We request that the Board reduce the required application fee from $7,220 (based on the entire area of the parcel at 121 acres) to $5,500 (based on the pit boundary of 35 acres.) We understand that the USR boundary encumbers the entire parcel boundary; however, the pit boundary is set at 35 acres. The pit boundary cannot be changed without amending the Construction Materials Regular (112) Operation Reclamation Permit through the Colorado Division of Reclamation Mining and Safety (DRMS). Per DRMS requirements the pit boundary must be staked prior to commencing mining operations. We respectfully request this reduction in fees.
