Chair Kirkmeyer advised the applicant's Attorney representative, Patrick Groom, that the applicant has the option of continuing this matter to a date when the full Board will be present. However, if they decide to proceed today, it will require three affirmative votes, or in the case of a tie vote, Commissioner Rademacher will listen to the record and make the determining vote. Mr. Groom indicated the applicant would like to proceed today. Bruce Barker, County Attorney, entered the following cases into the record: 1) The request of Bernhardt Farms, LLC, c/o DCP Midstream, LP, for a Site Specific Development Plan and Use by Special Review Permit #1791 for an Oil and Gas Support and Service, including oil and gas processing facilities and related equipment, including, but not limited to, four (4) compressors associated with gas processing or which compress gas to enter a pipeline for transport to market, in the A (Agricultural) Zone District; 2) The request of Herman Libsack, do DCP Midstream, LP, for a Site Specific Development Plan and Use by Special Review Permit #1793 for Oil and Gas Support and Service, including oil and gas processing facilities and related equipment, including, but not limited to, four (4) compressors associated with gas equipment processing or which compress gas to enter a pipeline for transport to market, in the A (Agricultural) Zone District; 2011-2634 PL2131 PL2133 PL2134 PL2135 HEARING CERTIFICATION - DCP MIDSTREAM, LP (USR-1791, USR-1793, USR-1794, AND US R11-0005) PAGE 3 3) The request of Kendall Sullivan, Go DCP Midstream, LP, for a Site Specific Development Plan and Use by Special Review Permit #1794 for Oil and Gas Support and Service, including oil and gas processing facilities and related equipment, including, but not limited to, four (4) compressors associated with gas processing or which compress gas to enter a pipeline for transport to market, in the A (Agricultural) Zone District; and 4) The request of WETCO Farms, Inc., Go DCP Midstream, LP, for a Site Specific Development Plan and Use by Special Review Permit, USR11-0005, for Oil and Gas Support and Service, including oil and gas processing facilities and related equipment, including, but not limited to, four (4) compressors associated with gas processing or which compress gas to enter a pipeline for transport to market, in the A (Agricultural) Zone District. Kim Ogle, Department of Planning Services, presented a brief summary of the combined proposals and entered the favorable recommendation of the Planning Commission into the record as written. He stated DCP is in the process of expanding its operations in Weld County, which will add to the current 2,800 miles of gathering lines, seven (7) natural gas plants, and twelve (12) compressor sites. He explained the five permits under consideration today will establish a new Natural Gas Plant, four compressor stations, and interconnecting pipelines. He stated there is a need for new infrastructure to deliver natural gas to market, based on new technology for recovering natural gas discoveries in the Niobrara Shale and to expand the DJ Basin. Mr. Ogle presented the following case summaries for the Board's consideration: 1) Use by Special Review (USR) Permit #1791 - Bernhardt Farms, LLC, Go DCP Midstream, LP. He gave a brief description of the location of the 160-acre site, and indicated the facility is proposed to be unmanned and contained to ten (10) acres of the overall site. He further stated ongoing agricultural production and center-pivot irrigation will continue on the portion not impacted by the proposed use. Mr. Ogle stated the property is located with the three-mile referral areas for the Towns of Milliken and Johnstown, and the Cities of Evans and Greeley. He noted the Town of Milliken and City of Evans did not provide a referral response, the Town of Johnstown indicated no conflict with its interests, and the City of Greeley indicated no conflict, although it did provide an advisory that there are six-inch and four-inch water mains on adjacent roads, and right-of-way approvals are required if access roads cross City of Greeley water lines. He reviewed the topography of the site and reviewed the surrounding land uses for the record. He further stated 14 referral agencies reviewed the proposal, four offered comments which have been incorporated into the Conditions of Approval and Development Standards, and staff received one letter from Kerr-McGee Gathering, LLC, expressing concern that the surface estate may be adversely impacted by the pipelines. He also reviewed photographs of the site and surrounding properties for the record. 2011-2634 PL2131 PL2133 PL2134 PL2135 HEARING CERTIFICATION - DCP MIDSTREAM, LP (USR-1791, USR-1793, USR-1794, AND USR11-0005) PAGE 4 2) Use by Special Review Permit, USR11-0005 -WETCO Farms, Inc., c/o DCP Midstream, LP. Mr. Ogle stated this facility is also referred to as the Godfrey Bottom Site and he gave a brief description of the location of the 150-acre site for the record. He explained the proposed compressor site will encompass ten (10) acres of the overall property and the remaining lands are designated as "Irrigated - Not Prime". Mr. Ogle stated this property is located within the three-mile referral areas for the Cities of Greeley and Evans, the site is generally flat and contains various oil and gas encumbrances, and he reviewed the surrounding land uses for the record. He stated 13 referral agencies reviewed the proposal, five offered comments which have been addressed in the Conditions of Approval and Development Standards, no comments have been received from surrounding property owners, and he displayed photographs of the site and the surrounding area. In response to Chair Kirkmeyer, Mr. Ogle displayed a map reflecting the site being located within the LaSalle Fire Protection District but accessed by a road maintained by the City of Evans through an annexation. 3) Use by Special Review Permit #1793 - Herman Libsack, c/o DCP Midstream, LP. Mr. Ogle gave a brief description of the location of the 76-acre parcel and indicated the proposed compressor station will utilize ten (10) acres of the overall site. He stated the remainder of the property will continue in ongoing agricultural production or unused lands. Mr. Ogle stated the property is also located within the three-mile referral area for the City of Greeley, which indicated no conflicts with its interests. He stated the site is relatively flat and planted in corn, and he provided a brief summary of the surrounding land uses. He further stated 16 referral agencies reviewed the proposal, five offered comments which have been addressed in the Conditions of Approval and Development Standards, and he displayed an aerial map and surrounding photographs for review. 4) Use by Special Review Permit #1794 - Kendall Sullivan, c/o DCP Midstream, LP. Mr. Ogle stated since the Planning Commission hearing, DCP has purchased the site property from Mr. Sullivan and he gave a brief description of the location of the 34.9-acre site. He stated the proposed compressor facility will utilize ten (10) acres of the overall property, which is not within the three-mile referral area for any municipality. Mr. Ogle stated twelve (12) referral agencies reviewed the proposal, four (4) offered comments which have been addressed in the Conditions of Approval and Development Standards, and no correspondence has been received from surrounding property owners. He also displayed an aerial site map and photographs of the site and surrounding uses. Heidi Hansen, Department of Public Works, stated each of the proposed compressor stations are on properties which are accessed from local gravel roads with the necessary access permits, and staff applied requirements which are consistent for these types of uses. She stated they are requiring adequate turning radii for trucks at the access points, double-cattle guards to prevent tracking onto the County roadways, and a Road Maintenance Agreement with dust control, which is usually only a concern during the construction phase. She stated the applicant has indicated they intend to complete the improvements prior to recording the plat to 2011-2634 PL2131 PL2133 PL2134 PL2135 HEARING CERTIFICATION - DCP MIDSTREAM, LP (USR-1791, USR-1793, USR-1794, AND USR11-0005) PAGE 5 avoid posting collateral, and each of the compressor station sites will be required to provide a water quality feature for stormwater control. Lauren Light, Department of Public Health and Environment, stated since the facilities will be unmanned, they do not require permanent water or sewer; however, that will be a requirement if any of the sites require a full-time employee. She stated Dust Abatement Plans will be required for each of the properties, and water trucks are proposed for dust control. She stated the applicant did submit Waste Handling Plans and staff is requesting Spill Prevention, Control and Counter Measure Plans (SPCC) and Air Pollution Emissions Notices (APEN) for each of the sites. She further stated noise will be regulated by the Colorado Oil and Gas Conservation Commissioner (COGCC), and all four permits have the same Development Standards, which are consistent with similar uses. Mr. Groom thanked the staff for their assistance throughout this process and explained this is an important project which will bring additional natural gas reserves to market. He explained the centerpiece of the project is the Electric Gas Processing Plant (LaSalle Plant) requested under USR-1792, which is the first of its kind and will allow DCP to reduce air emissions and the noise produced from the site. Mr. Groom stated the four proposed compressor stations will be connected by gathering and transmission lines, DCP has elected to purchase additional property beyond the sites to serve as visual and noise buffers, and a majority of the unencumbered lands will remain in agricultural production or dryland pasture. Mr. Groom stated the proposal will employ 500 contractors during the construction phase of the site, in addition to creating 32 full-time positions, and the overall project will have a positive impact on energy reserves in Weld County. In response to Commissioner Conway, Mr. Groom stated DCP intends to purchase all of the properties and is negotiating with the current property owners to continue farming after the lands are acquired. He stated if no lease agreement is reached, then they will pursue separate leases with other farmers. He further stated the current owners will be retaining the water rights to allow them to continue to farm the subject sites and certain neighboring properties. Responding to Commissioner Garcia, Mr. Groom stated the water quality features were included in the proposal as part of the Drainage Studies; however, they are not really necessary, since a majority of the sites will continue in agricultural production and maintain the natural drainage. Ms. Hansen confirmed the applicant submitted full Drainage Reports with full stormwater retention for each of the sites; however, staff typically just requires a two-foot deep water quality depression for the compressor sites. She added the water quality design will only be for the footprint of the compressor sites, not the outlying agricultural land. Eric Angus, surrounding property owner, stated he lives approximately three-quarters of a mile from the Libsack Site (USR-1793), and although he is not opposed to the overall proposal, he did request some assurance that the applicant would provide noise abatement for the equipment and control traffic impacts during construction. In response to Commissioner Conway, Mr. Angus stated the applicant did discuss their plans with him for a few minutes prior to this hearing; however, his only prior notice was the sign that was posted on the property. Mr. Angus stated he is a strong supporter of oil and gas production; however, the 55 decibel level needs to be enforced to protect the quality of life for citizens in the area. Ms. Light 2011-2634 PL2131 PL2133 PL2134 PL2135 HEARING CERTIFICATION - DCP MIDSTREAM, LP (USR-1791, USR-1793, USR-1794, AND USR11-0005) PAGE 6 stated 50 decibels is comparable to light auto traffic 100 feet away or an air conditioner unit at 20 feet; normal speech is measured at 60 decibels. There being no further comments, Chair Kirkmeyer closed public testimony. Mr. Groom stated DCP attempted to address neighborhood concerns by hosting a public meeting; however, they were just made aware of Mr. Angus' concerns this morning. He indicated DCP plans to construct insulated building structures to house the compressor units, which will significantly mitigate noise, and they will be situated in the center of the sites which will result in a large buffer to further reduce noise levels. He further stated the Conditions of Approval stipulate the sites will be subject to the COGCC noise standards and they will be enforced upon if complaints are received and a violation is demonstrated. Responding to Commissioner Garcia, Mr. Groom stated his reference to 500 contractors is for the entire project, including the pipelines, etcetera. He stated the hours of construction will be mitigated, the completed facilities will be unmanned, using pipelines to transport the natural gas to the processing site. Responding further to Commissioner Garcia, Floyd Webb, DCP Project Manager for the Compressor Station project, stated a typical construction timeline to construct a compressor station is nine months, depending on weather. He stated DCP is trying to maximize its resources by staggering the projects to be completed within one year. In response to Commissioner Conway, Mr. Webb reiterated each project will employ up to 100 people and Mr. Angus could potentially be impacted for up to nine months during construction. Responding to Commissioner Conway, Mr. Ogle displayed a vicinity map and indicated USR-1793 is located south of and adjacent to County Road 64. Mr. Groom stated the compressor site will be located within the center of the parcel. Mr. Webb stated the site will be accessed on the east toward the middle of the property line along County Road 49. Responding to Chair Kirkmeyer, Mr. Groom requested Development Standard #19 for USR-1791 be modified to reflect the Milliken Fire Protection District, which is the agency they have been working with. In response to Chair Kirkmeyer, Mr. Ogle agreed it should be the Milliken/Johnstown Fire Protection District and the Board agreed it should also be changed in the Conditions of Approval as well. He further stated although the specific language is not part of USR-1791, it is referenced in the other cases and he expressed concern with the Department of Building Inspection requiring a plan review prior to the submittal of building permit applications, explaining DCP does not want to have a meeting for 70 different submittals. He stated their intent would be to have a pre-submittal meeting. Chair Kirkmeyer also asked that Condition of Approval #8 be modified to remove the specific staff member name of the Utility Coordinator, and the Board agreed. (Clerk's Note: Based on the following discussion, Conditions of Approval #2 and #4 were modified to extend the plat submittal deadline to ninety (90) days.) Regarding USR-1793, Chair Kirkmeyer requested Condition of Approval #1.A.6 be modified to delete the specific Utility Coordinator's name. Mr. Groom referred to Condition of Approval #2.G regarding his previous statement of concern with the requirement for a pre-construction meeting before each permit application. In response to Chair Kirkmeyer, Mr. Ogle confirmed staffs intent is to conduct one general pre-construction meeting to provide an overview of the site. 2011-2634 PL2131 PL2133 PL2134 PL2135 HEARING CERTIFICATION - DCP MIDSTREAM, LP (USR-1791, USR-1793, USR-1794, AND USR11-0005) PAGE 7 Following discussion, Chair Kirkmeyer proposed modifying the language to require "one (1) pre- construction meeting..." to address the applicant's concern. Responding to Chair Kirkmeyer, Mr. Groom stated the 60-day plat submittal deadline will be a challenge and 90 days would be preferable. The Board agreed to amend Conditions of Approval #3 and #5 to extend the plat submittal deadline to ninety (90) days. In response to Commissioner Conway, Ms. Hansen stated there is an approved access permit on County Road 49, which is paved one-half mile south of the designated access, and the Improvements Agreement can be drafted to designate the haul route to ensure the shortest use of gravel roads and that traffic is directed to come from County Road 64. Commissioner Conway stated he understands employees come to the site from all directions; however, anything the company can do to direct employees would likely be appreciated by Mr. Angus and other area residents. Chair Kirkmeyer stated she lives within one quarter of a mile of a DCP compressor facility. She stated the construction impact was minimal and the employees are very good at working with area residents. She further stated the buildings really do keep the noise down to a minimum and she encouraged Mr. Angus to get to know the workers and establish a good working relationship. Mr. Groom stated Mr. Angus will be provided with the contact number of a DCP representative who may be reached to address any of his concerns. Regarding USR-1794, Mr. Groom explained that since the Planning Commission hearing, Kendall Sullivan did sell the property to DCP; however, Mr. Barker indicated it is better to retain the prior owner reference since they started the application. Chair Kirkmeyer confirmed all of the previously discussed changes need to be made to this Resolution, including the removal of the specific Utility Coordinator name, clarifying that only one pre-construction meeting will be required, and granting ninety (90) days to submit the plat for recording. Regarding USR11-0005, Mr. Groom stated DCP is not requesting any changes. Chair Kirkmeyer confirmed all of the previously discussed changes need to be made to this Resolution, including the removal of the specific Utility Coordinator name, clarifying that only one pre-construction meeting will be required, and granting ninety (90) days to submit the plat for recording. Responding to Chair Kirkmeyer, Mr. Groom stated he and the applicant have reviewed, and agree to abide by, the Conditions of Approval and Development Standards for each of the discussed cases, as proposed and modified. Commissioner Garcia moved to approve the request of Bernhardt Farms, LLC, do DCP Midstream, LP, for a Site Specific Development Plan and Use by Special Review Permit #1791 for an Oil and Gas Support and Service, including oil and gas processing facilities and related equipment, including, but not limited to, four (4) compressors associated with gas processing or which compress gas to enter a pipeline for transport to market, in the A (Agricultural) Zone District, based on the recommendations of Planning staff and the Planning Commission, with the Conditions of Approval and Development Standards as entered into the record. His motion included modifying Condition of Approval #1.A.8 to delete the specific Utility Coordinator name, amending Conditions of Approval #2 and #4 to extend the plat submittal deadline to ninety (90) days, and revising Development Standard #19 to reflect the appropriate Fire Protection District.
