RE: APPROVAL OF RECORDED EXEMPTION NO. 357 - J. EARL SCHLUPP, ET AL.
WHEREAS, the Board of County Commissioners of Weld County,
Colorado, pursuant to Colorado statute and the Weld County Home
Rule Charter, is vested with the authority of administering the
affairs of Weld County, Colorado, and
WHEREAS, it has been determined by the Board of County Com-
missioners of Weld County, Colorado, at a public hearing held on
the 13th day of December, 1978 in the Chambers of the Board of
County Commissioners of Weld County, Colorado, that the division
into two parcels of a certain parcel of land, as shown on the
plat known as Recorded Exemption No. 357 , being the property of
J. Earl Schlupp, et al, described as part of the Southwest Quarter
of Section 7 , Township 2 North, Range 68 West of the 6th P.M. ,
Weld County, Colorado, being more particularly described as
follows :
A tract of land located in the Southwest Quarter of
Section 7, Township 2 North, Range 68 West of the
6th P.M. in Weld County, Colorado; said tract being
Wore particularly described as follows:
Beginning at the Southwest corner of said Southwest
Quarter, Section 7, and with all hearings contained
herein relative to the West line of said Southwest
Quarter, Section 7;
Thence North 00°12'41" Fact, 2527.10 feet along the
West line of said Southwest Quarter to a point on
the South right-of-way line of the C B & Q Railroad;
Thence along said South right-of-way line the fol-
lowing courses and distances:
South 71°10'34" Fast, 190.51 feet;
Thence South 69°29'37" East, 67.71 feet;
Thence South 68°27'41" Fast, 2534.41 feet to a point
on the Fast line of said Southwest Quarter, Section 7;
Thence South 00°24'56" West, 1446.05 feet to the South
Quarter corner of said Section 7;
Thence South 88°33'31" West, 2600.83 feet to the point
of beginning;
Thus described tract containing 119.010 acres;
Together with and subject to all easements and rights-

Colorado finds that this particular division of land is not
within the purposes of the Weld County Subdivision Regulations
and the Board desires to exempt this particular division of
land from the definition of "subdivision" and "subdivided land"
pursuant to its authority under Section 30-28-101 (10) (d) , CRS
1973, as amended, and Section 2-lA (3) of the Weld County Sub-
division Regulations.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Com-
missioners of Weld County, Colorado that the hereinabove described
parcel of land owned by J. Earl Schlupp, et al, be, and hereby is ,
exempt from the definition of the terms "subdivision" and "sub-
divided land" pursuant to its authority under Section 30-28-101 (10)
(d) , CRS 1973, as amended.
The above and foregoing Resolution was , on motion duly made
and seconded, adopted by the following vote on the 13th day of

RE: Recorded Exemption #357
Dear Commissioners :
The attached application, plat and related items are in reference to
a request for a recorded exemption from J. Earl Schlupp, etal. The
parcel of land under consideration is described as Pt. SW* Section 7,
T2N, R68W of the 6th P.M. , Weld County, Colorado. This property con-
tains approximately 119 acres of Class II and III irrigated soils.
The request is to split the property into parcels of 5. 00 acres and
114. 01 acres. This property is located approximately 1/2 mile south
of Colorado Highway 119 on the east side of County Road 1.
As indicated in a letter dated November 2, 1978, it is the applicant ' s
desire to retain the family residence on the 5 acre parcel . At the
present time the applicant ' s brother, Alex Schlupp, wishes to continue
residing in the residence. The prospective purchasers of the 114. 01
acre parcel have indicated that it is their present intention to con-
tinue the agricultural use of the property utilizing local people to
help with the farming.
Based upon the information submitted and the adopted policies in the
County, the Department of Planning Services Staff recommends the re-
quest be approved for the following reasons :
1 . The request conforms with the intent clause of the recorded exemp-
tion procedure (Section 9-2 of the Weld County Subdivision Regu-
lations) , the intent clause of the Agricultural Zone District
(Section 3. 3 A. of the Weld County Zoning Resolution) , and the
Weld County Comprehensive Plan in that the uses will be compatible
with surrounding agricultural uses. The request will allow agri-
cultural and related uses to be the predominant land uses. There
will be no reduction in the amount of land currently being used
for agricultural production at the present time.

Re: Application for Recorded Exemption - Schlupp.
Gentlemen:
I am an owner and agent for the other owners of the
Schlupp family farm. We own 119 . 01 acres southeast of Long-
mont adjacent to Weld County Road immediately south of the
Burlington Northern Railroad. The land is intersected by
the St. Vrain Creek and Dry Creek. It is our desire to re-
tain the family residence together with five acres. At the
present time my brother, Alex Schlupp, wishes to continue to
reside in the family residence . The balance of the land
will be sold and is presently under contract. The purchaser
requires a right of first refusal on the five acre portion.
The proposed exemption would not alter the general
use of property in the neighborhood, which is zoned agricul-
tural , or have any adverse effect on the surrounding proper-
ties.

north of the Schlupp premises. Two members of my family,
Mr. Richard Nyman and I have entered into a contract to

TO WHOM IT MAY CONCERN:
The soil belonging to Earl Schlupp and Gordon Starbuck, located
in the SW1, Section 7, Township 2 North, Range 68 West, appears
not suitable for a conventional septic system because of high
groundwater (approximately 4.5 to 5.0 feet) . However, the exact
suitability of the soil cannot be determined until a soil perco-
lation test is performed.
