Bridge Street, Brighton, Co. 80601 303-654-1048 Division 10 STATUS REPORT TO THE DISTRICT COURT PERTAINING TO CLEAN UP OF HORSE RANCH PROPERTY COMES the Defendant, Trenton H. Parker, pro se, and submits the following narrative "Status Report" to the District Court pertaining to the horse ranch property situated in Weld County, Colorado; To Wit: 1. On July 8, 2009, the Court put me in jail subject to a $15,000 bond on me. That day the 23 horses which were stabled at the ranch had not been fed or watered and, I had no idea how long I would be in jail. Therefore, it was necessary to bond out of jail as quickly as possible and attempt to find a way to save the horses. The cost of the bond wiped out the last of the investors' money, leaving a net cash reserve in the amount of$7.38. There was enough hay to feed the horses for three days (32 bails). I feed 10 bales of hay a day at an average cost of$5.00 per bales. There was ''A day of water left in the water'tanker. The horses go through 750 gallons of water per day which must be haled in from Fort Lupton every day, regardless of weather, at $15.00 per day. It costs about $25.00 per day to cover all of the other expenses - such as food, grain, gas, propane, fuel, etc. Therefore, it takes $100.00 a day to operate the horse ranch under the best of conditions and that does not count any other costs or expenditures. On Friday July 10, 2009, following the contempt of court hearing, the two outside parts of the triple-wide bank building, which belonged to Robert Lang, were finally haled off the ranch property. It took several years of advertising, three court cases, and three sales to dispose of that building. It took the next 8 days to: Remove the walls from the flooring deck; Remove all of the electrical conduit from the floors and walls; Crush the center wall sections, pile them up and burn the side walls down to ash. 3. Since I had no money, I did not get the legally required state demolition permit nor did I have the building inspected by a"Haz-Mat" Inspector, inasmuch as the bank building would never pass a "Haz Mat" inspection due to the asbestos which was used in the building's insulation. Thus, I followed the Court's wise suggestion. I burned the center section down to the ground; I then dug 2 large holes (12212x12) and after removing the nails and metal with a magnet, pushed the ashes and toxic waste into the holes and then covered them up. Hopefully, no one will ever find out about the matter. Thereafter, I continued to carry on with my usual daily clean up activities. 4. On July 22 and July 24, 2009, "ICE Agent Salzman" contacted me by phone at the ranch ("ICE" stands for"International Code Enforcement" which falls under the "International Building Code" which has been adopted by Weld County). ICE Agent Salzman and I had a less than cordial phone conversation. The net result of the conversation was that, based upon her testimony in court and the conversation over the phone, there was no need to have ICE Agent Salzman come out to inspect the horse ranch property. 5. The whole matter was very simple. Not surprising, every single item on the horse ranch property, except a 40 year old tractor and a 20 year old front-end-loader was in violation of Weld County's International Zoning Code - as interpreted by ICE Agent Salzman. In order to comply with the Court's Orders, I had to build an 8 foot fence around the 45 acre ranch property so our "junk yard" could not be seen by any neighbor. The estimated cost of the materials to build Weld County's version of the Great Wall of China, amounted to $68,800.00 - not counting paint or labor. It takes time and money to build a fence. I checked my pockets and found that I did not have but a few dollars and the real owners/investors of the horse ranch property were already well on their way to the poor house—thanks to Weld County. 6. There is an old saying: The army is trained to build fortresses while the Marines are trained to storm them. In short, given the situation at hand and in order to comply with the Court's Orders, and given the desperate need for money on a daily basis, the battle plan called for- "Operation Slash, Burn and Scrap" to be instituted. 7. It was generally determined that everything on the horse ranch was "My Junk" or someone's "Junk" or just plain "Junk." The logical question then would be: Trenton! - Why don't you just haul all of those old "Junk" office trailers (Mobile Homes) off to the junk yard? There are "Four" good reasons why that has not been an option available to me. The First good reason is that we already got rid of all of the large trucks that could pull a large "80 foot construction trailer" - now converted into a portable horse stall. The Second good reason is that I am dead broke and don't have the $500.00 per trailer to hire someone to take the trailers to the land fill (dump). 8. The Third good reason is that, I do not have the titles to the trailers which one must have before you can dispose of a trailer at the landfills. And the Forth good reason is, that I do not have the $25.00 per foot to pay the landfill. An 80 foot trailer costs $2,000.00 to take to the dump. There are 3 office trailers, 3 portable hay shed trailers, and one 80 foot portable horse stall trailer all totaling about 430 feet in overall length, which comes out to be about $10,750 in dump fees and $3,500 in transportation costs totaling $14,250. I do not have $14,250.00. 9. As much as people may not like it,"Collateral Damage" goes hand in hand with war. That is to say,there are times that innocent people sometimes have to die or suffer and unfortunately the same holds true when one encounters a heartless government bureaucrat. At all time hereto, I have operated on the assumption that one zoning code violation is no less serious than another. Therefore, it was necessary for me to move as quickly as possible to stamp out ever zoning code violation while, at the same time, keep some form of cash flow coming in so as to keep the horses feed and watered or until it was necessary to kill the horses rather than to let them be hauled off to a public auction during a falling market, thereby resulting in the horses ending up south of the boarder in some Mexican slaughterhouse. 10. I have been careful to document as much of the past two months with pictures as possible. However some of the early work was not photographed simply because I did not have the money for the camera and film, let alone for the cost of developing the pictures. 11. During the period from July 9, 2009 and September 3, 2009 there was 7 days of down time due to equipment failure and repair of the front end loader, the water tanker and the ranch pickup truck. . There was 5 day of down time due to my cutting the back of my left hand with a high speed metal cutting blade requiring emergency medical treatment- stitches and splints. There were 5 days down due to another case of"bronchial something." All other days have been full working days, while still taking care of the horses and the ranch with no help. 12. The ICE Agent said that all school buses, if not being use as school buses, are considered commercial vehicles and therefore constitute a zoning code violation. Pictures 1-4 shows Nancy's bus which she bought for $3,500. She has spent the last year sanding and fixing it up to be used as a camping bus. She purchased new carpet and various other items to go into her camper. She was intending to have the bus painted before winter. She kept the title in the bus. The bus did not have current plates. Thus the bus was illegal! So, I got into the bus, got the title, and hauled the bus to the crusher, signed the back of the title and got about$550.00 for it ... which did not even cover the price of the new tires that Nancy had put on her bus. I pilled all of the bus's content out on the ground- and Nancy still does not know that her bus is history. 13. Bus #2 belonged to Marjorie. See pictures 5-8. The license plates were expired and one of the brake lights was burned out and therefore the bus was not"Road Worthy". The bus title, along with all of the other papers (registration/Insurance), were kept in the bus. I loaded up the bus on a flat bed trailer and took it, along with the title, to the crusher and got $560.00 for it. The contents of the bus have been placed out on the ground, as every form of storage on the ranch has been declared to be "illegal!". 14. Picture #9 is one of four portable Tough Sheds that were mounted on a trailer frame and use for storing personal items and horse gear. Three women investors chipped in to buy the shed and trailer for about $2,000. However, the ICE Agent said it was a"Mobile Home", so it is "illegal". The trailer was registered as a "home made trailer". However, it did not have tail lights, break lights or turn signals so it was not "Road Worthy" and the Registration was not current. So, I pushed the Tough Shed off of the frame; placed its contents out on the ground; burned the building down, and chopped up the frame and sold the scrap metal for $46.00. 15. Pictures 10 and 11 show a beautiful 2002 GMC Suburban worth about $12,000. It belonged to one of the female investors. It needed a head gasket which would take about 3 days to install at a cost of about $300. Therefore it was not"Road Worthy". I said I would fix it for free when I had the time. The registration had expired in June of 2009, and therefore the SUV was "illegal." I could not get my hands on the title, so I hauled to over to someone who runs a "chop-shop" and got $500.00 for it—no questions asked. 16. Pictures 12 and 13 show a 1989 Dodge Omni which was purchased for $750.00. One of the women investors got it to give to her grandson on his 17th birthday this November. The car was clean and in very good condition except that it needed a right tail light assembly which would cost about$35.00— therefore it was not "road worthy", and it did not have a current registration, therefore, it was "illegal". I could not get the title, so off it went to the"chop shop" and fetched $125.00— no questions asked. This is one birthday that will probably not be forgotten soon. 17. The investors, from the very beginning, had a foolish business practice of paying for everything as they went- bit by bit. They had almost paid for all of the support beams necessary to complete the proposed poll barn. However the ICE Agent determined—sight unseen - that all of the steel beams were just junk- and they had to be hidden behind an eight foot fence. All builders know that it is always easier to destroy something than it is to build it. Therefore, I gathered up all of the structural steel and everything of metal that might fetch a buck, including all of the womens' appliances, and hauled them off to the scrap metal yard. There is now no steel framing to build the pool barn with. There was about$12,000 in structural steel which brought in about $600.00 in scrap metal. See pictures 14-17-A. All of the steel on 17-A was scrapped, along with the trailer after the YIN Number had been torched off- as I did not have the title. 18. Pictures 18—22 shows Meg's car hauler with her winter fuel tanks. The trailer did not have a license plate so it was "illegal". I took all of her tanks to the scrap yard. I did not have the title so I cut the deck off and burned it up and then cut the trailer frame up and scrapped it. The trailer in picture 23 is history! 19. Pictures 24 and 25 show glass windows and doors stacked on a flat bed storage platform(Mobile Home). These "hard to find" windows belong to Marge, who collects them. She sells the windows for $25.00 to $50.00 each, to help supplement her social security. She averages about$100.00 per month. But the court found the windows to be "Junk." So I smashed the glass out of the windows and hulled the aluminum off to the scrap yard for 14 cents a pound. I have one more load of windows to haul away before I can start scrapping Marge's construction platform (Mobile Home). 20. Pictures 27-31 show an old horse trailer with a forward compartment and a rear horse area. The trailer was purchased for the sole purpose of using it as a horse stall in the back and to store grain and horse blanket in the forward compartment. It was never intended that the trailer ever go back on the road. But the ICE Agent has deemed it illegal because no one is allowed to use a trailer for storage, and it must be registered and plated and be "Road Worthy" - and it must have all of the lights working so ... the horse trailer is "illegal". Therefore, I have had to replace 3 roof sections, replace 6 windows, add 4 tires, fabricate a back end, recreate a new lighting system and throw all of the grain and blankets out side on the ground to mold and deteriorate. Some may find it hard to believe, but such an undertaking is not cheap and it is not a one day job. 22. Pictures 32-40 shows the full and complete destruction of a flat bed construction platform from beginning to end. It takes me (one person) about 3 or 4 days to complete the full destruction of one of these flat bed trailers (Mobile Home). It costs about $50.00 to run the blow torch. After everything is finished there is about a thousand pounds of steel. Steel is selling for $100.00 a ton, which means that I am only going to get about $50.00 for the scrap. In other words, the whole undertaking is a losing proposition. Remember, it takes $100.00 per day to run the horse ranch. Those who receive regular paycheck seldom appreciate those who do not. 23. Pictures 41-44 shows four "illegal" trailers that are currently on the ranch property. The blue horse trailer is illegal because we store the empty propane tanks in it until it is time to take them to the Ace Co-Op to get them refilled. You can not use any trailer for storage. The black water trailer is "illegal" because the ICE Agent has classified it as a "Mobile Home" - because it has mobile home "like" tires and is made from a mobile home "like" steel frame .... even though it is registered as a home made trailer and has current license plates, it is still "illegal". The green fencing trailer in picture 43 is "illegal" because it is not registered, it has no license plate, and it does not have brake lights and turn signals. Just think about it. You are out in the back 40 laying fence and while making a turn, you run over a jack rabbit because it became confused because you didn't have your turn signals on! The little yellow washer trailer in picture 44 is "illegal" for all of the same reasons as the that of the green fencing trailer. 24. Picture 45 shows an all steel box horse stall which is "illegal" because the ICE Agent has decided that the county code forbids the removal and use of a truck box off of a truck. Whereas, the horse stall shown in picture 46 is ... "Legal"! 25. Pictures 47-51 show a registered home made portable hay storage trailer with a grain storage room. The Weld County Ice Agent has decided that this trailer is really a "Mobile Home" and therefore it is "illegal" - and because nothing is allowed to be stored in a trailer. The hay is now out on open deck, which will probably be declared to be "Illegal" and in violation of some one or more of the county codes. I have 2 or 3 days left to finish painting the unit in order to deliver it to a buyer in Elbert County for $500 ... after spending$3,000 in materials to build it. I have spent nearly 2 weeks finishing off this hay storage trailer (Mobile Home). 26. Picture 52 shows the area where the old triple wide bank building was. The whole area has been cleaned up. 27. Pictures 53 -56 shows the investors personal property (JUNK) stored on flat beds to keep the items safe and up off of the ground. 28. Pictures 57-60 shows good personal property being dumped on the ground because there is no place left to put it, and because I have neither the time, materials or money to keep building"ICE" fences around everything. 29. Pictures 61-63 shows the legal tractor which is out of commission. It will take $400 to get it running and I don't have the money. Without the tractor, I can't use the PTO to dig the holes to build two miles of fence. Picture 63 shows the front end loader being repaired. Without the front end loader, the whole ranching operation shuts down. 30. Pictures 64-66 shows the actual surrounding area of the horse ranch without the use of the ICE Agent's telephoto lens. The closest neighbor is ' mile away. 31. Pictures 67-68 shows a good truck which I am in the process of cutting up since I don't own it and I do not have the title— "chop shop." Pictures 69-72 shows more destruction and burning. I have been doing as much destruction, demolition, torching, burning and hauling as I can and still try and keep the cash flow coming in and the horse ranch running. 32. The whole ranch would have already been moved if the County Attorney had not slandered the title by filing a les pendence and chased away the lenders, and that is a fact. Trenton H.
