RE: GRANT REQUEST CONCERNING EXTENSION OF TIME FOR SUBMITTAL OF
PLANNED UNIT DEVELOPMENT FINAL PLAN, PF #1048, MOREA MANOR NORTH -
WELD 45 ACRE, LLC
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, on November 5, 2008, by Resolution #2008-2726, the Board approved the
application of Weld 45 Acre, LLC, 9202 South Rockport Lane, Highland Ranch, Colorado 80126,
requesting a Site Specific Development Plan and Planned Unit Development Final Plan, PF#1048,
for eight (8) lots with E (Estate) Zone uses (24.1 acres) and three (3) non-residential outlots
(18.9 acres) for open space - Morea Manor North, for a parcel of land located on the following
described real estate, to-wit:
Lot B of Recorded Exemption #2812; being part of
the S1/2 NW1/4 of Section 2, Township 2 North,
Range 67 West of the 6th P.M., Weld County,
Colorado
WHEREAS,on October 26, 2009, by Resolution#2009-2808,the Board granted a two-year
extension of the submittal of the Planned Unit Development Final Plat for recording, as required by
Sections 27-8-60 and 27-8-70 of the Weld County Code, with said Final Plat to be submitted by
October 26, 2011, and
WHEREAS,the Board has been presented with a supplemental request from the applicant,
do Lee Petrides, for an additional three-year extension of the submittal of the Planned Unit
Development Final Plat for recording, as required by Sections 27-8-60 and 27-8-70 of the Weld
County Code, with said Final Plat to be submitted by October 26, 2014, and
WHEREAS,the Board of County Commissioners heard all the testimony and statements of
those present, studied the request of the applicant and the recommendation of the Department of
Planning Services, and, having been fully informed, finds that this request shall be denied and an
extension be granted for an additional two-year period, with the Final Plat to be submitted by
October 26, 2013.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld
County, Colorado, that the request of Weld 45 Acre, LLC, do Lee Petrides, for an additional
three-year extension of the submittal of the Planned Unit Development Final Plat for recording, as
required by Sections 27-8-60 and 27-8-70 of the Weld County Code,on the above referenced parcel
of land be, and hereby is, denied and an extension be granted for an additional two-year period,with
the Final Plat to be submitted by October 26, 2013.

SUBJECT: Proposed 3 year extension for collateral and recording of final
plan plat for PF-1048 (Morea Manor North)
Background: PF-1048 (A Planned Unit Development for eight (8) lots with E (Estate) Zone Uses
and three (3) non-residential outlots for open space) — Morea Manor North, was approved by the
Board of County Commissioners on November 5, 2008.
On October 26, 2009, The Board of County Commissioners granted a two-year extension for
recording of the final plat until October 26, 2011.
Request: The applicant, in a letter dated June 9, 2011, is requesting a 3-year extension (or until
the market improves) for recording the final plat and beginning construction on PF-1048 (Morea
Manor North). This extension is requested to allow the applicant time to provide Weld County
with proof of collateral for the improvements agreement for this project. The applicant has
indicated that he is having difficulty getting collateral (Surety Bond) for Morea Manor North due
to a feeble economy and unstable real estate market.
Staff Recommendation: Since this is the second extension request for this PUD. Staff
recommends granting a one-year extension from the upcoming expiration date of the previous
two-year extension until October 26, 2012.

Dear Mr. Gathman and Weld County Board of Commissioners,
I write this letter in request of a 3 year extension on providing Weld County with the proof of
collateral for the "Improvement Agreement"for Morea Manor North. As we are all aware; the
economy remains feeble and the real estate market continues to be unstable. For these
reasons, I am still having a difficult time getting a Surety Bond for Morea Manor North. Please
let me know if the County will approve this request for putting the Morea Manor North project
on hold without penalty for the next 3 years,or until such time as the market improves. I
appreciate your time and consideration in this matter and I look forward to your favorable
response.

Lee,
Here is the extension request memo for Morea Manor North. We are recommending a one-year extension (vs. a 3-year
extension). Of course the final decision will be up to the Board of Commissioners. This extension will either be scheduled
for 9 AM on Monday, July 11th or 9 AM on Wednesday, July 13th. Is there a particular date you would prefer(if you plan to
attend)?
