The Weld County Public Works Department has reviewed this proposal. This project falls under the Use by Special Review Standard, Weld County Code, Chapter 23, Article II, Division 4, Section 23. Staff comments made during this phase of the Use by Special Review process may not be all-inclusive, as other issues may arise during the remaining application process. COMMENTS: WCR 25 is a local paved road and requires a 60-foot right-of-way at full build out. There is presently a 60- foot right-of-way. This road is maintained by Weld County. Pursuant to the definition of SETBACK in the Weld County Zoning (23-1-90), the required setback is measured from the future right-of-way line. This parcel is located within the FEMA mapped Zone A 100-Year Floodplain and/or possibly the floodway. Weld County Code prohibits the construction of buildings within the floodway. The applicant has received conditional approval for AmFHDP-117 for the winery building. The plans submitted with the USR application show the parts of the winery building (1st floor and loading dock) with elevations below the Base Flood Elevation. These elevations will need to be revised so that they are above the established BFE of 4850.5 feet NGVD-29. The applicant must also comply with the provisions of the FHDP including providing elevation certificates for the top of foundation and prior to Certificate of Occupancy as well as providing as-built drawings. REQUIREMENTS: 1. Utilize the existing accesses to the site from WCR 25. No new accesses will be granted. 2. Pursuant to Chapter 15, Articles I and II of the Weld County Code, if noxious weeds exist on the property or become established as a result of the proposed development, the applicant/landowner shall be responsible for controlling the noxious weeds. All vegetation, other than grasses, needs to be maintained at a maximum height of 12 inches until the area is completely developed. 3. Please provide a revised site plan showing the First Floor and the Loading Dock above a base flood elevation of 4850.5 NGVD-29. 4. Please call out the survey datum (NGVD-29) used on the drawings. 5. The applicant shall comply with the provisions of the Flood Hazard Development Permit (AmFHDP-117). EXH BIT U:\Referrals\USR\USR-I i 2011-0980 6. Add the following notes to the Plat: A. WARNING: LOT MAY NOT BE BUILDABLE DUE TO FLOODPLAIN OR FLOODWAY DESIGNATION. Please be advised that owners of Parcel # 130918001003 may not be able to obtain building permits to construct structures. All construction or improvements occurring in the floodplain as delineated on Federal Emergency Management Agency FIRM Community Panel Map #8082660-0863C dated September 28, 1982, shall comply with the Flood Hazard Overlay District requirements of Chapter 23, Article V, Division 3 of the Weld County Code and all applicable FEMA regulations and requirements as described in 44 CFR parts 59, 60, and 65. B. Flood hazard development permits will be required for development activities located within the FEMA mapped South Platte River Floodplain. C. The installation of any septic system within the 100-year floodplain shall comply with the Weld County I.S.D.S. Floodplain Policy. In accordance with the State of Colorado I.S.D.S. Regulations, no septic system shall be installed within the floodway. D. The winery will also be used for holiday parties, wedding receptions and meetings. Any food provided for these events will be catered. All food preparation and warewashing will be performed by catering companies at their own facilities. Therefore, A Retail Food Establishment license will not be required. There is an existing home on the property that is served by an individual sewage disposal system (G19920041) and is permitted for 3 bedrooms. A septic system for the winery has been designed by an engineer and Septic Permit SP-1000128 has been issued. The septic system was designed for 100 patrons and 1 full-time employee per day. Due to the large-capacity septic system for the winery, the applicant is proposing to install a water meter to monitor daily water usage. In the event the combined design capacities of the existing residential and proposed winery septic systems exceed 2000 gallons per day, a site application will be required to be submitted for approval by the Water Quality Control Division of the Colorado Department of Public Health and Environment. Water will be supplied by an existing individual well (Permit #41068-F) and is permitted for domestic and stock uses. The well may not be sufficient for business usage. Written documentation from the State Division of Water Resources is required to verify the well is appropriately permitted for the proposed use. A waste handling plan was submitted that described the composting and on-site land application of waste produced from the production of wine. The waste handling plan shall also address removal and disposal of trash and garbage, including the contact information of the waste handler and disposal facility. The applicant is proposing to discharge process wastewater from the wine making process to the compost pile. The applicant shall provide evidence from the Water Quality Control Division of the Colorado Department of Health and Environment that this proposed discharge is approved. We have no objections to the proposal; however, we do recommend that the following conditions be part of any approval: We recommend that the following requirements be met prior to allowing the plat to be recorded: 1. The applicant shall submit a dust abatement plan, detailing on site dust control measures, for review and approval, to the Environmental Health Services, Weld County Department of Public Health & Environment. 2. The installation of the septic system shall comply with the Weld County I.S.D.S. flood plain regulations. No septic system shall be installed within a floodway. 3. In the event the septic system requires a design capacity of over 2,000 gallons of sewage per day the applicants shall provide evidence that all requirements of the Water Quality Control Division (WQCD) of the Colorado Department of Public Health and Environment (specifically Policies WQSA-6 and WQSA-8 ) have been satisfied. Evidence of compliance shall be provided to the Weld County Department of Public Health and Environment. Alternately, the applicant can provide evidence from the WQCD that they are not subject to these requirements. 4. The applicant shall submit evidence of a Colorado Discharge Permit System (CDPS) from the Water Quality Control Division of the Colorado Department of Health and Environment for any proposed discharge into State Waterways, if applicable. 5. The applicant shall submit written evidence from the Colorado Division of Water Resources demonstrating that the well is appropriately permitted for the commercial use. 6. In the event the facility's water system serves more 25 persons on a daily basis the water system shall comply with the Colorado Primary Drinking Water Regulations (5 CCR 1003-1). Evidence shall be provided to the Weld County Department of Public Health and Environment that the system complies with the Regulations. 7. The applicant shall submit evidence of an Underground Injection Control (UIC) Class V Injection Well permit from the Environmental Protection Agency (EPA) for any large-capacity septic system (a septic system with the capacity to serve 20 or more persons per day). Alternately, the applicant can provide evidence from the EPA that they are not subject to the EPA Class V requirements. 2 8. The applicant shall submit a waste handling plan, for approval, to the Environmental Health Services Division of the Weld County Department of Public Health & Environment. The plan shall include at a minimum, the following: 1) A list of wastes which are expected to be generated on site (this should include expected volumes and types of waste generated). 2) A list of the type and volume of chemicals expected to be stored on site. 3) The waste handler and facility where the waste will be disposed (including the facility name, address, and phone number). We recommend that the following requirements be incorporated into the permit as conditions that must be met prior to the issuance of the Certificate of Occupancy: 1. An individual sewage disposal system is required for the proposed facility and shall be installed according to the Weld County Individual Sewage Disposal Regulations. Septic Permit SP-1000128 must receive final approval from Environmental Health Services. We recommend that the following requirements be incorporated into the permit as development standards: 1. All liquid and solid wastes (as defined in the Solid Wastes Disposal Sites and Facilities Act, 30-20-100.5, C.R.S., as amended) shall be stored and removed for final disposal in a manner that protects against surface and groundwater contamination. 2. No permanent disposal of wastes shall be permitted at this site. This is not meant to include those wastes specifically excluded from the definition of a solid waste in the Solid Wastes Disposal Sites and Facilities Act, 30-20-100.5, C.R.S., as amended. 3. Waste materials shall be handled, stored, and disposed in a manner that controls fugitive dust, fugitive particulate emissions, blowing debris, and other potential nuisance conditions. 4. The applicant shall operate in accordance with the approved "waste handling plan", at all times. 5. Produce shall be handled and stored at the facility in such a manner so that no nuisance is created by odor, blowing of debris, fugitive dust, or spoiled produce on or around the facility. 6. Fugitive dust and fugitive particulate emissions shall be controlled on this site. 3 The facility shall be operated in accordance with the approved "dust abatement plan", at all times. 7. This facility shall adhere to the maximum permissible noise levels allowed in the Non-specified Zone as delineated in Section 14-9-30 of the Weld County Code. 8. Adequate drinking, hand washing and toilet facilities shall be provided for employees and patrons of the facility, at all times. 9. Any septic system located on the property must comply with all provisions of the Weld County Code, pertaining to Individual Sewage Disposal Systems. 10.A permanent, adequate water supply shall be provided for drinking and sanitary purposes. 11.Adequate toilet facilities (portable toilets) and hand washing units shall be provided during the construction of the facility. 12.Bottled water shall be utilized for drinking during construction of the project. 13.In the event the facility's water system serves more than 25 persons on a daily basis the water system shall comply with the Colorado Primary Drinking Water Regulations (5 CCR 1003-1). Evidence shall be provided to the Weld County Department of Public Health and Environment that the system complies with the Regulations. 14. If applicable, the applicant shall obtain a stormwater discharge permit from the Colorado Department of Public Health & Environment, Water Quality Control Division. 15.The operation shall comply with all applicable rules and regulations of State and Federal agencies and the Weld County Code. Additionally, please note the following: 1. This application is proposing a well(s) as its source of water. The applicant should be made aware that while they may be able to obtain a well permit from the Office of the State Engineer, Division of Water Resources, the quantity of water available for usage may be limited to specific uses, i.e. domestic use only, etc. Also, the applicant should be made aware that groundwater may not meet all drinking water standards as defined by the Colorado Department of Public Health and Environment.
