SUBJECT: USR-1785, Doris Cunningham
The Weld County Public Works Department has reviewed this proposal. This project falls under the Use
by Special Review Standard, Weld County Code, Chapter 23, Article II, Division 4, Section 23. Staff
comments made during this phase of the Use by Special Review process may not be all-inclusive, as
other issues may arise during the remaining application process.
COMMENTS:
WCR 33 is a collector road and requires an 80-foot right-of-way at full build out. There is presently a 60-
foot right-of-way. This road is maintained by Weld County. Pursuant to the definition of SETBACK in the
Weld County Zoning (23-1-90), the required setback is measured from the future right-of-way line.
The applicant will use the existing access to the property as approved by Access Permit #AP11-00133.
No additional accesses will be granted. Please show the existing accesses on the Plat and label them
with the Access Permit number.
• A Water Quality Feature has been designed for this site and is acceptable. The Water Quality Area is
shown on the site plan. Please label the water quality area as"Water Quality—No Build or Storage Area"
This area IS NOT in a Special Flood Hazard Area (SFHA) as determined by the Federal Emergency
Management Agency (FEMA).
REQUIREMENTS:
1. Show the existing access point on the Plat and label it with the Access Permit number (AP11-
00133).
2. Please label the Water Quality Area as"Water Quality—No Build or Storage Area"
3. Add the following notes to the plat:
a. Pursuant to Chapter 15, Articles i and II of the Weld County Code, if noxious weeds exist
on the property or become established as a result of the proposed development, the
applicant/landowner shall be responsible for controlling the noxious weeds. All
vegetation, other than grasses, needs to be maintained at a maximum height of 12
inches until the area is completely developed.
b. The historical flow patterns and run-off amounts will be maintained on site in such a
manner that it will reasonably preserve the natural character of the area and prevent
property damage of the type generally attributed to run-off rate and velocity increases,
diversions, concentration and/or unplanned ponding of storm run-off.
• c. Weld County is not responsible for the maintenance of drainage related features.

Environmental Health Services has reviewed this proposal for an oil and gas support
service business. The application indicates that there will be a total of eighteen people
who will use the site.
There is an existing onion warehouse located on site which is served by an individual
sewage disposal system (Permit #G19820005). According to this Departments records,
the septic system was sized for 6 persons. The application indicates that a larger septic
system is currently being designed to accommodate the increase in hydraulic flow.
• The site is currently served by an individual well (Permit # 260453) and is limited to
domestic use. The applicant has submitted an application to the State to re-permit the
well to commercial for business usage.
The application states that office and employee waste will be stored in commercial
containers and scrap metal will be sold to a metal recycler. We are requesting a waste
handling plan that includes the facilities name, address, and phone number.
Dust is minimal as the drive is recycled asphalt. If dust is created the applicant will
either apply water or magnesium chloride.
We have no objections to the proposal; however, we do recommend that the following
conditions be part of any approval:
We recommend that the following requirements be met prior to allowing the plat to be
recorded:
1. In the event the applicant intends to utilize the existing septic system for business
use, the septic system shall be reviewed by a Colorado Registered Professional
Engineer. The review shall consist of observation of the system and a technical
review describing the system's ability to handle the proposed hydraulic load. The
review shall be submitted to the Environmental Health Services Division of the

Weld County Department of Public Health and Environment. In the event the
system is found to be inadequately sized or constructed the system shall be
brought into compliance with current Regulations. Alternately, a new septic
system can be installed for business use.
2. The applicant shall submit written evidence from the Colorado Division of Water
Resources, demonstrating that the well is appropriately permitted for the
proposed business use.
3. The applicant shall submit a waste handling plan, for approval, to the
Environmental Health Services Division of the Weld County Department of Public
Health & Environment. The plan shall include at a minimum, the following:
1) A list of wastes which are expected to be generated on site (this should
include expected volumes and types of waste generated).
2) A list of the type and volume of chemicals expected to be stored on site.
3) The waste handler and facility where the waste will be disposed (including
the facility name, address, and phone number).
We recommend that the following requirements be incorporated into the permit as
development standards:
1. All liquid and solid wastes (as defined in the Solid Wastes Disposal Sites and
Facilities Act, 30-20-100.5, C.R.S., as amended) shall be stored and removed for
final disposal in a manner that protects against surface and groundwater
contamination.
2. No permanent disposal of wastes shall be permitted at this site. This is not
meant to include those wastes specifically excluded from the definition of a solid
waste in the Solid Wastes Disposal Sites and Facilities Act, 30-20-100.5, C.R.S.,
as amended.
3. Waste materials shall be handled, stored, and disposed in a manner that controls
fugitive dust, fugitive particulate emissions, blowing debris, and other potential
nuisance conditions.
4. The applicant shall operate in accordance with the approved "waste handling
plan", at all times.
5. Fugitive dust and fugitive particulate emissions shall be controlled on this site.
The facility shall be operated in accordance with the approved "dust abatement
plan", at all times.

• 6. This facility shall adhere to the maximum permissible noise levels allowed in the
Commercial Zone as delineated in Section 14-9-30 of the Weld County Code.
7. Any vehicle or equipment washing areas shall capture all effluent and prevent
discharges in accordance with the Rules and Regulations of the Water Quality
Control Commission, and the Environmental Protection Agency.
8. All potentially hazardous chemicals must be handled in a safe manner in
accordance with product labeling and in a manner that minimizes the release of
hazardous air pollutants (HAP's) and volatile organic compounds (VOC's). All
chemicals must be stored secure, on an impervious surface, and in accordance
with manufacturer's recommendations.
9. Adequate handwashing and toilet facilities shall be provided at all times.
10.Sewage disposal for the facility shall be by septic system. Any septic system
located on the property must comply with all provisions of the Weld County Code,
pertaining to Individual Sewage Disposal Systems.
11.A permanent, adequate water supply shall be provided for drinking and sanitary
purposes.
• 12.This application is proposing a well as its source of water. The applicant should
be made aware that while they may be able to obtain a well permit from the
Office of the State Engineer, Division of Water Resources, the quantity of water
available for usage may be limited to specific uses, i.e. domestic use only, etc.
Also, the applicant should be made aware that groundwater may not meet all
drinking water standards as defined by the Colorado Department of Public Health
and Environment. We strongly encourage the applicant to test their drinking
water prior to consumption and periodically test it over time.
13.The operation shall comply with all applicable rules and regulations of State and
Federal agencies and the Weld County Code.

Subject: USR-1785 Referral
Upon review of my case files and computer, an active Zoning Violation (ZCV11-00013)was noted. This
violation was initiated due to the operation of an excavation company (Dba: C & H Excavating) and
associated commercial storage,without the necessary Weld County Zoning Permits. This case has not
yet been presented to the Board of County Commissioners through the Violation Hearing process. Since
this is an active violation, an investigation fee is required.
This complaint was from a private citizen.
This application if approved by the Board of County Commissioners and once a plat is recorded will
correct the violation. If this application is denied, all commercial storage and operations shall be removed
from the property within 30 (thirty) days. Additionally, if denied by the Board of County Commissioners
please request this violation case be referred to the County Attorney's Office with a delay of legal action
for the 30 (thirty) days mentioned above.

Site Specific Development Plan and Special Review Permit for equipment manufacturing facility in an
Agricultural Zone District. Application proposes no new construction only change of use for use existing
structures for manufacturing of oil field equipment.
USR-1785
1. Building permits shall be obtained prior to the construction or change of use of any building
.Requirements for submitting plans for permitting process may vary with each change of use..Please contact
Weld County Building Inspection Department for specific requirements.
2. A plan review is required for each building except for buildings that meet the definition of Ag Exempt
•
buildings. Plans require the wet stamp of a Colorado registered architect or engineer.
3. Buildings shall conform to the requirements of the codes adopted by Weld County at the time of permit
application. Current adopted codes include the 2006 International Residential Code; 2006 International
Building Code; 2006 International Mechanical Code; 2006 International Plumbing Code; 2006 International
Fuel Gas Code; 2006 International Energy Conservation Code; 2008 National Electrical Code and Chapter 29
of the Weld County Code.
4. Each building will require an engineered foundation based on a site-specific geotechnical report or an open
hole inspection performed by a Colorado registered engineer. Engineered foundations shall be designed by a
Colorado registered engineer.
5. Fire resistance of walls and openings, construction requirements, maximum building height and allowable
areas will be reviewed at the plan review. Setback and offset distances shall be determined by the Zoning
Ordinance.
6. Building height shall be measured in accordance with the 2006 International Building Code for the purpose
of determining the maximum building size and height for various uses and types of construction and to
determine compliance with the Bulk Requirements from Chapter 23 of the Weld County Code. Building height
shall be measured in accordance with Chapter 23 of the Weld County Code in order to determine compliance
with offset and setback requirements. Offset and setback requirements are measured to the farthest
projection from the building.
7. Provide letter of approval from Eaton Fire Protection District prior to new residential construction.

Dear Chris,
I am writing to offer comment on Planning Case No. USR 1785, even though I missed the referral deadline for providing
comment prior to the Weld County Planning Commission Hearing. In this case, the applicant is seeking approval to
operate a manufacturing facility for oil field equipment on a site previously occupied by an agricultural packaging and
trucking company. The existing well on the property dates to the 1950's and was registered in 2004 for historic
residential uses, including household, animal watering, and irrigation of home lawn and garden. This well can be
repermitted as a commercial exempt well if the applicant can demonstrate that annual water use will not exceed the
allowable limit of 1/3 acre-foot, or 108,600 gallons. The well will have to be fitted with a totalizing flowmeter so that
the operator can track water use and be able to show compliance with that aspect of the permit. Note also that a
commercial exempt well can only be used for interior uses(drinking supply and sanitation)within a business by
employees and customers, and may not be used outside the building(s) for any landscape irrigation,vehicle washing, or
other purpose. If such outside uses are necessary or desired by the applicant, a commercial nonexempt well permit will
be required, and that will only be issuable after the applicant has first obtained approval for an augmentation plan
