(Legal description part SE4 Section 30, T1 N, R66W of the 6th P.M.) The Schack's work in oil and gas support and service, specifically, hauling crude oil. There are currently 14 employees with two of them located onsite during the day and the other employees arriving in the morning and leaving with a company vehicle and returning in the evening. There is an office building and a shop building. The shop building is used for light maintenance (oil change, tire repair, springs, brake repair, etc.). There are no floor drains in the building. Both of the buildings are nonconforming buildings as they do not adhere to the 25 foot setback. Currently they are located 16 feet from the future right-of-way. Because they are nonconforming structures, improvements to the buildings cannot exceed 50% of the assessed value. According to Building Department records, no building permit was pulled on any of the buildings; therefore a Change of Use Building Permit is required for both buildings. A letter signed by a structural engineer is required to determine whether the structure has been constructed to current building code regulations, in this instance the 2006 IBC. Approval in writing with a wet stamp attesting to building and site findings as established by a structural engineer will be required. (The legal description is SE4 Section 30, T1 N, R66W of the 6th P.M.; Situs Address is 12629 CR 4) Background Information: The applicant's business is hauling of crude oil. There are currently 14 employees with two of them located onsite during the day and the other employees arriving in the morning and leaving with a company vehicle and returning in the evening. The well can only be used for drinking and sanitary services; watering of the outside is not allowed. A 1979 septic permit was found in the department files. It is sized for six (6) people and will therefore need to be evaluated by an engineer for adequacy. A Waste Handling Plan is required. Staff stated that they will need to find another approved source of water if they intend to water down the lot for dust control. Public Works It appears that the access road is very wide; therefore because CR 4 is a collector road it is requested that the access be narrowed or better defined. In addition, an additional 10 feet of right- of-way will need to be identified on the site plan. There is presently 30 feet of right-of-way. No traffic study is required; however a narrative estimating the number of trips per day and the type of vehicles accessing the site will need to be submitted. No Drainage Report is required; however the applicant shall provide a short description of the historic stormwater flows across the property and how their application will affect those flows. The description shall include but not be limited to: 1) where the water originates if it flows onto the property from an offsite source, 2)where it flows to as it leaves the property, 3) the direction of flow across the property, and 4) if there have been previous drainage problems with the property. The application shall also provide flow arrows on the map showing where the stormwater starts, how it goes across the property, and where it leaves the property. The applicant will still be responsible for providing a water quality feature that conforms to the methodology outlined in Volume 3, Section 4.4.2 of the Urban Storm Drainage Criteria manual. Planninq Department Road Impact fees, County Facilities fees, and Drainage Impact fees will be applied at time of building permit issuance. Staff encouraged the applicants to first obtain a structural engineer for approval of the buildings. After the applicants have received that letter, they should schedule a meeting with the Building Department for further direction. Staff provided a copy of the previous land use permit (SPR-319) which was withdrawn by the previous owner as an example. Staff urged the applicant to contact staff for any questions: Planner On Call available Monday through Friday 7:30 a.m. to 4:30 p.m. Staff explained the SPR process. For the applicant to proceed with the SPR application, the applicant shall submit 4 packets for a 7 day completeness review. After the 7 day completeness review the applicant will be informed of what items are still required to make the application complete. Staff requested that the applicant submit the remaining material in electronic form. Upon submittal of a completed application it will be sent out for referral for 28 days. A SPR application does not include any public hearings; the application is reviewed by staff and referral entities. The applicant will meet with their Planner to discuss the referrals and address as many of the referrals as possible. Staff will provide the applicant with completed comments within 60 days of submittal of a complete application. The above notes are provided as a courtesy to the applicant.
