RE: ACTION OF THE BOARD CONCERNING BCV #1100084 AGAINST MID PLAINS
INVESTMENT LLC AND RUSSELL RICHARDSON FOR VIOLATION OF THE WELD
COUNTY CODE
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, Mid Plains Investment, LLC, and Russell Richardson, BCV #1100084, are
allegedly in violation of the Weld County Code, and
WHEREAS, despite efforts by the Planning staff to resolve said matter, the violation has
not been corrected, and
WHEREAS, on the 13th day of September, 2011, a public hearing was held before the
Board of County Commissioners for the purpose of hearing testimony relating to said violation,
and
WHEREAS, Mid Plains Investment, LLC, and Russell Richardson were not present or
represented at said hearing, although all parties were notified of said hearing by Department of
Planning Services staff, and
WHEREAS, the Board deems it advisable to bring legal action against those individuals
named above to correct said violation.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of
Weld County, Colorado, that the Weld County Attorney be, and hereby is, authorized to proceed
with legal action against Mid Plains Investment, LLC, and Russell Richardson to remedy the
violation of the Weld County Code, and any other persons occupying the properties, any
persons claiming an interest in the properties, and any persons acting in active concert with the
identified parties.

OTHER CASE HISTORY:
08/25/2011 E-Mail Received Received e-mail complaint of no electricity at 1401 East 18th Street
which is a multi unit dwelling (previously a motel). Some units are
powered by generators. There are children living in the complex.
08/26/2011 E-Mail Received Received e-mail, electricity was shut off due to non-payment of Xcel
Energy bill and possible pirating of electricity. Gas meters have
been removed due to possible leaks.
08/26/2011 Phone Call Jonathan Gesick
Conversation with Xcel Energy concerning 1401 E 18th St. (electric)
I talked with Jerry, he explained to me that the tenants had somehow
bypassed the electrical meter and pirated power. Xcel went out to the site
to remove the meter. He wasn't sure exactly when but said it was about
2-3 months ago. Jerry was going to have Judy with credit collections call
me. (she never called)
Conversation with Atmos Energy concerning 1401 E 18th St. (gas)
I talked with Margaret ID#26547, she explained that
the customer had tampered with the meter on Unit 16. The customer had
fixed the problems and they reset the meter on May 31st, 2011.
The other units had their meter pulled on June 20th, 2011 for tampering
and non-payment of their bill. Atmos required them to have an inspection
completed by Weld County and an air test on the lines to check for leaks.
Atmos came back out a second time and required the same thing on July
5th, 2011. They have an outstanding balance due at Atmos of
$3,340.72.
08/26/2011 Phone Call Jonathan Gesick
Phone conversation with Julie"Christine" Yates.
Christine called our office to talk about the requirements of the permit that I
requested she pull for the work that has been done without a permit. I
explained to her that our office has been discussing the situation at
1401 E 18th St. I told her that we were in the process of determining if
the building would require vacation of the units due to the lack of electricity,
gas, hot water, and violations. She responded casually saying that she
would like some of the tenants evicted anyway. I asked for her phone
number and she gave me 970-573-0286. I asked what prison the owner
was in so we could serve him a notice and order when and if it came to
that, she said he was in the Bent County Correctional Facility. She said
she had the power of attorney for all of his financial and legal matters but
not medical. I informed her that Human Services would be involved due
to children living in these conditions and that they would be contacting her.
I asked her about her plan to solve the issues and she said that they are
working on getting rent or maybe getting a loan from the owner's father to
do the improvements and pay the utilities so the gas and power could be
turned back on. I told her that Frank and I would be out today around
2:30 to walk the property again and would likeher to be present. She
agreed to meet us then.

BUILDING VIOLATION CASE SUMMARY
08/26/2011 Phone Call I contacted human Services regarding the living conditions at 1401 E 18th
St. They sent an investigator out to look at the property and are working
on the issue.
08/30/2011 Phone Call Research revealed owner is in the Bent County Correctional Facility.
Phone call to Brad Jones at the Bent County Sheriffs Department to
make arrangements to have letter advising this case is scheduled
with the BOCC served to the owner.
09/02/2011 Office Visit The tenants from Unit 16, Damien Combs and April Ward, came to
the office today and met with Jonathan Gesick, Frank Piacentino,
and myself. They would like to have the utilities changes into their
names so they can resume service and continue to live in the unit as
it has separate electrical and gas meters. They have been
successful in putting the Atmos Energy and Waste Management
bills in their name but say the Xcel Energy bill is very expensive and
the company will not separate the amount out to just Unit 16. While
here, a phone call was placed to Xcel Energy and Jonathan Gesick
spoke to them and was able to work out a payment arrangement so
that when the first installment is paid, the electric meter will be
re-installed. There is only one violation in this unit which they say
they are able to remedy today. Jonathan will verify that.
09/06/2011 Phone Call April Ward called on 9/6/11 at 2:25PM to explain her situation with Xcel.
She told me that they have paid the upfront fees to get the meter in their
name and Xcel came out to set the meter. When Xcel arrived they had
concerns that, if they set the meter, it would also power the other units so
they chose not to set the meter. She asked me what they should do. I
told her to have an electrician come out and investigate the issue and write
them a letter stating the power and wires are totally separate. She said
that is what she would do. I also told her to call me if they have any
problems with that.
09/07/2011 Phone Call Phone call to Christine Yates, manager. She says she has a Power
of Attorney and I asked her for a copy of that. She will fax it to me.
She says she is leaving tomorrow for 3-5 months and there is no
one who can step in as the manager. She briefly spoke with Russell
Richardson regarding the building issues.
Christine states she has spoken with the owners mother and asked
for a loan to help pay for the necessary contractors and repairs.
Mrs. Richardson stated that one of the former tenants took Lee
Richardson, brother of the owner, to Court and, as a result, the
family can not be involved in any way.
Christine states this is an"overwhelming mess"and there is no
budget so they will probably have to board up the structures.
09/07/2011 Phone Call Phone call from Brad Jones of the Bent County Sheriffs Department.
Russell Richardson was served the BOCC letter and pictures on
Friday, September 2, 2011. Brad has also received a letter from the
Health Department and that will also be served as soon as possible.
09/07/2011 Received Certificate Received Certificate of Service from Brad Jones, Deputy, Bent County
Of Service Sheriffs Department, stating letter and attached photos were served
to Russell Richardson on September 2, 2011.

09/07/2011 Phone Call Phone call to the Bent County Correctional Facility to attempt to set up a
conference call with Russell Richardson. I was told I need to speak with
Mr. Hernandez, the case manager. I left a message for him to call me.
09/07/2011 Phone Call Phone call to Mr. Hernandez to request a conference call with Mr.
Richardson to discuss the violation case prior to the BOCC Hearing
on September 13. He will verify if that is possible and call me back
this afternoon.
INSPECTION SUMMARY:

I arrived at 1401 East 18th Street at 2:23 PM. I met and talked with Ted who stated
he lives in unit#15. He then later told me that he did not live there. I asked Ted
about the situation and he explained to me that many of the tenants were moving out.
The owner is in prison and no one is paying their rent and that is why
they shut the power off. He also told me that the gas line was drilled out at the
shut off valve which allowed them to get free gas. The service company found
out and pulled the meter. There are 14 units on the property. I was able
to walk through some units to inspect the life safety issues. I met the manager,
Julie"Christine"Yates, and walked through 7 units including the mechanical
room, laundry room, and carport. I asked for her permission and she guided me
through the units. I was with her the entire time I was in each unit and explained
the violations that I found.
Unit 15-Storage/Shop-The bathroom has been removed and the pipes have
towels pushed in them due to the smell. There are outlet covers missing and
outlets hanging out of the wall. No smoke detectors were installed. Ted told me
that he was going to put a cot in the room and sleep there.
Unit 12-Managers Unit-Smoke detector and CO detector required.
Unit 11-Smoke detector and CO detector required.
Unit 2- I did not have access to the unit but the manager told me they had a
double key lock bolt. They will need to replace the hardware with a turn style
on the inside and keyed on the outside.
Unit 16-There is a separate gas and electrical meter to this unit. The gas was on and
electrical turned off. I had the owner turn the gas off to the furnace as a
precaution. A gas vent hood that extends to the exterior to
vent the gas range needs to be installed. Smoke and CO detectors required. Repair
electrical violations in the bathroom, on the porch and in the crawlspace.
Laundry Room-Vent drains for washer to exterior or install an air admittance
valve. Repair the ceiling. Drywall is falling off and there are multiple holes. There
are multiple electrical violations.
Carport-Open electrical boxes were found, install weather resistant materials
and protect NM cable with conduit.
Unit 17(Trailer 1958?- Electrical wiring violations including splices and no protection
for NM cable. Install smoke and CO detectors.
Mechanical Room- Need to rewire to NEC, multiple electrical and mechanical
violations. Repair drywall in ceiling to maintain fire rating. Install combustion air
to mechanical code requirements. Install venting for hot water heaters. Boiler is
torn apart and needs to be installed to the Mechanical code. The boiler is being used
to heat all the units in the main building so there is no heat in these units.

Inspection Result Comments Frank Piacentino and I (Jonathan Gesick)walked the property to review the previous
days inspection and to look at the septic. We met Julie"Christine"Yates at the
property and she guided us through. Upon walking the property a second time we
found more electrical, plumbing, and mechanical issues. We asked for Christine to
give us a plan of how she will accomplish getting the power back on and correct the
violations. She didn't seem to quite know at this time. We asked her to call
us on Monday to discuss the issues further.
The additional violations are no venting for the gas appliance(range) in the
units. The ranges must be vented according to the manufacturers instructions.
We found more electrical work on Unit 18 including an outlet ran through a
basement window without protection. There is an open cleanout outside the
laundry room that is open directly to the sewer. We again informed them that
they will need to obtain a permit for the work; but that they can have their
maintenance men (Ted and Damien) repair the vents for the hot water heaters
and fix the flooring in the mechanical room. They will still need to have a
contractor repair the boiler and electrical issues.

on the 13th of September, 2011. She signed the document in front of myself and
Ted who lives in Unit#11.
Building Code Inspection 09/02/2011 Noncompliance Jonathan Gesick
Inspection Result Comments I served the tenants the notices for the BOCC hearing to determine
the outcome or the next step that will be taken to resolve the violations that are
present at the property. While I was there I talked to Brian Bunting and looked
at his home which is Unit 18. They have multiple electrical and mechanical
violations in the basement mechanical room, including but not limited to the
following:
No cover on the panel. Open junction boxes with exposed copper wire.
Propane tank hooked to a natural gas water heater. The flue vent for the hot
water heater is not installed correctly to any riser vent, it is stubbed into the
chimney and loose. They will need to drop a vent down the chimney to exhaust
the fumes. Smoke detectors and CO detectors need to be installed throughout the
home. This is a life safety concern, especially since the violations can
cause CO poisoning and are a fire hazard. They will need to install GFCI
protection in the bathrooms, kitchen, and exterior. There is unprotected wiring
in the entry that will need to be removed. There is wiring on the porch with
exposed conductors and wire that is against a sharp metal surface that is
cutting in the conductor that will fail and may create a fire. The septic is
overflowing and in a non-working condition. I contacted Mary in the Health
Department and she is going to look into it today.

Dear Occupant/Tenant:
The Weld County Building Department recently received a complaint concerning the lack of gas and
electricity to the structures here at 1401 East 18th Street. As a result of the complaint, staff from the
Department completed site visits and noted multiple building code violations and possible
health/life/safety issues, some of which need immediate attention. These conditions exist as a result
of lack of proper maintenance and repairs by the owner.
We wanted you to be aware that the Department has advised the owner of the property to appear
before the Board of County Commissioners on September 13, 2011, to determine what action will be
taken to correct and/or remedy the issues. As a result, there is a possibility all units will be ordered to
be vacated until all code issues are remedied. Should such an order be issued the building would
likely be secured so that you cannot re-enter.
In the event the structures are ordered to be vacated you may be asked to leave on very short notice—
as short as a few hours. Please plan accordingly. I have listed several assistance resources you can
contact for possible housing:

Dear Mr. Richardson:
The property referenced above is in violation of the Weld County Code. I have scheduled a meeting
with the Board of County Commissioners on September 13, 2011, at 10:00 a.m., to consider the
violations. The property is in violation of the following Sections of the Weld County Code:
Section 29-3-10 "Building permit required."
Section 29-3-60 "Maintenance."
Section 29-11-40 "Dangerous buildings.
Section 29-11-50 "Hazardous, defective, or unsafe systems or equipment."
Section 29-11-70 "Authority to condemn systems or equipment."
Following inspections of the property at 1401 East 18t°Street, building staff has observed the following
conditions that were found to render the structures to be dangerous and/or unsafe:
General conditions include but are not limited to:
• Unsafe or faulty wiring that is not in conformity with the NEC (National Electrical Code)
• Numerous alterations to electrical, heating, and plumbing have been made without appropriate
permits
• The structures have no hot water—Section 607 of the IPC (International Plumbing Code)
• No heat source and/or electricity as required by code — natural gas and electrical have been
tumed off by Atmos Energy and Xcel. (except Unit 18)
• Heating systems have been removed. Section 1204 IBC (International Building Code)
• Sewage disposal system has been altered and does not appear to be functioning properly.
• The exterior lights have no covers or bulbs and are not rated to be installed outdoors.

Specific conditions/violations include but are not limited to:
Unit 15: the bathroom has been removed and the pipes are stuffed with towels in an attempt to prevent
the odor, outlet covers missing, outlets hanging out of the walls, no smoke detectors installed.
There is a possibility this is being used as a bedroom.
Unit 12: (managers unit)—no smoke and/or carbon monoxide detectors
Unit 2: did not gain access but the manager stated it has a double key lock bolt, the hardware needs
to be replaced with a turn style on the inside and keyed on the outside.
Unit 18: this unit has a separate gas and electrical meter, gas was on and electrical off. Inspection
personnel required gas to be turned off as a precaution. A gas vent hood that extends to the
exterior to vent the gas range shall be installed, smoke and carbon monoxide detectors
installed, electrical violations in the bathroom, porch, and crawlspace.
Laundry room: vent drain for washer to exterior to install an air admittance valve, repair the ceiling,
drywall is falling off and there are multiple holes, multiple electrical violations.
Carport: open electrical boxes, install weather resistant materials and protect NM (non-metallic) cable,
install smoke and carbon monoxide detectors.
Mobile home: electrical violations including splices and no protection for NM (non-metallic) cable, install
smoke and carbon monoxide detectors.
Mechanical room: multiple electrical and mechanical violations, need to rewire to 2008 NEC (National
Electrical Code), repair drywall in ceiling to maintain fire rating, install combustion air to
mechanical code requirements, install venting for hot water heaters, two boilers and copper
piping have been removed or disconnected. The boiler is used for heating to all units in the
main building. A licensed mechanical contractor shall perform the required, work/repairs.
To bring your property into compliance:
You must obtain appropriate building permits. An application must be submitted and processed, fees
paid, the permits issued, and all inspections completed or all units on the property vacated and the
buildings secured and maintained against entry.
This meeting will take place in the County Commissioners Hearing Room, Weld County Administration
Building, 1150 O Street, Greeley, Colorado. It is recommended that you or a representative be in
attendance at this meeting to answer any questions the Board of County Commissioners might have
regarding the violation.
The Department of Building Inspection will be recommending that the Board of County Commissioners
authorize the County Attorney to proceed with legal action to remedy the violation. If you have any

Dear Mr.Richardson:
In response to a complaint,your property located at 1401 E 18th St,Greeley,CO was investigated on
September 2,2011 by Mary Evett,an Environmental Health Specialist of this Department. The
inspection revealed that your septic system appears to be falling. Specifically,we observed sewage
surfacing from a broken sewer pipe and sewage overflowing from the septic tank for the single family
residence. In addition,there are several septic tanks on the north side of the motel that are missing lids
and the openings have been covered with plywood or pallets.One of the tanks is used for the lift
station;however,the pump has been removed.
Please be advised that the above described situations are In violation of Section 30-2-10 of Weld
County Code pertaining to Individual Sewage Disposal Systems,as follows in part:
Sec 30-2-10 'General Sanitation Requirements: The owner of any structure where
people live,work,or congregate shall insure that the structure contains an adequate,
convenient,sanitary toilet and sewage disposal system in good working order. Under
no condition shall sewage or effluent be permitted to be discharged upon the surface of
the ground,..."
Also be further advised that:
Colorado Revised Statute Section 25-1-613 provides the following:
'The Board of Health shall examine all nuisances,sources of filth,and causes of sickness,
which,in its opinion,may be injurious to the health of the inhabitants,within its own town,city
or county...,and it shall destroy,remove,or prevent the same as the case may require."

Be advised that you have ten(10)days from receipt of this notice to correct the aforementioned
violations.Failure to comply with the above shall result In further legal actions as specified in Section
30-8-10 of Weld County Code pertaining to Individual Sewage Disposal Systems as follows, in part:
30-8-10 B.Section 25-10-113,C.R.S.Penalties
1.Any person who commits any of the following acts or violates any of the provisions of this
Section commits a Class I petty offense,as defined in Section 18-1-107,CRS.:
a. Constructs,alters,installs,or permits the use of any individual sewage disposal system,
without first having applied for and received a permit as provided for In Sections 25-10-105
(1)(f)or 25-10-106,CRS.

Dear Mr. Richardson or representative of Mid Plains Investments,LLC:
In response to a complaint, your property located at 1401 E 18th St, Greeley, Colorado
was investigated on July 8,2011,by Mary Evett an Environmental Health Specialist of this
Department..The inspection revealed that your individual sewage disposal system (septic
system)appears to be failing. Specifically, we observed sewage surfacing from a broken
sewer pipe to the east of the single family residence on the property. In addition,the septic
tank(s) lids are constructed of a material that is not watertight(wood),and the lift station is
not operating properly.
Please be advised that the above described situation is in violation of Section 30.2-10 of
Weld County Code pertaining to Individual Sewage Disposal Systems,as follows In part:
Sec 30-2-10 `General Sanitation Requirements: The owner of any structure where
people live,work, or congregate shall insure that the structure contains an
adequate,convenient, sanitary toilet and sewage disposal system in good
working order. Under no condition shall sewage or effluent be permitted to
be discharged upon the surface of the ground,....`
It is the intention of this office to assist and cooperate with you in gaining compliance with
this issue;however, we have no discretion in this matter if you fall to correct this violation.
Please contact me immediately to discuss a course of action. If I do not hear from you
within ten(10)days,from receipt of this letter,our office is obligated to pursue legal action
as specified in Section 30-8-10 of Weld County Code pertaining to Individual Sewage
Disposal Systems.
Please note that a permit is needed from this office to construct or after a sewage disposal
system. Forms may be obtained from this office or at the County website listed above.

2" PVC pipe in the tank that the pump once was connected to. Pallet is the only cover over tank.
