RE: APPROVAL OF CONDITIONAL USE PERMIT NO. 37 : 78 : 5 FOR A MICRO-
WAVE RADIO TOWER ON A TRACT OF LAND LOCATED IN THE NORTHEAST
QUARTER OF SECTION 5, TOWNSHIP 6 NORTH, RANGE 62 WEST OF THE
6TH P.M. , WELD COUNTY, COLORADO.
WHEREAS, the Board of County Commissioners of Weld County,
Colorado, pursuant to Colorado statute and the Weld County Home
Rule Charter, is vested with the authority of administering the
affairs of Weld County, Colorado, and
WHEREAS, the Board of County Commissioners of Weld County,
Colorado held a public hearing on the 11th day of October, 1978
at the hour of 9: 00 o'clock a.m. for the purpose of hearing the
application of Jim Gilbert for the granting of a Conditional Use
Permit for a microwave radio tower on the following described
real estate, to-wit:
A tract of land located in the Northeast quarter
of Section 5, Tbanship 6 North, Range 62 West of
the Sixth Principal Meridian, Weld County, Colo-
rado. Being more particularly described as fol-
lows:
Beginning at a point on the North line of said
Northeast quarter, said point being located
1759.39 feet West of the Northeast corner of
said Northeast quarter:
Thence South 416.00 feet to a point;
Thence West 416.00 feet to a point;
Thence North 416.00 feet to a point on the North
line of said Northeast quarter;
Thence East 416.00 feet to the point of beginning;
Containing 3.97 acres more or less.
Subject however to a county road easement to a
depth of 30 feet along the full length of the
Northerly boundary.
Basis of bearings:
Assumed West along the North line of Section 5.
WHEREAS, the petitioner was present, and
WHEREAS, evidence was presented in support of the grant of
the Conditional Use Permit for a microwave radio tower, and
WHEREAS, Section 3. 3.D. of the Weld County Zoning Resolution
authorizes such a use in an Agricultural District on the grant of
a Conditional Use Permit by the Board of County Commissioners, and
WHEREAS, the Board of County Commissioners of Weld County,
Colorado, heard all the testimony and statements of those present,
has studied the request of the petitioner and the recommendations
of the Weld County Planning Commission and all of the exhibits and

evidence presented in this matter, and having been fully informed
and satisfied that the request for a Conditional Use Permit for
a microwave radio tower on the hereinabove described real estate,
complies with all of the conditions as set out in Section 3. 3 .D (2)
of the Weld County Zoning Resolution.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Com-
missioners of Weld County, Colorado, that the application of Jim
Gilbert for a Conditional Use Permit for a microwave radio tower
on the hereinabove described tract of land, be and hereby is,
granted, subject to the development standards contained in the
Conditional Use Permit.
BE IT FURTHER RESOLVED by the Board of County Commissioners of
Weld County, Colorado, that the reasons for approval contained in
the Planning Commission Recommendations dated October 3, 1978 be,
and hereby are, incorporated as the findings of fact of the Board
of County Commissioners in this matter.
The above and foregoing Resolution was , on motion duly made
and second, adopted by the following vote on the 11th day of
October, A.D. , 1978.

DEVELOPMENT STANDARDS
1. The permit ed uses on the hereon described parcel shall be
the facilities as shown for a microwave radio tower not to
exceed 250lfeet in height ; a 8' xis! equipment building; and
all uses p rmitted by right under Section 3.3 B. of the
Weld County Zoning Resolution.
2. Installation of the radio tower shall conform to Federal
Aviation Administration standards- and/or regualations
regarding air safety and lighting. and any other applicable
rules and regulations of governmental bodies having
jurisdiction on the premises.
3. The CUP area shall be maintained in--such a manner so as to
prevent soil erosion, fugitive dust, and the growth of
noxious weeds.
4. All phases of the operation shall comply' with all County and
State Heal h Standards and Regulations-pertaining to air
quality, water quality, noise emission, and sanitary disposal
systems.
5 . The site s all be enclosed by a 3 strand barbed wire fence .
6. All construction, electrical work and fabrication shall be
done in accordance with the Weld County Building Code.
7. The appearlIance of the facility shall be maintained in a neat
and order]Jy condition through periodic painting and
maintenan Ie.
8. All acces es shall have the. approval of the Weld County
Engineering Department . All accesses shall be constructed in
accordance with the recommendations and/or requirements of
the Weld County Engineering Department .
9. The Conditional Use Permit shall be limited to the plans shown
hereon and governed by the ,Development Standards stated above
and all applicable Weld County Regulations. Any material
deviations from the plans and/or Development Standards as
shown or stated above shall require the approval of an amend-
ment to t e Conditional Use Permit by the Planning Commission
and Board of County Commissioners before such changes from
the plans and/or Development Standards shall be permitted.
Any other changes from the plans and/or Development Standards
shall be filed in the office of the Department of Planning
Services.

October 3., 19178 , at 1: 30 p.m. in the. Weld County Centennial Center

As a .quorum was present, the meeting proceeded as scheduled. The
minutes of the September 19, 1978, meeting were approved unanimously.

' SUBJECT: Amendment to SUP-348 - Oil Field Fluids Disposal Site
APPEARANCE: Stan Rech
DISCUSSION: This request was continued from the September 19, 1978,
meeting for additional information and a field trip to the property.
The' field trip was held the morning of October 3, 1978 . Mr. Rech . '
again briefly explained that the request is for the addition of six
more tanks and a gel water pit for the benefit of the members of the
Planning Commission. There being no questions or comments at this '
time, Chuck Cunliffe read the staff' s comments . The Planning staff
was unable toI reach a recommendation regarding this application . Some
discussion followed regarding sealing of the gel water. Mr. Hiatt
expressed concern with the feasibility of property line monitoring
wells being placed there now for water quality and results from the
tests. John Hall of the Weld County 'Health Department responded by
stating that tests have been conducted on local domestic wells in . the
area and have fairly good data on them. These tests were taken at the
request of thle County Commissioners . These wells will most likely
be monitored on a six month to a year basis for current data. Mr.
Kiefer questibbned what would he the effect of adjacent property on the
surface. Mr.l Rech- responded that all that - exists there now is weeds
and sage brush. Discussion followed regarding the possible damage
which could be caused by the gel -water pits . Adolph Anderson, adjacent
property owner, said he was concerned with the proposal not being
bonded in case something did happen. - IIe also stated that his property
is already snowing signs of seepage.

MOTION: Be it therefore resolved to deny the application because
there is not enough data to support the. request . Motion by Jim
Gilbert, seconded' by Jerry Kiefer. A vote of "aye" was cast by
. Chuck .Carlsoll, Percy Hiatt, Fred Otis, Jerry Kiefer, and Jim Gilbert .
Mr. Suckla abstained from voting. 'Motion-carried for denial .

' also desires to construct a finishing, barn. There being no questions
• at this time, Chuck Cunliffe read the. staffs recommendation for
approval and the'. Development Standards. • Mr. Ottinger stated he was
in 'agreement with the. Development Standards. At this time Vern Lawhead,
surrounding property owner, expressed his concern because of -the- odor
• and dust problem which could be created. Mr. Lawhead is a neighbor
• to a hog farm- to the east and does not wish to put up with more odor •
and dust, Harold Herbst expressed the same concern . John Hall of
the Weld 'Courty Health Department stated that there are standards which
must be met in regard to odor with the use of a scentometer which
measures air1quali.ty . This standard must be met by the applicant.
Discussion followed.. Gary Knapp, also a surrounding property owner,
expressed his concern regarding the odor and fly problem as well as '
the problem with the pits leaking and seeping onto adjacent property. .
He was also concerned with the distance from the proposed location
. to existing residences and the noise that hogs create when feeding.
Diahe Walker also expressed concern with odors . Discussion then
• . followed regarding the distance to existing residences.
MOTION: Be it therefore . res'olyed to continue the hearing; to October
17, 1978, to verify the location from the proposed operation to '
• existing residences and a report on noise pollution when- hogs are
feeding. Motion by Jim Gilbert , seconded by Jerry Kiefer. A vote of -
"aye" was cast by Chuck Carlson, Percy Hiatt , Fred Otis, Jerry Kiefer,
Jim Gilbert , and Frank Suckla. Motion carried.

sugar beet receiving station. Carolyn Bu.lthaup, surrounding property
owner, state she has no quarrel with the proposal , but would rather
have it left as agricultural ground. Lowell Geoke, manager of the
Loveland/Longmont District of Great Western Sugar, commented that he
felt this wasp an ideal location for this industry as there are good .
• facilities already existing there for the operation and the population
is sparse. No further discussion .
MOTION: Be it therefore resolved to recommend denial based on the
staff ' s recommendation to the Board of County Commissioners . Motion
by Fred Otis, seconded by Jerry Kiefer. A vote of "aye" was cast by
Percy Hiatt , Fred Otis, Jerry Kiefer, Chuck Carlson abstained from
voting and Jim Gilbert cast a "no" vote . Motion carried for denial . •

DISCUSSION:. Mr. Connell stated that this request is for property that
is presently in pasture and in not an area for future agricultural
use orirrigated farming. There are a number of small acreage units
• in the area and a mobile home park acress the road. Water .is available '
' for the property and also sanitation facilities . This proposal 'is
for one to three acre parcels. There being no questions or comments
at` this time, Tom Honn read the staff ' s recommendation for approval .
Chairman Carlson expressed concern with regard to the letter received
from the Soil' Conservation Service about the soil in the area providing
. • a severe deficiency for the construction of dwellings _with or without
basements . . 1r. Connell stated :he fully understood this . •

of County Commissioners based on the staff ' s recommendation . . Motion

a '15 megawatt power plant near Wheatland, Wyoming. This will deliver
power to norilheast Colorado. This station is one of 20 stations that
• will be constructed. There is presently a station approximately 2z
• miles south . There being no questions or comments, Tom Bonn read the
staff ' s recommendation for .approval and the Development Standards .
MOTION ; Be ift therefore resolved to recommend approval to the Board
of County Gommissioners based on the staff ' s recommendation . Motion
by Jim Gilbert , seconded by Frank Suckla. A vote of "aye" was cast

"The Planning Commission and Board of County
Commissioners shall consider the following in making
their determination in approving or denying a
Conditional Use Permit : Compatibility with the
surrounding area, harmony with the character of
the neighborhood and existing agricultural uses,
need for the proposed use, its effect upon the
immediate area, its effect on future development
of the area and the health, safety and welfare
of the inhabitants of the area and the County. "
This determination is based upon the following:
A. The following referral entities have reviewed this
request and have set forth no objections to it :
1 . Weld County Health Department
2. Weld County Engineering Department
B. The Colorado Geological Survey has set forth no objections
to the request . It has recommended in a letter dated
September 7, 1978, that the applicant consider conducting
a soil and foundation investigation so that the tower
foundation can be properly designed.
C. The West Greeley Soil Conservation District has set
forth no objections to the request . It has been
recommended in a letter dated September 8, 1978, that
the applicant conduct an on-site soil engineering test
to determine adequate design requirements for the
building type being considered by the applicant .
D. To date , our office has not received any opposition from
any of the surrounding property owners.
The Planning Commission recommendation for approval is conditional
upon the following:
1. The attached Development Standards being recommended and
approved for the Conditional Use Permit .
2. No building or electrical permits shall be issued on
the Conditional Use Permit area until the Development
Standards for the Conditional Use Permit have been
placed on the Conditional Use Permit plat and said
plat has been delivered to the office of the Department
of Planning Services.

The following omments are in relation to the request from you for review of
a Conditional Ise Permit for a Microwave Radio Tower by Basin Electric Cooper-
ative to be located in a portion of the NE1 of Section 5, Twp. 6N, Range 62W, -
Weld County, Colorado.
The four acre_ ite, as described in the application, is located on the-soil
type Nunn loam -1 to' 3 percent 'slopes. This soil is considered to have. high • .
potential non-irrigated cropland use, or is prime farmland when adequate irri_
' gation water is available. The soil does have .a moderate to high shrink-;swell,
characteristic which could effect .construction of 1Duildings with slab on grade,
or shallow.foundations. On site soil engineering data should be obtained to
• determine adequate design requirements for the building type being considered. '
Roads 'should be constructed on the contour as much as possible' to minimize the
'water erosion otential. Revegetation of disturbed areas is recommended to
. reduce the pot ntial wind .erosion hazard. .

Attachment to Conditional Use Permit Application
For Basin Electric Power Cooperative
The planned microwave radio tower to be constructed in Weld County,
Colorado, is part of a communications system that will protect and
coordinate delivery of bulk electric power into northeast Colorado
from the applicants generating station near Wheatland, Wyoming.
Electri power serving Weld County will be delivered to a power
substation near Ault, Colorado.
This tower site will consist of a 200-250 foot tall guyed galvanized
steel tower constructed on concrete foundations. The installation
will conform to Federal Aviation Administration Standards for Air
Safety and will be marked as required.
Operation of radio equipment will be licensed under the private
operational fixed rules of the Federal Communications Commission.
All electronic equipment will be contained in an 8' x 18' building
which will be located at the base of the tower. The completed site
will be fenced to keep livestock away from the tower, building, and
guy wire anchor points.
Effects on the environment will be minimal as the station contains
electronic radio equipment which causes no noise, odor, or other forms
of pollution. The station will, however, contain a built-in liquid
propane engine-generator set for standby electric power during periods
when electric service is interrupted, such as during major snow and
ice storms. This engine-generator will be indoors and have no noticable
noise or pollution effects.

Water and sewage facilities are not required at this station because
it will be an unmanned facility. The station will be constructed
on undisturbed grazing land at the top of a hill and no drainage
facilities will be required.
We anticipate having employees at this station approximately one day
per month after construction is completed. Construction will be spread
over a ix month period to install all equipment and complete final
testing

1. It is th,e opinion of the Department of Planning Services staff
that thins request is in agreement with the Weld County
Comprehensive Plan in that the proposed use would not appear
to have any 'adverse impacts on the agricultural interests of

B. The Colorado Geological Survey has set forth no objections

STAFF RECOMMENDATION
October 3, 1978
C. The West{ Greeley Soil Conservation District has set forth
no objections to the request . It has been recommended in
a letter dated September 8, 1978, that the applicant
conduct an on-site soil engineering test to determine
adequate; design requirements for the building type being
considered by the applicant .
D. To date, our office has not received any opposition from
any of the surrounding property owners.
The Department of Planning Services staff recommendation for approval
is conditional upon the following:
1. The attached Development Standards being recommended and
approved for the Conditional Use Permit .
2 . No building ,or electrical permits shall be issued on
the Conditional Use Permit area until the Development
Standards for the Conditional Use Permit have been
placed on the Conditional Use Permit plat and said
plat has been delivered to the 'Office of the Department

1 . Contract of purchase between seller and purchaser
dated July 11 , 1973.
2. Lease agreement dated July 11 , 1973, between seller
and purchaser.
3. Lease letter dated July 11 , 1973, between seller and
purchaser.
4. Warranty deed signed by Jesse E. Loyd and Evelyn T.
Loyd conveying Section 5, Township 6 North, Range 62
West of the 6th F.M. , Weld County, Colorado, to Jackson
B. Wells and Albert B. Wells.
5. Quit Claim deed.
You are hereby instructed to carry out the provisions of the con-
tract of purchase as follows:
1. Total purchase price for said land is $64,000.00.
2. Down payment has been made of $14,000.00.
3. Balance of $50,000.00 is due to be paid on the contract
in ten equal annual installments of $5 ,000.00 beginning
July 11 , 1.974 and thereafter until paid in full .
4. The balance of $50,000.00 is to bear interest at the
rate of 6% per annum; interest is to be paid annually on
unpaid balance of principal.
5. The Purchasers shall have the right to prepay the princi-
pal balance plus interest at any time if the holder of
the First Deed of Trust of record will in turn accept
payment in full of the note which is secured by said Deed
of Trust.
6. You ere to collect the annual principal payments plus
interest from the purchasers and pay over said sums to
sellers.
7. Upon payment of $50,000.00 with interest by the purchasers,
you are to deliver the warranty deed to purchasers.
B. Upon payment of $50,000.00 with interest to sellers, you
are to receive from the sellers the note and deed of trust
presently of record against said property. Said note and
deed of trust shall be marked paid and then delivered with
release of deed of trust to the purchasers.
9. Said real estate has been leased by purchaser to Seller for
a period of ten years at $. 1y00o.00 000..,00______payable in install-
ments of $100.00 in advance, with first installment having
been paid. The balance of rent due on said lease, you shall
collect on the 11th day of July of each year during the term
• of the lease , beginning July 11 , 1974 and thereafter from the `,

sellers, Jesse E. Loyd and Evelyn T. Loyd and deliver said
rent to Jackson B. Wells and Albert B. Wells.

10. Any late payment on the contract of purchase shall
draw interest at 127. until paid. Further if any
money is advanced by seller for payment of taxes ,
such money shall draw interest at the rate of 127.
per annum.
11 . Upon refusal by the purchaser to complete the contract
and make the payments as set forth therein, you are
instructed to deliver the quit claim deed to the
sellers.
12. You are instructed that upon the close of the escrow
account , to return the lease contract , warranty deed
and quit claim deed to the purchaser , and further to •
collect from seller the necessary fees for release of '
deed of trust.
