RESOLUTION NO. 2011-006
A RESOLUTION OF THE CITY COUNCIL OF FORT LUPTON SUPPORTING COLORADO HOUSE
BILL 11-1082 RELATED TO THE VEHICLE INSPECTION PROGRAM APPLICABLE TO FORT
LUPTON.
WHEREAS, the Fort Lupton City Council is vested with the authority to promote the general
welfare of the community; and
WHEREAS, the State of Colorado adopted certain amendments to regulations which require
portions of Larimer and Weld Counties, including Fort Lupton, to be included in a Vehicle Emission
Inspection Program as part of a strategy to reduce ozone omissions along the Colorado Front Range; and
WHEREAS, air quality readings at designated Weld County locations indicate that Fort Lupton
and Weld County achieved an annual decrease in the 4th Maximum, 8-hour Average parts per million
(ppm) ozone value, such that the three-year average in 2009 was at .071 ppm which is below the .075
ppm requirement set forth in the State Implementation Plan (SIP); and
WHEREAS, based upon evidence that Fort Lupton currently complies with the required air quality
standard, the Fort Lupton City Council formally expressed its objection to inclusion in the State Plan; and
WHEREAS, over such objection, Fort Lupton and Weld County have been included in the State
Implementation Plan and Vehicle Emission Inspection Program; and
WHEREAS, current legislation known as HB 11-1082 has been introduced that would provide
relief to Fort Lupton and Weld County from participation in the required Vehicle Emission Inspection
Program based upon sustained achievement of air quality standards.
NOW, THEREFORE, BE IT RESOLVED THE FORT LUPTON CITY COUNCIL supports the adoption of
HB 11-1082 pertaining to the inclusion of the subject portions of Fort Lupton and Weld County in the
Vehicle Emission Inspection Program.
