Dear Mr. Fitzgerald:
The Board of Weld County Commissioners has reviewed the
proposal by the Audubon Society, Aims Community College,
District 6 Schools, and the University of Northern
Colorado for use of the Davis Ranch property as an
Outdoor Education Site.
Unfortunately, the Board is not in a position to authorize
such use at this time. The Davis Ranch property is presently
under lease; the County must abide by the terms of the lease
agreements and by the lessee' s wishes in determining uses
not covered in those agreements.
The lessee of the major share of the property in question,
Mr. Harold Law, foresees many problems with such a program,
due to his use of the property for livestock grazing. The
cattle pastured on the land are not confined to one area
but graze throughout the property; therefore, scheduling
activities away from the cattle would not be feasible.
Mr. Law is also concerned that authorizing the use of the
property for this program may make it difficult to control
access by other groups or individuals. Controlling and
coordinating such access would be Mr. Law's responsibility,
one which he does not appear willing to assume without
major fencing improvements on the property. He would not
be in favor of the program under the present circumstances,
both for reasons of safety and the practicability of
operating under such conditions.

Therefore, the Board must at this time deny the request of
the sponsoring groups for use of this particular property.
We recognize that such a program would be of great benefit
to your group and to students involved in such studies.
When the time comes to renegotiate the Davis property lease,
the Board would be willing to consider adding such a provision
to a future lease agreement, if it could be made mutually
agreeable to both the County and the lessee.
If we should learn of other property, either governmental
or private, which would be both suitable and available
for an Outdoor Education Program, we will notify members
of your group. Please contact the Board if we can be
of any assistance in the future.
