multipurpose trailers and trailer coaches are also considered temporary living or sleeping accommodations. 15-AR-DPT ARL VOL 2 1-84 Rev 01-11 American Homestar Corporation, one of the leading producers of site-assembled manufactured housing in the United States, was forced to declare Chapter 11 bankruptcy in early 2001, due to an industry-wide slump. Reorganization ensues, and the company hopes to resume its design, construction, and marketing of pre-constructed homes. Manufactured homes are complete single-family housing units fabricated in sections,,or 'floors.' Constructed in a factory and then trailered to a site of their owner's choosing, they offer amenities comparable with those of site-built homes.Although manufactured homes were once the focus of ridicule within the housing construction industry, in the 1990s they managed to shed their association with the tacky,disordered trailer parks of the 1960s and 1970s.
