A detailed review of these items was not complete at this step in process. Comments made during this stage of the review process will not be all inclusive, as revised materials are submitted other concerns or issues may arise. All issues of concern and critical issues during further review must be resolved with the Public Works Department. Site Plan Review: Revise and add the additional asphalt to square up the asphalt access for the existing trucks. Revise and show on USR plat. • Improvements Agreement: Prior to recording of the final plat, the applicant needs to enter into an Improvements Agreement for the onsite and offsite work to be done. Collateral needs to be submitted to and accepted by the Weld County Board of County Commissioners prior to recording of the final plat. Traffic Study: The applicant has provided a traffic narrative and has received an access permit for this facility AP10-00112. The applicant is proposing 100 daily round trips to the facility. A right turn deceleration lane with tapers and a left turn deceleration lane with tapers will be required prior to operation of the site; both deceleration lanes are shown on the submitted plat. A right acceleration lane will be required when the trigger of 50 vehicles per the peak hour turn right of the facility. An Improvements Agreement will be needed to work out for on-site and off- site improvements. For the off-site improvements, the applicant will coordinate the effort with the traffic engineer or her representative. Preliminary Drainage: The applicant has provided a drainage report and plan for Conquest Waste Services' new C-8 facility. The drainage report was signed, stamped, and dated by Eric Wernsman, P.E. Number 33371. 1. Please address the redline comments on the drainage report and drawings that were returned to the applicant's engineer. 2. Please provide design calculations for all swales and channels that will be constructed on the site. 3. Please show the detention pond in a drainage easement on the final plat and label the volume and release rate. 4. Please include a map delineating the off-site drainage basins that drain onto the site. • 5. Please include a map delineating the on-site sub-basins that drain into the detention pond. The permit must be stamped by a registered professional engineer licensed in the State of Colorado. Please note that the grading permit will not be released until the applicant has signed the improvements agreement, posted collateral, and submitted the final plat for recording. Geotechnical Soil Report: The applicant has provided a Geotechnical Soil Report by CTL Thompson. The geotechnical report has been signed and stamped by R.B. Leadbetter Ill, P.E. Number 35516. The geotechnical report addresses on-site buildings and appears to be acceptable to Public Works. Please note that it will be necessary to provide an off-site geotechnical report that contains a pavement design for the turning lanes that are being added to WCR 77. The off-site geotechnical report is necessary to ensure that the soils in the bar ditch are suitable to building turn lanes upon. Onsite and Road Construction Drawings The applicant has provided construction drawings for both the on-site and off-site improvements. The drawings have not been stamped, signed, and dated by a registered professional engineer licensed in the State of Colorado. 1. Upon acceptance of the construction drawings, please provide 3 sets of drawings (2 24 x 36 and 1 11x17) that have been signed, stamped, and dated by a registered • professional engineer licensed in the State of Colorado. 2. Please show dimensions on the cross-section for new asphalt lanes, thickness of asphalt, and base. 3. The road cross-sections appear to show that the bar ditches along WCR 77 are being partially filled to accommodate the turning lanes into the site. Please show how the bar ditches will be re-constructed. Maximum side slopes on the re-constructed bar ditch should not exceed 4:1 to provide for mowing, snow removal, and routine maintenance. We have no objections to the proposal; however, we do recommend that the following conditions be part of any approval: We recommend that the following requirements be met prior to allowing the plat to be recorded: 1. The applicant shall file an Air Pollution Emission Notice (A.P.E.N.) with the Colorado Department of Health and Environment's (CDPHE) Air Pollution Control Division. • 2. A Ground Water Monitoring Plan shall be submitted to and approved by the Weld County Department of Public Health & Environment (WCDPHE). 3. Stormwater Discharge Permit coverage shall be obtained from the CDPHE Water Quality Control Division for construction activities. We recommend that the following requirements be met prior to receiving final approval of building permits: 1. Detailed plans for the concrete secondary containment structures for all storage and processing tanks shall be submitted. Secondary containment volume shall provide containment for the entire contents of the largest single tank plus sufficient freeboard to allow for precipitation. 2. A leak detection system shall be designed and installed beneath the concrete unloading pad(s) and sumps(s). A detailed design shall be submitted to and approved by WCDPHE. 3. The applicant shall submit evidence to the WCDPHE, Weld County Planning Services and the Colorado Oil and Gas Conservation Commission (COGCC) that the facility was constructed in accordance with application materials. • • 4. An individual sewage disposal system (I.S.D.S.) permit is required for sewage flow from the proposed office building. The system must be designed by a Colorado Registered Professional Engineer and permitted in accordance with provisions of the Weld County Code pertaining to I.S.D.S. 5. A detailed closure plan shall be submitted to the Weld County Department of Public Health and Environment and the Colorado Oil and Gas Conservation Commission. The plan shall include a description of the manner in which the well will be plugged and abandoned, as well as specific details regarding reclamation of the property. No structures or equipment associated with the facility shall remain on the property following closure. 6. The facility shall post financial assurance with the COGCC. The financial assurance shall be adequate to cover a third-party closure of the facility, including the plugging and abandonment of the well, in accordance with industry standards, and the removal of all structures (including concrete) on the facility. The site shall be returned to its original grade. The facility shall submit evidence to the WCDPHE that the appropriate financial assurance has been obtained. We recommend that the following requirements be incorporated into the permit as development standards: • 1. 'The facility shall be constructed and operated to ensure that contamination of soil and groundwater does not occur. 2. A manager, knowledgeable in operating an injection well, shall be on site when the facility is receiving waste. 3. No disposal of waste, other than Class II, as defined by the Environmental Protection Agency, is permitted. Any changes from the approved Class II use would require an amendment to this Special Use Permit. 4. Liquid and solid wastes (as defined in the Solid Wastes Disposal Sites and Facilities Act, 30-20-100.5, C.R.S.) shall be stored, treated, and removed for final disposal in a manner that protects against surface and groundwater contamination. 5. In accordance with Section 8 of the Regulations Pertaining to Solid Waste Sites and Facilities (6 CCR 1007, Part 2), an annual report shall be filed for the recycling operations, which includes the amount of produced water recycled. The annual report shall be submitted to the Weld County Department of Public Health & Environment (WCDPHE) and the Colorado Department of Public Health and Environment (CDPHE) Hazardous Materials and Waste Management Division by May first of each year. 6. This facility shall adhere to the maximum permissible noise level of 70 dBA as allowed in the industrial zone as delineated in 25-12-103 C.R.S. • 2 • 7. Fugitive dust and fugitive particulate emissions shall be controlled on this site. 8. All chemicals must be stored secure, on an impervious surface, and in accordance with manufacturer's recommendations. 9. The facility shall comply with Colorado Air Quality Control Commission Regulations and any air permits issued by the CDPHE Air Pollution Control Division. 10. All liquid wastes received at the facility shall be unloaded on the unloading pad. The unloading/loading pad leak detection system shall be constructed and operated in accordance with the approved design. The concrete unloading pad shall be cleaned at a frequency that prevents oils and other wastes from building up on the pad. During winter months, the facility shall maintain the unloading pad free of ice. 11. Analytical data on wastes and environmental monitoring data shall be made available to WCDPHE, who reserves the right to require additional more extensive monitoring. 12. All liquid and solid wastes (as defined in the Solid Wastes Disposal Sites and Facilities Act, 30-20-100.5, C.R.S.) shall be stored, treated, and removed for final disposal in a manner that protects against surface and groundwater contamination. • 13. Any petroleum contaminated soils on the facility shall be removed, treated or disposed of in accordance with all applicable rules and regulations. 14. The facility shall comply with the approved groundwater monitoring plan. 15. All storm water, which has come into contact with waste materials on the site, shall be confined on the site. In the event that storm water is not adequately controlled on the site, upon written notification from the WCDPHE or CDPHE, a comprehensive site-wide storm water plan shall be developed and implemented. The plan must be approved, in writing, prior to implementation by WCDPHE and CDPHE. 16. Adequate drinking water, hand washing, and toilet facilities shall be provided. 17. Any individual sewage disposal system (I.S.D.S.) on the property shall be permitted, installed, maintained and operated in compliance with all provisions of the Weld County Code, pertaining to I.S.D.S. 18. Any required Spill Prevention Control and Countermeasures Plan (SPCC) Plan(s) shall be prepared and maintained on-site per 40 CFR 112. 19. Water Division 1, Water District 1 Dear Mr. Ogle: We have reviewed the above referenced application for a use by special review permit for an oil and gas support operation consisting of a saltwater injection facility and a water recycling facility on two parcels, Lots A and B of RE-4538, totaling 5 acres. The submitted material does not appear to qualify as a "subdivision" as defined in Section 30-28-101(10)(a) C.R.S. Therefore, pursuant to the State Engineer's March 4, 2005 memorandum to county planning directors, this office will only perform a cursory review of the referral information and provide comments. The comments will not address the adequacy of the water supply plan for • this property or the ability of the water supply plan to satisfy any County regulations or requirements. The submitted materials indicate that a water well is intended to be the water source for the property. There is one existing well located on Lot B of RE-4538, late registered under permit no. 283983 for livestock watering, domestic, and lawn and garden irrigation purposes. The applicant must obtain a new well permit from this office prior to the use of the existing well for any commercial purposes. It is anticipated that this office could approve a commercial exempt well permit application to use the existing well for commercial drinking and sanitary purposes inside an individual commercial business, with no outside landscaping or other uses allowed. Our final determination regarding if such a well permit can be issued will be made after the well permit application is submitted to this office.
