HomeMy WebLinkAbout20110111.tiff RESOLUTION RE: ACTION OF THE BOARD CONCERNING ZCV #1000123 AGAINST RITA GAONA AND TONY GUTIERREZ FOR VIOLATION OF THE WELD COUNTY CODE WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, Rita Gaona and Tony Gutierrez, ZCV#1000123, are allegedly in violation of the Weld County Code, and WHEREAS, despite efforts by the Planning staff to resolve said matter, the violation has not been corrected, and WHEREAS, on the 11th day of January, 2011, a public hearing was held before the Board of County Commissioners for the purpose of hearing testimony relating to said violation, and WHEREAS, Joe Gaona, representative, was present at said hearing, and WHEREAS, the Board of County Commissioners deems it advisable to refer said violation to the Weld County Attorney's Office for legal action, with an instruction for delay of action upon such referral until April 11, 2011, to allow adequate time for the property owner(s) to finish installing screening on the property, and remove all derelict vehicles, including the mobile home, from the property. She indicated that her husband and she just lost their house with a mechanic shop. She indicated they had 5 days to remove everything. She said several of the vehicles do indeed belong to customers; however, a majority of them are in Mexico, so he is unable to contact them. She asked about screening them. I explained that they could screen vehicles that were theirs, but not vehicles that belong to customers. I then brought up that they are living in a trailer. She asked if I could call Joe directly and explain everything to him as well. I told her I would be happy to do so. Joe= 324-3017 10/04/2010 Phone call I called Joe Gaona (324-3017). He indicated that he wanted to put fencing around his customer's vehicles. I explained that would not correct the violation. He indicated that he intends to install a cedar wooden privacy fence along the road. He indicated a metal fence along the alley. He said it would be painted in one color. I advised him that my next step was a 30 day letter, then the next step would be a Violation Hearing. I mentioned the occupied RV. He said right now they are homeless. I explained that he would need to explain this situation to the Board. He said he would try to bring the property into compliance in order to avoid any hearings. 11/17/2010 Office visit Joe Gaona came to the Greeley Planning Office. He indicated that he had already installed a privacy fence along the Western side of the street. He said he has been cleaning the property and is down to about 6 vehicles on the property. I asked if the property was now screened from all adjacent properties and public rights-of-ways (allies and streets). He indicated he still needed to install something along the alley. I asked how soon he would have that installed. He said if the weekend is nice, then over the weekend. I asked about the RV. He indicated they were still using the RV as a dwelling unit. I advised him that I would be scheduling his case for a Violation Hearing for January 11, 2011. He said he plans on having everything taken care of well before that date. 11/30/2010 Certified receipt Certified Receipt received -signed. 12/28/2010 Office visit Joe Gutierrez came to the Greeley Planning Office. He indicated he was mainly there to talk about the Joel Garcia (ZCV10-00057) Violation. He said his property(ZCV10-00123)was not done yet, but he still thinks he will have it done before the hearing.
