HomeMy WebLinkAbout20110157.tiff RESOLUTION RE: APPROVE CERTIFICATION OF COMPLIANCE FOR COLORADO SENATE BILL#06-090 AND AUTHORIZE CHAIR TO SIGN WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS,the Board has been presented with a Certification of Compliance for Colorado Senate Bill #06-090 from the County of Weld, State of Colorado, by and through the Board of County Commissioners of Weld County,to the Colorado Department of Local Affairs,with terms and conditions being as stated in said certification, and WHEREAS, after review,the Board deems it advisable to approve said certification, a copy of which is attached hereto and incorporated herein by reference. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that the Certification of Compliance for Colorado Senate Bill #06-090 from the County of Weld, State of Colorado, by and through the Board of County Commissioners of Weld County, to the Colorado Department of Local Affairs be, and hereby is, approved. BE IT FURTHER RESOLVED by the Board that the Chair be, and hereby is, authorized to sign said certification. Without your compliance certification, your local government is ineligible to receive financial assistance through grants administered by the Department of Local Affairs (DOLA). This affects any new awards, reimbursements, supplemental increases, reallocations and budget modifications. As a result of a state audit conducted in May 2009, the General Assembly determined that local governments need to annually certify the following: 1 ) no immigration sanctuary policies have been implemented; 2) peace officers have been provided written notification of their duty to cooperate with state and federal officials regarding the enforcement of immigration laws; and 3) the local government has submitted its report to Legislative Council on the number of arrestees reported to ICE during the previous calendar year. This certification form is enclosed and also posted on the department's website at www.dola.colorado.gov. Please complete and return to DOLA, 1313 Sherman Street, Denver, CO 80203, Attn: Dianne Rogers. Your written confirmation to the General Assembly confirming you have provided such notice is due annually, on or before March 1, to the Legislative Council of the General Assembly. Also, you must report to the General Assembly the number of reports made to the United States Immigration and Customs Enforcement Office as required under article 29 of Title 29, C.R.S. This report may be filed by downloading the form from www.leq.state.co.us click on Senate Bill 06-090 Immigration Reporting. Follow the directions on the website to complete the form and fax or mail it to the Office of the Legislative Council, Room 029 State Capitol Building, Denver, CO 80203-1784. It is imperative DOLA receive your certifications and notice from the Legislative Council that you have filed a report before you will be considered to be in compliance with SB06-90. This must occur prior to DOLA issuing any grant awards or reimbursement requests. Immigration Status — Cooperation with Federal Officials As the Local Authorized Official for Weld County I hereby certify by my signature below, that: 1. The County of Weld does not presently have any ordinance or policy that limits or prohibits a peace officer, local official or local government employee from communication or cooperating with federal officials with regard to the immigration status of any person within this state. 2. The governing body of Weld County hereby agrees that it has provided notice in writing to peace officers of the duty to cooperate with state and federal officials with regards to enforcement of the state and federal laws regarding immigration and comply with section 29-29-103(2)(a), C.R.S. 3. Weld County has submitted a report to the Legislative Council of the General Assembly by March 1 , on the number of arrests reported to the United States Immigration and Customs Enforcement Office during the previous calendar year as required under article 29 of Title 29, C.R.S. and a copy of the report has been provided to the Department of Local Affairs.
