HomeMy WebLinkAbout20111484.tiff HEARING CERTIFICATION DOCKET NO. 2011-32 RE: A SITE SPECIFIC DEVELOPMENT PLAN AND USE BY SPECIAL REVIEW PERMIT#1772 FOR AN OIL AND GAS SUPPORT FACILITY (FIELD OFFICE, STORAGE YARD, WAREHOUSE, 150-FOOT COMMUNICATION TOWER, SHOP, POWER GENERATION FACILITY, PROCESSING PLANT, GAS METERING STATION, TRUCK LOADING FACILITY AND PARKING) IN THE A (AGRICULTURAL) ZONE DISTRICT- PETERS 313 RANCH, INC., C/O PECAN PIPELINE (RM) INC. A public hearing was conducted on June 15, 2011, at 10:00 a.m., with the following present: Commissioner Barbara Kirkmeyer, Chair Commissioner Sean P. Conway, Pro-Tem Commissioner William F. Garcia Commissioner David E. Long Commissioner Douglas Rademacher Also present: Acting Clerk to the Board, Christie Peters County Attorney, Lee Morrison Planning Department representative, Tom Parko Health Department representative, Mary Evett Public Works representative, Heidi Hansen The following business was transacted: I hereby certify that pursuant to a notice dated May 13, 2011, and duly published May 18, 2011, in the Fort Lupton Press, a public hearing was conducted to consider the request of Peters 313 Ranch, Inc., c/o Pecan Pipeline (RM) Inc., for a Site Specific Development Plan and Use by Special Review Permit #1772 for an Oil and Gas Support Facility (field office, storage yard, warehouse, 150-foot communication tower, shop, power generation facility, processing plant, gas metering station, truck loading facility and parking) in the A (Agricultural) Zone District. Bruce Barker, County Attorney, made this a matter of record. Tom Parko, Department of Planning Services, presented a brief summary of the proposal and entered the favorable recommendation of the Planning Commission into the record as written. He stated the property is located north of and adjacent to County Road 136.5; west of and adjacent to County Road 71. Mr. Parko stated that the owner of the property is 313 Ranch, Inc., which consists of approximately 473 acres. Pecan Pipeline is planning to construct the facility on eighty (80) acres, which are not part of a platted county subdivision or recorded exemption, and will be deeded to the applicant once the Use by Special Review (USR) is approved. He identified the nearest residences on a map and displayed the plot plan, which described the various types of uses and their respective locations. Mr. Parko stated the applicant has a pending interconnect agreement with Colorado Interstate Gas (CIG) and gas for the site will be connected and transported via an existing CIG pipeline. He further stated the applicant will utilize the natural landscapes for screening and the lay down yard will be screened by opaque material. Mr. Parko indicated the proposed site is not located within the three-mile referral area for any municipality and there have been no letters or electronic messages received regarding �� . He stated fourteen (14) referral agencies have reviewed the proposal and four (4) have offered comments. He displayed photographs of the site and a similar site located in North Dakota. Heidi Hansen, Department of Public Works, stated County Roads 71 and 136.5 are local gravel roads, which require sixty (60) feet of right-of-way at full buildout. She stated the applicant has been working with Janet Carter, Department of Public Works, and has requested three (3) new accesses from County Road 71 to the site, which have been approved. Ms. Hansen indicated the applicant has submitted a Final Drainage Report and staff is almost finished reviewing it. She stated the applicant has been very diligent about addressing staff's comment and concerns, by completing the Conditions of Approval ahead of time. She added an Improvements Agreement between the applicant and the County will be required in the future for road damage, etcetera. In response to Commissioner Rademacher, Ms. Hansen identified the three (3) new accesses on the map. Lauren Light, Department of Public Health and Environment, stated permanent water for the site is provided by a well and staff has received a copy of the Commercial Well Permit, as well as documentation from the State, which indicates the well is not considered a public water system based on the number of employees and the usage. She indicated sewage disposal will be handled by a septic system, which has already been designed and approved by the Board of Health. Ms. Light indicated that according to documentation provided by the Environmental Protection Agency (EPA), this system will not be classified as an Injection Well, and the applicant has provided a letter which states only sanitary waste will be processed through the system. The applicant has submitted Dust Abatement and Waste Management Plans, and Clean Harbors Environmental Services will be contracted to properly dispose of any chemical waste at the site. She indicated Development Standards #5 through #21 are typical for these types of operations, the applicant did a fantastic job of addressing all of the Conditions of Approval prior to the Planning Commission hearing, and staff has no concerns with this request. In response to Commissioner Rademacher, Ms. Light stated the septic system is approved for fifteen (15) employees through the Board of Health. Greg Jacobsen, represented the applicant and stated the proposed request will support the ongoing gas operations of EOG Resources (EOG) in the vicinity, and if any third parties start drilling in the surrounding area and would like to process gas through the proposed processing plant, they are open to working on an agreement to allow them to do so. He stated EOG will be the user of the office space, lay down yard, and the warehouse to support the ongoing field operations, and the communications tower will be utilized to communicate with employees in the field and to receive communication data coming back from the wells. He further stated Peters 313 Ranch, Inc., has been very supportive of this proposal and wants to see the USR process end as soon as possible. Chair Kirkmeyer commended the applicant for addressing staff's Conditions of Approval ahead of time. No public testimony was offered concerning this matter. In response to Chair Kirkmeyer, Mr. Jacobsen inquired about Condition of Approval #8 and stated the applicant would like to start some grading at the site, as well as commence the construction of the detention pond as soon as possible. In response to Mr. Jacobsen, Mr. Parko stated this 2011-1284 PL2118 HEARING CERTIFICATION - PETERS 313 RANCH, INC., CIO PECAN PIPELINE (RM) INC. (USR-1772) PAGE 3 Condition does not prohibit the applicant from applying for, and being issued, a grading permit through the Department of Planning Services. In response to Commissioner Rademacher, Mr. Jacobsen stated the number of employees, included in Development Standard #3, is adequate for this request. In response to Commissioner Rademacher, Commissioner Long stated he does not believe there is a need for an opaque fence around the perimeter of the lay down yard. Commissioner Rademacher stated an opaque fence may be more of a hindrance for collecting weeds and other debris; he is comfortable with a regular fence for security and cosmetic purposes, and he suggested the deletion of the last sentence in Development Standard #25, and the Board concurred. In response to Chair Kirkmeyer, Mr. Jacobsen stated the applicant has reviewed, and agrees to abide by, the Conditions of Approval and Development Standards, as proposed and modified. Commissioner Rademacher moved to approve the request of Peters 313 Ranch, Inc., c/o Pecan Pipeline (RM) Inc., for a Site Specific Development Plan and Use by Special Review Permit#1772 for an Oil and Gas Support Facility (field office, storage yard, warehouse, 150-foot communication tower, shop, power generation facility, processing plant, gas metering station, truck loading facility and parking) in the A (Agricultural) Zone District, based on the recommendations of Planning staff and the Planning Commission, with the Conditions of Approval and Development Standards as entered into the record. His motion included the deletion of the last sentence in Development Standard #25. The motion was seconded by Commissioner Long, and it carried unanimously. There being no further discussion, the hearing was completed at 10:44 a.m. This Certification was approved on the 20th day of June, 2011.
