Lupton, 80621 The Weld County Public Works Department received the collection of correspondence recently sent to the Board by Ross Bachofer, resident and landowner at the above address located about '/ mile south of WCR 18. The County and others have had an extensive history with Mr. Bachofer, as summarized below. Background: The Bachofer single family home is on a 6.3 acre (parcel # 130930000048). The home lies between the South Plate River and the Platteville Ditch. The Bachofer home lies on the eroding cut bank of the South Platte River. The Bachofer residence appears to lie out of the Approximate Floodplain of the South Platte as mapped on FIRM map panel #080266-0868C. However, current County air photos show the South Platte River has eroded and migrated eastward out of its FEMA mapped floodplain — it has migrated into the Bachofer property. The FEMA maps in that area have not been updated to reflect current conditions of the river. Timeline: 1991 - Bachofer received Building permit#BP37137 for a single family ranch house, main floor 1496 sq. ft., on a full UNFINISHED basement. February 17, 2000 — Weld County Planning issued a conditionally approved Flood Hazard Development permit (FHDP-355) for the Everist gravel pit. November 1, 2004 — Bachofer objected to the Everist gravel mine application in front of the Colorado Division of Reclamation and Mining Safety (DRMS). December 17, 2004 - Bachofer wrote a complaint letter to L. G. Everist & DRMS expressing worry that their mine would impact his well, other issues degrading his quality of life. Everist responded that the river acts as a groundwater barrier, there would be no well impact. January 17, 2005 — Everist received conditional approval of AmFHDP-335 for expansion of their gravel operations. Spring 2007 — Public Works site visit in response to Mr. Bachofer's request to observe L.G. Everist's operations across the South Platte. Berming around Everist's pit, in conformance with the screening requirements of their USR with Weld County were seen. The river was well within its channel, not confined by the Everist berms. Spring 2008 - Bachofer filed complaint with Colorado DRMS alleging his flooding was caused by the Everist gravel pit. Page 1 of 3 M\PLANNING-DEVELOPMENT REVIEW\Drainage Complaints\Ross Bachover\Memo to BOCC 3-4-11.doc February 28, 2008 — the Colorado DRMS conducted an inspection of the Everist pit and requested removal of soil stockpiles and berms in the floodplain to bring the site into conformance with the Weld County FHDP. March 10, 2008— Everist submitted to DRMS a plan for correction to be completed by April 1. December 31, 2008 — Weld County reviewed and accepted Everist's HEC-RAS modeling showing the gravel pit operations do not restrict the floodplain and have not caused flooding on the Bachofer property. Early June, 2009 — Bachofer called B. Barker to complain that his flooding was due to the access road built for some CalPine wells on the Ewing Farms property directly south (upstream) of his home. The road and wells were approved in 2002 under USR-1339, and later determined to be allowed as a Use-By-Right, no flood hazard permit was submitted. Flows in the river have not reached the road and so the road has not altered river flow or recent flooding patterns upstream of the Bachofer property. May 28, 2009 — Bachofer filed a complaint with Colorado DRMS regarding Everist gravel pit berms. June 4, 2009 - in response to a second Bachofer complaint, the Colorado DRMS conducted an inspection of the Bachofer property. June 9, 2009 - Colorado DRMS issued a report on the June 4 inspection. See the attached copy of the DRMS report. The DRMS found that Bachofer had built his home at the edge of the floodplain and removed the adjacent soil between his house and the river. Bachofer has cut his basement wall to create a walk-out access; high flows in the river can enter his basement. The DRMS found no evidence that the Everist mining activity had altered the river or caused Bachofer's flooding. August 25, 2010 - Bachofer wrote a complaint letter to the Colorado DRMS alleging mining across the river has changed the flood patterns. Late February 2011 — Bachofer contacted FEMA requesting compensation for his damages under his flood insurance. As part of the map validation process associated with the nation- wide Digital Mapping program, FEMA examined the old floodplain maps and current river location in the vicinity of the Bachofer house. FEMA has revised the floodplain map in that area and moved the boundary of the South Platte floodplain so that it now shows the Bachofer house within the floodplain. FEMA advised Bachofer that he could conduct his own study to determine if he is actually in a floodplain. March 7, 2011 — at a conference, FEMA informed Weld County staff that it is their belief that Bachofer has placed himself in the floodplain due to his own actions. Spring 2011 — Everist and the City of Aurora will be submitting a Letter of Map Revision (LOMR) to FEMA showing existing floodplain boundaries. Topographic survey and computer modeling performed by Everist's engineer show that Bachofer's activities have placed his house in the floodplain confirming the 2009 DRMS findings. Page 2 of 3 M'.\PLANNING—DEVELOPMENT REVIEW\Drainage Complaints\Ross Bachover\Memo to BOCC 3-4-11.doc Summary and Recommendation: Weld County Planning and Building Departments did not request a Flood Hazard Development permit for construction of the Bachofer home in 1991 because the FEMA floodplain maps available at the time did not show his proposed homesite to be in the South Platte floodplain. Subsequent natural river meandering has eroded the riverbank and has allowed the river to encroach into the Bachofer property. The river is currently outside of the 'old' mapped floodplain. As noted by the State DRMS, Bachofer's construction of a walk-out basement and his removal of the soil bench between his walk-out and the river has provided a direct route for high river flows to enter his basement. Bachofer has flooded himself. There is no need for Bachofer to perform a computer modeling study as suggested by FEMA; Everist and the City of Aurora will be submitting a Letter of Map Revision (LOMR) to FEMA showing existing floodplain boundaries. That study will show the relationship of his home to the floodplain boundary. To reduce risk of future flood damages, the solution is for Bachofer to brick over his walk-out basement opening, backfill around the west side of his foundation with gravel to create a French drain, install a sump pump, and replace by backfill, the soil in the area from his basement to the river bench and so restore the protection from flooding he originally had. Mr. Russ Bachofer sent a letter to DRMS alleging that activity associated with the Ft. Lupton Sand and Gravel site (M1999-120)or other mining activity in the vicinity had impacted the flood plain morphology sufficiently to cause flooding on his property that would not be otherwise occurring. Mr. Bachofer also made the same compliant previously, in the spring of 2008. At that time DBMS representatives Peter Hays and Erica Crosby inspected the site, the surrounding area, and reviewed the site files for M1999-120. It was determined that the mine needed to move some soil stockpiles that were located in the flood plain,and conduct a flood plain analysis to comply with Weld County's Flood Hazard Development Plan requirements. The mine complied and the soil stockpiles were removed entirely from the flood plain, and a floodplain analysis was conducted and submitted to Weld County for review and approval. On December 31, 2008, Weld County approved the flood hazard analysis and stated that Ft Lupton Sand and Gravel had adequately demonstrated that the operation does not negatively impact the flood plain, and was in compliance with their approved flood hazard development plan. At that time DRMS considered the matter to be resolved and Ft Lupton Sand and Gravel to be in compliance. No increases were shown by the flood plain analysis modeling that were even near the one-foot allowable increase, and for currently existing conditions over most of the site,the 100 year water surface profile is equal to or even less than the pre-mining condition. On June 4, 2009, DRMS representatives Eric Scott, Peter Hays, and David Bird met with Mr. Bachofer at 9:00 on his property to respond to this latest complaint and examine the situation. It was apparent that water had indeed risen to the level of the walk-out basement of the home. Upon inspection of the property, and contour mapping taken from 2008 aerial photography, it was apparent that the home and associated garage were constructed on top of an approximately three to four foot high bench along the east bank of the river in that location. It appears that in this area this bench is functionally the eastern limit of the floodplain. It also corresponds with the delineation of the eastern 100 yr floodplain boundary in the area as depicted on the FEMA floodplain map. There is minimal elevation change in the area between the base of the bench and the top of the riverbank. This bench was removed along the west side of the home to create the entrance to the walk-out basement. The basement exit as constructed is at the base of this three to four foot bench, and therefore"walks- out" onto the level of the local floodplain. Because of this configuration, any time the river tops its banks, very little additional increase in water level is necessary to impact the basement of the home. Also note that the 100 year flood plain,by definition, contains many areas that are flooded much more frequently. The area behind the house may, in fact,also be within the annual or 5 year floodplain. DRMS then inspected the west side of the river in that area to determine if any recent changes have occurred associated with mining that may contribute to the reported flooding. None were observed. During the inspection of the western riverbank it was noted that the river had also left its banks on the west side in several areas and has encroached onto the mine property and other properties on the west side of the river. This would seem to indicate that the river is not being significantly constrained by activities associated with the mine, and is in fact leaving its banks on both sides during flood events. Until such time that it can be demonstrated that there is a direct correlation between the mining activities and adverse off site flooding impacts, or that flood plain development compliance requirements are no longer being met, DRMS has no authority and therefore considers this matter closed.
