WHEREAS , the Board of County Commissioners of Weld County , Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, are vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS , a public meeting was held on the 5th day of January, 1977 in the Chambers of the Board of County Commis- sioners , Weld County, Colorado, for the purpose of hearing the petition of the Humane Society of Weld County, Jerre F. Largent, President, 1325 7th Street, Greeley, Colorado 80631, requesting a special use permit for the construction of an animal shelter on the following described parcel of land: A tract or land located in the Southeast Quarter (SE'--&) of Section 1 , Township 5 North, Range 65 West of the 6th P.11. , Weld County, Colorado, lying North and West of the Ogilvy Ditch as the same is now constructed, and being more particularly described as follows: Beginning at the North Quarter Corner (N!r. Car) of said Section 1 , and considering the North-South centerline of Section 1, as bearing South 00°33' 14" West, with all other bearings contained herein being relative thereto; Thence South 00°33' 14" West, along the North-South centerline of said Section 1 , 3175. 57 feet to a point on the Southerly R-0-W line of Colorado State Highway No. 263; Thence along said Southerly R-0-W line North 78°10' 11" East, 1100.70 feet to a point, said point being the True Point of Beginning; Thence continuing along said Southerly R-0-W line North 78°10' 11" East, 312.63 feet to a point on the approximate Northwesterly R-O-W line of the Ogilvy Ditch as the same is now constructed; Thence along the approximate Northwesterly R-0-W line of said Ogilvy Ditch the following courses and distances: South 16°52' 20" East, 86. 12 feet; South 21°42'45" East, 213.39 feet; South 09°28 ' 09" West, 84. 09 feet; South 50°06'41" West, 103.06 feet; South 77°33 ' 22" West, 135. 50 feet; South 79°23 '31" West, 159.38 feet to a point; Thence leaving said Ogilvy Ditch R-O-W and continuing North 03°47 '04" West, 425. 12 feet. to a point on the Southerly R-0-W line of said Colorado State Highway No. 263 said point being the True Point of Beginning. WHEREAS , petitioner was present, and WHEREAS , the above-described parcel of land is located in an agricultural zone as set forth in a the Weld County Zoning ti/tP`n'Resolution, and PL0964 y f c 770335 WHEREAS , Section 3. 3.E. 4 of the Weld County Zoning Resolution authorizes such a use in an agricultural district on the grant of a special use permit by the Board of County Commissioners,and WHEREAS, the Board of County Commissioners has considered all the testimony and statements of those present, has studied the request of petitioner, and has studied the recommendations of the Weld County Planning Commission having been fully in- formed and satisfied that the requested use complies with the Weld County Comprehensive Plan, and the provisions of the Weld County Zoning Resolution. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that the application of the Humane Society of Weld County, 1325 7th Street, Greeley, Colorado, 80631, for the construction of an animal shelter, be, and hereby is granted, subject to the development standards contained in the special use permit. " This determination is based upon the follow- ing: (a) The City of Greeley Planning Commission has indicated the City of Greeley has no objections to the proposed animal shelter. (b) The Weld County Municipal Airport Board indicated the proposed facility would be compatible with the airport develop- ment and they had no objections to the proposal. The proposed shelter facility shall not exceed the height limitation in the horizontal surface of the airport as set forth in Section 3.13 (3)(a) of the Weld County Zoning Resolution and as displayed on the WEld County Municipal Airport Zoning Map. The elevation of the proposed site is approximately 4625' which is 173' lower than the horizontal surface elevation of 4798 ' . (c) The Western Hills Fire Protection District has indicated the fire district has no objections to this new facility. (d) The WEld County Engineering Department indicated they did not identify any engineering problems associated with the proposed development. (3) The Weld County Health Department has recommended approval of this request indicating the proposal is in compliance with all applicable Weld County and State Health stand- ards and regulations. (f) The State Highway Department has indicated they have no objections to the proposal. (g) The Ogilvy Irrigation and Land Company has indicated they have no objections to the new animal shelter facility. The Planning Commission XXKXX recom- mendation of approval is conditional upon the Special Use Permit plans being amended to show the additional 35 feet of right-of-way for State Highway 236 requested by the State Highway Department. As set forth in the development standards the additional right-of-way shall be protected by setback. Verbally, Mr. Noffsinger indicated he opposed the proposal due to the noise, odor, and increased traffic he anticipates from the development . (b) Any structure including communication towers and/or antennas in excess of 40 feet above the site elevation must have the approval of the Board of County Commissioners who ,shall re- ceive a recommendation from the Weld County Municipal Airport Board before making their decision. Radio towers and other uses similar in nature must be approved through the Con- ditional Use Permit process. (c) Precautions shall be taken in the manner in which the lighting is installed on the pro- perty so as not to create a safety hazard for landing aircraft. Lighting shall not be flashing or blinking and colored lights shall not be permitted. (3) The Special Use Permit area shall be maintained in such a manner so as to prevent soil erosion, fugitive dust, and the growth of noxious weeds. As a representative of the University of Northern Colorado and acting director of the Campus Police Department, I would like to inform you of the fine job that they do for us. As you probably are aware, the students at the University are great animal lovers. The per capita number of animals within one-half mile of the University is probably greater than anywhere else in the County. Because of the students° generosity in wanting to feed and care for them, the University has an abundance of stray animals (snakes, badgers, birds, skunks, etc) . The Weld County Humane Society has responded to our area over the past years and has done an extremely fine job. Their personnel are college age and are sympathetic with the students. They handle the situations well and do not hassle people. The Humane Society provides information at registration to all students who request it. This educational procedure on their part has helped our department and the community as well. The University has subsidized the Humane Society the last two quarters and is happy with their response to our problems. Will this Shelter have Security Watch 24 hours a day? (2) . If no Security Watch is planned, what will prevent vandalism from dogs being scattered all up and down the river bottom? (3) . To maintain this Shelter with {, good security Match would surely be a much greater expense to operate than the one already located in the city limits of Greeley where the City Police patroll the area regularly. Dear Sirs: As indicated in our previous letter, we oppose the granting of this permit. Our reasons are many. The purpose of this letter is to again voice our opposition to the construction of this facility at the proposed lo- cation and at the present time. A few of our reasons for opposing are as follows: 1. Prior to the gift of the proposed building site to the Humane Society by the county, we had completed a complex and expensive facility to accomodate our prize herd of registered Limousin cattle directly across the highway from the proposed building site. These cattle originate in France, and are relatively new to this country. They range in value from $1000. , to #3000.00 per head. Of the 398 acres that we own which joins the proposed site both along the North directly across the highway, and to the West, joined by fence line, the center of our cattle herd opperation is focused directly across from the proposed site. Improvements W our facility imclude complete fencing of the ex- terior of our 171 acre parcel and a complete complex system of fences and gates separating the pastures and farmland. We also cleaned and cleared off old dead trees at an existing lake on the property which had filled with silt. 2. At the lake site which is directly across the road from the pro- posed shelter site, Mr. Robert W. Noffsinger, President and owner or our company, intends to build a new residence. 3. We presently have an establised access to and from the highway and we believe the site would need to acquire one, which we feel will cause traffic safety problems at this specific location. 2 4. One of the main reasons we purchased the property in question is because for several years we tried to raise and keep cattle on an acreage directly behind Ellis & Capp Equipment Co. , which is directly across the highway from the present facility of the Humane Society. We continually had cattle run through fences and injured by being physically attacked by dogs. We feel that the numerous running dogs in the area were due to the close proximity to the Humane Society shelter and that the barking animals hindered the normal reproductive process of the cattle as we had an unusuily high percentage of open heifers and cows. We also have had newborn calves torn apart and killed by dogs. We have a continual problem at our feedlot facility on the edge of Ault, Colorado, with dogs, and along with our more severe problems near the Ellis & Capp location, can forsee nothing but future problems if the fvoposed facility is allow- ed at the proposed site. 5. On September,27, 1976, we, along with approximately 200 other property owners within about a 5 square mile area surrounding Weld County Municipal Airport, were subjected to a public meeting for the purpose of considering designating approx- imately 14 sections of land surrounding the airport an "area of state interest." This would have most likely meant that no zoning changes and/or construction of any kind would have been alloyed for about 18 months, until the airport "Master Study Plan" presently underway could be completed, adopted and implemented. In a surprising move, the meeting was opened by a statement by the chairman of the airport board that after further study and consideration was given to the matter that the airport board and the county had decided that this designa- tion of an area of state interest was not at the present time after all because of the techIicalities involved. It was argued atk the time of the opening statement that such a state ment should determine the meeting closed, but it was the wish of the airport board chairman to continue, stating a desire to pass a resolution requiring any property owner desiring any construction or land use change to come before a public hearing for approval or denial. After much opposition by the landowners present and a couple of motions to approve the public hearing resolution by a couple of county commissioners, it was decided finally after two hours, that things should re- main the same regarding zpning policy in the area, with a last pleats to the landowners to take no action with regard to doing anything with their land which might interfere with the airports Master Plan. We wonder if the decision not to place a moratorium designating the area an area of state interest might have been in anticipation of allowing or at least considering this Humane Society request and perhaps other county interests on county owned land. 3 We feel that if this permit is granted, that in a sense the county will be initiating exactly the type of thing that the county did not and does not want the individual landowners to do and that the county will be taking the first initial step toward interfering with the Airport Master Plan, presently in progress at a considerable taxpayer expense. Our company is in no way against the Humane Society, but certainly feel that for the above reasons we must oppose the granting of this permit. After the completion of the master plan and guidelines are set up with regard to such, we might offer some suggestions for a better location of a future Humane Society Animal Shelter location if given the opportunity. There is no question about the need for such a facility. The present one is lacking in both space and modernity. The problems in Greeley and Weld County are severe. The community's dependence on the Weld County Humane Society is both gratifying and problem-generating. The construction of a facility would help in solving those problems. I have watched with interest and approval the dedication of the staff of the Humane Society. I am personally supportive of their philosophy and have witnessed that philosophy in action. The Society has responded positively to requests from the University for educational programs and for occasional direct action in the "fish-bowl" environment of the campus. They have responded well. In addition, my family watched the Humane Society deal with a former family problem pet in a humane way and we currently have a delightful pet acquired through the Humane Society. ATTENDANCE. Present: President-Phil Brewer, Tom Carter, Harlan Houtchens, Ernest Martin, Roy Moser, Don Preston, and Warren Terry. Absent: Gordon Johnson and Jerry Ratliff. 2. APPROVAL OF MINUTES OF OCTOBER 13, 1976 REGULAR MEETING AS MAILED TO EACH BOARD MEMBER. Motion by Warren Terry and seconded by Roy Moser that the minutes of the October 13, 1976, regular meeting be approved as written. Motion carried unanimously. 3. REPORT BY BUILDINGS AND GROUNDS COMMITTEE CONCERNING AIRPORT SIGN. Tabled to December meeting. 4. REPORT BY BUILDINGS AND GROUNDS COMMITTEE CONCERNING DRAINAGE PROBLEM. Russ Anson reported that he and Barton Buss met with Greg Isbill and Mr. Isbill suggested that they leave the drainage problem alone as he will include this in the Master Plan. 5. REPORT BY BUILDINGS AND GROUNDS COMMITTEE CONCERNING DOORS ON HANGAR OCCUPIED BY NOLAN. Ernest Martin reported that the cost would be approximately $4500 to $5000. Therefore, he felt we could do this much cheaper by doing it in-house. The Board asked Ed Beegles to make up plans and advise them of the cost. ( " 6. REQUEST BY AERO-WEST FLYING CLUB CONCERNING CONSTRUCTION OF ADDITION TO BUILDING. Aero-West Flying Club presented a sketch of restrooms which they desire to build, and after a short discussion, motion by Tom Carter and seconded by Roy Moser to approve. Motion carried unanimously. 7. DISCUSSION OF BUILDING BIDS. Motion by Tom Carter and seconded by Don Preston to accept the bid of Growling Bear Company, Inc. to build a 20' X 24' concrete block office building for the amount of $12,130.00. 8. RECOMMENDATION BY COMMITTEE CONCERNING AERO-KINETICS LEASE. The Committee recommended a proposal on standard lease provisions for rental rates on long term leases. The recommendation was for an annual increase in rent based upon standard cost of living increases and a five year review of all lease agreements with the option of the Board to adjust rental rates to a standard rate as determined by the discretion of the Board. Also, the lessee would have the option to terminate their lease agreement if they felt the rental rates were unjustly high. The proposal was discussed and several objections were made by lessees which were present. A second proposal was made by Russ Anson. He suggested a 20 year lease term with five year options to renew on the part of the lessee. The Lessor would have the right to an annual review of rental fees and to raise the rental rate to the general rate charged for comparable property at that time. Motion by Tom Carter and seconded by Harlan Houtchens to reject the committee proposal and to accept the proposal by Russ Anson. Motion carried unanimously. 9. FURTHER REPORT CONCERNING BUD CLEMONS HANGAR PROPOSAL. Tabled to the December meeting. The President asked the Secretary to set up a special meeting within the next two weeks and to notify all parties concerned to be present. November 9, 1976 Page 294 10. OCTOBER FINANCIAL REPORT. The October financial reports were presented and there being no questions, same as on file with the Secretary. 11 . MANAGER'S REPORT. Ed Beegles complimented Aero-Kinetics on the way they have fixed up the Terminal Building. 12. OTHER BUSINESS. Ken McWilliams gave a short presentation on the animal shelter facility which the Weld County Humane Society had submitted an application for a special use permit. This facility would be in the proximity of the Airport. Motion by Roy Moser and seconded by Tom Carter to accept the location of the animal shelter facility. The President advised,Mr. McWilliams that the facility would be at the end of the runway if and when the second one is built. Don Stone, member of the Greeley Chamber of Commerce Aviation Committee, gave a short presentation on what the committee was doing. The goals of the committee are self education, public education, and facilitation of city/county support. They are writing letters to other cities asking how they manage and finance their airports. AMENDMENTS TO ZONING ORDINANCE: PARKING REQUIREMENT FOR ELDERLY HOUSING John Given, Current Planner, reviewed the memo to the Planning Commission regarding the proposed amendment to Article 6, Section 23-606 of the Zoning Code. In response to Commissioner Keirns question about limiting the change to residences for elderly and handicapped that are publicly owned or financially assisted, Planning Director Sam Sasaki re- sponded that this covers units that are generally low-income with limited car ownership. Mr. Sasaki also said that a procedure will be set up for appeal to the Planning Commission. Several Commissioners commented on the 2 block and 5 block limita- tions in the proposed amendment. Mr. Sasaki indicated these figures were used so it was fairly definable instead of a term like "general proximity" which would be open to numerous interpretations. It was suggested that the word "approximately" be inserted in the amend- ments. Dr. Kemme of Greeley Manor was present and commented on the amend- ments. The Division of Highways has no objections to the proposal . However, consideration should be given to the preservation of at least the minimum right of way that will be needed for improvement of SH 263. Projecting present traffic volumes 20 years hence will require a minimum of 150 feet of right of way (75 feet each side of centerline) . The additional right of way needed to meet this requirement should be protected by reservation, setback, or dedication (preferably the latter) as local zoning laws and regulations permit. Where the County may have a comprehensive plan for the area showing sidewalks, bicycle paths, noise berms, etc. , to be built adjacent to the highway, additional right-of-way widths must be reserved to accommodate these facilities. The developers have met the Division's usual request for noise setback from the nearest travel lane. The plat shows a building setback of 150 feet from the front property line. Generally, we request a noise setback of 100 feet to 150 feet from the nearest travel lane. Due consideration must be given to runoff attributable to the development proposal . In general , the developer must not re-contour the land so that water will drain onto the highway right of way where it has not historically done so. Where a drainage system has been developed and an increased runoff or rate of runoff is attributable to the development proposal , the developer must provide necessary on-site drainage retention ponds to hold the increased runoff attributable to the development proposal . If this is not possible, the developer must bear the cost of new or enlarged drainage structures on the highway right of way. Also, drainage from sewage lines, sewage ponds, or other waste water will not be permitted to drain onto the highway right of way. Box 789 Greeley, CO 80631 Dear Mr. Largent: The soils found in the SE's of Section 1, Township 5, Range 65 are Dacona Clay loam, Bankard loamy sand, and Sandy breaks and terrace faces. Dacona clay loam is moderately shallow, moderately well drained soil. It has a heavy textured surface and subsoil. Water intake is slow and water holding capacity is good. Bankard loamy sand is a shallow soil with light to moderately light textured surface and subsoil. The soils are subject to overflow. Water intake is rapid and water holding capacity is poor. Sandy breaks and terrace faces is a shallow well drained steep soil. The subsoil has no development and grades into gravel. Water intake is rapid. Water holding capacity is poor. Extreme erosion hazard from water. These soils should pose no immediate problems for the proposed Human Society Shelter. The soil survey is made on the basis of 50 to 60 inch borings. The information should be used for general planning and does not exclude the need for on-site investigation for specific engineering purposes. Indluded is a plan map , a record of coopera- tors decisions , seeding recommendations soils information , and field windbreak standards and specifications. I recommend leaving the area in a native state. During contruction of facilities it is advisable to protect the adjacent native area from damage. If the area is damaged enough to denude the vegetation , weeds will appear. The seeding recommendations will give you some guidance if damage occurs. The trees for field windbteaks can be purchased through the Soil Conservation District at a very reasonable price . Order blanks will be available in December of each year. The plant materials for beautk fication purposes can be obtained form the Soil Conservation Service at no charge if such plant material are available. The roots of tree and shrub planting stock must be kept moist x after being received by the cooperator and before planting. t.' , b. The planting holes or furrows must be deep enough so that the roots are not curled or crowded. • c. The seedling must be planted with the root collar at or not more than 1 inch below the ground level. d. The soil must be compacted around the roots. • e. Cultivation should be timely and frequent enough to keep the planting reasonably free of weeds. b. A strip of 12 feet or more will be cultivated beyond the outside rows of the planting, except on sandy soils. (See Item 2-C) . c. The planting will be protected from fire and grazing. d. Replanting of trees that do not survive the first year should be made the following year. e. When weed control is done chemically, the following precautions and rates will be observed. Chemicals must be applied on no less than a 24-inch band over the row. No chemical is to be applied in the remaining area between the rows. Do not cultivate or disturb the treated _., area. The ridges left by the tree planter should be leveled before chemical application. Chemicals must be applied acccrding_ to soil type, age of trees, and species. The facility selected, located east of Greeley, is the old Wyatt School, Howard Kennedy, Youth Shelter Home Director and Dan Fowler, Social Services Supervisor, assisted Mr. McKenna in further expressing the need, Included in the Social Services budget for 1977 was $7,200 for rental of a facility for this project. However, the total cost for the year will be $12,000. After much discussion, Commissioner Jacobucci made amotion to approve the one year lease rental of the Wyatt School at the $12,000 lease rental price. Commissioner Roe seconded the motion. Commissioners Jacobucci, Roe and Chairman Steinmark voted aye. Commissioner Dunbar did not vote. The motion did carry. HUMAN RESOURCES EMERGENCY ENERGY GRANT FOR 1977, ONE-TIME-ONLY SENIOR NUTRITION PROJECT, SENIOR NUTRITION GRANT REQUEST FOR 1977, AND SENIOR NUTRITION AFFIRMATIVE ACTION PLAN: Mr. Speckman, Human Resources Director, reviewed each individual grant and answered questions. On the Senior Nutrition Grant Request for 1977, Chairman Steinmark asked that reports be filed periodically, reflecting the various activities. There was an individual motion and second to approve each of the grants reviewed by Mr. Speckman. Each motion carried unanimously. The Chairman called a break. (Change Tape #77-5) SCHELLENBERG LIQUOR LICENSE: Arthur Roy, Legal Counsel representing the Schellenbergs, was present and requested that due to the distribution of the residents in the Roggen area, the neighborhood to be served be enlarged. Mr. David, County Attorney, stated that he could see no problems with the request. After discussion, Commissioner Dunbar made a motion to increase the area to 16 square miles. Commissioner Jacobucci seconded the motion. There was additional discussion regarding the radis of the area to be served, afterwhich, the Commissioners making and seconding the motion withdrew their action. Mr. David referred to a map and therefrom read the legal discription encompassing a 64 square mile area for service. Commissioner Dunbar made a motion that the legal discription read by Mr. David be designated the neighborhood to be served. Commisioner Jacobucci seconded the motion and it carried unanimously.
