ORDERING WAGON TRAIL IN SECTION 36, TOWNSHIP 6 N. , RANGE 66 W.,
VACATED, ABANDONED AND CLOSED:
WHEREAS, a petition has been presented to the Board of County Commissioners
signed by property owners adjoining wagon road more particularly described as follows,
towit:
a portion of land lying parallel to the North side of the Colorado
and Southern Railroad track in the Southwest corner of the South-
west Quarter (SW4) of Section 36, Township 6 North, Range 66 West
of the 6th P. M.
and
WHEREAS, no objections to said petition for the abandonment of said wagon
road have been received in the office of the Board of County Commissioners, Weld
County, Colorado, and,
WHEREAS, the Board of County Commissioners, Weld County, Colorado, believes
it to be in the best interest of Weld County to approve said petition.
NOW, THEREFORE, BE IT RESOLVED, by the Board of County Commissioners,
Weld County, Colorado, that the aforementioned wagon road be, and is hereby vacated,
abandoned and closed.
The above and foregoing resolution was, on motion duly made and seconded,
adopted by the following vote:

adoption:
:HEPEAS, Veld County has acquired, by quit claim deed recorded in
Book 1007 at Page 167 in the records of the County Clerk & Recorder of reld
County, Colorado, certain lands in the Northwest Quarter of the Northwest
Quarter (N7 N:ft) of Section Thirty—six (36), Township Six (6) North of Range
Sixty—six (66) ;pest of the 6th P.M., and
WHEREAS, these certain lands are no longer required by Weld County,
Colorado, and
WHEREAS, Dale E. Shannon, the present owner of said tract of land,
has requested that the said tract of lnn4 be conveyed to him to clear the
title.
NOW, THEREFORE, BE IT RESOLVED, and it is hereby ordered that
Kathleen E. Day is hereby constituted and appointed as Commissioner of Weld
County, Colorado, to make a conveyance, by deed, of said property, as afore—

corporation, certain tracts of land as shorn on maps attached to and made a
part of the deed dated December 15, 1934 and recorded in Book 1007 at Pale
153 of the records of the County Clerk & Recorder of Weld County, Colorado
on March 18, 1037, and
tHERLAS, The Larimer & Weld Investment Company, a corporation, has brought
suit against Weld County, Colorado in the District Court demanding that said
tracts of land be reconveyed to said The L:..trincr & Weld Investment Company
by Weld County, Colorado, and
WHEREAS, order, judgment and decree of the District Court entered on January
4, 1838 in Case No. 9510 requires said tracts of land to be reconveyed to said
The Larimer & Weld Investment Company, a corporation.
NOW, THEREFORE, BE IT RESOLVED, and it is hereby ordered that Kathleen E. Day
is hereby constituted and appointed as Commissioner of Weld County, Colorado,
to make a conveyance, by deed, of said property, as aforesaid, to said The

BE IT RESOLVED that the Board of County Commissioners of Weld
County, Colorado, purchase of and from The Larimer.and Weld Investment
Company, a corporation, the following described lands, situate in the
County of Weld, and State of Colorado:
-A strip of land eighty (80) feet in width lying immediately
North parallel and adjacent to the right of way of Colorado
and Southern Railway Company commencing at a point where
said right of way intersects the North line of the Southwest
Quarter of the Southwest quarter (SWW SWf) of Section Thirty—
Six (36), Township Six (6) North, of Range Sixty—six (66)
West of the Sixth P.M., in Weld County, .Colorado, running

county highway over and across lands owned by second party described as

A strip of land, eighty (80) feet in width lying immediately
North, parallel and adjacent to the right of way of Colorado and Southern
Railway Company commencing at a point where said right of way intersects
the North line of the Southwest quarter of the Southwest quarter (SW4 SW4)
of Section Thirty—six (36) Township Six (6) North of Range Sixty—six (66)
West ofthe Sixth P.M., in Weld County, Colorado, running thence Northwester—
ly to the West line of the Southeast quarter of the Northeast quarter (SPI
-) of Section Thirty-four (34) Township Six (6) North of Range Sixty—six
(66) West of the Sixth P.M., in Weld County, Colorado.
ra NOW, TREFORE, in consideration of the mutual promises, covenants
and agreements herein set forth, the parties hereto have agreed and by
these presents do agree as follows, to-wit:
FIRST: Party of the second part agrees that it will convey by quit-
claim deed for a county highway the strip of land eighty (80) feet in width
over and across the above described lands for county highway purposes.
SECOND: Party of the first part agrees that it will acquire MMct+tional
right of way for a contirrsation of said public highway along the right of
way of Colorado and Southern Railway from a point where said right of way
intersects the West line of the Southeast quarter of the Northeast quarter
(3E�s NE4) of Section Thirty-four (34) Township Six (6) North of Range Sixty-
six (66) test of the Sixth P. I. to the West line of said Section Thirty-four
(34).
THIRD: First party will commence the construction of a public high-
way over and across said strip of land immediately upon receipt of deed
from second party and will pursue the construction thereof, with diligence
and after completion of same, will maintain same as a public highway.

FOURTH: Party of the tirst part agrees that it will use its
best endeavors to obtain additional right of way for a further continuance
of said highway aforesaid, parallel to Colorado and Southern Railway right
of way from a point on the Last line of Section Thirty-three (33) Township •
Six (6) North of Range Sixty-six (66) West of the Sixth P.M., to the point
where said Railway right of way intersects the North line of said Section
Thirty-three (33) and if title is acquired thereto, will construct and
maintain over same a public county highway provided, however, that it is
understood and agreed that the acquisition of the right of way is this sub-
paragraph mentioned is not to be regarded as a necessary element in the ac-
quisition of title for the right of way across the lams conveyed by se-
cond.party to first party.

BE IT RESOLVED that the Board of County Commissioners enter into
a contract with The Lorimer and Weld Investment Company, a corporation,
for a right of way over and across certain lands,for the Greeley C.C.C.

Camp, according to the terms of this contract,more particularly described
and set forth in contract this day submitted to the Board of County
Commissioners, and that the Board of County Commissioners be and they are
hereby authorized and directed to execute said contract on behalf of Weld
County, which contract is hereby referred to and made a part of this
Resolution.

GT TEE SSETH:
tiitl*AS, the party of the second part has executed and delivered
to party of the first part its quit claim deed to the property of the
lands as shown in cross hatch on the attached exhibits "A" and "B", ,and
7ibraAS, party of the first part has acquired said title for
the purpose of the development of river improvement by the Civilian Con-
servation Corps located at Greeley, and
WHEREAS, it is represented that the title to said lands so con-
veyed is not required to remain permanently in ..eld County, and the road
through said lands is being constructed for purposes other than a county
highway,
DOW, THEREFORE, in consideration of the mutual promises and cov-
enants herein contained, the parties hereto "have 'agreed and by these-pre-
sents do agree as follows:
FIRST: In consideration that the partg_of the second part will
and does execute and convey said lands to the County of Weld for the
purposes as hereinabove set forth, the party of the first part agrees that
et and upon the e.:piratior, of six months after the abandonment of the CCC
Carp at Greeley, it will reconvey the lands shown in cross hatch on Exhibit
"A" and "B" hereto attached, to the party of the second part.
SECOND; The party of the first part agrees that it will not de-
clare or dedicate the roadway to be built across said lands as a public
or county highe:a;> so that upon reconveyance Of said property, the said
lands will not be burdened with an easement for a county or public high-
way.
THIRD: Party of the first part agrees that the road across said

lands shall be constructed in such manner as not to damage any irrigation
laterals, ditches or dikes as now constructed over said lands, and further
agrees that no fences shall be built that will interfere with the use of pas—
tures on said lands or that will interfere with the access of livestock to
any water, and that where said road crosses fence lines, proper cattle guards
will be constructed across the highway of such efficiency that livestock will
be prevented from crossing such fence lines.
BMWs Party of the first part agrees that it will endeavor and
use its best efforts to require the bridge across The Cache la Poudre River
along said road to be built immediately North of the Colorado and Southern
Railway right of way, and that same will be of such construction that it will
bear and carry heavy traffic over same.
