RE: APPROVAL OF RECORDED EXEMPTION NO. 416 - JOE AND LARRY
INTERMILL.
WHEREAS, the Board of County Commissioners of Weld County,
Colorado , pursuant to Colorado statute and the Weld County Home
Rule Charter, is vested with the authority of administering the
affairs of Weld County, Colorado, and
WHEREAS, it has been determined by the Board of County Com-
missioners of Weld County, Colorado, at a public hearing held on
the 29th day of August, 1979 in the Chambers of the Board of
County Commissioners of Weld County, Colorado, that the division
into two parcels of land, as shown on the plat known as Recorded
Exemption No. 416, being the property of Joe and Larry Intermill ,
described as the West Half of the Northeast Quarter of Section
22 , Township 6 North, Range 66 West of the 6th P.M. , Weld
County, Colorado, being more particularly described as follows :

of the 6th Principal Meridian, Weld County,

does not come within the purview of the definition of the terms,
"subdivision" and "subdivided land" pursuant to its authority
under Section 30-28-101 (10) (d) , CRS 1973, as amended, and
WHEREAS, the Board of County Commissioners of Weld County,
Colorado finds that this particular division of land is not within
the purposes of the Weld County Subdivision Regulations and the
Board desires to exempt this particular division of land from the
definitions of "subdivision" and "subdivided land" pursuant to
its authority under Section 30-28-101 (10) (d) , CRS 1973 , as
amended, and Section 2-lA(3) of the Weld County Subdivision Regu-
lations .
NOW, THEREFORE, BE IT RESOLVED by the Board of County Com-
missioners of Weld County, Colorado that the hereinabove described
parcels of land owned by Joe and Larry Intermill be, and hereby
are, exempt from the definition of the terms "subdivision" and
"subdivided land" pursuant to its authority under Section
30-28-101 (10) (d) , CRS 1973, as amended , subject to the Recorded
Exemption Plat being amended to reflect the request of the Colo-
rado Division of Highways for 75 feet each side of State Highway
392 for future right-of-way prior to recording said plat.
The above and foregoing Resolution was , on motion duly made
and seconded, adopted by the following vote on the 29th day of
August, A.D. , 1979 .

RE: Recorded Exemption #416
Dear Commissioners:
The attached application, plat, and related items are in reference to a request
from Joe and Larry Intermill for a recorded exemption. The parcel of land under
consideration is described as the W' NEa Section 22, T6N, R66W of the 6th P.M. ,
Weld County, Colorado. The property contains approximately 80 acres of Class II
and III irrigated soils. The request is to divide the property into parcels of
7.62 acres and 72.38 acres. The property is located approximately 3-1/2 miles
west of Lucerne on the south side of State Highway 392.
The applicants desire to sell the 7.62 acre parcel as part of a divorce settlement.
Each parcel does have an existing residence located on it. An irrigation ditch
separates the two proposed parcels.
Based upon the information submitted and the adopted policies in the County, the
Department of Planning Services Staff recommends the request be approved for the
following reasons:
1 . The request conforms with Section 9-2 of the Weld County Subdivision Regula-
tidns (intent clause of the Recorded Exemption Procedure), Section 3.3. A. of
the Weld County Zoning Resolution (intent clause of the Agricultural Zone
District), and the Weld County Comprehensive Plan in that the use will be
compatible with surrounding agricultural uses. Each resulting parcel does
have an existing set of improvements. The request will allow agriculture and
related uses to be the predominant land use. There will be no reduction in
the amount of land currently being used for agricultural production.

2. The request complies with the provisions of Section 9-4 A. of the Weld County
Subdivision Regulations.
The Colorado Division of Highways has, in a letter dated August 21, 1979, requested
that 75 feet each side of State Highway 392 be reserved for future right-of-way.
The Department of Planning Services Staff recommends that the recorded exemption
plat be amended to include this request. This should be accomplished prior to
recording the recorded exemption plat.

This 80 acre farm is deeded to Larry G. Intermill and Joe A. Intermill Jr.
There are two residents on the farm, my wife and I are presently getting a
divorce and we need to sell off part of the farm for the settlement. The
portion we are asking to excempt off is the house and 7. 62 acres where we
lived. This portion is split from the main part of the farm by the
LaGrange Lateral.

Dear Mr. Cunliffe:
We have reviewed the Joe and Larry Intermill application for a Recorded Exemption,
and we have the following comments.
1 . Projected traffic volumes on State Highway 392 indicate the need for a total
of 150 feet of right of way, 75 feet each side of the centerline. We ask
that any additional right of way to meet this need be protected by the
appropriate technique.
2. Access to this site is currently available from S.H. 392. We prefer that
no additional access demands be created if this exemption is approved.
