RESOLUTION
RE: ACTION OF BOARD CONCERNING RECORDED EXEMPTION#3967-JACK SWAYZE
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, on December 20, 2004, the Department of Planning Services administratively
approved the request of Jack Swayze, 18995 County Road 17, Johnstown, Colorado 80534, for
Recorded Exemption #3967, to divide the property into parcels estimated to be approximately 3.1
acres and one (1) acre, for property which is located on the following described real estate, to-wit:
Lot A of Recorded Exemption#516; Part of the NE1/4
of Section 32, Township 4 North, Range 67 West of
the 6th P.M., Weld County, Colorado
WHEREAS, the Department of Planning Services staff notified the applicant, by certified
letters dated April 6, and May 4, 2011,that certain outstanding Conditions of Approval had not been
completed and that the matter would be scheduled for a hearing before the Board of Weld County
Commissioners unless written documentation was received requesting a withdrawal of the case, or
the outstanding items were completed and the mylar plat recorded, and
WHEREAS, after reviewing Department of Planning Services concerns and hearing the
testimony presented,the Board determined that said request shall be continued until July 18, 2011,
to allow the applicant additional time to record the mylar plat.
WHEREAS, after reviewing the matter and hearing the testimony presented on July 18,
2011, the Board determined that the remaining Condition of Approval has been completed and that
Recorded Exemption #3967 shall be referred back to staff for processing.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld
County, Colorado, that Recorded Exemption #3967 be, and hereby is, referred back to staff for
processing.

Approved with Conditions
The Weld County Department of Planning Services has determined through an administrative review that the
standards of Section 24-8-40 of the Weld County Code have been met. This Recorded Exemption is
approved with the following conditions in accordance with information submitted in the application and the
policies of Weld County.
1. A Weld County septic permit is required for any proposed home. The septic system shall be installed
according to the Weld County Individual Sewage Disposal System (I.S.D.S.) regulations.
2. Topographic or physical features of the proposed Lots A and B, such as ravines,ditches, streams etc.
may limit the area available for a new or replacement septic system. Prior to recording the plat the
Weld County Department of Public Health and Environment recommends that the applicant review the
Weld County Code pertaining to septic systems to assure that any installed septic system will comply
with all setback requirements found in the Code. In the event the proposed lot is not of sufficient size to
allow the installation of a septic system the lot may need to be enlarged.
3. All septic systems must be located on their respective lots and meet all lot line setback requirements.
4. Prior to r ording the plat:
. The plat shall be titled: Recorded Exemption No. 1059-32-1 RE-3967

(; b.) The applicant shall submit to the Weld County Department of Planning Services evidence
DNS i that any existing septic system meets all requirements of the Weld County Department of
• ,z. 'Ni Public Health and Environment. The Weld County Department of Public Health and
• v p �� Environment was unable to locate a septic permit for the septic system located at 18995
County Road 17. Any existing septic system which is currently not permitted through the
o Weld County Department of Public Health and Environment will require an I.S.D.S.evaluation
prior to the issuance of the required septic permits. In the event the system is found to be
ingdequate, the system must be brought into compliance with current I.S.D.S. regulations.
c. A and B shall use the existing residential access point as no additional accesses shall
be granted. A 30 foot wide joint access and utility easement extending across Lots A and B
from County Road 40,for the benefit of Lots A and B,shall be shown clearly on the plat.The
joint easement shall be dedicated for the use as shown using the language set forth in the
Weld County Code,Appendix 24-F.E.The easement shall be graded and drained to provide
all weather access.
. All accesses shall be clearly shown on the plat.
e. County Roads 17 and 40 are designated on the Weld County Road Classification Plan as
arterial status roads,which require 140 feet of right-of-way at full build out.There is presently
60 feet of right-of-way.A total of 70 feet from the centerline of County Roads 17 and 40 shall
be delineated on the plat as right-of-way reservation for future expansion of County Roads 17
VS' nd 40. This road is maintained by Weld County.
,�(7�'' Li. All vehicles located on the property must be operational with current license plates, or be
x`07 screened from all adjacent properties and public rights of way, or be removed from the
property. All other items considered to be part of a noncommercial junkyard must also be
removed from the property or screened from adjacent properties and public rights-of-way.

6Opy'� The property is in violation of Chapter 23 of the Weld County Code(Violation#VI-0400125).
The applicant shall schedule a final inspection with the Weld County Zoning Compliance
Officer and submit a copy of the closure letter indicating compliance with Chapter 23 of the
Weld County Code. The following items need to be addressed prior to closing this violation:
1) The applicant shall submit a letter outlining what the three semi-trailers and semi truck on
the property are being used for. Additional permits may be required by the Department
of Planning Services based on the information outlined in the letter.
• •
2) The applicant shall apply for a mobile home zoning permit for the existing mobile home
proposed to be located on proposed Lot A of this recorded exemption. The mobile home
shall be required to meet all setbacks from proposed and existing road rights-of-way.
3) The"Noncommercial Junkyard"consisting of derelict vehicles, metal/iron, buckets and
miscellaneous debris shall be removed, restored or completely screened from all
adjacent properties and public rights-of-way.
S8Lots A and B shall comply with the one(1)acre net minimum lot size required by Section 24-
-40.L of the Weld County Code.
91 j. / The applicant shall submit nonconforming structure applications to the Department of
�,/ Planning Services for any buildings/structures located within the future right-of-way expansion
areas for County Roads 17 and 40.
k. The applicant shall provide evidence that all requirements of the Little Thompson Water
District have been addressed and that separate water service(taps)have been obtained for
both lots.0�I./ The applicant shall provide the Weld County Department of Planning Services with a
Statement of Taxes from the Weld County Treasurer showing no delinquent taxes exist for
the original parcel.
m. The following notes shall be placed on the plat:
1) All proposed structures will meet the minimum setback and offset requirements for the
zone district in which the property is located. Pursuant to the definition of setback in the
Weld County Code,the required setback is measured from the future right-of-way line.
* No building or structure as defined and limited to those occupancies listed as Groups A,
B, E, F,H, I, M and R in Section 302.1 of the 2003 International Building Code, shall be
constructed within a 200-foot radius of any tank battery or within a 150-foot radius of any
wellhead. Any construction within a 200-foot radius of any tank battery or 150-foot radius
of any wellhead shall require a variance from the terms of the Section 23-3-10 of the
Weld County Code.
2) Any future structures or uses on site must obtain the appropriate zoning and building
permits.
3) Lot A and Lot B are not eligible for a future land exemption in accordance with Section
24-8-20.C.1 of the Weld County Code.
4) Prior to the release of building permits, the applicant shall submit a recorded deed
describing the Lot upon which the building permit is requested with the building permit
applications. The legal description on such deed shall include the Lot designation and
Recorded Exemption number.
5) Prior to the release of building permits, the applicant shall submit evidence to the
Department of Planning Services that Lots A and B have an adequate water supply of
sufficient quality, quantity and dependability.
6) Prior to the release of building permits for any structure exceeding 3,600 square feet,the
applicant must comply with the requirements of Appendix III-A of the International Fire
Code.
7) Should noxious weeds exist on the property or become established as a result of the
proposed development the applicant/landowner shall be responsible for controlling the
noxious weeds, pursuant to Chapter 15, Articles I and II of the Weld County Code.
8) Building permits shall be obtained prior to the construction of any building. Buildings that
meet the definition of an Ag Exempt Building per the requirements of Section 29-1-20
and Section 29-3-20.B.13 of the Weld County Code do not need building permits,
however,a Certificate of Compliance must be filed with the Planning Department and an
electrical and/or plumbing permit is required for any electrical service to the building or
water for watering or washing of livestock or poultry.
9) Effective January 1, 2003, Building Permits issued on the proposed lots will be required
to adhere to the fee structure of the County Road Impact Program. (Ordinance 2002-11)
10) In the event Weld County or any other governmental authority exercises its right to
expand County Road 17 and/or County Road 40 into the rights-of-way noted on this
Recorded Exemption and such expansion requires the demolition,destruction,alteration,
or taking of any improvements existing on the subject property as of the date this
Recorded Exemption is recorded, the owner of the subject property shall be entitled to
just compensation as determined in an eminent domain proceeding for such property
and its improvements. This requirement shall be binding upon the parties regardless of
the legal effect of whether the subject rights-of-way are "reserved" or"dedicated".
11) WELD COUNTY'S RIGHT TO FARM: Weld County is one of the most productive
agricultural counties in the United States, ranking fifth in total market value of agricultural
products sold. The rural areas of Weld County may be open and spacious, but they are
intensively used for agriculture. Persons moving into a rural area must recognize and
accept there are drawbacks, including conflicts with longstanding agricultural practices
and a lower level of services than in town. Along with the drawbacks come the incentives
which attract urban dwellers to relocate to rural area:open views, spaciousness,wildlife,
lack of city noise and congestion, and the rural atmosphere and way of life. Without
neighboring farms, those features which attract urban dwellers to rural Weld County
would quickly be gone forever.
Agricultural users of the land should not be expected to change their long-established
agricultural practices to accommodate the intrusions of urban users into a rural area.
Well run agricultural activities will generate off-site impacts, including noise from tractors
and equipment; slow-moving farm vehicles on rural roads; dust from animal pens, field
work, harvest, and gravel roads; odor from animal confinement, silage, and manure;
smoke from ditch burning;flies and mosquitoes; and the use of pesticides and fertilizers
in the fields, including the use of aerial spraying. Ditches and reservoirs cannot simply
be moved out of the way of residential development without threatening the efficient
delivery of irrigation to fields which is essential to farm production.
Section 35-3.5-102,C. R.S.,provides that an agricultural operation shall not be found to
be a public or private nuisance if the agricultural operation alleged to be a nuisance
employs methods or practices that are commonly or reasonably associated with
agricultural production.
Weld County covers a land area of over 4,000 square miles in size (twice the State of
Delaware) with more than 3,700 miles of state and County roads outside of
municipalities. The sheer magnitude of the area to be served stretches available
resources. Law enforcement is based on responses to complaints more than on patrols

of the county and the distances which must be traveled may delay all emergency
responses, including law enforcement, ambulance, and fire. Fire protection is usually
provided by volunteers who must leave their jobs and families to respond to
emergencies. County gravel roads, no matter how often they are bladed,will not provide
the same kind of surface expected from a paved road. Snow removal priorities mean
that roads from subdivisions to arterials may not be cleared for several days after a major
snowstorm. Snow removal for roads within subdivisions are of the lowest priority for
public works or may be the private responsibility of the homeowners. Services in rural
areas, in many cases,will not be equivalent to municipal services. Rural dwellers must,
by necessity, be more self-sufficient than urban dwellers.
Children are exposed to different hazards in the county than in an urban or suburban
setting. Farm equipment and oil field equipment, ponds and irrigation ditches,electrical
power for pumps and center pivot operations, high speed traffic, sand burs, puncture
vines, territorial farm dogs, and livestock present real threats to children. Controlling
children's activities is important, not only for their safety, but also for the protection of the
farmer's livelihood. Parents are responsible for their children.
n. The applicant shall submit two(2) paper copies of the plat for preliminary approval to the Weld
County Department of Planning Services. Upon approval of the paper copies the applicant
shall submit a Mylar plat along with all other documentation required as conditions of
approval. The Mylar plat shall be recorded in the office of the Weld County Clerk and
Recorder by Department of Planning Services' Staff. The plat shall be prepared in
accordance with the requirements of Section 24-8-60 of the Weld County Code. The Mylar
plat and additional requirements shall be submitted within sixty(60)days from the date the
Administrative Review was signed. The applicant shall be responsible for paying the
recording fee.
o. The Department of Planning Services respectfully requests the surveyor provide a digital copy
of this Recorded Exemption. Acceptable CAD formats are .dwg, .dxf, and .dgn
(Microstation); acceptable GIS formats are ArcView shapefiles, Arclnfo Coverages and
Arclnfo Export files format type is .e00. The preferred format for Images is .tif (Group 4).
(Group 6 is not acceptable). This digital file may be sent to maps@co.weld.co.us.
p. The Weld County Department of Planning Staff's approval of this Recorded Exemption
Application is based on satisfying the Conditions of Approval. Should an applicant be
unwilling or unable to meet any one of these conditions within 60 days of approval,then this
case will be forwarded to the Weld County Board of County Commissioners with a staff

Planning Services Staff. The plat shall be prepared in accordance with the requirements of Section 24-
8-60 of the Weld County Code. The Mylar plat and additional requirements shall be submitted within
sixty(60)days from the date the Administrative Review was signed.The applicant shall be responsible
for paying the recording fee.
Staff Recommendation:
The only remaining condition of approval is to submit the RE-3967 plat for recording. I anticipate
that the plat will be submitted for recording within a week. Staff recommends either referring this
case back to staff or continuing this case hearing for 30 days.

WELD COUNTY'S RIGHT TO FARM: Weld County is one of the most productive agricultural
counties in the United States, typically ranking in the top ten counties in the country in total market
value of agricultural products sold. The rural areas of Weld County may be open and spacious, but
they are intensively used for agriculture. Persons moving into a rural area must recognize and accept
there are drawbacks, including conflicts with long-standing agricultural practices and a lower level of
services than in town. Along with the drawbacks come the incentives which attract urban dwellers to

relocate to rural areas: open views, spaciousness, wildlife, lack of city noise and congestion, and the
rural atmosphere and way of life. Without neighboring farms, those features which attract urban
dwellers to rural Weld County would quickly be gone forever.
Agricultural users of the land should not be expected to change their long-established agricultural
practices to accommodate the intrusions of urban users into a rural area. Well-run agricultural
activities will generate off-site impacts, including noise from tractors and equipment; slow-moving
farm vehicles on rural roads; dust from animal pens, field work, harvest and gravel roads; odor from
animal confinement, silage and manure; smoke from ditch burning; flies and mosquitoes; hunting and
trapping activities; shooting sports, legal hazing of nuisance wildlife; and the use of pesticides and
fertilizers in the fields, including the use of aerial spraying. It is common practice for agricultural
producers to utilize an accumulation of agricultural machinery and supplies to assist in their
agricultural operations. A concentration of miscellaneous agricultural materials often produces a
visual disparity between rural and urban areas of the County. Section 35-3.5-102, C.R.S., provides
that an agricultural operation shall not be found to be a public or private nuisance if the agricultural
operation alleged to be a nuisance employs methods or practices that are commonly or reasonably
associated with agricultural production.
Water has been, and continues to be, the lifeline for the agricultural community. It is unrealistic to
assume that ditches and reservoirs may simply be moved "out of the way" of residential
development. When moving to the County, property owners and residents must realize they cannot
take water from irrigation ditches, lakes, or other structures, unless they have an adjudicated right to
the water.
Weld County covers a land area of approximately four thousand (4,000) square miles in size (twice
the size of the State of Delaware) with more than three thousand seven hundred (3,700) miles of
state and County roads outside of municipalities. The sheer magnitude of the area to be served
stretches available resources. Law enforcement is based on responses to complaints more than on
patrols of the County, and the distances which must be traveled may delay all emergency responses,
including law enforcement, ambulance, and fire. Fire protection is usually provided by volunteers who
must leave their jobs and families to respond to emergencies. County gravel roads, no matter how
often they are bladed, will not provide the same kind of surface expected from a paved road. Snow
removal priorities mean that roads from subdivisions to arterials may not be cleared for several days
after a major snowstorm. Services in rural areas, in many cases, will not be equivalent to municipal
services. Rural dwellers must, by necessity, be more self-sufficient than urban dwellers.
People are exposed to different hazards in the County than in an urban or suburban setting. Farm
equipment and oil field equipment, ponds and irrigation ditches, electrical power for pumps and center
pivot operations, high speed traffic, sand burs, puncture vines, territorial farm dogs and livestock, and
open burning present real threats. Controlling children's activities is important, not only for their
safety, but also for the protection of the farmer's livelihood.
C) The Right of Way Requirements for County Road 40 have been changed—per the updated Weld County
Transportation Plan—Weld County Road 40 is identified as a Local Gravel Road and only required 60 feet of
right-of-way (30 feet from centerline). Please update the Right-of-way.
D) WCR 19 shall be changed to WCR 15 on the vicinity map.

1. I provided a copy of the plat to the Health Department to verify if the septic envelopes are acceptable.
I also have one question:
How close are the existing buildings to the edge of future right-of-way for County Road 17?—If closer than 20-
feet—then the applicant needs to submit a nonconforming structure application. (The application form is
attached to this e-mail)

a. Domestic use. The statement will include evidence that a water supply of sufficient quality,quantity and
dependability will be available to serve all proposed lots. A letter from a water district, municipality, or a
well permit are examples of evidence for domestic use.
Water is provided to proposed Lot B by Little Thompson Water District under Tap#3130. Proposed Lot A
can also be serviced by Little Thompson Water District, see letter in the application packet.
b. Irrigation water. The statement will include the type and quantity of irrigation water to the site, whether
irrigation water has been removed from the site and, if so, when.
There is no irrigation water associated with this site.
2. A statement explaining that the proposed lots will have an adequate means for the disposal of sewage in
compliance with the requirements of the underlying zone district and the Weld County Department of Public
Health and Environment.
A Statement of Existing for a Septic Permit has been applied for through the Weld County Department
of Public Health and Environment. Pending inspection a Septic Permit Number will be issued.

The Weld County Public Works Department has reviewed this proposal. Our comments and requirements are
as follows:
COMMENTS:
WCR 40 is designated on the Weld County Road Classification Plan (FHU) as an arterial status road, which
requires a 140-foot right-of-way at full build out. There is presently a 60-foot right-of-way. The road is
maintained by Weld County. Pursuant to the definition of SETBACK in the Weld County Code, Chapter 23,
Article III, Section 23-3-50, the required setback is measured from the future right-of-way line.
WCR 17 is designated on the Weld County Road Classification Plan (FHU) as an arterial road, which requires
a 140-foot right-of-way at full build out. There is presently a 60-foot right-of-way. The road is maintained by
Weld County. Pursuant to the definition of SETBACK in the Weld County Code, Chapter 23, Article III, Section
23-3-50, the required setback is measured from the future right-of-way line.
REQUIREMENTS:
The Weld County Public Works Department recommends approval of this application.
Reserved setbacks should be shown for future right-of-way on both sides of Lot A at the intersection of WCR
40 and WCR 17.
The applicant shall utilize the existing residential access to this parcel. (Lot B)
Pursuant to Chapter 15, Articles I and II of the Weld County Code, if noxious weeds exist on the property or
become established as a result of the proposed development, the applicant/landowner shall be responsible for
controlling the noxious weeds.
Both Lots A and B shall share a joint access point from the existing access on WCR 40.

Environmental Health Services has reviewed this proposal; the following conditions are
recommended to be part of any approval:
1 . All septic systems located on the property shall have appropriate permits from
the Weld County Department of Public Health & Environment. The
Environmental Health Division of the Weld County Department of Public Health
& Environment was unable to locate a septic permit for the septic system located
on the smaller parcel of this application, which serves the mobile home. Any
existing septic system(s) which is not currently permitted through the Weld
County Department of Public Health & Environment will require an I.S.D.S.
Evaluation prior to the issuance of the required septic permit(s). In the event the
system(s) is found to be inadequate, the system(s) must be brought into
compliance with current I.S.D.S. regulations.
2. All septic systems must be located on their respective lots and meet all lot line
set back requirements.
Additionally, please note the following:
1 . Our Department recommends the applicant to set aside an area for a septic
system replacement envelope.
2. Topographic or physical features of the proposed lot, such as ravines, ditches,
streams, etc. may limit the area available for a new or replacement septic
system. Prior to recording the plat the Division recommends that the applicant
review the County Code pertaining to Septic Systems to assure that any installed
septic system will comply with all setback requirements found in the Code. In the
event the proposed lot is not of sufficient size to allow the installation of a septic
system the lot may be need to be enlarged.

This letter is in response to your request for a water service commitment for up one tap for a
residential lot, in the location described as follows:

The District provides water service within its service area as defined by the District. The
provision of water service by extension of existing water lines of the District to the above property and
the installation of taps for lots is done under the terms of the Rules and Regulations of the District
established by the Board of the District from time to time. You may obtain a copy of the Rules and
Regulations from the District. This letter outlines the provisions of the Rules and Regulations, however
this letter does not change any provisions of the Rules and Regulations. The Board of the District may
alter and amend the Rules and Regulations at any time, and the provisions of this letter are subject to
alteration and amendment based on changes in the Rules and Regulations of the District.
We currently have an 8" diameter water line located along WCR 40 West of WCR 15 with
additional capacity available Therefore, we can commit to provide service to the above property, subject
to the limitations in this letter, for one standard residential 5/8" X 3/4" water tap per lot; and the
following additional limitations on the provision of water service are:
1. All improvements to District facilities required to provide service will be the financial
responsibility of the developer in accordance with the District Rules and Regulations. All
improvements must conform to District Specifications.
2. Little Thompson Water District requires you to transfer 1.4 shares of Colorado Big
Thompson water for each lot in the commitment and then to pay for the rest of the tap fee
as the water lines are put in service.
3. If a fire hydrant is required for the subdivision there is a $2,000 fire hydrant fee that
needs to be paid prior to installation of the fire hydrant. You will be responsible for any
improvements or upgrades needed to meet the required fire flows in your subdivision.

4. In order to provide the required flows to the subdivision you will be required to install a
minimum 6" Diameter water line from the existing 8"diameter waterline located West of
WCR 15. A rebate is due the developer that installed the new 8" line. This water line is
would be nearly a mile in length and would need to be placed in a utility easement next o
WCR 40. The enclosed map shows the proposed upgrade to extend service to your lot.
5. You will be required to provide the needed water lines in the proposed subdivision.
6. The design, installation and total cost of the project will be the responsibility of the
developer.
This commitment letter will expire two years from the date of this letter if the tap has not been
purchased, paid for and installed by that date of expiration. The current fee for the domestic 5/8" X 3/4"
tap is $25,700. YOU ARE HEREBY ADVISED THAT THE RULES, REGULATIONS AND
TARIFFS OF THE DISTRICT ARE SUBJECT TO CHANGE WITHOUT NOTICE; AND THIS
LETTER IS ISSUED WITH THE SPECIFIC LIMITATION THAT THE DISTRICT MAY
CHANGE THE RULES, REGULATIONS AND TARIFFS APPLICABLE TO THE ABOVE
PROPERTY AT ANY TIME WITHOUT NOTICE TO YOU OR ANY PERSON.

was conducted by Pain Smith, an Environmental Specialist of this department.
The existing individual septic disposal system is of sufficient size and capacity to adequately handle the
proposed load. This evaluation is based on a final treatment capacity for a 2 bedroom residence.
Be advised,neither the County of Weld nor any of its agents or employees undertake or assume any
liability to the owner of the above property, to any purchaser of the above property or to any lending
agency making a loan on the above property or in the report.
This inspection was conducted for the purpose of determining compliance with current regulations and
for detecting health hazards observable at the time of inspection. This does not constitute a warranty that
the system is without flaw or that it will continue to function in the future. Inspections requested during
periods of snow cover and high soil saturation may be of questionable value to potential buyers due to
adverse conditions. Evaluations based on Statements of Existing(S.O.E.) relies on information the
property owner provides,under oath, indicating current status of the system and representing to the best
of his/her knowledge the system is not failing•to function properly.
