RE: ACTION OF THE BOARD OF COUNTY COMMISSIONERS CONCERNING
SPECIAL USE PERMIT FOR OPEN CUT MINING PERMIT - ADOLPH
COORS COMPANY
WHEREAS, the Board of County Commissioners of Weld County ,
Colorado, pursuant to Colorado statute and the Weld County Home
Rule Charter, is vested with the authority of administering the
affairs of Weld County, Colorado, and
WHEREAS, on June 20, 1979 , the Board of County Commissioners
of Weld County, Colorado approveda Special Use Permit for an
open cut mining permit for Adolph Coors Company, and
WHEREAS, condition #2 of said Special Use Permit was amended
by the Board of County Commissioners on July 11, 1979 to state
as follows :
"2 . No development of the property occur
until applicant presents a construc-
tion and maintenance program regarding
the access roads , which is acceptable
to the Board. "
WHEREAS, Adolph Coors Company has presented a construction
and maintenance program to the Board of County Commissioners of
Weld County, Colorado and the Board finds that the construction
and maintenance program for the access roads known as County
Road 59 and 18 is acceptable and therefore, development may
commence on the Special Use Permit area.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Com-
missioners of Weld County, Colorado that the construction and
maintenance program for the access roads known as County Road
59 and 18 is acceptable and development may commence on the
Special Use Permit area.
BE IT FURTHER RESOLVED by the Board that the agreements
and plans shall be assimilated when final corrections have been
completed in such a manner to be acted on by the Board no later
than January 30 , 1980 . The aforementioned agreements and plans
will be, by reference, made a part of this action.
The above and foregoing Resolution was , on motion duly made

Dear Commissioner Carlson:
Re: Keenesburg Mine Site Roadways
In our work session of November 19 we furnished the Board of
Commissioners with a letter of our proposal for the responsibility of
upgrading and maintenance of County Road No. 18 east from the centerline
of Section 23, Township 2 North, Range 64 West to County Road 59,
then north to the south line of Sections 11 and 12, Township 2 North,
Range 64 West.
Since our meeting, we have supplied design plans and a letter
outlining our plans to Al Chotvacs of the Colorado State Highway Depart-
ment and Drew Scheltinga of Weld County for approval . In addition, we
signed a letter of understanding with Mr. and Mrs. Andreas Arnusch con-
cerning a new driveway on their property and right-of-way for the curve
at the intersection of County Roads No. 59 and 18. Copies of the corres-
pondence to the above are enclosed.
We feel that we have met the requirements necessary in obtaining
our Weld County Special Use Permit for mining at the Keenesburg site and
request that the Board of Commissioners take the appropriate action to
grant us the permit.

Re: Weld County .I-76 Frontage Road northeast of Keenesburg
Dear Mr. Chotvacs:
Enclosed are Coors ' Drawings No. KN4-1 and KN4-10 through KN4-15
showing the design plans for the upgrading of that portion of County
Road 18 located in State Highway right-of-way.
As indicated in my letter of November 13, 1979, we will pave the
roadway to a total width of thirty feet, fifteen feet on -either side of
the existing centerline maintaining the existing drainage ditches. A
glare screen will be erected at the point where County Road 18 joins
your service road if lights from truck traffic creates a problem to south-
bound traffic on I-76. Road base and paving will be as indicated on the
enclosed plans.
We will appreciate your early review of our plans and a letter
directed to the Weld County Commissioners if our plans are acceptable to
your department. We further request that a "Change Point of Access" be
filed by the State Highway Department with the appropriate Federal agency
because of the rework of the curves at both points of access to State
right-of-way. _

Re: Weld County Roadway Improvements to Keenesburg Mine
Dear Drew:
Enclosed herewith are Coors ' Drawings No. KM-4-1 and KM-4-10
through KM-4-15 showing plans for the upgrading of County Road 18 from
the South 1 corner of Section 23, Township 2 North, Range 64 West, east
to the intersection of County Road 59; and County Road 59 north to the
south line of Section 2, Township 2 North, Range 64 West.
We propose paving that portion of public roadway from the South
1 corner of Section 23 east to that portion of roadway within State
Highway right-of-way to a width of twenty-six feet with three foot shoulders.
The remainder of public roadway will be paved to a width of thirty feet.
Paving will be to State Highway Department specifications.
We plan to modify the curve at the intersection of County Roads
18 and 59 to allow for a speed of 38 miles an hour. This modification
will require additional right-of-way, and Mr. and Mrs. Arnusch have agreed
to grant a right-of-way to Weld County for this purpose. Enclosed is• a
letter of understanding concerning the right-of-way grant and the con- •
struction of a new driveway west of the Arnusch home.
Mr. Al Chotvacs of the Colorado State Highway Department has been
furnished copies of the drawing for review.

Dear Mr. and Mrs. Arnusch:
In our conversation of Monday you agreed to grant a right-of-way to
Weld County for modification to the existing curve joining County Road 18
located in Colorado State Highway right-of-way and County Road 59 in Section
23, Township 2 North, Range 64 West. As shown on the attached Coors' drawing
No. 4-44446, sheet 1 of 2, the area to be granted for the right-of-way will
measure 4701± west of the east line of Section 23, Township 2 North, Range
64 West at your property line along County Road No. 18 and 480' - north of
the centerline of thee -existing County Road 18 on your east property line.
The right-of-way will allow for a radius of 800' .
In consideration of the above we will construct a fifteen foot drive-
way from County Road 18 at your existing field access approximately 1100 ±
west of your house, also shown on Coors' drawing No. 4-44446, sheet 2 of 2.
The driveway will be constructed parallel with the north side of the existing
concrete irrigation ditch immediately north of County Road 18 and will curve
around the west side and northwest corner of your house to your existing
parking area. The driveway will have asphaltic concrete paving, cap placed
over your irrigation ditch under the driveway. Staking of the driveway will
be done under your supervision. .

As you are probably aware, the towns of Frederick,
Dacono, and Firestone and the city of Fort Lupton have
formed a coalition to protect our interests against the
adverse effects of the proposed Northglenn Sewer Project.
We now feel a meeting should be scheduled between the
Weld County Commissioners to discuss what must be the next
step. We feel, also, that you, as County Commissioners,
are our main support in this matter. Therefore, we are
requesting a meeting with you in Fort Lupton before Jan-
uary 7, 1980. Please give this request your immediate
consideration.

Dear Mr. ClN-Qon c'—
I want to thank you for the time and effort you and your staff put
forth in making application for Energy Impact Assistance Funds.
With $0.7 million in grant funds available and $3.5 million of
applications the State Impact Advisory Committee had some difficult
choices to make in their recommendations to me at their October 4 and 5,
1979 meeting. As Mr. Warden has probably already told you, the
Committee recommended that your proposal not be funded. I concur with
that recommendation.
In evaluating the applications, both the Committee and I ask first
whether there is a high probability of significant mineral or energy
development impact on the applicant. Second, we must ask how the pro-
ject relates to meeting needs generated by that impact. Third, we
review the financial options of the effected local government and
its ability to recover costs of the project from taxes on the develop-
ment or associated activities.
It is our feeling that the requested expenditure is a responsibility
of the mining company.
Be assured that this decision does not in any way criticize the merits
of the project. It is just that with one dollar of grant funds for
every five dollars of applications we have to limit our funding to
proposals that have no financial alternatives .

Re: Keenesburg Mine Site Roadways
Dear Commissioner Carlson:
Earlier this year, we proposed that Weld County share the responsibility with
Coors for the upgrading and maintenances of County Road No. 18 east from the
I-76 North to the south line of Sections 11 and 12, Township 2 North, Range 64
West.
At a work session, the County Commissioners advised us that County funding
would not be available for upgrading, but agreed to apply for assistance
from the State of Colorado tax funding to energy impacted areas.
Application was subsequently made to the Colorado Socio-Economic Impact Office,
and Don Warden advised us two weeks ago that assistance for upgrading the
roadway was denied.
Since funding is not available, we agree to upgrade the roadways described
above through roadbase, and will share costs of applying dust suppresants which
will be needed to provide control dust emissions until our project is in opera-
tion. We will apply asphalt surfacing to the roads as soon as weather permits
after the hauling of coal begins.
After completion of the paving, we feel it the responsibility of the County
to maintain the public portion of the roadway. This includes approximately
one quarter of a mile connecting County Roads 18 and 59 which is within State
Highway right-of-way. This portion of roadway was necessarily constructed to
connect County roadways when 1-76 was constructed, and we understand that in
the past Weld County has been maintaining it.

was granted by the Board on June 20, 1979.
