HEARING CERTIFICATION DOCKET NO. 2011-40 RE: A SITE SPECIFIC DEVELOPMENT PLAN AND USE BY SPECIAL REVIEW PERMIT#1784 FOR ONE (1) SINGLE FAMILY DWELLING UNIT PER LOT, OTHER THAN THOSE PERMITTED UNDER SECTION 23-3-20.A OF THE WELD COUNTY CODE, IN THE A (AGRICULTURAL) ZONE DISTRICT - GLEN TRUE AND SHARON WELLS-TRUE A public hearing was conducted on August 3, 2011, at 10:00 a.m., with the following present: Commissioner Barbara Kirkmeyer, Chair Commissioner Sean P. Conway, Pro-Tem Commissioner William F. Garcia Commissioner David E. Long Commissioner Douglas Rademacher Also present: Acting Clerk to the Board, Esther Gesick County Attorney, Bruce Barker Planning Department representative, Kim Ogle Health Department representative, Trevor Jiricek Public Works representative, Heidi Hansen The following business was transacted: I hereby certify that pursuant to a notice dated June 17, 2011, and duly published June 22, 2011, in the Fort Lupton Press, a public hearing was conducted to consider the request of Glen True and Sharon Wells-True, for a Site Specific Development Plan and Use by Special Review Permit #1784 for one (1) Single Family Dwelling Unit per lot, other than those permitted under Section 23-3-20.A of the Weld County Code, in the A (Agricultural) Zone District. Bruce Barker, County Attorney, made this a matter of record. Kim Ogle, Department of Planning Services, presented a brief summary of the proposal, entered the favorable recommendation of the Planning Commission into the record as written, and provided a brief description of the location of the site. He stated the Town of Frederick returned the Notice of Inquiry, without comments, and did not return a referral response. He further stated the City of Dacono indicated no conflict with its interests. Mr. Ogle stated the site is accessed from County Road 18, he provided a brief summary of the adjacent land uses, and indicated the general area is an enclave to the Town of Frederick. He stated 14 referral agencies reviewed the proposal, nine provided comments which have been addressed in the Conditions of Approval and Development Standards, and staff received several telephone calls and one letter of opposition. He displayed a vicinity map, indicated the location of the residence in opposition, reviewed an aerial layout of the site, and displayed photographs of the parcel and surrounding properties. He explained the existing living quarters are within the first floor of the barn structure. In response to Commissioner Garcia, Mr. Ogle stated this application was initiated as a Violation, which was referred back to staff, and the applicant received approval for a Zoning Permit for a Home Occupation (ZPMO-0004) for Internet sales and delivery of specialty bicycle tires and tubes, True-Goo Products, and professional consulting services, which resolved the violation. a . 04, fit, kJ hk I 2011-2098 Q-/.3 - ( PL2122 HEARING CERTIFICATION -GLEN TRUE AND SHARON WELLS-TRUE (USR-1784) PAGE 2 Heidi Hansen, Department of Public Works, stated the site is accessed from County Road 18, which is under the jurisdiction of the Town of Frederick. She stated the applicant will be using an existing access, and staff is not requiring a water quality feature since the structure already exists. Trevor Jiricek, Department of Public Health and Environment, stated staff has no issues with this application. He stated the second home has been connected to the existing septic system and the applicants are in the process of getting the system inspected and permitted. Sharon Wells-True and Glen True, applicants, were present to answer questions. In response to Chair Kirkmeyer, Ms. True stated they are seeking approval for the second residence, since they serve as the primary care givers for her aging father-in-law. No public testimony was offered concerning this matter. In response to Chair Kirkmeyer, Ms. True stated they have reviewed, and agree to abide by, the Conditions of Approval and Development Standards, as proposed. Chair Kirkmeyer suggested Conditions of Approval #3 and #4 be modified to extend the deadline for recording the plat from "thirty (30) days" to "sixty (60) days," and Ms. True indicated agreement with the proposed changes. Commissioner Rademacher moved to approve the request of Glen True and Sharon Wells-True for a Site Specific Development Plan and Use by Special Review Permit #1784 for one (1) Single Family Dwelling Unit per lot, other than those permitted under Section 23-3-20.A of the Weld County Code, in the A (Agricultural) Zone District, based on the recommendations of Planning staff and the Planning Commission, with the Conditions of Approval and Development Standards as entered into the record. His motion included modifying Conditions of Approval #3 and #4 to extend the deadline for recording the plat from "thirty (30) days" to "sixty (60) days." The motion was seconded by Commissioner Garcia, and it carried unanimously. There being no further discussion, the hearing was completed at 10:43 a.m. This Certification was approved on the 10th day of August, 2011.
