RE: ACTION OF THE BOARD CONCERNING ZCV #0900265 AGAINST ABELARDO AND
NANCY VEGA FOR VIOLATION OF THE WELD COUNTY CODE
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, Abelardo and Nancy Vega, ZCV #0900265, are allegedly in violation of the
Weld County Code, and
WHEREAS, despite efforts by the Planning staff to resolve said matter, the violation has
not been corrected, and
WHEREAS, on the 11th day of October, 2011, a public hearing was held before the
Board of County Commissioners for the purpose of hearing testimony relating to said violation,
and
WHEREAS, at the request of Planning staff, the Board deems it advisable to refer the
matter back to the Department of Planning Services.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of
Weld County, Colorado, that ZCV #0900265 be, and hereby is, referred back to the Department
of Planning Services.
The above and foregoing Resolution was, on motion duly made and seconded, adopted
by the following vote on the 11th day of October, A.D., 2011.

REMEDY
Chris Gathman advised you last year that there was information missing which was necessary in order
for staff to process your Use by Special Review(USR-1752) application. This information still has not
been submitted to the Department of Planning Services; therefore, USR-1752 has not been able to
proceed. This USR was to permit the rodeo events and the second home(mobile home)on the property.
RECOMMENDATION
The Department of Planning Services recommends that this case be referred to the County Attorney's
Office for immediate legal action.

06/07/2010 Property Inspected Upon a visual inspection of the property, the following
items were noted: a keyhole arena is present. I also
noted a starting gate in the adjacent field. No pictures
were taken during this inspection.
06/08/2010 Other I discussed this case with Chris Gathman, Planner. He
advised that Mr. Vega did submit a Use by Special
Review application back in November 2009; however, the
application was deemed incomplete by Public Works.
Chris indicated that he sent Mr. Vega a letter requesting
the missing information back in December 2009 and had
not heard from him since. I advised him that I would
scheduling this case for a Violation Hearing on July 13. I

The hearing is set for November 10, 2009 at 10:00 a.m. The hearing will take place in the County
Commissioners Hearing Room, first floor, Weld County Centennial Center,915 10th Street, Greeley, Colorado.
Neighbor attendance will be pertinent in this case as Mr. Vega(while he still intends to obtain a permit for a
rodeo facility)at this time states he is not charging for people to use the facility and says his numbers are below
300. Without evidence of this the violation could possibly be dismissed by the Board of County Commissioners.
It Vega states he would like to eventually start charging and states that he will have an application prior to the
violation hearings, but with him claiming he does not charge there technically is no violation on the property.
Additionally,the Sheriffs office does not enforce county code so if there is not a law being broken then they are
correct in stating that there is nothing that they can do in this case.
If you are having any issues with noise please contact the Health Department, Phil Brewer, and they should be
able to help you out there.

Trina,
Mr. Vega is being scheduled into November's violation hearings. He is stating that these events are just
"friends" and is not charging so it's making it difficult as that would be the trigger to make it a definite
requirement for a permit. Are you and other concerned neighbors willing to attend these hearings on your
behalf? Otherwise there may be a chance this case gets dismissed as it did last time.

Hi Ann.
I wanted to inform you that Jorge Vega on WCR 55 and 74 is still holding rodeos. He had one this past
Saturday with well over 100 people. Probably close to 300. It was an all day event with people that appeared to
have been drinking leaving in mass droves in the evening hours.
Is there anyway you could inform the Weld County Sheriffs office that he does not have the proper
permit to be holding these events? They seem to think he is well within his rights to be holding these rodeos
and do not want to do anything about it.
I don't understand how it continues to go on but it is extremely frustrating for me as well as many of my
neighbors.
Please advise.

He had a rather large gathering on Saturday which was an all day event. One of my neighbors called the sheriff

of County Commissioners. Those meetings are the 2nd Tuesday of each month. At that time we would

I'm the North Code Enforcement Officer for the County.Talked with you a few times, on this case in particular.
We are getting reports of rodeo events at CR 55&74 again. Property owner is George or Abel Vega. I ended up
taking the case to the Board of County Commissioners back in January of this year however Mr. Vega stated he
would not hold any more events until a USR was submitted to permit the facility. A neighbor is now
complaining that events are still being held and that they have called the Sherriffs office. I was just curious if
any visits to the property were made by any of your deputies and if they noted any activity. I would just like

this past December so I was not aware of all of this. I have never attended one of their rodeos so I could not tell

Thanks for the information Trina. I put an email in to the deputy for that area to provide me with any additional
information as well. A violation will be initiated on the property and he will have 30-60 days to submit a Use by
Special Review application. Otherwise a violation hearing will be scheduled. Feel free to check in with me any
time for an update and if he does happen to be scheduled into violation hearings I will let you know. It's open to
the public and public testimony is sometimes crucial in getting legal action started on a violation as I am not

I contacted the Department of Planning Services, and the applicant is actually in the process of obtaining
a Use by Special Review(USR)Permit for the site. (Side Note for your reference: Temporary Assembly
permits, reviewed by our office, are generally issued for a one-time event, i.e. one rodeo per year). The
applicant's property is currently in violation, and in order to remedy the violation, the applicant has elected to
apply for a USR permit, seeking approval to hold rodeo events on the property throughout the year. These

permits are reviewed by the Department of Planning Services, which are thee.presented to the Planning
Commission for preliminary consideration. Final consideration is ultimately made by the Board of County
Commissioners, and members of the public and concerned neighbors are invited to speak at both hearings, or
provide written documentation for the file.
I spoke with Bethany Salzman, Zoning Compliance Officer, and she indicated if the USR permit is
approved,there will be a specified noise level enforced through the Conditions of Approval for the permit. For
now, if you have questions regarding the violation status, please feel free to contact Bethany at (970) 353-6100,

Thanks for your response. They have in fact been holding rodeos all summer long. We just moved to the area
this past December so I was not aware of all of this. I have never attended one of their rodeos so I could not tell
you if they are charging people or not but I know they have large gathers. I have had the sheriffs office go out
there on a number of occasions because of all the noise but was told there was nothing I could do about them
holding these events.

We currently do not have this property in violation. I initiated one on 9/9/08 and this case went to the
Board of County Commissioners through a violation hearing in January of this year. At that time Mr. Vega
stated he was no longer holding events. I requested the Board allow me to refer the case back to the Department
of Planning Services to monitor and ensure rodeo activity did not start back up however the Board did dismiss
the case and I had to close it.
If they are in fact up and running again and are **charging people** for events then I will initiate a new
violation. Please contact me with any new information you have and we can get this taken care of!

I contacted the Department of Planning Services, and the applicant is actually in the process of obtaining
a Use by Special Review(USR) Permit for the site. (Side Note for your reference: Temporary Assembly
permits, reviewed by our office, are generally issued for a one-time event, i.e. one rodeo per year). The
applicant's property is currently in violation, and in order to remedy the violation,the applicant has elected to
apply for a USR permit, seeking approval to hold rodeo events on the property throughout the year. These
permits are reviewed by the Department of Planning Services, which are then presented to the Planning
Commission for preliminary consideration. Final consideration is ultimately made by the Board of County
Commissioners, and members of the public and concerned neighbors are invited to speak at both hearings, or
provide written documentation for the file.
I spoke with Bethany Salzman, Zoning Compliance Officer, and she indicated if the USR permit is
approved, there will be a specified noise level enforced through the Conditions of Approval for the permit. For
now, if you have questions regarding the violation status, please feel free to contact Bethany at (970) 353-6100,
ext 3555, or by email at bsalzman@co.weld.co.us. I assure you that she is one knowledgeable lady J She
indicated a Planner has not yet been assigned to this file, as it is still in preliminary stages, but if you have any

Thank you for your help. I made a call to the sheriff last week-end regarding the noise during one of
their rodeos and was told they were applying for an assembly permit. Perhaps they have not submitted it yet. It
was my understanding that if they got the permit the noise ordinance would no longer apply and they could
gather more than 300 people. Is that correct?
