SOLELY OF A STREET RIGHT OF WAY FROM THE TOWN OF PIERCE WHEREAS, certain property known as Highland Addition an addition to the Town of Pierce was annexed into the Town of Pierce on August 3, 1970; and, WI IEREAS, such property is located in the southwest quarter of Section 26, Township 8 North, Range 66, West of the 6th P.M.; and, WI IIiRI?AS, when such property was annexed into the Town of Pierce it was common to annex the entire parcel including one half of the county road right of way; and, WHEREAS, the north one half of County Road 88 commencing at the west right of way of US I lighway 85 and extending approximately 1200 feet west of US Highway 85 is divided along the approximate center line of County Road 88, with the north one half of such parcel being within the Town limits of the Town of Pierce and the south one half of such county road right of way being outside of the Town limits; and, WHEREAS, all of the remainder of County Road 88 including where it is adjacent to the Town of Pierce lies outside of the Town of Pierce; and, WI IEREAS, such divided rights of way create uncertainty and difficulty in maintenance of the roadways; and, WHEREAS, the Town of Pierce believes that it is in the best interests of the Town of Pierce to disconnect that portion of County Road 88 between US Highway 85 and the approximate center line of First Street east of the US Highway 85 and the approximate center line of First Street from the Town of Pierce. NOW THEREFORE 1313 IT ORDAINED BY THE BOARD OF TRUSTEES OF 'tIIL TOWN OF PIERCE, COLORADO AS FOLLOWS: Section] . No tax revenue from any of the property hereby disconnected is pledged for the payment of any debt of the Town of Pierce. None of the property to be disconnected is served by Town of Pierce water or sewer utilities. Section 2. The south 30 feet of Highland Addition to the Town of Pierce, Weld County, Colorado which lies west of US Highway 85 and east of the approximate center line of First Street and which consists solely of Weld County Road 88 right of way is hereby disconnected from the Town of Pierce. Should any section, clause, sentence or part of this ordinance be adjudged by a court of competent jurisdiction to be unconstitutional, and or invalid, such adjudication shall not affect the validity of the ordinance as a whole or any part thereof other than the part so declared to be unconstitutional or invalid. Section 4. Effective Date. This Ordinance shall take effect thirty (30) days after it publication as required by law. PASSED, ADOPTED AND APPROVED THIS 9W DAY OF MAY, 2011. Thereafter, Trustee Cleveland made a motion to adopt the ordinance. Second by Trustee Guzman. Upon roll call vote the following Trustees voted "AYE" : Trustee Smith, Trustee Van Why, Trustee Hoover, Trustee Guzman, Trustee Heberlee, Trustee Cleveland and Mayor Spurgeon-Paris. Trustees voting "NO": None. Motion carried. Whereupon, Mayor Spurgeon-Paris declared the Ordinance passed and approved the same by her signature.
