Therefore,there are a number of important requirements which you,as a permittee,should fully understand. These requirements are listed below. Please read and initial each requirement, in the space provided, to acknowledge that you understand your obligations. If you do not understand these obligations then please contact this Office for a full explanation. 1. Your obligation to reclaim the site is not limited to the amount of the financial warranty. You assume legal liability for all reasonable expanses which the Board or the Office may incur to reclaim the affected lands associated with your mining operation in the event your permit is revoked and financial warranty is forfeited; 2. The Board may suspend or revoke this permit,or assess a civil penalty,upon a finding that the permittee violated the terms or conditions of this permit, the Act, the Mineral Rules and Regulations, or that information contained in the application or your permit misrepresent important material facts; 3. If your mining and reclamation operations affect areas beyond the boundaries of an approved permit boundary, substantial civil penalties,to you as permittee can result; 4. Any modification to the approved mining and reclamation plan from those described in your approved application requires you to submit a permit modification and obtain approval from the Board or Office; 114{ 5. It is your responsibility to notify the Office of any changes in your address or phone number; 6. Upon permit issuance and prior to beginning on-site mining activity,you must post a sign at the entrance of the mine site,which shall be clearly visible from the access road,with the following information(Rule 3.1.12): a. the name of the operator; b. a statement that a reclamation permit for the operation has been issued by the Colorado Mined Land Reclamation Board;and, c. the permit number. 7. The boundaries of the permit boundary area must be marked by monuments or other markers that are clearly visible and adequate to delineate such boundaries prior to site disturbance; 8. It is a provision of this permit that the operations will be conducted in accordance with the terms and conditions listed in your application,as well as with the provisions of the Act and the Mineral Rules and Regulations in effect at the time the permit is issued. 9. Annually,on the anniversary date of permit issuance,you must submit an annual fee as specified by Statute,and an annual report which includes a map describing the acreage affected and the acreage reclaimed to date(if there are changes from the previous year),any monitoring required by the Reclamation Plan to be submitted annually on the anniversary date of the permit approval. Annual fees are for the previous year a permit is held. For example,a permit with the anniversary date of July 1, 1995,the annual fee is for the period of July 1,1994 through June 30,1995.Failure to submit your annual fee and report by the permit anniversary date may result in a civil penalty,revocation of your permit,and forfeiture of your financial warranty. It is your responsibility,as the permittee,to continue to pay your annual fee to the Office until the Board releases you from your total reclamation responsibility. ,4J 10. Description of vegetation and soil characteristics: Peetz gravelly sandy loam, 5 to 20 percent slopes. 2. Identify any permanent man-made structures within two hundred fee to affected area:No structures 3. Description of water resources in the area: Porter Creek EXHIBIT C-Mining Plan Mining Plan A. Mine is located on a high, dry, ridge top that is used primarily as a natural grazing land and wildlife use. Basic Energy Services proposes to open said mine in 2011. Life of mine is expected to be twenty years (2031). Mining activity will be intermittent on an as needed basis. B. Topsoil will be salvaged and stock piled on permitted area. Topsoil from access road area will be windrowed to sides of R.O.W. and then spread back over back slopes on access road. Six inches of topsoil will be removed from mine site utilizing motor scraper, dozers, and motor graders. This material will be stockpiled in the north side of proposed mine site. This stockpile will have no slopes steeper than a 3:1 slope and will be seeded to stabilize stock pile until topsoil is needed to aid in reclamation of mine. Topsoil stockpile will be clearly marked with signs identifying area. Entire mine area will not immediately be stripped of all topsoil. Migration of stripped area will be in a two phase operation as demand for material increases. Phase one will include approximately 2/3 of permitted area to be stripped to make way for mining equipment and to stockpile material. When phase two area is stripped, this topsoil will be spread on approximately 2.65 acres of phase one operation. This topsoil will be seeded and fenced to keep mine activity off reclaimed area. C. No overburden is expected in mine area. If overburden is encountered, it will be stock piled and labeled with a sign on mine site. D, G, H, I, J Gravel mined will be from 6"to 20' in depth. Mining will start in northwest area of site and work in a southeast direction. Initial mining will take place using motor scrapers and dozers to excavate and stock pile material to allow a level area for mining equipment to work safely. An estimated two acres of working area will be needed for traffic to safely enter and exit mine and room for excavating equipment. No permanent equipment or building will be needed at this site. No water will be developed on site or will be needed to process any materials. However,water may be needed for dust control. If dust becomes an issue, water will be brought in by tanker trucks and purchased from an outside source. No ground water is anticipated as mine is located on a ridge top. Surface water will be intercepted by using a series of berms and shallow sediment containment retention areas. Berms will be used to keep all surface water within pit boundary. Sediment containment retention areas will retain any sediment within the mine site. As mining begins in a southeast direction,the 1s`of 3 sediment retention areas will be constructed. As extraction progresses, the 2"d and 3rd sediment retention areas will follow. E. Major components of mining operation will include approximately 2300' of new access road to be constructed and an estimated 7.8 acres of mining area. Existing county roads will be used to access new mine. These existing roads are currently being utilized by multiple varieties of personal and commercial traffic. F. No office, shop, maintenance buildings, or permanent facilities will be needed to operate this mine. Temporary portable gravel processing plants may be utilized if demand for specific gravel products is needed. K. No toxic material is anticipated during mining activities. In case toxic materials are exposed from mining equipment, containment systems will be accessible on site to contain any exposed material. Any contaminated material will be reported to regulatory agencies and removed to an approved disposal sites. L. During mine operation, berms will be built on outside perimeter of pit to retain any onsite run off. Mining will typically leave low area to help contain water within site area. Access road has been engineered to allow water flows that will not increase or decrease existing flow of water. After site is reclaimed, it will have the same design, elements and configuration as the original contour. M. All materials will be processed on mine site. If demand is needed for gravel products other than pit run gravel, a portable gravel processing plant may be temporarily used to help process specific types of material. Sand, clean rock, and crushed road base are examples of materials that may be produced. No chemicals are necessary for these types of products. These stock piles would be placed in depleted areas of mine floor in separate stock piles and will be clearly marked with signs to keep variations clear. N. Primary product mined and extracted from pit will be bank run(pit run gravel). This is the natural material found on mine site with no processing other than being stock piled by heavy machinery such as scrapers, dozers, and loaders. Secondary product would be crushed road base material that would have to be processed by portable crushing plant. This makes product more uniform in size which can aid in compaction. O. These materials are mainly being used to aid in construction process of new oilfield roads and drill sites. P. No explosives will be used. EXHIBIT D—Reclamation Plan Reclamation Plan A. Reclamation would not start for the first five years (2016)of operation. A suitable area will be required to safely operate the mine. Basic Energy Services plans to operate two phases of operations at this mine. Reclamation will start when phase two of the pit excavation starts. This stage of the mine will be to expose unexcavated area of remaining mine area. While stripping this new area of topsoil (6"), this material will be laid over reclaimed portion of previously mined area. As gravel is mined from previous mining area, care will be taken to uniformly shape pit floor to be representative of elevations on pit reclaim print. All cut slope areas that will be on north side of mine area will be no steeper than 3:1 slope. Other pit area to the east and west will daylight out to natural upcoming slopes and will be representative natural contour of the area. When phase two topsoil material (2,000/cy) is being removed,we will have suitable area for new mining,product stock piles, and safe entry and exit of mine to start reclaiming a portion of the excavated area in the northeast and southeast mine area. Phase two should yield approximately 2,000/cy of topsoil from 2.65 acres. At this point, we will prepare the mined area by grading and contouring it. Topsoil will be spread over graded area(2.65 acres)to achieve a topsoil thickness of 6". Topsoil then will be prepared by disking or scarifying area. Approved certified seed will be planted on the newly top soiled area with the use of a seed drill. A mixture of straw/mulch will offer crop cover and help retain moisture to ensure seeding gets a strong start. Temporary fence will be constructed to keep mining activity off from reclamation area. Remaining reclamation work will begin when depletion of remaining mine area is complete. Grading and contouring as shown on reclaim print will leave no slopes steeper than 3:1 and will blend post mining slopes with the undisturbed native lands wherever possible to achieve a design representative to the natural contour of the area. No stockpiles or water retention systems will remain following final reclamation of the site. When topsoil has been replaced from existing topsoil, stockpile area will be prepared by scarifying area. Approved certified seed will be planted on the newly top soiled area with the use of a seed drill. A mixture of straw/mulch will offer crop cover and help retain moisture to ensure seeding gets a strong start. All seeding will take place in fall of the year. No trees or shrubs will be planted. Area will be returned to grazing land and wildlife use. There will be no change from pre-mining land use. Estimated cost to reclaim entire mine site is $37,254.00. These prices include all operator wages/benefits, fuel/ lubricant consumption, and equipment depreciation. Mobilizing equipment to and from site is estimated to require 10 hours of Lowboy time @ 140.00/hr. Lowboy is needed to move D8 Dozer, Seed Drill and Crimper as well as 20 tons of clean straw. $1,400.00 Motor Scrapers (2), Motor Grader and Farm Tractor will be self transported to site. Each piece of equipment will require 3/hr for mobilization and demobilization. Scrapers(2) x 3/hr @ 190.00/hr is 1,140.00, Motor Grader x 3/hrs @ 128.00/hr is 384.00, Farm Tractor x 3/hrs @ 110.00/hr is 330.00. $1,854.00 Backfilling, Grading and contouring entire mine site will require Moving an estimated 2,000/cy of material(extra care will be taken to closely leave all cut slopes at a 3:1 or less grade and floor of the pit will represent contour shown on reclaim print). Competitive cy price for moving earth with scraper, dozers and motor graders is 1.25/cy. Material @ 2000/cy x 1.25/cy $2,500.00 Top soil placement and seedbed prep will require use of Scrapers, Dozer and Motor Grader. Top soil will be spread 6"deep and prep for seed over all the disturbed area within pit boundary. Top soil @ 6,000/cy(plus or minus) @1.25/cy $7,500.00 Cost of pure seed and clean straw is estimated to be 8,000.00.
