The Weld County Public Works Department has reviewed this proposal. This project falls under the Use by Special Review Standard, Weld County Code, Chapter 23, Article II, Division 4, Section 23. Staff comments made during this phase of the Use by Special Review process may not be all-inclusive, as other issues may arise during the remaining application process. COMMENTS: WCR 32 is a collector road and requires an 80-foot right-of-way at full build out. There is presently a 60- foot right-of-way. This road is maintained by Weld County. Pursuant to the definition of SETBACK in the Weld County Zoning (23-1-90), the required setback is measured from the future right-of-way line. The applicant will utilize the 5 existing accesses to the property. No additional accesses will be granted. • Please show the locations of the existing accesses on the Plat and label the accesses with the Access Permit number(will be provided). An existing on-site low point will be used for water quality. Please show and label this area on the Plat as "Water Quality—No Build or Storage Area". This area IS NOT in a Special Flood Hazard Area (SFHA) as determined by the Federal Emergency Management Agency (FEMA). REQUIREMENTS: 1. Utilize the existing accesses to the site. No new accesses will be granted. 2. Show and label the existing accesses on the Plat with the approved access permit number. 3. Please show and label the Water Quality Depression on the Plat as "Water Quality — No Build or Storage Area". 4. Please place the following notes on the Plat: a. Pursuant to Chapter 15, Articles I and II of the Weld County Code, if noxious weeds exist on the property or become established as a result of the proposed development, the applicant/landowner shall be responsible for controlling the noxious weeds. All vegetation, other than grasses, needs to be maintained at a maximum height of 12 inches until the area is completely developed. • b. Water for the machine shop, mobile home and warehouse is provided by a domestic well (permit 239959) which specifically states "This well is limited to fire protection, ordinary household purposes inside not more than three (3) single family dwellings, the watering of poultry, domestic animals and livestock on a farm or ranch and the irrigation of not more than one (1) acre of home gardens and lawns". The application included three additional well permits for the property that are all permitted for domestic use. There are two Individual sewage disposal system permits on file for the property. • Permit SE-1100007 serves the machine shop and was evaluated by Total Engineering on February 11, 2011. The evaluation indicated the system can serve 2 employees. Permit G19870022 serves the mobile home and is sized for 6 people. The mobile home system was originally designed for an office. The application indicates there could be a total of 26 people who are associated with the airport and the machine shop. If the existing restroom facility for the machine shop or the mobile home will be used, the system must be reevaluated by an engineer for the increased flow. Instead of utilizing the existing systems a new septic system could be installed to accommodate the additional people. Dust abatement will consist of watering as necessary. The waste handling plan states there is a large tank for used oil which is serviced by Safety-Kleen. B&C Refuse provides trash pickup on a weekly basis. All products, pesticides, fertilizer, and other potentially hazardous chemicals must be stored in compliance with manufactures recommendations. • • We have no objections to the proposal; however, we do recommend that the following conditions be part of any approval: We recommend that the following requirements be met prior to allowing the plat to be recorded: 1. In the event the applicant intends to utilize the existing septic systems for additional personnel, the septic system shall be reviewed by a Colorado Registered Professional Engineer. The review shall consist of observation of the system and a technical review describing the systems ability to handle the proposed hydraulic load. The review shall be submitted to the Environmental Health Services Division of the Weld County Department of Public Health and Environment. In the event the system is found to be inadequately sized or constructed the system shall be brought into compliance with current Regulations. Alternately, the applicant can install a new septic system to serve the additional personnel. 2. In the event the septic system requires a design capacity of over 2,000 gallons of sewage per day the applicants shall provide evidence that all requirements of the Water Quality Control Division (WQCD) of the Colorado Department of Public Health and Environment (specifically Policies WQSA-6 and WQSA-8 ) have been satisfied. Evidence of compliance shall be provided to the Environmental Health • Services Division, Weld County Department of Public Health and Environment. Alternately, the applicant can provide evidence from the WQCD that they are not subject to these requirements. 3. The applicant shall submit written evidence from the Colorado Division of Water Resources, demonstrating that the wells are appropriately permitted for the commercial and residential uses. Evidence of compliance shall be provided to the Environmental Health Services Division, Weld County Department of Public Health and Environment. 4. In the event the facility's water system serves more than 25 persons on a daily basis the water system shall comply with the Colorado Primary Drinking Water Regulations (5 CCR 1003-1). Evidence shall be provided to the Environmental Health Services Division, Weld County Department of Public Health and Environment that the system complies with the Regulations. 5. The applicant shall submit evidence of an Underground Injection Control (UIC) Class V Injection Well permit from the Environmental Protection Agency (EPA) for any large-capacity septic system (a septic system with the capacity to serve 20 or more persons per day). Alternately, the applicant can provide evidence from the EPA that they are not subject to the EPA Class V requirements. Evidence of compliance shall be provided to the Environmental Health Services Division, Weld County Department of Public Health and Environment. • 2 6. The applicant shall submit evidence of a Colorado Discharge Permit System (CDPS) from the Water Quality Control Division of the Colorado Department of Health and Environment for any proposed discharge into State Waterways, if applicable. Evidence of compliance shall be provided to the Environmental Health Services Division, Weld County Department of Public Health and Environment. 7. The applicant shall provide written evidence to the Weld County Department of Public Health and Environment that the applicant has contacted and/or submitted an application to the Colorado Department of Agriculture (CDA), Division of Plant Industry. This contact/evidence shall determine if a license under the Pesticide Applicators' Act as defined under C.R.S. 35-10-101 through 35-10-128. is required. Alternately, the applicant can provide evidence from CDA, Division of Plant Industry that they are not subject to these requirements. Evidence shall be provided to the Environmental Health Services Division, Weld County Department of Public Health and Environment that the business complies with the Regulations. We recommend that the following requirements be incorporated into the permit as development standards: • 1. All liquid and solid wastes (as defined in the Solid Wastes Disposal Sites and Facilities Act, 30-20-100.5, C.R.S., as amended) shall be stored and removed for final disposal in a manner that protects against surface and groundwater contamination. 2. No permanent disposal of wastes shall be permitted at this site. This is not meant to include those wastes specifically excluded from the definition of a solid waste in the Solid Wastes Disposal Sites and Facilities Act, 30-20-100.5, C.R.S., as amended. 3. Waste materials shall be handled, stored, and disposed in a manner that controls fugitive dust, fugitive particulate emissions, blowing debris, and other potential nuisance conditions. 4. The applicant shall operate in accordance with the approved "waste handling plan", at all times. 5. Any airplane or equipment washing areas shall capture all effluent and prevent discharges in accordance with the Rules and Regulations of the Water Quality Control Commission, and the Environmental Protection Agency. • 3 6. Fugitive dust and fugitive particulate emissions shall be controlled on this site. • The facility shall be operated in accordance with the approved "dust abatement plan", at all times. 7. This facility shall adhere to the maximum permissible noise levels allowed in the Industrial Zone as delineated in Section 14-9-30 of the Weld County Code. 8. Sewage disposal for the facility shall be by septic system. Any septic system located on the property must comply with all provisions of the Weld County Code, pertaining to Individual Sewage Disposal Systems. 9. Adequate hand washing and toilet facilities shall be provided for employees and patrons of the facility, at all times. 10.A permanent, adequate water supply shall be provided for drinking and sanitary purposes. 11.In the event the facility's water system serves more than 25 persons on a daily basis the water system shall comply with the Colorado Primary Drinking Water Regulations (5 CCR 1003-1). 12.The applicant shall comply with all provisions of the State Underground and • Above Ground Storage Tank Regulations. 13.The applicant shall comply with all provisions of the Pesticide Applicators' Act issued by the Colorado Department of Agriculture, Division of Plant Industry. 14.All pesticides, fertilizer, and other potentially hazardous chemicals must be handled in a safe manner in accordance with product labeling and in a manner that minimizes the release of hazardous air pollutants (HAP's) and volatile organic compounds (VOC's). All chemicals must be stored secure, on an impervious surface, and in accordance with manufacturer's recommendations. 15.This application is proposing a well as its source of water. The applicant should be made aware that while they may be able to obtain a well permit from the Office of the State Engineer, Division of Water Resources, the quantity of water available for usage may be limited to specific uses, i.e. domestic use only, etc. Also, the applicant should be made aware that groundwater may not meet all drinking water standards as defined by the Colorado Department of Public Health and Environment. This violation was initiated due to the expansion of use relating to USR-521. In addition, there were people living in camper/trailers& RV's and a Noncommercial Junkyard. This case has not yet been presented to the Board of County Commissioners through the Violation Hearing process. Since this is an active violation, an investigation fee is required. The initial complaint was received from a Weld County Citizen. This application if approved by the Board of County Commissioners and once a plat is recorded will correct the violation. If this application is denied, the commercial activities shall be returned to fall in compliance with USR-521 within 30(thirty)days or they shall be completely removed from the property. Water Division 1, Water District 2 Dear Mr. Parko: We have reviewed the above referenced application for a Site Specific Development Plan and Amended Use by Special Review Permit to allow an air runway, two manufacturing buildings, support buildings, airplane hangars, and a residential trailer home on five parcels totaling 331.13 acres. The submitted material does not qualify as a "subdivision" as defined in Section 30-28-101(10)(a) C.R.S., therefore, pursuant to the State Engineer's March 4, 2005 memorandum to county planning directors, this office will only perform a cursory review of the referral information and provide comments. The comments will not address the adequacy of the water supply plan for this property or the ability of the water supply plan to satisfy any County regulations or requirements. • The submitted Water Supply Information Summary estimates water requirements to be 450 gallons per day (0.50 acre-feet per year)for household, commercial, and stock watering use. The proposed water supply is four existing on-lot wells, permit nos. 239959, 247419, 247432, and 231884. The submitted Questionnaire identifies the well with permit no. 239959 as the proposed water supply for Building A, identified as a commercial hangar/warehouse/storage facility. The Questionnaire also identifies the well with permit no. 239959 as the current and proposed water supply for Building B, the residential trailer house, and Building C, Farley's Machine Shop. The specific use of water provided by the well in or around these buildings was not identified. Well permit no. 239959 authorizes the use of the well for ordinary household purposes inside three single family dwellings, the watering of poultry, domestic animals, and livestock on a farm or ranch, and the irrigation of up to one acre of home gardens and lawns. In order for this well to be used to provide water to the commercial business, such as for restrooms for employees or airplane/machine washing, the Applicant must obtain a new permit for the existing well or obtain a permit to construct a new well that would allow for such commerciai use. The ability for the applicant to obtain a commercial well permit will be evaluated at the time that a well permit application is submitted. Please note that this office would be unable to issue a commercial exempt permit for a well to serve both the rental trailer home and a commercial business. Since insufficient information was provided regarding the use of the existing wells, we cannot comment on the ability of any of the wells, as currently permitted, to serve the site.
